1980/11/10 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES November 10, 1980 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commepce Boulevard, Rohnert Park, with Mayor Stewart The re gu;_ar session was preceded by an executive sess:°on which at 'Y;CO p.m. and at which all Council- men, except Councilman Carbone and Mayor Stewart, and City Manager Callinan were present and which was held to discuss personnel and litigation matters. Call to Order Councilman Hopkins called the meeting of the regular session to order at approximately 7:06 p.m. Present: (3),Covneilmen Cavalli, Hopkins and Roberts Absunt: ( 0) i qi)e Late: (2) Councilman Carbone and Mayor Stewart (whose time.r)f arrival is specifically noted in these minutes) Staff present for all or part of the meeting: City Manager Callinan, City Atturney Flitner, Director of Public Works/ City Engineer B1 ust Mayor Stewart Arrives Mayor Stewart arrived at this point in the meeting, the time being approximately 7 :07 p.m., assumed chairing of the meeting and led the pledge of allegiance. Councilman Carbone Councilman Carbone arrived at this point in the meeting, the Arrives time being approximately 7:08 p.m. Approval.of Minutes Upon motion.of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved with Mayor Stewart abstain- ing from voting, the minutes of October 27, 1980 were approved as submitted. Approval of Bills Upon motion of- Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved, the bills presented per the attached list in the amount of $2,480,401.00 were approved as submitted. Said total includes $5,092.50 for the Rohnert Park Civic Commission. Resolution:No. 80 -201 A RESOLUTION ACCEPTING COMPLETION AND DIRECTING ENGINTZR TO FILE NOTICE OF COMPLETION (Ladybug Pool, Project Nu. 1979 -1) City Manager Callinan explained the resolution. Project No. 1980 -17 Lighting Evergreen Soccer Field and Base- ball Field at Eagle Park Upon motion of Councilman Cavalli, seconded by Counc ^_roan Hopkins, and unanimously approved, reading of Reso1.i. t.'.on No. 80 -201 was waived and said resolution was adopted. City Manager Callinan, referring to his Council meeting memo dated November 6, 1980, reviewed the bid results for this project and advised that a letter had been received from the low bidder, St. Francis Electric, requesting that they be allowed to withdraw their bid, without penalty, because of a mistake of $30,000 in its bid for fixtures. Page 2 November 10, 1980 Director of Public Works /City Engineer Brust informed that in checking with the second lowest bidder, Edward W. Scott Electric Co., Inc. concerning the fixtures bid that firm's representative felt that their estimate was comparable to the $56,000 fixtures allowance of St. Francis Electric and that it would be impossible for St. Francis Electric to supply the fixtures for $259698 quoted in its bid. Discussion followed between staff and Council members. City Attorney Flitner commented on provisions of the law concerning relieving a bidder of his bid for an error and the authority not to relinquish..hold on the bidder's bond. Mr. Bob Spinardi, Vice - President of St. Francis Electric, was recognized and explained that St. Francis had indeed made an honest or unintentional mistake, how the mistake was made and that if his company could in any way perform the work it would.have considered taking the job. He also commented that 'if the bidder's bond was withheld, then his firm would file suit as allowed in the law to recover the amount of the bond. City Manager Callinan informed that the Council could meet in executive session to discuss the matter further since there had been a threat of legal action. Scott White, representing Federal Wholesale, was recognized and explained that he would accept responsibility for the error made in the fixtures bid, how the $30,000 mistake was found, and pointed out that it had been corrected within a short. period. Mayor Stewart indicated that this matter would be deferred until later in the meeting when the Council would meet in executive session to` discuss 'same. Resolution No. 80 -203 A RESOLUTION OF AWARD OF CONTRACT (Benecia Park Ballfield Lighting, Project No. 1980 -19) City Manager Callinan reviewed the bid results and explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No. 80 -203 was waived and said resolution was adopted. Resolution No. 80 -204 A RESOLUTION OF AWARD OF CONTRACT (Turfing and Irrigation, Evergreen School Site, Project No. 1980 -27) City Manager Callinan, referring to his November 6, 1980 Council meeting memo, reviewed the bids for this project and informed that the school district alleges it could only afford to landscape the small area in front of the Evergreen School. He reminded the Council that the City was committed to completing the soccer field and lighting and recommended that the matter be deferred so that the school district could be approached again to provide funds to complete the school site and award the total contract. Discussion followed during which the Council concurred that the school district should participate. 