Approval of Minutes
ROHNERT PARK CITY COUNCIL MINUTES
April 14, 1980
The Council of-the City of-Rohnert Park 'met this date in regular
session commencing at 7:00 p.m. in the City'Offices, 6750 Commerce
Boulevard, Rohnert Park, with Mayor Roberts presiding. The
regular session was preceded by an executive session which
commenced at 7:00 p.m. and at which Councilmen Carbone, Hopkins,
Stewart and Roberts' and Councilman-elect Cavalli and City
Manager Callinan "'were present and which was held to discuss
personnel, meet and confer, and litigation matters.
Mayor Roberts called the meeting of the regular session to
order at approximately 7 :30 p.m. and led,the pledge of alle-
giance.
Present: (4) Councilmen Carbone, Hopkins, Stewart and Roberts
Absent: (0) None
Staff,present for all or part of the meeting: City Manager
Callinan,`City Attorney'Flitner and Planning Director Skanchy.
Upon motion of Councilman Hopkins,, seconded by Councilman
Carbone, and unanimously approved with Councilman Stewart
abstaining, the minutes of March'24, 1980 were approved as
submitted.
Approval of Bills
Upon motion of Councilman Hopkins, seconded by Councilman
Carbone, and unanimously approved,`the bills presented per
the attached list in the amount of $1,981,547.22 were approved
as submitted.
Skateboard Park
Mr. William Adams, 184 Madrigal, was recognized and expressed
concern for the safety of children who are playing in the
abandoned skateboard,park located across from the Rancho
Feliz " Mobile `Home Park. He explained that the youngsters
were 'getting into the facility through the delapidated fence
and urged the Council to initiate proceedings to abate the
facility.
Mayor Roberts told Mr. Adams that this was the first time
the Council had heard of the problem and asked City Manager
Callinan to'look into the matter to make sure the area was
properly secured. Discussion followed.
Masonary Fence on
Mr. Franke Gilman, 89 Alma Avenue, was recognized and asked
Southwest /Commerce
if the Council was scheduled to consider installation of the
masonary fence in the area of Alma and Adele Avenues on Southwest
Boulevard.
Mayor Roberts informed that City Manager Callinan had been
in touch with P.G. &E. to develop a program for undergrounding
the overhead electrical wires before the city installed the
masonary fence. Discussiou followed during which Mr. Gilman
commented that he would not be in favor of a sidewalk,on the
north 'side of Southwest Boulevard.'.

Solar Energy
Mr. �Sam Clauder, 535 Arlen Drive, was recognized and read
a letter (a copy of which is attached to the original set
of these minutes) urging the;:Counc l.- .to.establ.ish a solar
energy program. Discussion: followed. ;..-
Upon motion of Councilman: >,Hopkins, seconded by Councilman
Carbone, and unanimously, approved, staff was directed to research
the feasibility of incorporating solar .:.energy requirements
into specific city regulations•j -.;.
Skateboard Park
Mrs. Maxine Brumley, 190 Argonne Way, was recognized and
commented that she .felt it was each parents responsibility
to see that their children do not trespass by using the abandoned
skateboard park and that the city should.not have to make
the area secure.
Zoning Notices
City Manager Callinan, responding to an inquiry of Mr. Sam
Clauder, informed that public notices regarding proposed
rezonings would be mailed to� residents living in the vicinity
of the proposed ,rezoning on a trial basis.-to See if it results
i -- ? a greater response or attendance at public hearings.
Solar Energy,
Mr. Steve Wisbaum,, 8 Alexis, was recognized and asked if
- residents could participate, in developing the city's solar
energy program.
Mayor,Roberts;informed. that any information and /or: input should
be provided to staff and that after the initial report was
,
prepared a public.hearing would be scheduled on the matter.

