1980/11/24 City Council MinutesROHNERT PARK.CITY COUNCIL MINUTES November 24, 1980 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices,;.6750. Commerce Boulevard, Rohnert Park, with Councilman Hopkins presiding. Call to Order _ Councilman Hopkins called the meeting of the regular session to order at approximately 7:02 p.m. Roll Call Present: (3) Councilmen Cavalli, Hopkins and Roberts Absent: (1) Councilman Carbone Late: (1) Mayor Stewart (whose time of arrival is specifically noted in these minutes) Staff present for all or part of the meeting: City Manager Callinan, City Attorney Flitner, and Planning Director Skanchy. Approval of Minutes Upon motion of Councilman Roberts, seconded by Councilman Cavalli, and unanimously approved, the minutes of November 10, 1980 were-approved as submitted. Approval of Bills Upon motion of Councilman Roberts, seconded by Councilman Cavalli: and unanimously approved, the bills presented per the attached list in the amount of $811,745.57 were approved as submitted. Adding Non - Agendaed City Manager Callinan requested that time be allotted under Items to Agenda the "City Manager °s Report1P section for discussion and possible action concerning Ukiah °s application for the use of power from Warm Springs Dam. City Manager Callinan requested that Resolution No. 80 -206 regarding Award of Contract for the backstop at the Rohnert - Park Stadium be removed from the Consent Calendar due to a memo being received from the contractor requesting that their bid be withdrawn due to an error in calculations. Discussion followed. Councilman Cavalli initiated discussion concerning the possi- bility of removing from the Consent Calendar resolutions for adoption wherein funds are being spent. Discussion followed. It was the consensus of the Council that Resolutions Nos. 80- 206 through 80 -209 be removed from the Consent Calendar and voted upon separately. as C O N S E N T C A L E N D A R City Manager Callinan referred the Council to his Council meeting memo dated November 21, 1980 for explanation of all the matters on the Consent Calendar. Resolution No. 80 -210 RESOLUTION APPROVING AGREEMENT WITH COUNTY OF SONOMA TO PURCHASE TAX - DEEDED PROPERTY (A.P. No. 143 - 051 -01 6 143- 051 -02, Hinebaugh Creek Drainage Channel) Page 2 November 249 1980 Resolution No, 80 -211 RESOLUTION OF "THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING SONOMA COUNTY WATER AGENCY TO MAINTAIN PORTIONS OF COLEMAN CREEK (In Coleman Malley Subdivision No. 3) Resolution No,. 80=212 RESOLUTION ENDORSING TRANSFER AGREEMENT BETWEEN TRANSIT OPERATIONS WITHIN'SO.NOMA COUNTY Upon motion of Councilman Roberts, seconded by Councilman Cavalli, and unanimously approved;`roading of Resolutions Nos. 80 -210 through 80- 212 -was waived and said resolutions were adopted. Planning Director Planning Director Skanchy arrived at'this point in the meeting, Skanchy Arrives the time being approximately 7:15 p.m. Resolution No, 80 -206 _AWARD OF CONTRACT .(Backstop,, Rohnert Park Stadium, Project Noe 1980 -12) City Manager Callinan.explained the resolution and reviewed a memoletter from Alviso Fence, Inc. requesting permission to withdraw their bid. ,Upon motion of Councilman Cavalli, seconded by Councilman Roberts,, and unanimously approved, Council deferred considera- tion of Resolution No,*80 -206 until its December 8, 1980 meeting,..,, Resolution No. 80 -207 AWARD OF CONTRACT.(Lighting, Rohnert Park Stadium, Project No. 1980-19) , City.Manager.Callinan explained the resolution and reviewed bids. received'e . Resolution No. 80 -208 AWARD OF CONTRACT (Seating, Rohnert Park Stadium, Project No. .1980 -12) City Manager Callinan explained the resolution and reviewed bids received. Mayor Stewart Arrives Mayor Stewart arrived at this point in the meeting, the time being approximately 7:18 p.m. Upon motion of Councilman Cavalli, seconded by Mayor Stewart, and approved by the following roll call vote, reading of Resolution No. 80 -208 was waived and said resolution was adopted. AYES.: (3) Councilmen Cavalli, Hopkins and Stewart NOES: (1) Councilman Roberts ABSENT: (1) Councilman Carbone Resolution No. 80 =209 Page 3 November 24, 1980 Councilman Roberts indicated that he had voted no because he felt that seating at the new stadium was sufficient