1980/03/10 City Council MinutesCall, to Order ROHNERT PARK CITY COUNCIL MINUTES March 10, 1980 The Council.`of the City of Rohnert Park met this date in regular session commencing at 7 :00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Roberts presiding. The regular session was preceded by an executive session which commenced at 7:00 p.m. and at which all Councilmen Beary, Hopkins and Roberts and City Manager Callinan were present and which was held to discuss personnel and litigation matters. Mayor Roberts called,the,meeting of the regular session to order at approximately 7:17 p.m. and led the pledge of allegiance.` Roll Call Present: (4) Councilmen Beary, ,Hopkins, Stewart and Roberts Late: W Councilman Carbone (whose time of arrival is specifically noted in these minutes). Mayor Roberts informed that Councilman Carbone had called to say that he would arrive later in the meeting. Staff present for all or part of the meeting: City Manager .Callinan, Director of Public Works /City Engineer Brust and Planning Director'Skanchy. City,Attorney Flitner was absent due to illness. Approval of Minutes Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously- approved, the minutes of February 25, 1980 were approved as submitted. Approval of Bills Upon motion of Councilman Hopkins, seconded by Councilman Stewart, and unanimously approved, the bills presented per the attached list in,the amount of $371,839.69 were approved as submitted. Said total includes $4,662.50 for the Rohnert Park Civic Commission. Non - Agendaed Items Mayor Roberts indicated that after the consent calendar he would present the "Outstanding Organization Award" issued to the City of Rohnert Park by the California Associa- tion of Park and Recreation Commissioners and Board Members. Unscheduled Durward DeBrunner, 5731 Dorian Drive, was recognized and Appearances commented'on the shortage of reasonably priced housing in Rohnert Park. He said that residential neighborhoods had deteriorated because of the number of renters and asked that Councilman Stewart's ordinance limiting rentals in residential districts be re- considered. Frank Gilman, 89'Alma Avenue, was recognized and explained that the homeowners ..'on'Alma and Adele Avenues felt that the fence between their homes.and'Southwest Boulevard was in shambles. He described the increased traffic and related noise generated from--Southwest Boulevard, said the homeowners in the area felt that the city should improve the fence, and pointed out that if the city does not improve the fence, then the homeowners would be forced to replace it which would result in a patch --type appearing fence. He also commented on the overhead electrical wires in his neighborhood saying that homeowners would like to see the wires placed underground. Mr. Gilman 'concluded thanking the Council for the good garbage collection service. Page 2 March 10, 1080 Frank Alexander, 801 Holly Avenue, was recognized and commented about the problems associated with the condominium units on Country Club Drive, in the area of Marguerite Hahn School, which, create a hazard to. children. He informed that the no all night.parking restriction for the area is not being enforced, motorist's view of the school. is blocked by the two story structures, and.because of various other conditions a person cannot see the intersection has a crosswalk for the elementary school. Mr. Alexander said that there should be ample parking provided by the city and that the absentee landlords will cause transcient, type individuals which will lead to crime. He asked what the City Council had done to find out what the people of Rohnert .Park wanted and said that the situation he described was a serious one. Donald Moitoza, 5732 Dorian Drive, was recognized and asked how a' ordinance could be re- considered. Councilman Hopkins informed that the ordinance would have to.be re- introduced by one of the Council members. Mr. Moitoza requested the Council take a look at Council- man Stewart's ordinance. for owner: occupied units and that it postpone the condominium issue tonight. He stated that it would not be in the best interest of the community by opening up the units to speculators. Helen _Lawrence,,_942 Ellen Street, was recognized and indicated that she agreed with the gentleman that spoke tonight and commented that in the past two years there had been a tremendous increase in ,multiple family units, most of which are rented. She informed that she had recently taken a tour of the Racquet club development and found little open space and no recreation facilities. She felt that the development dial not have a community type atmosphere and that the city was moving ahead on a program of development that didn't coincide with the growth management program that was implemented.in 1977. She endorsed Councilman Stewart': ordinance and requested that any further consideration of the development be postponed tonight. Charles Kitchen,.4457 Hollingsworth Circle, was recognized and expressed that he agreed with others in that Councilman Heary could have a possible conflict of interest. He asked if there was any Council member who had any interest in the proposed.development..None of the Council