1980/04/28 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES April 28, 1980 The Council'of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard', Rohnert Park, with Mayor Stewart presiding. The regular session was preceded by an executive session which commenced at 7:00 p.m. and.at which all Council - men and'City.Manager Callinan were present and which was,held to discuss personnel, meet and confer, and litigation matters. Call to Order, Mayor Stewart called the meeting of the regular session to order at approximately 7:46 p.m. and led the pledge of alle- . giance. Roll Call Present: (5) Councilmen Carbone, Cavalli, Hopkins, Roberts and Stewart Absent: (0) None Staff present for all.or part of the meeting: City Manager Callinan; ;City Attorney Flitner, Planning Director Skanchy and Director of Public Safety Dennett. Approval of- Minutes. Upon motion .of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, the minutes of April 14, 1980 and April 15 1980 were approved as submitted. Approval of Bills Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and unanimously approved, the bills presented per the attached-,list in the amount of $955,510.36 were approved as submitted. Unscheduled Public Barry Rosen, 5079 Country Club Drive, was recognized and 'Appearances initiated a'discussion concerning parking problems on the north.end'of Country Club Drive and the inability to park two cars in the two -car garage homes in that area. Discussion followed during which City Manager Callinan indicated that the matter would be brought up later in the meeting. Saemen Hunter, 42 Ann Street, was recognized and informed the Council of various studies available on housing etc. at Sonoma State University. Mr. Hunter expressed concerns regarding housing, "need for low income and student housing. Discussion followed. Resolution No. 80 -.86:. Carbone, seconded by Councilman Roberts,; and, unanimously approved, reading of Resolutions Nos. 80-86 and 80-87 was waived and said resolutions were adopted and the listed miscellaneous approvals on the Consent Calendar were approved. Plaque of Appreciation City Manager Callinan reported that James Swatts was not in attendance'-at the moment and recommended his presentation be held later -in theimeet -ng. Council concurred. Family Information Pat Agnew, Director of Family Information Center, was Center "Play and Learn ocogniz &d" ' distributed material to each Council, member and Day Camp" gave a presentation on the Family Information Center's "Play andl Learn Flay Camp ",:" reported that the center was seeking supportive funds from Rohnert Park for the 1980 summer, program.. Discussion followed 'after which the Council took the request under advisement. Planning and Zoning City Manager Callinan, referring to his_April .25, 1980 Matters Council'meeting memo, informed that the planning and zoning ­matters listed on the meeting's agenda were duly noticed for public hearing if required and copies of all pertinent information had`been provided to each Council member. File No. 0500 -- City Manager Callinan referred Council to his memo dated Qantas Development; April 25, 1980 to the City Council concerning precise Precise Development `development plan and architectural review for a proposed 48 Plan '& Architectural unit condominium project .to be located at the northeast Review corner of Camino Corto� and Avenida Cala. City Manager Callinan indicated that the'matter came before the Council with a recommendation for approval by the Planning Commis - sion and the city staff. Planning Director. Skanchy,.e.xplained the proposed project referring to site. plans and elevations on display and .noted that the application had been approved by the Planning Commission subject to conditions. Jon Joslyn, Qantas Development Corporation, was recognized a upon inquiry indicated that he was hopeful that the project would proceed this year. Mayor Stewart expressed concerns of lack of apartment units within the city. Discussion followed. File No. 0732 - T� R. Barnard Use Permit Denial Page 3 April 28, 1980 Councilman Carbone made a motion, seconded by Councilman Hopkins, to,approve.Qantas Development Corporation's applica- tion for precise development plan and architectural review for a 48 unit condominium project to be located to the northeast corner of Camino Corro and Avenida Cala subject to the conditions recommended in the planning staff report. Discussion followed. Saemen Hunter, 42 Ann Street,.was recognized and briefly reviewed a clipping from the San Francisco Chronicle regard- ing housing and presented a`copy of same to the Council. City Attorney Flitner upon inquiry informed that changing from an apartment project to .a condominium project was legal since the project met'all the requirements including zoning. Discussion followed with Jon Joslyn participating. (1) Councilman Cavalli City Manager Callin an referred the Council to his memo dated April 25, 1980 to the City Council concerning T. R. Barnard's appeal of Planning Commission denial of use permit to reduce the required 20 foot rearyard setback to 15 feet at 4407 Hampton Court Planning Director Skanchy referred Council to a plot plan and reviewed planning staff report recommending denial of said use permit. T. R. Barnard, Builders Inc., was recognized and explained the lot layout to Council indicating that if he could not get a use permit to reduce the rearyard setback to 15 feet then he would have to build a two -story building. ' Discus- sion- followed. Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and approved by the following roll call vote, Council granted use.permit to reduce the required 20 foot rearyard'setb'ack to 15 feet at 4407 Hampton Court, subject to the conditions as set forth by the Planning Commission and staff. AYES: (3) Councilmen Carbone, Hopkins and Roberts NOES: (2) Councilmen Cavalli and Stewart File No. 0734,- City Manager,Callinan referred the Council to his memo Ken Porter, Precise dated April 25, 1980 to the City Council concerning precise Development Plan and development plan and architectural review for a three -story Architectural Review commercial /industrial building to be located on the west side of Commerce Boulevard, south of and contiguous to Hine - baugh Creek, east of U.S. 101 freeway and pointed out that the matter was scheduled for a public hearing. Recess Mayor Stewart opened the public hearing on Ken Porter's application for precise development plan and architectural review for e three story commercial /industrial building to be located on the west side of Commerce Boulevard. Vern" Avila, Building'Designer, was recognized and briefly commented on the project and-upon inquiry informed Council 'that the building did provide for solar energy and that the windows in the building.did open on the second story facing ''south. Discussion followed. 'There being no one else desiring to be heard and no written communications received, Mayor Stewart closed the public hearing. Upon motion of Councilman Hopkins, seconded by Councilman Cavalli, and unanimously approved, Council,granted architectural review and precise development plan approval to'Ken Porter's plans for a three -story commercial / industrial building to be located on the west side of Commerce Boulevard, south of and contiguous to Hinebaugh Creek, east'of U.S. 101 freeway, subject to the conditions recommended'in the planning staff report. Mayor Stewart declared a recess at this point in the meeting the time being approximately 9:10 p.m. Reconvene Mayor Stewart reconvened the meeting at this time the time being approximately 9:25 pm., File No. 0717, City Manager Callinan reported that the United California United California Bank had applied for and received Planning Commission Bank, Modular approval for a modular building to be located on the bank's Building future site on the .Rohnert Park Expressway. City Manager Callinan referred to site and elevation plans on display and 'explained the' Commission's action. He advised that he wanted the Council to be aware of the approval of the temporary b uilding. :`Discussion followed. Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, the Council stayed the Planning Commission's approval and called up for Council, review the matter of the United California Bank proposed . temporary modular building at the next regularly scheduled City Council meeting. Jim:Redding, 7174 Barbl Lane, was recognized and requested that the Council not limit or freeze commercial condominiums. Council:, indicated that the motion did not include commercial/ industrial condominiums. Jim Swatts City; Manager,Callinan :indicated that due to another engage - Presentation ment, Jim- Swatts would 1e unable to make the meeting for the presentation of the,plaque of appreciation for his work for the city's Police Explorer's and as a Police Reserve Officer. .and -that the matter would be deferred to another Council meeting. , Commercial /Industrial City"Manager Callinan referred Council to his memo to the Study,. - `,Council dated April 25, 1980 concerning the Commercial/ - :Industrial Study briefly updating on same. A brief discus- sion followed. Performing Arts Center ,, City Manager Callinan referred Council to his memo to the Programming Study Council ;dated -April 25, 1980.concerning,the presentation of S. Leonard Auerbach & Associates Pre - Architectural Programming Study for Performing Arts Center :and scheduling a joint meeting with commissions re. same for May 15, 1979,, _:. , Oouncil concurred regarding the joint meeting with,.ihe commissions for May 15, 1980. Taxi Cab`Service City Manager Callinap referred Council to his memo to the Councii dated April 25, 1980 concerning applications for Certificate of Public Convenience and Necessity to operate a taxi cab service from Patterson Transportation Co. and ':Yellow Cab Co., indicated that the applications were scheduled for public hearings and that notices had been sent out regarding.:same. City Manager Callinan read aloud a memo letter concerning a telephone conversation with Patterson Transportation Co. indicating'that they would like to withdraw their applica- ti,on,( copy of which is attached to the original set of these minutes). Mayor'Stewart opened the public hearing on the application for Certificate of Public Convenience and Necessity to operate a.taxi cab service by Patterson Transportation Co. Page 6 April 28, 1980 There being no one desiring to be heard and no written communib�rt;ions received, Mayor Stewart closed the public hearing.