City Manager Callinan explained the ordinance.
Upon motion of Councilman Carbone, seconded by Councilman
Stewart, and :unanimously approved by a roll call vote, reading
or Ordinance No.- 372 -was waived and said ordinance was adopted.
City Manager Callinan requested that consideration of Transporta-
tion Development Act matters be postponed until later in the
meeting.
Parks and Recreation City Manager Callinan referred the Council to his memo dated
Matters April 10, 1980 concerning scheduling of playfields and lighting
the tennis courts at=- Rohnert Park Junior High School. Discussion
followed.during which the Council declined the offer of a
verbal, pre sent atio'n on the playfields scheduling.
City Manager Callinan asked that staff be authorized to proceed
with preparation of the plans Iand specifications for the
resurfacing and lighting of the junior high school tennis
courts. The Council concurred.

Ordinance No. 371

City Manager Callinan explained the ordinance.

Carbone, and unanimously approved by a roll call vote, reading
of Ordinance No. 371 was waived and said ordinance was adopted.

AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING TITLE 17
OF THE ROHNERT PARK MUNICIPAL CODE TO PROVIDE FOR THE, DEPOSIT
OF A'BOND WITH THE .CITY TO SECURE AND INSURE THE INSTALLATION
OF LANDSCAPING PURSUANT TO PLAN

City Manager Callinan explained the ordinance.
Upon motion of Councilman Carbone, seconded by Councilman
Stewart, and :unanimously approved by a roll call vote, reading
or Ordinance No.- 372 -was waived and said ordinance was adopted.
City Manager Callinan requested that consideration of Transporta-

Mr. Sam Clauder, 535 Arlen Avenue, was recognized and expressed
concern that the proposed: structures be designed for north /south
facing.
Mr. Star Williams, 30 Alexis, was .recognized and asked that
.,the. , developer be contacted concerning, tak,).ng advantage of solar
energy in the suture.
Mr. Seaman Hunter, Anne Street, was recognized and expressed
that he would like to see,developments . in the city oriented
towards a village concept with community buildings and endorsed
use of solar energy:

A motion was made by Councilman Hopkins, seconded by Councilman
Carbone, to approve the precise' development plan and archi-
tectural review for Qantas Development Corporation's 48 condominium
unit project'to be located at the northeast corner of Camino
Corto and Avenida Cala. Said motion failed by the following
roll call vote.

Mayor Roberts t6quetted that the matter be placed on the next
agenda to try and resolve the deadlock.

Mayor Roberts. opened the public hearing. on Thomas Whitson's

application for precise development plan and architectural

review for a Transcon Lines freight trucking terminal.
Terminal Facility
Mr. Thomas.Whitson was.,recognized and described Transcon
Lines' freight trucking services.
Planning Director Skanchy described the location of the proposed
project as shown on a site plan which,was en display.
Mr' Whitson explained that there would be approximately 6 -8
large and 10 -12 small trucks using the terminal with many
of -the large..trucks arriving at night or early morning. He
explained that.it' was important that the driveway be 35' in
width instead of the 24' recommended by staff.
There being no one further desiring to be heard and no written
communications received, Mayor Roberts closed the public hear-
ing. Discussion followed between Council members, City Manager
Callinan, Planning Director Skanchy with Mr. Whitson participating.
Councilman Hopkins made a motion, .which was seconed by Council-
man Stewart, to approve precise development plan and architectural
review for a Transcon Lines freight trucking terminal located
on Carlson Court at Labath Avenue (Lot 53) in Laguna Verde
Industrial Subdivision, subject to the conditions contained
in the planning staff report. Discussion followed.
Councilman Hopkins amended his motion to allow a 35' wide
drivew ay subject to the condition that the applicant provide
additional landscaping as outlined in the planning staff report.
Councilman Carbone seconded the motion which was approved
by the following voice vote:

Building
Peter Beck, Codding Enterprises,` was recognized and offered
to answer any questions.
Mr. Sam Clauder, 535 Arlen Drive, was recognized and said
he had a question about north facing.. Planning Director
pointed out north on the site plan.

Upon motion of Councilman Hopkins, seconded by Councilman
Stewart, and approved by the following voice vote, Codding
Enterprises' application for precise development plan and
architectural review for a commercial /industrial building
to be,located north of Rohnert Park Expressway, west of and
contiguous to Labath Avenue in the area west of the freeway,
was approved subject to conditions recommended by the Planning
Commission.