members responded in the affirmative. Mayor Roberts explained that Mr. Kitchen was speaking under the '.'Unscheduled Public Appearance's" section of the meeting's agenda and that the development he referred to was the subject of a public hearing to be held later in the meeting. Councilman Stewart thanked members of the audience for their support and informed that the ordinance regarding owner occupancy of residential units had been the subject of a duly noticed public hearing I some time ago. She expressed that it was important.to keep Council members informed about citizenery viewpoints,,. but not to come after the fact and say that the Council was not doing a. good job. C °a }C C ae 7Q iS o CONSENT CALENDAR City Manager Callinan referred the Council, to Council memo dated March 6, 1980 for explanation of all the,matters on the Consent Calendar, Resolution No. 80 -56 RESOLUTION OF THE ROHNERT PARK CITY COUNCIL REJECTING THE CLAIM OF WAYNE FOX Resolution No.,80 -57 RESOLUTION REMOVING ADDING_MACHINE FROM FIXED ASSETS RECORD Resolution No.. 80. - "58 RESOLUTION OF 'THE CITY COUNCIL OF. THE CITY OF ROHNERT PARK REGARDING AIR QUALITY PLANNING RE- DESIGNATION Upon motion of Councilman Beary,,seconded by Councilman Hopkins, and unanimously approved, reading of Resolution Nos. 80-»56 through 80 -58 was waived and said resolutions were adopted.. Councilman Carbone- City',Manager Callinan inquired.. if the Mayor had informed Late Arrival the audience that Councilman Carbone had called to say that he would arrive later in the meeting. Mayor Roberts responded in the affirmative. Outstanding Organiza- Mayor. Roberts read the statement made at the awards banquet Lion Award of the California Association of Park and Recreation Commissioner and Board Members held Saturday, March 8, 1980 in Sacramento at which Rohnert Park was presented with the "Outstanding Organization Award" .for, outstanding contributions to the field of parks and recreation and foresight in planning,' community development and citizen involvement, in the State of California. Mayor Roberts ordered City Manager Callinan to.have the prestigeous award displayed at the Community and Recreation Center. Councilman Carbone. Councilman Carbone arrived at this point in the meeting, Arrives the time being approximately 7:49 p.m. Councilman Stewart Councilman Stewart left the Council Chambers at approximately Leaves.. 7:54 p.m. Community Resources Mayor Roberts indicated that the Council would move on to for Independence the "Scheduled Public Appearance" portion of the meeting's agenda due to the fact that agenda matters were somewhat behind schedule,, Katherine Valdez,.812 Lombard Way, Community Resources for Independence, was recognized and said that as a "member of the community as well as the disabled community she urged access -be provided to public transportation for the disabled citizens of Rohnert Park. She informed that during the past week she had received calls from two individuals to go to school or work in Santa Rosa and that it was imperative that there be good public transportation for the disabled. Councilman Stewart Councilman Stewart.returned and City Manager Callinan left Returns /City Manager the Council Chambers at this point in the meeting, the time Callinan Leaves being approximately 8:03.p.m. Mr. Lee commented on,the number of disable persons residing in Rohnert Park and suggested that before the Council adopt a resolution supporting the Five Year 'Transportation Plan that it should be amended to address estab lishment of a light rail system in the County, bicycle` paths in the unincorporated areas, and.providing lifts on some of the Golden Gate transit busses that have routes through the city. Discussion followed between the Council members and Mr. Lee and during which he was advised that Councilman Carbone was the cities' representative to the Paratransit Coordinating Committee. The Council thanked Miss Valdez and Mr. Lee for their input. Resolution No. 80 -59 A RESOLUTION OF AWARD OF CONTRACT (Future Wells, Holes and Casings Only, Project No. 1979 -20)' City Manager Callinan explained the resolution and City Engineer Brust commented on bid results. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No. 80 -59 was waived and said resolution was adopted. Resolution No. 80--60 A RESOLUTION OF AWARD OF CONTRACT (Traffic Signals on South- west Boulevard at Country Club Drive, Camino Colegio and Snyder Lane, Project No.. 1979-9) City Manager Callinan explained the resolution and City Engineer Brust commented on bid results. Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution No. 80--60 was waived and said resolution was adopted. Resolution No. 80 -61 A RESOLUTION OF AWARD OF CONTRACT (Pedestrian Bridge Over Copeland Creek and Over Hinebaugh Creek, Project No. 1980 - 5) City Manager Callinan explained the resolution. Councilman Carbone Councilman Carbone left the Council Chambers at approximately Leaves and Returns 8:25 p.m. and returned at approximatelly 8:26 p.m. Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution No. 80 -61 was waived and said resolution was approved. Page 5 March 10, 1980 Project No. 1979 -7 City Manager Ca1]inan, referring to his March 6, 1980 Council Industrial Center Way meeting memo, reminded that the City Council had continued Assessment District the public hearing on the Engineer's Report for Industrial Center Way Assessment District Improvement Project No. 1979- 7 because bond bids came in so high. He advised that Bond Counsel Assaf suggested that the Council open the public hearing and continue same to the March 24, 1980 Council meeting. Mayor Roberts opened the public hearing on Project No. 1979 - 7, Industrial Center Way Assessment District. Recess Sam Clauder, 535 Arlen Drive, was recognized and asked to be updated on the status of this matter. City Manager Callinan explained the project and 1911 Act assessment district proceedings. He informed that because the bond bid had come in so high (8% interest rate per annum with a 30% discount on par) that the developer was trying to set up a program for installation of the improvements and that-the Council keeps jurisdiction by keeping the public hearing open. There being no one further desiring to be heard and no written communications received, the Council continued the public hearing to its March 24, 1980 meeting at 7:00 p.m. Mayor Roberts declared a recess at this point in the meeting, .the time being approximately "8:37 p.m. Reconvene Mayor Roberts reconvened the meeting at approximately 8:50 p.m. with all Council members present. Planning and City Manager Callinan, referring to his March 6, 1980 Council Zoning Matters meeting memo, informed that all the planning and zoning matters listed on the meeting's agenda were duly noticed for public. hearing. File No.. 0714 - Planning Director Skanchy explained Dewayne Strawther's Dewayne Strawther, application for rezoning of 6.6 acres located south of East Rezoning Cotati Avenue, east of Cristobal Road extension from "A" (Agricultural) District to "RM- 2000 -PD" (Multiple Family, Planned Unit Development) District. Mayor Roberts opened the public hearing on File No. 0714, Dewayne Strawther's application for rezoning of A.P. Nos. 143- 350 -15 and 21. Frank Alexander, 801 Holly Avenue, was recognized and commented on prior multi- family zoning of the subject area and inquired how individuals.in the area have been given notification of the proposed rezoning. Mayor Roberts explained. Mr..Alexander inquired if units would be owner occupied. Mayor Roberts explained that this was strictly a rezoning matter. Sam Clauder, 535 Arlen Drive, was recognized and expressed concern about mailing; and posting of public notice for the proposed project. Page 6 March 10, 1980 'City Manager Callinan explained the procedure for 'publication and mailing of notices. Mr. Clauder felt that notices should be mailed to persons who live in the area but who are not property owners. Planning Director Skanchy explained that notices were mailed according to the city's municipal code and state law and to the 'City of Cotati because of the close proximity of the proposed rezoning to that entity's city limits. Mr. Clauder informed that at a recent meeting at Sonoma Grove residents had no knowledge of the proposed development and he compared the location of the project described In the Notice of Public Hearing and agenda. Mayor Roberts asked that Mr. Clauder either express support Or opposition to the project Mr. Clauder requested continuance of this matter to the next Council meeting in order to notify residents of Sonoma Grove and the nearby apartment complexes about the proposed project City Manager Callinan explained that, if approved, the matter would automatically be on the next regular Council agenda because rezoning ordinances must be acted on twice, i.e. introduced then adopted. There being no one further desiring to be heard and no written communications received, Mayor Roberts closed the public hearing. Ordinance No. 371 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING THE ROHNERT PARK MUNICIPAL CODE, TITLE 17 (ZONING MAP CHANGE ASSESSOR'S PARCEL NUMBER 143 - 350 -21 and 15, PLANNING FILE NO. 0714) Councilman Carbone made a motion, which was seconded by Councilman Hopkins, to waive the reading of Ordinance No. 371 and introduce.said ordinance,, Councilman Beary stated that he would vote on this project because he does not plan on bidding on same, Councilman Carbone's motion to waive the reading of Ordinance No. 371 and introduce said ordinance was approved by the following roll call vote: AYES: (4) Councilmen Beary, Carbone, Hopkins and Roberts NOES- (1) Councilman Stewart File No, 0725 - Planning Director Skanchy, referring to a plan on display, Condiotti, Precise reviewed the proposed precise development plan for 216 Development Plan condominium units to be located at the southeast corner Of Golf Course Drive and Snyder Lane. Mayor Roberts' opened the public hearing on File No. 0725, Art Condio-tti's preolse development plan for a 216 condominium unit development., Page 7 March 10, 1980 Bob Weinman, 5763 Dexter Circle, was recognized and asked if both Files Nos. 0725 and 0718 could be addressed at the same time. He commented on Councilman Beary's service to the city, expressed concern for.safety of children going back and forth to school, signalization of