with the seating to be transferred from the junior high and that the additional seating for '600 was not, necessary. AWARD OF CONTRACT (Water Storage Tank No. 3, Rohnert Foothills Subdivision Area, Project No. 1980 -26) City Manager Callinan explained the resolution and reviewed bids received.' Upon motion of Councilman Cavalli, seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 80 -209 was waived and said resolution was adopted. Chairing Meeting Mayor Stewart assumed the chairing of the meeting from Councilman Hopkins at this point in the meeting. Resolution No. 80 -204 AWARD OF CONTRACT (Evergreen School Irrigation and Turfing, Project No. 1980 -27) City Manager Callinan explained the resolution and requested that the `matter be considered at the next Council meeting because a response has not been received from the school district. Upon motion of Councilman Hopkins, seconded by Councilman Roberts,, and unanimously approved, Council deferred considera- tion of Resolution No. 80 -204 until its December 8, 1980 meeting. Resolution No. 80 -213 A RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK SETTING GARBAGE AND 'RUBBISH OR REFUSE COLLECTION RATES City Manager Callinan explained the resolution referring Council to his Council.meeting' memo dated November 21, 1980. Councilman Cavalli expressed that the proposed rates were not out of line and reflect the results of a discussion between representatives of Rohnert Park Disposal Co. and the City Council's committee comprised of himself and Councilman Roberts Upon motion of Councilman Cavalli, seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 80 -213 was waived and said resolution was adopted. 1988 Golf Course Rates/ City Manager Callinan, referring to his Council meeting memo Calif. Golf- Tennis dated November 21, 1980, concerning California Golf's request I hat the city issue residents cards who want to enjoy a dis- count at the golf courses. He indicated that copies of California Golf's proposed rate increases for 1981 had been distributed to each Councilmen and requested that the matter be deferred until the Council's golf course committee com- prised of Mayor Stewart and Councilman Cavalli had an opportunil to review the proposal and to discuss it directly with CaliforniE Golf prior to any Council decision. Councilman Hopkins indicated that he would like to know exactly what the increased revenue would be and how California Gaff - Tennis can justify excessive rates. Discussion followed. Upon motion of Councilman Cavalli, seconded by Councilman Roberts,.and unanimously approved, Council deferred considera- tion of California Golf-Tennis' proposal for an increase in rates for 1981 until its December 8, 1980 meeting. Resolution No. 80 -214 12ESOLUTION CREATING THE ROHNERT PARK SENIOR CITIZENS ADVISORY COMMISSION Councilman Roberts Leaves and Returns City Manager read.and explained the resolution. Councilman Roberts left the Council Chambers at approximately 7:40 p.m. and returned at approximately 7 :41 p.m. City Manager Callinan noted that the draft resolution would be amended to include the definition of a senior citizen and that the senior citizen commission member must be a Rohnert ..Park resident. Discussion followed. Peter McCormick, A.A.R,P. indicated that he had informed various senior citizen related organizations of the formulation of this commission. Upon motion of Councilman.Cavalli,.seconded by Councilman. Hopkins,.and unanimously approved, reading of Resolution No. 80 -214 was waived and said resolution was adopted. Councilman Roberts made a motion to appoint Mr. Peter McCormick as a member and temporary Chairman of the Senior Citizens Advisory Commission until all 5 members had been appointed and a Chairman chosen by the Commission, seconded by Councilman Cavalli, and unanimously approved. Scheduled Public Clara Brown, Cultural Arts Commission was recognized and Appearances presented a civic banner from Vita Jones to the Council. Mayor Stewart accepted the banner on behalf of the Council and thanked Vita Jones indicating that the banner would be displayed with a plaque explaining its.or.igin and creation Maurice Seaman, 205 Walnut Circle was recognized and presented the Council with copies of the City of Benecia Ordinance No. 78 -17 N.S. regarding