File No. 0669 - City Manager Callinan reviewed his Council meeting memo dated
C 6 N Products re. April 10, 1980 'concerning C 6 Nr Products' appeal of the Planning
Taco Bell Sign Commission denial of architectural.review for Taco Bell signs.
Mr. John Stewart, project representative for Taco Bell, was
recognized and commented on previously.approved signs for
other commercial establishments along Commerce Boulevard.
Discussion followed between Mr. Stewart, City Council members
and staff.
Councilman Carbone
Returns
Yr. Lon Wallace, C & N Products, was recognized and informed
that his company had appealed the Planning Commission's decisior.
for the Taco Bell signs and explained why it was felt that
a sign was needed on the front of the building. Discussiop
followed.
Councilman Carbone returned to the Council Chambers at this
point in the meeting, the time being approximately 8:45 p.m.
Upon motion of Councilman Stewart, seconded by Councilman
Hopkins, and approved by the following voice vote, the City
Council ratified the Planning Commission's denial of architectural
review for the proposed Taco Bell signs and approved signs
subject to the following conditions:
1. That a freestanding sign be allowed but the proposed
such sign be re- designed to have a border and not exceed
9 feet in height (measured from finish grade of sidewalk
along Commerce Boulevard).
2. That the sign on the front of the structure be re- designed
to be an individual- letters type sign (similar to Kentucky
Fried Chicken's attached sign) and which letters are
to be internally illuminated and that there be no flood
lights shining on the sign or on the building.

City Manager Callinan referred the Council to his memo dated
April 10, 1980 concerning the Bank of America's April 4, 1980
letter re, acceptable uses for the northwest corner of the
Park Plaza Shopping Center. City Manager Callinan informed
that staff was of the opinion that the shopping center must
be looked at in Coto and that the site which the bank leased
on the corneris not a separate parcel from the Park Plaza
Shopping Center, Discussion followed.
The Council concurred with staff's opinion and directed that
a leter be sent to the bank so stating.
City Manager Callinan referred the Council to his memo dated
April 10, 1980 concerning designating the State of California
as the Mobile Home and Mobile Home Park Law enforcement agent
in the 'City of Rohnert Park,
Mr, William Adams, 184 Madrigal, was recognized and informed
that he lived i.n Leisure Lake Mobile Home Park in Petaluma
and that whenever something was brought to the State's attention
` the matter seemed to get resolved.
Mr. Seaman Hunter, Anne Street, was recognized and suggested
that information concerning violations at Sonoma
Grove be communicated to the individuals who prepare
the Grove's newsletter as well as the owners.
Mr. Sam Clauder, 535 Arlen Drive, was recognized and asked
why Sonoma Grove hadn't been allowed to have a representative
on the Mobile Home Advisory Committee.
Mayor Roberts informed that Sonoma Grove was considered a
travel trailer park. Discussion followed.
Resolution No. 80 -83 RESOLUTION RETURNING TO THE STATE OF CALIFORNIA THE ENFORCE -
MENT RESPONSIBILITY FOR THE MOBILE HOME AND MOBILE HOME PARK
LAW IN THE CITY OF ROHNERT PARK
City Manager Callinan explained.the resolution,
Upon motion of Councilman Hopkins, seconded by Councilman
Stewart, and unanimously approved, reading of Resolution No.
80 -83 was waived and said resolution was adopted.
Recess Mayor Roberts declared a recess at this point in the meeting,
the time.being approximately 9:15 p.m.
Reconvene Mayor Roberts reconvened the meeting at approximately 9:33
p.m. with all Councilmen, except Councilman Hopkins present
Sonoma County City Manager Callinan referred the Council to his memo dated
Commercial/Industrial- April 10, 1980 concerning the Sonoma County Commercial/ Industrial
Study Study which was undertaken by the County Planning Department.
The Council requested that this matter be continued to its
next meeting in order that Councilman -Elect Cavalli could
"participate in the discussion.
Communications Communications per the attached outline were brought to the
attention of the City Council. No action was taken on any
communica#ons except as specifically noted in these minutes.