Country Club Drive at Southwest Boulevard, and asked when the proposed condominiums would be developed. Mayor Roberts informed that the units would not be built this year unless there was a transfer of units under the city's growth management policy. Councilman Carbone commented that the Planning Commission minutes showed that the units would be built in 2 -3 years. Mr. Weinman expressed that because of the possible displacement of middle income persons he supported Councilman Stewart's ordinance'requiring owner occupied units and asked if the city had required owner occupied units in the Racquet Club development. Mayor Roberts answered that the City had requested that the units be owner occupied and the developer agreed. Mr. Weinman requested that, on behalf of the parents and youngsters, consideration of the proposed condominium units be postponed until after the election or 2 -3 months from now. Charles Kitchen, 4457 Hollingsworth Circle, was recognized and made reference to his previous comments objecting to the proposed development, commented on widening of Snyder Lane, and expressed concern about traffic circulation because residents of the proposed development will probably cut through "D" and "E" Neighborhoods in order to avoid Snyder Lane. He said that he was mainly concerned with the safety of children and'that he didn't believe there were adequate streets to accommodate the proposed development. He also commented that the 108 Rohnert condominiums had a condition imposing owner occupancy which was waived by the Planning Commission. Frank Alexander, 801 Holly Avenue, was recognized and reflected on the difference between the two project's locations and asked that the record show his comments applied to both projects (File Nos. 0725 and 0718). Mr. Alexander expressed concern about the amount of parking provided for the units. Mayor Roberts informed that there were 2 1/4 parking spaces per unit in compliance with the city's code. Mr. Alexander asked if it would be possible to provide 100 more parking stating that there is inadequate parking in the area of 'Hahn School. He commented on traffic circulation, instituting a no parking provision, installation of signs calling attention to the school, and informed that one of his children attended Hahn School and the other Emily School and which causes inconvenience to his family. Mr. Alexander also felt that the city should assist homeowners in theft prevention programs and expressed concern about the ratio between owner occupied vs. tenant units. Page 8 March 109 1980 Councilman Stewart commented on the fact that the school district and city were two separate and distinct entities. Mr. Alexander asked if there were any way to monitor the number of rental units in the city. City Manager Callinan replied in the affirmative and explained that staff looks at each neighborhood separately to determine "A the rental /owner occupancy factor. , /A Councilman Carbone briefly commented on the importance of the rental market. Mr. Alexander expressed that he felt San Francisco's greatest problem was absentee landlords and felt that growth should be closely associated with owner occupancy. Durward DeBrunner, 5731 Dorian Drive, was recognized and pointed out that there was only one entrance /exit to the proposed project which may present a problem in case of emergency. City Manager Callinan informed that the city's fire services staff had reviewed the proposed development plan and found it acceptable insofar as access was concerned. Mr. DeBrunner asked someone to explain the 10% low income housing provision. City Manager Callinan responded. City Manager Callinan, at Councilman Hopkins' request, read aloud a letter from the Cotati- Rohnert Park Unified School District, dated March 5, 1980, concerning student yield from the proposed developments. Chuck Linthicum, Debra Homes, was recognized and commented on the single access to the development and informed that there was adequate turn around area on the site, explained the 10% low income housing units offered by the developer,`'` incremental development of the project, off - street parking, ;J owner occupied,units and establishment of a homeowner's association. Councilman Stewart Councilman Stewart left the Council Chambers at approximately Leaves'' 9:50 p.m. Mr..Linthicum also commented on the developer's improvement of Golf Course Drive to Country Club Drive. Robert 'Weinman, 5763 Dexter Circle, was recognized and asked if the Council's approval of this project would be a commitment of the next City Council. Mayor Roberts responder in the affirmative. Donald Moitoza, 5732 Dorian Drive, was recognized and asked if the school district had indicated that the proposed develop - ment would. yield 51 students. Councilman Hopkins responded 1154 ". Page 9 March 10, 1980 City Manager Callinan indicated that the figure represented a combined total yield from 535 units, not only the project under discussion. Mr. Moitoza remarked that he could foresee the same thing happening as in I'D" Neighborhood where the school site was not needed and later developed into single family homes. Mr. Arthur Condiotti, President Debra Homes, was recognized and