establishing a mobile home rent review commission. Mr.. Seaman briefly commented on the rent increases for mobile home parks within_ Rohnert Park and the cost of i ving indexes used.to establish these rent increases. Discussion followed. Page 5 November 24, 1980 Gerald Cuttahay, Golden Gate Mobile Home Association was re- cognized and recommended that the Council establish a rent review board such as the City of Benecia's. Bill Adams, President of Rancho Feliz Association was recognized and asked by the Council to make any comments relative to the matter at the.end of the meeting under "Unscheduled Public Appearances ". Country Club City Manager Callinan referred Council to his Council meeting Village memo dated November 21, 1980 concerning the elderly housing project being constructed south of the Rohnert Park Expressway, west of Country Club Drive, and north of the Valley Village Mobile Home Park, noting an oversight :h issuing a building permit based on plans which show the roofing to be constructed with asphalt shingles rather than wood shake or tile shingles as requested by the Planning Commission and City Council. James,Felps, Shappel Industries was recognized and displayed the roofing material proposed for the project, noted that HUD had required the asphalt roofing material instead of wood or tile. Planning Director Skanchy indicated that he had spoke to representatives of HUD and that it did not matter what type of roofing material was used. Discussion followed. Council directed staff to look into the matter and make a decision in the near future so as not to delay the project further. The Council went on record as recommending that the roofing material remain as requested, wood shingles or tile shingles. 1981 Building Permit City Manager Callinan referred Council to his Council meeting Allocations memo regarding the 1981 Growth Management Program. Informed of a meeting held on November 21, 1980, between builders/ developers and staff, noted that copies of the 1981 Building Permit Allocation Requests and Staff's Recommendation had been provided to each Councilmen for review. Resolution No. 80 -215 RESOLUTION APPROVING THE GROWTH ALLOCATION FOR 1981 City Manager Callinan explained the resolution. City-Manager Callinan referring to his Council meeting memo initiated discussion concerning a condition that each builder or developer agree to not allow more than 200 of their units to be sold to investors or persons who would rent them, that 800 of the units for which building permits would be issued would have to be sold to owner- occupant type individuals, persons who would agree to occupy the units for at least one year, unless, unusual circumstances force an earlier vacancy and that units not,be sold to the builder's sales personnel for rental investment purposes. Mr. Callinan indicated that declarations would have to be obtained by the developers from the buyers on forms provided by the city. Page s November 24, 1980 Discussion followed. Councilman Hopkins made a motion, seconded by Councilman Cavatli, to adopt Resolution.No. 80 -215. Mayor Stewart moved to amend Resolution No. 80 -215 to allow builders or developers to not allow more than 100 of their units to be sold to investors.or, persons who would rent them, that 900 of,the units be sold to owner - occupant type individuals who would agree to occupy the units for at least one year. Motion died for lack of a second. Ordinance No. 376 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING THE ROHNERT PARK MUNICIPAL CODE, TITLE 15, BUILDING AND CONSTRUCTION, TO ADOPT THE, UNIFORM BUILDING CODE, 1979 EDITION; THE UNIFORM HOUSING CODE, 1979 EDITION; THE UNIFORM PLUMBING CODE, 1979 EDITION; THE UNIFORM MECHANICAL CODE, 1979 EDITION; THE UNIFORM FIRE CODE, 1979 EDITION% THE UNIFORM SWIMMING POOL CODE, 1979 EDITION; AND THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, 1979 EDITION; AS AMENDED, AND ADOPTING OTHER REQUIREMENTS AND ADOPTING,FINDZNGS IN SUPPORT OF SUCH AMENDMENTS Ordinance No. 377 City.Manager Callinan explained Ordinance No. 376. Upon motion of Councilman Cavalli, seconded by Councilman Hopkins, and unanimously approved, Ordinance No. 376 was introduced and a public hearing on same was set for the December 22, 1980 meeting., AN ORDINANCE