'Page. 3 November 10.,. 1980 Upon motion of Councilman Carbone, seconded by Councilman Roberts, and unanimously approved, further consideration regarding.award of contract for Project No. 1980 -27 was deferred until the November 24, 1980 City Council meeting. Resolution No. 80 -205 RESOLUTION OF THE CITY OF ROHNERT PARK ADOPTING THE APPLICATION FOR GRANT FUNDS UNDER THE SOLID WASTE MANAGEMENT ACT OF 1980 City Manager Callinan explained the resolution. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution No. 80 -205 was waived and said resolution was adopted. Sonoma Racquet Club Rickey Coover, representing the Sonoma Racquet Club Home - Homeowner's Assn. owner's Association, was recognized and explained various., problems in the Sonoma Racquet Club development which had not,been resolved after having been brought to the developer's attention:. Mrs. Coover presented the Council with pictures and other documents and requested that the City not release the performance bond for the development until the homeowner's complaints had been investigated. ,Discussion followed between Mrs. Coover, City Council members. and City Manager Callinan. Councilman Hopkins made a motion to direct staff to follow -up in an appropriate manner. Discussion followed. City Manager Callinan referred the Council to a recap sheet of city staff's November 7th walk- through, a copy of which is attached to the original set of these minutes. The Council indicated that the matter would be turned over to the City Manager for further follow -up and that represen- tatives of the Homeowner's,Association should get together with the City Manager in order to conduct another walk - through of the development. Project No. 1980 -13 City Manager Callinan introduced Gary Matsuda, Avila Enter Corporation Yard prises, who reviewed the site plan and architectural drawings Addition for the proposed addition to the Corporation Yard. Discussion_ followed. .Upon.motion of Councilman Cavalli, seconded by Councilman Carbone, and unanimously approved, the site plans and architectural renderings for the proposed addition to the city?s Corporation Yard were approved, Councilman Cavalli Councilman Cavalli left `the Council Chambers at this point Leaves in the meeting, the time being approximately 8 :04 p.m. Bus Transit -Fares City Manager Callinan reviewed his November 6, 1980 Council meeting memo concerning, a letter received from the Sonoma County Department of Public Works regarding a proposal to change the Golden Gate Transit local service fare structure for zones within the County. External Auditor's Reports Golf Course Restrooms Rohnert Park Expressway Extension City Manager Callinan, referring to his November 6, 1980 Council meeting memo, informed that copies of the external auditor's reports for the fiscal year .ending June 30, 1980 for the City of Rohnert Park and Rohnert Park Civic Commis - sion as prepared by the firm of Linkenheimer, Hebrew and Co. had been disseminated to each Council member. City Manager Callinan reviewed his November 6, 1980 Council meeting memo concerning construction of.restrooms on the Moun- tain Shadows Golf Course and indicated that the restroom facilities would be landscaped. City Manager Callinan, referring to his Council meeting memo dated November 6, 1980, reminded that the Board of Supervisors would be holding a hearing on November 13, 1980 at 3:15 p.m. to consider whether or not the westerly extension of the Expressway should be deleted from the County,-- General Plan. Page 4 November 10, 1980 Councilman Cavalli Returns /City Attorney Councilman Cavalli returned and City Attorney Flitner left Flitner, Leaves the Council Chambers at this point during the meeting, the time being approximately 8:05 p.m. Discussion followed between City Council members, but no action was specifically taken concerning the proposed County zonal bus fares. Bus Transit - Routes City Manager Callinan reviewed his November 6, 1980 Council 10 & 12 Transfers meeting memo concerning a letter received from the Sonoma County Department of Public Works to provide transfers between Routes 10 and 12 with no additional fare to the passengers. Discussion followed. Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, the City Council endorsed the concept of no- charge transfers between Routes 10 and 12. Incoming Communications per the attached outline were brought to the Communications, attention of the City Council. No action was taken on any communications except as specifically noted in these minutes. Councilman Hopkins Councilman Hopkins left the Council Chambers at approximately Leaves 8:16 P.M. Cadle's Ambulance Councilman Carbone initiated a discussion regarding Clarice Rates McCreary's letter about the high rates of Cadle's Mercy Ambulance Service. Discussion followed during which City Manager Callinan indicated he would look into the matter. Housing Bonds Program City Manager Callinan reviewed his Council meeting memo dated November 6, 1980 regarding the City's application for a $133 million dollar housing bonds program and its considera- tion by the State Housing Bond Credit Committee on November 5, 1980 in Sacramento and subsequent continuance of the matter to November 20, 1980. Councilman Cavalli gave,an overview of the November 5, 1980 State Housing Bond Credit Committee meeting. City Manager's Report City Manager Callinan referred the Council to his memo dated November 6,:1980 for explanation of all matters on the City Manager's Report section of the meeting agenda. Poncia and Carinalli, and their attorney William Kuziara,.who were present in the audience, concern- ing whether or not.treated effluent could be used for irriga- tion purposes within 1,000 feet of the future extension of the Expressway and whether or not the road would be constructed 'north of Hinebaugh /Wilfred Creek channel or south of same. Mosquito Abatement City Manager Callinan informed that a letter had been District Rep. received from the Marin /Sonoma Mosquito Abatement District regarding appointment of a representative to that body's Board of Directors. Upon motion of Councilman Carbone, seconded by Councilman Cavalli, and unanimously approved, Councilman Roberts was appointed to the Turin /Sonoma Mosquito Abatement .District Board of Directors for the two year term commencing January 1, 1981. City Attorney City Attorney Flitner returned at this point in the meeting, Flitner Returns the time being approximately 8:35 p.m. Conference on Aging City Manager Callinan informed that, a letter had been received from the Sonoma County Office of Commissions regarding the 1981 White House Conference on Aging to be held in Santa Rosa on November 20, 1980. Mayor Stewart and Councilman Cavalli were designated as representatives to the 1981 White House Conference on Aging. Garbage Rates The Council committee to review garbage rates, comprised of Councilmen Roberts and Cavalli, advised that there would be a meeting with respresentatives of the Rohnert Park Disposal Co. on Thursday, November 13, 1980 at 7:30 a.m. in order to discuss that firm's request for a rate increase. KAIROS A report regarding KAIROS request for financial assistance was deferred because Councilman Hopkins was absent. Discus- sion followed. December Council City Manager Callinan asked if the Council was inclined to Meeting Changes conduct its regularly scheduled meetings during the month of December. The Council responded in the affirmative. Mayor Stewart informed that she would be unable to attend the December 8, 1980 meeting because she would be out of town. Bingo Ordinance Councilman Roberts initiated a discussion regarding whether or not the city would consider allowing local organizations to conduct bingo games in Rohnert Park. Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, City Attorney Flitner was directed to prepare an ordinance that would allow bingo for local non - profit organizations. Inoperative Mr. Jack Duport, 7652 Bonita Avenue, was recognized and Vehicle Notice informed that the Public Safety Department had issued a Courtesy Notice to him regarding a car that was parked in his driveway. Page 6 November 10, 1980 Mr. Duport explained that the car was licensed and that he planned on making repairs to same. He objected to being cited for an "inoperative vehicle" while other vehicles, trailers, etc. in the area had been parked for more than 72 hours in the street. He stated that even though he objected to the regulation that he did put the car in his garage.. City Manager Callinan explained the purpose of the inoperative vehicles section of the municipal code. City Attorney City Attorney Flitner left the Council Chambers at this point Flitner Leaves in the meeting, the time being approximately 8:45 p.m. Adjournment to Executive Session The City Council adjourned to executive session at this point in the meeting, the time being approximately 8 :50 p.m., with all Council members, except