Approval of Minutes Approval of Bills ROHNERT PARK CITY`"COUNCIL MINUTES December 22, 1980 The Council of the City of'Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard,,Rohnert Park, with Mayor Stewart presiding. The regular session was preceded by an executive session which commenced at 7:00 p.m. and at which all Council- men and City Manager Callinan were present and which was held to discuss personnel and litigation matters. Mayor.Stewart called, the meeting of the regular session to order,at. approximately,. -7:34 p.m.� Present: (5) Councilmen Carbone, Cavalli, Hopkins, Roberts and Stewart Absent: (0) None Staff present for all or part of'the meeting: City Manager Callinan., City Attorney Flitner, Director of Public Works/ City Engineer Brust and Fire Services Commander Bick. Upon motion'ot Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved with Mayor Stewart abstain - ing, the minutes of December 8, 1980 were approved as submitted. Upon motion of Councilman'Carbone, seconded by Councilman Hopkins, and unanimously approved, the bills presented per the attached list in the amount of $2,445,169.66 were approved as submitted, which includes $7,050.00 for the Rohnert Park Civic' Commission'. Upon.motion of Councilman Roberts,,' seconded by Councilman Carbone, and-unanimously-approved, reading of Resolution ..Nos. 80 -220 through 80 -224 was waived and said resolutions were adopted, and.the listed miscellaneous approval on the consent calendar was approved. Senior „Citizen City Manager Callinan referred to his December 18, 1,980 memo. Advisory Commission to the Council concerning the list of applicants for the Senior Citizen Advisory Commission appointments. Mr. Callinan noted that a call had been received:from applicant Mr. George Stevens explaining that he would be unable to attend the meet- ing due to illness. Mayor Stewart inquired if there were any applicants in the audience desiring to speak. Ralph E. Bacon 3 Walnut:Circle was recognized and explained that he would like to get involved in the community through the Senior Citizens Advisory Commission. John Chase, 6062 Dolores Drive, was recognized and informed that he had been a resident 4 years and had been Vice- President of A.A.R.P. as well`as Secretary of the Friends of the Library. Daisy Dolby, 111 Walnut Circle'was "recognized and informed that she had been a resident 5 years and currently active in the Senior Citizen White House Conference. Mrs. Dolby ex- pressed why she wanted to participate on the commission. Betty Ferra, 433 Ava Avenue was recognized and informed that she Yras been involved with senior- citizens for a long time, currently active with,the Fun,After Fifty, Kitchen Kut Ups., A.A.R.P. and the Foxy Trotters. -Ester Krause, 1 L'as`Casitas Drive was recognized and explained that she was new-to the area and feelings for wanting to participate on the commission. Mrs. Krause pointed out that she had a great vigor to work hard. Herbert Lyons, 7518 Boris Court"was recognized and expla1hed that he would like to get involved in the community through the Senior Citizens Advisory Commission. Bill:Taylor, 376 Circulo Laredo was recognized and informed that he was a graduate of San Francisco and Berkeley Colleges and a:retired salesman. Mr. Taylor offered to the commission his organizational skills. It was noted that Mr. Walter Wright was not in attendance for oommentss. �;_. Page 3 December 22, 1980 Mayor Stewart explained that`the Council members would decide the new appointeesfby secret ballotiand that the applicants receiving at least three' votes would be appointed. City Manager .Callinan and'City,'Attorney Flitner collected and read the, results of the secret ballot. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, acid °unanimously approved,-.the following individuals were appointed to the Senior Citizens Advisory Commission: Peter McCormick;—Daisy Dolby, Betty Ferra, Herbert Lyons, and William Taylor. City Manager Callinan advised that pursuant to Resolution No. 80 -214, the appointees will determine by lot the length of their terms and they would be notified as to the date and time of the first meeting. The Council thanked all the applicants: Stop Signs City Manager Callinan referred Council to his Council meeting memo dated December 18, 1980 concerning residents request for the installation of `stop 's'igns on Country