Tax Deduction for Councilman Stewart initiated discussion concerning the City
Olympics of Sanger's Resolution No. 1761.
Upon motion,of.Councilman Carbone, seconded by Councilman
City Manager's
Report
Paramedical,
Communications
Stewart, and .unanimously approved, th" City Council went on
records as endorsing the City of Sanger's support for a volun-
tary Federal.Tax deduction for funding of U.S. Olympic athletes
and their participation in the olympic games.
City Manager Callinan referred the Council to his memo dated
April 10, 1980 for explanation of all matters on the City
„Manager' s,Report section of the meeting agenda.
Upon motion of Councilman Carbone, seconded by Councilman
Stewart, and unanimously approved,,the City Council went on
record as endorsing the State Office of Traffic Safety grant
to establish; a paramedical communications network within Sonoma
County and the city's willingness.,to.participate in the program
in accordance, with the requirements for cities participation
as outlined in the Mareh.,31, 1980.letter from the County of
Sonoma.
Library
Upon,motion of Council.man.Carbone, seconded by Councilman
Stewart.; and unanimously: approved, the City Manager was authorized
to have the exterior of the Rohnert Park Library painted at
an estimated cost of $3,500.
Planning Commission
The Council requested that matter be scheduled for the
Compensation
_this
next Council meeting.
Urban Renewal
City Manager Callinan informed that the Supreme Court had
Lawsuit
decided not to hear the city's petition for hearing regarding
the Santa Rosa Urban Renewal Lawsuit...so the lawsuit was
now ended.
Lawsuits: Sanders
City Manager Callinan informed that the City had been served
Southern Pacific
with papers concerning the alleged false arrest of James Sanders
and additional filings in the Southern Pacific Railroad class
action suit to recoup back property taxes.
Profile Structures/
City Attorney Flitner commented on: a) the release in the
National Advertising
Profile Structures Inc., Plaintiff vs. G & V Contractors
and b) informed that he expected a summary judgement from
Judge Murphy soon concerning removal of the National Advertising/
Ryan Outdoor Advertising billboard structure.
Tow Truck Rotation
Mayor Roberts informed that he would like to have the City
Council consider putting Mr. Fred Andreoli of Fred's Union
Service Station added.back: onto the city's list of tow.services
used. D:,.scussaori followed.
Mr:-:Gary Sterner, Cotati- Rohnert Park Auto Body, was recognized
and asked how the city would prevent Mr. Andreoli from storing
towed vehicles behind his service station in Cotati. Discussion
followed.

Upon motion of Councilman Carbone, seconded by Councilman
Stewart, and unanimously approved, the City Council authorized
adding Fred Andreoli's name to the list of tow services used
by the city subject to the condition that he have an appropriate
place to store towed vehicles and provided that he can comply
with all the requirements and regulations imposed on tow services
by the California Highway Patrol.
The Council also directed staff to contact the City of Cotati
concerning the possibility of expanding its tow service rotation
list so as to allow the Park Plaza Texaco Service Station
to be added to it.
New Mayors & Council Upon motion of Councilman Carbone, seconded by Councilman
Members Institute Stewart, and unanimously approved, the Council authorized
any Council member desiring to attend the League of California
Cities, New Mayors and Council Members Institute in Santa
Clara Marriott Hotel, May 8 -10 to so do.
Copy Costs Mayor Roberts initiated a discussion concerning the tremendous
amount of reading material and copies of memos and reports which
are provided to each Council member and suggested that perhaps
some of the routine matters should not be copied
unless, after a- Council member has reviewed the communication
outline,ha.requests a copy of whatever he was interested in. Mayor
Roberts indicated he was interested in reducing the city's
copy costs.
A brief discussion followed and the City Manager was authorized
to use his discretion in providing copies of material or reports
to the Council.
Mobile Home Mayor Roberts advised that the Council would make appointment
Advisory Committee of a liaison to the Mobile Home Advisory Committee at the
next Council meeting.
University Mr. Sam Clauder, 535 Arlen Drive, was recognized and inquired
how he would pursue a possible criminal investigation relating
to an employee at the Sonoma State University. Cit Manager
Callinan informed that Mr. Clauder should initially come into
the office to discuss the matter with him.
Adjournment There being no further business, Mayor Roberts adjourned the
meeting at approximately 10:10 p.m.
