1980/08/25 City Council MinutesCall to Order Approval of Minutes ROHNERT PARK CITY COUNCIL MINUTES August 25, 1980 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Stewart presiding. The regular session was preceded by an executive session which commenced at 7:00 p.m. and at which all Councilmen, except Councilman Hopkins, City Managerr,.:Callinan and City Attorney Flitner were present and which was held to,, discuss personnel and litigation matters. Mayor Stewart called the meeting of.the regular session to order at approximately 7:25 p.m. and led the pledge of allegiance. Present: (4) Councilmen Carbone, Cavalli, Roberts and Stewart `Absent: (1) Councilman Hopkins Staff present for all or part of the meeting. City Manager Callinan, Planning Director 'Skanchy,`Finance Director/ Treasurer'Netter and City Attorney Flitner. Upon motidn of Councilman Carbone, seconded by Councilman Roberts and unanimously approved with Mayor Stewart abstaining, the minutes of August 119 1980 were approved as submitted. Approval. of Bills Upon motion of Councilman Carbone, seconded by Councilman Roberts and unanimously approved, the bills presented per the attached list in the amount of $368,319.96 were approved as submitted. August 25, 1980 seconded by Councilman reading of Resolutions ved and said resolutions approval on the consent Unscheduled Public Mr.Duport, 7652 Bonita Avenue was recognized and requested Appearance that the Rohnert Park Soccer Club be allowed to use the Jr. High School ballfield, currently used by the Pioneers baseball team, for soccer tames. Upon inquiry Mr. Duport indicated that play would be complted by the end of November. Pedestrian Safety Citation Award Child Care Center Discussion followed. Councilman Roberts made a motion, seconded by Councilman Carbone, and unanimously approved, to approve Rohnert Park Soccer Club's use of the'Jr. High School ballfield for soccer games subject to approval.of the Cotati - Rohnert Park School District, Jack Dudland., California State Automobile Association, Santa Rosa:District Office representative, was recognized and presented Council with a Pedestrian Safety Citation ..Award for 1979.1 Mayor Stewart accepted the award on behalf of the city. Betty Winter, representing Two Cities Business and Professional Women's Association, was recognized and expressed her organi- ation's,interest in initiating a.study on child care needs in Rohnert Park,and the possibility of developing a child care center. Councilman Roberts informed Ms. Winter's that the State and County had just completed such a study and recommended that she contact same for additional information and also indica- ted that he had a lot of literature that she could have that might be useful. City Manager Callinan recommended that the Council endorse the Two Cities Business and Professional Women's Association child care study. Upon motion of Councilman Cavalli, seconded by Councilman Carbone., and unanimously approved, Council endorsed Two Cities Business and Professional Women's Association's initia- ting a study on child care needs in Rohnert Park. Councilman Carbone volunteered to participate on a committee for the child_ care study. Community Center James Stevenson, 28 Corby Avenue was recognized and explained Sculpture that he had.been chosen by the Cultural Arts Corporation to erect a sculpture at the Community Center on Snyder Lane. Mr. Stevenson described the proposed sculpture i.e. material, size, etc..and displayed a model of same. He informed that the cost,to construct the,'sculpture would be approximately' $4,040 of which $1,,100 will be donated towards the project leaving $2,940 to be raised. Page 3 August 25, 1980 Clara Brown,,Cultural Arts Commission was recognized and informed that fund raising for the sculpture would be regulated and accounted for by the Cultural Arts Corporation. Councilman Carbone made a motion ,to donate $500 towards the construction of Mr. Stevenson's to for the Community Center. Said motion died for lack of a second. Councilman Cavalli made a motion, seconded by Councilman Roberts, and unanimously approved to endorse construction of a sculpture by Mr..Stevenson at the Community Center on Snyder Lane with the condition that the Cultural Arts Corporation regulate and account for all fund raising for same. Planning and Zoning City Manager Callinan informed that copies of planning staff Matters reports, Planning Commission minutes, communications and other pertinent information relating to the Planning and Zoning - Matters section of the'meeting agenda had been previously disseminated to each Council members. File No. 0748 - John