Club Drive at the Emily Avenue and Santa Dorotea Circle, south leg inter- section. Discussion followed. Upon motion of Councilman Cavalli, seconded by Councilman Hopkins, and approved by the following roll call vote, Council denied installation of stop signs on Country Club Drive, northbound and southbound•at the southern leg of Santa Dorotea<Circle and Emily Avenue intersection. AYES: (4) Councilmen Carbone, Cavalli, Hopkins and Stewart NOES: (1) Councilman Roberts :.Ordinance No. 376, AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING THE ROHNERT PARK MUNICIPAL CODE,, TITLE 15a BUILDING AND CONSTRUCTION, TO ADOPT THI UNIFORM BUILDING CODE, 1979 EDITION, THE UNIFORM HOUSING CODE, 1979 EDITION; THE UNIFORM PLUMBING CODE, 1979 EDITION- THE UNIFORM MECHANICAL CODE, 1979 EDITION; THE UNIFORM FIRE CODE;, 1979 EDITION, THE UNIFORM SWIMMING POOL CODE, 1979 EDITION AND THE'UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, 1979 EDITION; AS.AMENDED,,AND ADOPT ING OTHER REQUIREMENTS.AND ADOPTING FINDINGS IN SUPPORT OF SUCH AMENDMENTS City Manager Callinan explained Ordinance No. 376 in detail and advised that the matter was duly noticed for public hearing< Councilman Roberts expressed that he would like to have a condition stipulating that all - commercial buildings be re- quired to be sprinkled. Discussion followed. City Manager Callinan informed that it was staff's recom- mendation that all buildings 8,000 sq. feet and over be required to be sprinkled. Page 4 December 22, 1980 Fire Services Commander Bck explained that 8,000 sq. feet was cost.effective to'the. builders and that most commercial buildings were not, less than 8,On0 sq, ft. He pointed out that he,had spoke to an irsurance` agency and found out that ,commercial buildings that.were sprinkled could save up to 30% insurance wise. City Manager Callinan noted that any building under 8,000 sq.; ft. having a high hazard``accupancy would be required by staff to be sprinkled. Discussion followed. Mayor Stewart opened the public hearing on Amending Municipal Code, Title 15 regarding building and construction Uniform Codes`.... Ralph Jones, •5309 Country Club Drive was recognized and ex- pressed opposition to requiring smoke detectors in homes as a condition of transfer of ownership upon the sale of a home. Bill Adams, 184 Madrigal was recognized and briefly commented on cost effectiveness of reducing the square footage require- ment for sprinkling a'buzldinga John Revelle, Belita Avenue was recognized and briefly com- mented on the proposed amendment to the Fire Code reducing the square footage for requiring sprinkling. There being no one further desiring to be heard and no written communications received, Mayor Stewart closed the public hearing. Councilman Roberts made a motion, seconded by Councilman Carbone, and unanimously approved to waive the reading of Ordinance No. 376 and adopt said Ordinance as amended and also to have said ordinance amend the Uniform Fire Code, 1979 Edition to require all commercial buildings 5,000 sq. ft. and over to be sprinkled with a provision that any builder/ developer finding this requirement to be a hardship may appeal it to, the.;Council. Discussion followed. Ordinance No, 377 AN ORDINANCE OF THE CITY OF ROHNERT PARK RESTRICTING THE PURCHASE OF INDIVIDUAL RESIDENTIAL OWNERSHIP UNITS WITHIN THE CITY OF ROHNERT PARK City-Manager Callinan explained the ordinance, informed that the matter was duly notice for public hearing and copies of all pertinent information had been provided to each Council member. Mayor.S.tewart.opened the public.,hearing on restricting the purchase o:E individual residential units within the City of Rol-nert Paxk> Councilman Roberts Leaves and Returns Councilman Cavalli. Leaves and'Returns Page 5 December 22, 1980 City Manager Callinan informed of correspondence received fronyXhe following in opposition of,Ordinance No. 377 and read aloud letters from: 1. MDH- Western Properties dated December 18, 1980. 