OF THE CITY OF ROHNERT PARK RESTRICTING THE PURCHASE 'OF INDIVIDUAL RESIDENTIAL OWNERSHIP UNITS WITHIN THE CITY OF ROHNERT PARK City Manager Callinan referring to his Council meeting memo dated November 219 1980, read and explained Ordinance No. 377. Discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Cavalli, and approved by the following roll call vote, the Council introduced Ordinance No.,377 and set a public hearing on same at the December 22, 1980 meeting. Page 7 AYES: (3) NOES: (1) ABSENT., (1) November 24, 1980 Councilmen Cavalli, Hopkins and Stewart Councilman Roberts: Councilman Carbone External Auditor's City Manager Callinan referred Council to his Council meeting Reports memo dated November 21, 1980, recommended formal acceptance of the auditor's reports for the fiscal year ending June 30, 1980. Councilman Cavalli made a motion, seconded by Councilman Hopkins, and unanimously approved, to formally accept the external auditor's financial reports for City /Federal Revenue Sharing and Rohnert Park Civic Commission for the fiscal year ending June 30, 1980. Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken on any communications except as specifically noted in these minutes. City Manager's City Manager Callinan referred the Council to his Council Report meeting memo dated November 21, 1980 for explanation of all matters on the City Manager's Report section of the meeting's agenda. R.P. Expwy. Westerly City Manager Callinan referred Council to his Council meeting Extension Update memo dated November 21, 1980 concerning the Rohnert Park Expressway westerly extension, noting that the Sonoma County Board of Supervisors consideration is scheduled for December 9, 1980 at 8 :30 p.m.' Housing Mortgage City Manager Callinan referring to his Council meeting memo Bonds dated November 211, 1980, informed to staff's meeting with ;Bond Counsel and representatives of Sutro to determine whether or not the.Qity could get to the bond market in time to guarantee bond sale and delivery by the required deadline of December 31, 1980. Mr. Callinan indicated that both Bond Counsel and Sutro recommended stopping the program at this time and possibly entering into a new program in January. Discussion followed. Sonoma Racquet Club City Manager Callinan informed that staff and himself had walked through the Sonoma Racquet Club project upon the request of a concerned citizens complaint. Mr. Callinan reported that problems relating to the sauna and pool were being taken care of presently. Warm Springs Dam City Manager Callinan reported on the City of Ukiah's applica- tion for the use of power from Warm Springs Dam and recommended that Council direct a letter of protest concerning same. Councilman Roberts made a motion, seconded by Councilman Hopkins, and unanimously approved, to protest the City of Ukiah's application for a power plant at Warm Springs Dam, City Attorney's City Attorney Flitner presented the Council with an ordinance Report adding Chapter 9.66 to the Rohnert Park Municipal Code that would allow imago games in the City of Rohnert Park for the benefit of charitable organizations. The Council deferred the matter to its December 8, 1980 Council meeting in order to further review the proposed ordinance. Page 8l November 249 1980 Unscheduled Public Robert Jeffreys, President of Golden West Mobile Home League Appearances was recognized and expressed his support for the rent review commission, Chuck Carter, resident was recognized and expressed feelings on unfair rent increases and supported the rent review commission. Bill Adams, President of Rancho Feliz Association was recog- nized`and ,expressed support - for _the rent review commission and indicated that he would like to see the County of Sonoma get its own CPI, Jim Davis, 916 Joanne Court was recognized and supported the rent review commission. Vi Clemen, Valley Village, Associate Director of Golden West Mobile Home'Le4ue, was recognized and asked that the City of Benecia'rerit review commission' ordinance be seriously considered. El Selm, 7454 Beverly Drive, supported the rent review commission. Adjournment There being no further business Mayor Stewart adjourned the meeting at approximately 10:03 p.m, to executive session to discuss personnel and litigation matters.