Councilman Hopkins, City Manager Callinan and City Attorney Flitner present. The executive session was held to discuss the matter with St. Francis Electric regarding Project No. 1980 =17. The executive session adjourned at, 9:00 p.m. and those'present reconvened in regular session., City Manager Callinan explained that the bid from St. Francis Electric for. Project No. 1980 -17 had been discussed with Council members in executive session . and a determination had been made that there had been a legitimate and honest mistake by St. Francis, therefore, the. contract would be awarded to the next`l.owest bidder,J,.e. Edward W. Scott Electric Co. Resolution No. 80 -202 A'RESOLUTION OF AWARD OF CONTRACT (Evergreen Soccer Field and Eagle Park Ballfield Lighting, Project No. 1980 -17) Adjournment City Manager Callinan explained the resolution. Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No. 80 -202 was waived and said resolution was adopted. There being no further business, the meeting was adjourned at approximately 9 20 p.m., ° eputy.City Clerk Faus SONOMA RACQUET CLUB DEVELOPMF.NI' Items needing follow -up per City Manager's discussion with Rickey Response Coover on Nov. 6, 1980 1. The electrical hook -up has not been made to the clubhouse. 2. The piping to the jacuzzi is not correct. They allege there is 1 1/2" pipe that should be a larger size and that the smaller diameter pipe leading to the larger 2" diameter pipe has caused some operational problems and is the reason for the burn outcf the second motor. 3. The sidewalk at the west end of the tennis courts is in need of repair or replacement. All parties involved were confused over this matter. My follow -up and check with P.G. & E. reveals that McKellar. and Associates has paid P. G. & E. for, and P. G. & E. has, installed a 400 amp. panel in the clubhouse. McKellar simply has to have their electrical contractor make the connection per Ralph Fitch. The parties thought another metier was required, which according to Mr. Fitch is not so. For some reason the manager of the Racquet Club was requested by the Board of Directors of the Homeowner's Association not to contact P. G. & E. The problem may revert back to the swimming pool. contractor. McKellar agreed to have the matter looked into and I. am informed that they have contracted Swift Plumbing to get the matter corrected. They contacted Swift rather than the swimming pool_ contractor in order to get prompt and effective results. Sidewalk has been repaired. 4. Cyclone fence has not-been installed Fence: not lantalled at city staff's request. The path along the creek should not be fenced along Hi.nebaugh Creek as was indicated in so that it could not be used by other would be required per the subdivision citizens. Take a close look at the landscaping in Phase III, it consists mostly of weeds, which was just mowed this week for the first time in about six weeks. 6. The fleshings are not painted. 7. The water boxes are not to grade in many areas. 8. In the vicinity of No. 636 and 665 near the carport overhangs, electrical wires are not buried and are simply covered by bark. 9. The stove in the clubhouse has enamel coming off it. This is how it was installed. Apparently McKellar thought the Homeowners Association was maintaining this area. The homeowners did have a landscape contractor maintaining it but then he stopped dosing so because of non - payment and no communication was made between the association and McKellar re. the matter. McKellar has engaged Bob Boyd landscaping to restore the area so that it can be turned over to the Homeowners Association; much work has already been done by Bob Boyd. All fleshings will be painted. The water boxes will be brought to grade. By using a rake we dug for wiring, but could not find any. The chip in the front part of the stove will be repaired. 10. Dale Carlson allegedly informed the Homeowners Association that the area along the Expressway was deeded to the city and it was presumed that the city was going to maintain the landscaping along the Expressway. 13. In Sec. 11 area a few trees were planted that are dying and the parking area has very limited landscaping. believe the city can demand the lighting be installed by McKellar. The Homeowners Association can always have it installed If it wants to pay for same. McKellar says that plans were provided to the Homeowners Association. However., another complete set is being provided to the Associa- tion. This is something for the Council to decide and in keeping with the decision made on Golf Course Drive adjacent to the proposed Crocker Homes development city assumption of the maintenance would appear to be in order.