reminded that this property was already zoned, that 20 acres had been donated to the city for a public facilities site or park, and commented on various other concessions that had been made by his firm in order for the development to proceed. Sam Clauder, 535 Arlen Drive, was recognized and inquired if the proposed structures had a southern exposure so that they could be converted to solar energy in the future. Planning Director Skanchy explained that a portion of the units had a southwest exposure and that the pool would be heated by solar energy.' Mr. Clauder requested postponement of the project until it had been re-designed to accommodate solar energy. Mr. Frank Alexander, 801 Holly Avenue, was recognized and and said that he supported Mr. Clauder's concern about solar energy. There being no one further desiring to be heard and no other written communications received, Mayor Roberts closed the public hearing: Mr. DeBrunner was recognized and asked at what point a home- owner's association would be formed to take over managing the development. Chuck Linthicum, Debra Homes, replied when 51% of the units were sold. City Manager Callinan commented on improvement of Snyder Lane in the unincorporated area and future school for IIG'I neighborhood, Councilman Carbone made a motion, which was seconded by Councilman Hopkins, to approve Art Condiottils precise development plan for 216 condominium units, (File No.0725) to be located at the southeast corner of Golf Course Drive and Snyder Lane subject to the conditions recommended by the Planning Commission, Discussion followed. Councilman Beary stated that he would vote on this project because he would not be a bidder on same. Discussion continued between Council members and during which Mr. Condiott-i. answered questions about the antivipatod pr-Tve of the condo- minium units. Page 10 March 10, 1980 Councilman Carbone's motion to approve the precise development plan for a 216 condominium unit development by Art Condiotti (File No. 0725) was approved by the following roil calf. vote: AYES: (4) Councilmen Beary, Carbone, Hopkins and Stewart NOES: (1) Mayor Roberts File No. 0718 - Mayor Roberts opened the public hearing on File No. 0718, Debra Homes, Precise Debra Homes' application for precise development plan Development Plan for a 250 condominium unit project and informed that Messrs. Alexander and Weinman's statements during the preceeding Public hearing would be part of the public hearing record for this matter. Councilmen Carbone and Stewart Leave/ Return Mayor Roberts Leaves Mayor Roberts Returns Planning Director Skanchy, referring to the plan on display, reviewed the precise development plan for a condominium development to be located on the north and south sides of Golf Course Drive extension, between Snyder Lane and Country Club Drive. Councilman Carbone left the Council Chambers at approximately 10:23 p.m. and Councilman Stuart left at approximately 10:29.p.m. and returned at approximately 10 :30 p.m. Mayor Roberts left at this point in the meeting, the time being approximately 10:30 p.m. Charles Kitchen, 4457 Hollingsworth Circle, was recognized and explained that he was especially concerned with safety of school aged children. He informed that he had discussed children attending different neighborhood schools, inadequacy of the playground area and provision for a mid -year school site with School Supt. McConnell. He said that school district funds for projects . was running low. Councilman Hopkins commented that the Emily and Hahn Schools were near capacity and not at full capacity. Mayor Roberts returned at this point in the meeting, the time being approximately 10:34 p.m. Mr. Kitchen commented on the close proximity of the park site to Country, Club Drive, youngsters being forced into traffic lanes because of parked cars on Country Club Drive, and informed that on December 10, 1979 he had presented 57 signatures from residents of I'D" and "E4l Neighborhoods concerning the rezoning of this particular land. Mr. Kitchen recommended that the Council limit the speculation of condomin- ium units. Frank Alexander, 801 Holly Avenue, asked if the proposed units could be designed with carports instead of garages, recommended that a storage area be provided for each unit and commented on use of garages as storage area thereby necessitating use of off-street parking. Gerald Schlvetter, 6089 Daphine, was recognized and commented about using brighter colors on the site plan. Page 11 March 10, 1980 Councilman Hopkins read a recap of a telephone conversation between staff and Asst. School Supt.,Davidson concerning Emily,. Evergreen and Hahn Schools. Ray Regnault, 4406 Hedge Court, was recognized and asked about the school district projection that there would be only 54 students generated from 535 units and commented that the proposed units would probably be occupied by young people who traditionally have more kids. Councilman Carbone Councilman Carbone returned at this point in the meeting, Returns the time being approximately 10:44 p.m. City Manager Callinan commented on the the school district's student yield projection for the proposed project and the fact that children are attending schools in other neighborhoods. Sam Clauder, 535 Arlen Drive, was recognized and commented on the city's planning through the years. Councilman Carbone raised a question on a point of order. Mr. Clauder recommended that the development be re- designed so that each unit could be retrofitted to solar energy at some future date. Durward DeBrunner, 5731 Dorian Drive, was recognized and expressed concern about access to the proposed development. 