City ,Manager Callinan referred Council to his Council meeting Roberts,.Precise Deve- memo dated August 22, 1980 concerning precise development plan lopment Plan & Arch. and architectural review for a 12,925 sq. ft. office retail Review building to be.located at 6600 South Santa Rosa Avenue (Redwood Drive) south of the Buttercup Pantry Restaurant (old skateboard park). He informed that the matter was duly noticed for public hearing and copies of all pertinent information had been pro - vided to each Council member. Planning Director Skanchy explained the proposed project referring to site plans and elevations on display and noted that the „application had been approved by the Planning Commission subject to coi.ditions. Councilman Carbone Councilman Carbone left the Council Chambers at this point in Leaves the meeting the time being approximately 8:06 p.m. Mayor Stewart opened the public hearing on John Roberts application for precise development plan and architectural review, File No. 0748 for an office retail building. John Roberts, Designer., was recognized and described the proposed project, indicated that all uses of the building will be referred to the Planning Commission for review and approval. There being no one further desiring to be heard, and no written communications received, Mayor Stewart closed the public. hearing. Planning Director Skanchy distributed pictures of an existing Sizzler Restaurant and described the new design forthe parapet roof. The Council endorsed°the revised roof design for the Sizzler Restaurant and directed that the matter be referred to the Planning Commission for its review. Ord. Re. Wilful City Manager Callinan reviewed his August 22,1980 Council Misconduct of meeting memo concerning misconduct of minor children. Discus- Minor Children Sion followed concerning amending the city code to provide that parents can be held responsible, up to a certain limit, for the wilful misconduct of their minor children and provi- sions which already exist in.State law. Councilman Carbone Returns Councilman Carbone returned to,the Council Chambers at this point in the meeting the time being approximately 8:15 p.m. Upon motion of Councilman Cavalli, seconded by Councilman Roberts, and approved by the following roll call vote, the Council approved indefinitely tabling the ordinance.regarding wilful misconduct of minor children.. (1)' Councilman Carbone ABSENT: (1) Councilman Hopkins Resolution No. 80-150 A RESOLUTION OF THE CITY OF ROHNERT PARK ENDORSING CALIFORNIA CIVIL CODE SECTION 1714 (Responsibility of Parents for Wilful Misconduct of Minor Children) City Manager Callinan explained the,resolution. Councilman Cavalli made a motion, seconded by Councilman Roberts, and unanimously approved, to waive the reading of Resolution No. 80-150 and adopt said resolution. Ordinance No. 373 FINDING AND DECLARING PUBLIC URINATION AND DEFACATION AND THE PUBLIC -EXPOSURE OF PRIVATE PARTS FOR THE PURPOSE THEREOF INI- MICAL TO THE PUBLIC HEALTH, SAFETY AND WELFARE AND PROHIBITING SUCH ACTS Page 5 August 25, 1980 `City Manager Callinan explained the ordinance. Councilman Cavalli Councilman Cavalli returned to the Council Chambers at Returns approximately 8:22 p.m. Project No. 1980 -2 City Manager Callinan referred the Council to Council meeting Sunrise Park memo dated August 22, 1980 concerning Sunrise Park and indicated that delay of construction was due,tothe possibility of receiving additional grant funds for said project. A woman in the audience, who wished to remain anonymous, inquired about the approximate date when construction of the -park might begin. City Manager Callinan indicated that until the city received an indication from.the State regarding the supplemental grant, no construction date could be set. Steve Dunn, resident, was recognized and expressed concern about the weeds on the proposed park site. City Manager Callinan indicated that he would follow -up on the matter.. Redwood Pioneers: City Manager Callinan reviewed his Council meeting memo Baseball dated August 22, 1980 concerning the Redwood Pioneers use of the junior high baseball field and a survey,taken,of, the residents in the vicinity (a copy of which is attached to the original set of these minutes). Resolution No. 80 -151 RESOLUTION .CALLING FOR SEALED PROPOSALS FOR.IRRIGATION AND TURFING OF ROHNERT PARK STADIUM (Project No. 1980 -12) City Manager Callinan explained the resolution. Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No:•80 -151 was waived and said resolution was adopted. Recess Mayor Stewart declared a recess at this point in the meeting the time being approximately 8:45 p.m. Reconvene Mayor Stewartreconvened the meeting at approximately 8:50 p.m. Page 6 August 25, 1980 Tax Exempt Housing City Manager Callinan referred the Council members to his Bonds Council meeting memo dated August 22, 1980 concerning tax exempt housing bonds and requested that the Council authorize staff to select a bond underwriter in order to get an,appoint- ment with a bond rating _agency. Mr. Calli nan indicated that this action would not commit the city to any obligation since at this stage any services performed by the underwriter, bon d couasel,.or a mortgage lender will', be on a contingency basis. Discussion followed. Councilman Carbone Councilman Carbone, .,left the Council Chatibe -vti at approximately Leaves and Returns' 8:50 p.m. and'ret,UIrned at approximately 9:06 p.m. Finance Director Netter explained the proposed program. Resolution No. 80 -152 RESOLUTION OF INTENTION TO ISSUE MORTGAGE REVENUE BONDS AND TO-RETAIN BOND COUNSEL Special Water Connection Fees Resolution No. Communications' City.Manager Callinan explained the resolution. Upon motion.of Councilman Roberts, seconded by Councilman. Cavalli, and unanimously approved, reading of Resolution No. .80- 152.was waived and said resolution was adopted.. City Manager Callinan referred the Council members to his Council meeting memo dated August 22, 1980 concerning escalating. :costs for..water system „improvements and the need for the city to adjust its water connection fees or establish a special water, connection fee to cover the cost of improve- ments to the city's water system. City Manager Callinan referred to a breal0own sheet,pr.epared by City Engineer Brust.(a.copy of which,,is attached to the original set of these minutes). 80 -153 RESOLUTION OF THE CITY OF ROHNERT PARK ESTABLISHING SPECIAL WATER 'CONNECTION FEE City Manager Callinan explained the resolution. Upon motion of Councilman Carbone; seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 80 -153 was waived and said resolution.was adopted., Communications per the attached outline were brought to the attention of.the City Council. No' action was taken-on any communications except.as,specifically noted in these minutes. City Manager's Report City Manager Callinan referred the Council to his memo dated August 22, 1980 for explanation of all matters on the City Manager's Report section of the Meeting agenda. City Manager's City Manager Callinan indicated that he would be leaving for Vacation vacation within the next few days and requested that the Council approve his appointment of Robert M. Albright, Asst. to the City Manager, as City Manager Pro - Tempore during his absence. Upon motion of Councilman Roberts.;, seconded by Councilman Carbone, and unanimously approved, Asst. to the City'Manager Robert M. Albright was:approve.d.as City Manager Pro- Tempore during City Manager Callinan °s absence. The Council directed City Manager Callinan to respond to the school district's letter regarding the ballfield saying that all the relocatable improvements would be removed from the junior high ballfield unless the school district expressed interest in having any of the improvements left at the site. Mayors' and Council- Councilman Carbone reported on the Mayors' and Councilmen's men's Assn. Mtg. Association of Sonoma County meeting, including discussion of the 911 emergency telephone system, endorsing the establishment of a technical advisory committee for county dumps operations and scheduling for discussion at its September meeting Rohnert Park's resolution concerning Marin County's growth. Matters from Councilman Roberts informed of a concert at the Burton Avenue Councilmen Recreation Center on Wednesday, August 27, 1980 at 7:00 p.me presented by the Light Signers called "America You're too Young to Die". Jack Behl Jack Behl, 56 Allan Avenue, was recognized and expressed concern about alcoholism and his alleged mbrepresentation of the Cultural Arts Commission. Discussion followed. Clara Brown, Cultural Arts Commission Chairman, was recognized and informed that a report had been presented to the City Manager's office accounting for funds collected by the Cultural Arts group for the amphitheatre. City Manager Callinan indicated that he would follow -up on the matter. Jr. High Ballfield City Manager Callinan informed that a letter had been received from the Cotati - Rohnert Park Unified School District inquiring when the junior high baseball field would be restored to its original condition. Discussion followed. Did the games cause any appreciable increase in traffic on your street? .No! But all perimet.er.streets to'Junior High