` Mayor Stewart opened the public hearing on the application for,Cei'rtficate of Public Convenience and Necessity to operaie`a'taxi cab service by Yellow Cab Co. George Probst, representing Yellow Cab Co., was recognized and informed that he would answer any questions the Council mighi have. Upon inquiry, Mr. Probst indicated that the rates in Rohnert Park would be the same as those in Santa Rosa. James Orr,, 7486 Boris Court;. was recognized and inquired if discounts for senior citizens would be provided. Mr. Probst advised that was not included yet far Rohnert Park but:that it` was 'offered in Santa Rosa. City Manager Callinan recommended that the Council, as part of its approval, require the discounted rates. The Council concurred. Resolution No. 80-88 A RESOLUTION OF THE CITY OF ROHNERT PARK AUTHORIZING THE ISSUANCE OF A`CERTIFICAT'E OF,PUBLIC CONVENIENCE AND 'NECESSITY TO YELLOW CAB COMPANY OF SANTA ROSA FOR'TAXI CAB SERVICE -Upon motion of Councilman' Carbone, seconded by Councilman Roberts,'and`unanimously approved, the reading of Resolu- tion No.. 80 -88 was waived and said resolution was adopted. Solid.Waste Management City Manager'Callinan referred Council to his meeting memo Plan dated Apri1'25, 1980 concerning input on Solid Waste Manage- tent Plan. Councilman Carbone briefly reported on the Solid Waste Management Plan and the advisory board and a proposal to increase dump fees. Discussion followed. Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved, Council approved indicatiz strong protest against any :Solid Waste Management Committee recommendations until all cities involved have a chance for their input., Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken on any communications except as specifically noted in these minutes. A brief discussion followed concerning the letter received concerning the "Coca Cola" signs on the golf course's driving range. City Manager's Report City Manager Callinan referred the Council to his memo dated April 25, 1980 to the Council for explanation of all matters on the City Manager's Report section of the meeting agenda. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved, Council authorized staff and Council to attend School District Superintendent Les Meyers' retirement dinner. Page 7 April 28, 1980 E Mobile Nome Advisory , City Manager Callinan reported that the Mobile Home '-Committee Meeting Advisory Committee meeting was scheduled to meet at City ;.• Hall, May 6, 1980 at 7:00 p.m. Community Gym Update City Manager Callinan referring to floor plans on display explained "the 'revised floor plan of the proposed community gym. Hahn School Traffic; City Manager Callinan reported of the many complaints Problems of traffic problems near-the Hahn School. He recommended that a bike path be developed with concrete blocks placed on the east side.of Country Club Drive and that parking be prohibited on "'the east side of said street because of the proposed bike path but that parking be allowed on the west side of the street. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, the Council authorized the "construction of the bike path on Country Club Drive and the change in parking as recommended and explained by the City Manager.' Sunshine Bus City Manager- Callinan reported of an accident in Cotati with the Sunshine Bus and indicated that reports of the accident will be provided at a later \time. Parker /Walker Suit City Manager Callinan advised the Council of a lawsuit filed against the City by Goldie Parker and William Walker and that -the matter had been referred to the Redwood Empire Municipal Insurance Fund for handling. Baseball Memorial City Manager Callinan indicated that the Parks and Recrea- tion Commission had recommended that the new baseball field at the Rohnert Park Junior High School be memorially named after Bob Dewan a deceased former member of the Parks and Recreation Commission and President of Rohnert Park Babe Ruth Baseball. City Manager Callinan advised that he would refer the matter'to the School District for handling with the Council's approval. Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved, the recommendation to name the new..baseball , field at the Rohnert Park Jurdor High after Bob Dewan was referred to the Cotati - Rohnert Park Unified School District. Commission The Council directed that the persons on City Commission's Appointments whose terms expire on June 30th be contacted to determine who is interested in being considered for re- appointment. Retirement City Manager Callinan requested authorization for Council Dinner: Les Meyers and staff to attend Les Meyers' retirement dinner on May 30, 1980. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved, Council authorized staff and Council to attend School District Superintendent Les Meyers' retirement dinner. Joint Meeting Commissions Compensation, Adjournment Joint Council directed staff to set up a meeting between the school district Board of Education and the City Council at a date that;,was convenient,to both parties. Council, directed staff to.set up a joint meeting with the Cotati.:City Council to meet in Rohnert Park on a date that was.convenient to both parties. The Council indicated that the Planning Commission's request for compensation betaken up at budget time for all Commis- sions.