'Planning Director Skanchy pointed out access points on the development plan which was displayed. Arthur Condiotti, President of Debra Homes, was recognized and informed that the proposed units were designed with a southern exposure for conversion to solar energy. Mr. Condiotti informed that his firm had donated one -half of the new Mountain Shadows Golf Course for the density shown on the development plan. Additionally his firm had contri- buted towards the acquisition of the school site and improved street frontage for said site. Helen Lawrence, 942 Ellen Street, was recognized and commented about the "free enterprise" system and said that the citizens were more concerned that they be provided with services to which they are entitled and asked that the Council keep that in mind when voting on the proposed development. There being no one further desiring to be heard and no, written communications received, Mayor Roberts closed the public hearing. Councilman Carbone made a motion, which was seconded by Councilman Stewart, to approve Debra Homes' precise develop- ment plan for 250 condominium units (File No. 0718) to be located on the north and south sides of Golf Course Drive extension, between Snyder Lane and Country Club Drive subject to the cond.i tTons recommended by the Planning Commis- sion. Councilman Carbone's motion to approved the precise development plan for a 250 condominium unit development proposed by Debra Homes (File N'o.,0718) was approved by the following roll can vote: AYES: (4) Councilmen Beary, Carbone, Hopkins and Stewart NOES: (1) Mayor, Roberts Meeting Extension Due to the fact ,that the 11:00.p.m. adjournment deadline had been reached, other matters listed.on the agenda were deferred to the next Council meeting. ,Upon motion of Councilman Carbone, seconded by Councilman Stewart, and approved by the following voice vote, the Council agreed to move ahead on the agenda to the remainder :of Planning and Zoning Matters and to extend the 11:00 p.m. adjournment deadline. Mayor Roberts opened the public hearing on File No, 0720, Fairway Business Park Associates' application for precise development plan and architectural review of two office - warehouse structures. Jim Redding, 7147 Barbi Lane,representing Fairway Business Park Associates, was recognized and commented on the condition requiring installation of a sound wall between the homes and golf course and the east side of the railroad tracks. Planning Director Skanchy explained that several developments would be participating in the development of a sound wall in the same area. Mr. Redding objected to imposition of a condition requiring installation of a sound wall because it was specifically to eliminate noise from the: - trains and not his development. Mr Redding questioned the city's policy of providing a sound wall for the higher income homes in the community without providing something similar in P1A ", "B" and "L" Neighborhoods. Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and approved by the following voice vote, Fairway Business Park Associates' precise development plan and architectural review of a two office - warehouse building complex (File No. 0720) was approved subject to the conditions recommended by the Planning Commission, except Condition No. 2 regarding installation of a sound wall, and that the applicant install a chain link fence and landscaping on the ea-,tern perimeter of the projact site. Eagle Park City Manager Callinan referred to his Council meeting memo, Restroom dated March 6, 1980, concerning.a. quote which was received for installation of a pre -- fabricated metal restroom /storage concession stand building for Eagle Park. Upon motion of Councilman - Beary, seconded by Councilman Carbone, and unanimously approved, the Council approved installation of —a pre - fabricated metal building by Super Secur Manufacturing Co. in Eagle Park. Appreciation for Mayor Roberts expressed sincere appreciation for all that Councilman Beary Councilman Beary had done in the past and, on behalf of the Council wished him much good luck in the future. This resignation is in protest of the current conflicts of interest laws and growth policies prevalent in our state today. I feel that the conflict of interest code denies true representative government and these codes are contrary to the public's interest. The conflicts of interest code discourage certain legitimate and honest businessmen from seeking elective offices and give no guarantees against corrupt and unresponsive government. Anti - growth policies are counter- productive in that they create scarcity of housing and encourage speculation in a country where the only legitimate control should be the public needs and the public demands for housing.