were, as you know, very heavily congested before and after the games. (Barbi Lane) .Did not appreciate. (Almond Street) ..Sometimes I have trouble entering my driveway because of parked cars. .Cars racing up and down streets. .Everyones driveway was blocked and beer cans strewn all over. (Bernice Avenue) .Traffic was heavy on Alta and people would make U- -turns in.front of Souse, so they could find a place to park. (Alta Avenue) .There has been an increase of the t9Almond- Anson -Alta Loopers" on'the nights of home games. As°you are well aware, we have had some pretty.good "TAS" on the Alta side of the "loop ". ',My 'concerns are; Youngsters on the street,,longer days, school out etc. Intersection, Almond /Southwest, persons in vehicles tend to stop and chat with friends on.foot, backs up traffic.. No problems other than those above, however, intersections of Alta - Almond - Southwest are problems that should be looked into. (Alta Avenue) .Some parking problems along Alta and Almond. (Alta Avenue) .A little more traffic but not noticable usually. (Burton Avenue) Just before and after games. (Burton Avenue) .I live on Santa Barbara Drive, they park over here then the people who live here have to park other places.. .Faster traffic and more racing around. None were blocking driveways, and none I'c,an recall were 'noisy. (Alta Avenue) .However, parking by people attending the games was noticable on Baron Drive. Did you experience any problems with parking during the games? .Not as a property owner, since our street is not a perimeter street to,;the school grounds, as a spectator, yes! (Barbi Lane) .I don't live that close. (Adrian Drive) .Did not appreciate. (Almond Street) .No room left in front of myhouse,' %.Beer cans. and bottles, in gutters aren't very. neat or sanitary. We need a more efficient sanitary department. (Burton Avenue) .However there was no room for guests to park in'front of my house:: -(Alta Ave.) .We had to plan our own parking for our owp cars and people blocked driveway and parked in crosswalk. (Alta Avenue) .We utilize the driveway in most cases. (Bobbie Way) .No problem parking we lave across the street on Burton:Avenue. .But only the first few game. (Alta Avenue) .Fairly minor. (Alta Avenue) .Only a couple of times. (Burton Avenue) .Our street (Alta) had cars parked on both sides of street during games. .1 had trouble getting into my own driveway. (Burton Avenue) .On -most game nights our street was full which left no „parking for us oi'our friends. On one occasion our driveway was blocked and we couldn't get in. (Almond Street) ,.Blocking my driveway. (Almond Street) .We walked to the games which.was very nice. (Alta.Avenue) .I couldn't park in front of my own house. .Visitors to our home had problems. (Burton Avenue) .We walked to the games we attended. I am concerned about the parking and pedestrian traffic on Southwest Blvd.near the field. Jaywalking. The elimin- ation of parking on north side of Southwest Blvd. should help. (Bobbie. Way) 3. Was there any problems with litters during the games? .Not on our street .' 'For our town someone goofed.and.it wasn5t me. (Burton Avenue) .Yes, in fact at times it would not be picked :up in back.of my house for a week or more. (Alta Avenue.) .Dropped paper wrappers and cans on ,lawn .and sidewalks..(Bernice Avenue.) ,We had to pick up paper cups and other paper trash from street and yard. Need trash cans.out on sidewalks for people to drop trash in. (Alta Avenue) .I didn't really notice anymore litter,than any other place with alot of people. (Burton Avenue) ,Not on this block. (Burton Avenue) ,Very little. (Alta Avenue) ,No more than usual for the school kids, (Burton Avenue) " .There was papers and cans or bottles....Mostly paper and.broken bottles.(Burton) .They don't ever clean up there stuff.,: .It always looks bad..(Santa Barbara Dr.) .More trash left in our frcnt yard.; (Almond'Street) .My front yard was a catchall for'empiy beer bottles, paper cups and paper. (Almond Street) .Mostly during the first part of the season. .Beer cans on our lawn. But only in the grandstand dstand area. I don't remember seeing any on the streets more than normal. (Alta Avenue) ,Jr`. *High fields and surrounding ' are a had noticable increase in litter following the games. (Barbi Lane) ,Beer bottles started showing up in and around our area. (Santa Barbara) .On the Junior High School grounds, not on our property: (Barbi Lane) .Not anymore than we get from the Jr. High. If there is not a professional organization behind the team next year, major parent or not, I will not be able to support the Pioneers next season.