2. Claudette Greenblack dated December 1, 1980. John Revelle, resident was recognized and expressed feelings on 'the loss of residential units. the proposed ordinance would create. Tony Wilson, Racquet 'Club Circle was,,recognized and commented on the low number of owner /occupied' units within Sonoma Racquet Club and expressed.support for the proposed ordinance. Council discussion with Mr. Wilson followed. Bill, Adams, 184 Madrigal was recognized and commented on the amount of'affordable housing within the city, inquired if the ordinance would apply to mobile homes. Council answered in the affirmative. Mr. Adams also expressed feelings on the enforcement of the proposed ordinance. Meimei Ullrich., Realtor was recognized and indicated that she represented the Sonoma County Board of Realtors as Vice - President, informed.that the City of Davis was currently being challenged on a similar type of ordinance. Miss Ullrich expressed opposition to the ordinance and her feelings on the proposed ordinance limiting rights of travel and housing, depleting rental units within . the city. She noted that an environmental impact report had not been done for the pro- ­posed project_. Discussion followed. Council manIRoberts left -the Council.Chambers at approximately 9:14 p.m. and returned at approximately 9:15 p.m. Councilman Cavalli left the Council Chambers at approximately 9:20_p,rri. and returned at approximately 9025 p.m. Bob Rose, 604 Coronado Court was recognized and informed that he was a'realtor and there were currently no vacancies within" Rohnert Park. Mr. Rose indicated that he was in opposition to the proposed ordinance. Discussion followed. Ralph Jones, 5309 Country Club Drive was recognized and commented on Cotati, °s current limitations and the problems that city is facing. He opposed proposed ordinance no. 377, Russ Hoiem, 4690 Flores Drive was recognized and expressed that his comments fell in line with those previously made i.e. opposition to the ordinance. Jim Redding, 7147 Barbi Lane.was recognized and commented on financing.problems in relation to the proposed ordinance. Mr. Redding indicated that'he was in opposition to the pro- posed ordinance. Page 6 December 22., 1980 Walt Randle, 842 Lilac Way appeared,and expressed opposition to the proposed ordinance. City Manager Callinan explained the resolution. There being no one further desiring to be heard and no written `,communications received, Mayor Stewart closed the public hearing. Councilman Roberts made a motion, seconded by Councilman Carbone, and approved by the following roll call vote to table indefinitely Ordinance No, 377 regarding restricting the purchase of individual ownership units within the City of Rohnert Park. Upon motion; of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved, reading of Ordinance No. 378...was waived and said ordinance was adopted. Ordinance No. 379 AN ORDINANCE AMENDING THE ROHNERT PARK MUNICIPAL CODE; TITLE . 15,E SECTION 15.40,020.(Capital Outlay Fund Fees Adjustment for Increase in Cost of Construction Index) City Manager Callinan explained the ordinance. Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved, reading of Ordinance No. 379 was waived and said ordinance was introduced. Ordinance No. 3.80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AMENDING SECTION 8,12.260 OF THE ROHNERT PARK MUNICIPAL CODE (Refuse Disposal) City Manager Callinan:explained the :ordinance. Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved, reading of Ordinance No, 3.8.0 was waived and said ordinance was introduced, Resolution No, 80 -225 RESOLUTION GRANTING APPROVAL FOR 1981; GOLF COURSE RATES FOR CALIFORNIA GOLF- TENNIS City Manager Callinan explained the resolution. Page 7 December 22, 1980 City Manager Callinan referred Council to his'Council meeting memo dated December 18, 1980 concerning the proposed 1981 rates for play at the Mountain Shadows Golf Courses (northisouth).- "He pointed out that the rates have been discussed and agreed upon,by the Counc'il's golf course committee comprised of Mayor Stewart and Councilman Cavalli "and representatives of the golf courses. Discussion followed. Councilman Cavalli noted that the 9 hole rate for residents should probably be deleted. City Manager Callinan suggested that `"a condition be included that Gal -Golf post all rates. Councilman Cavalli briefly reviewed the proposed golf course rates. Mayor Stewart Leaves Mayor Stewart left the Council Chambers at approximately 10:11 and Returns- p.m. and returned at approximately 10014 p.m. Mr. Lyons, 7518 Boris Court was recognized and commented on the courses being closed during tournament play and that persons were being charged holiday rates for weekdays following a holiday. Discussion followed. Upon motion of Councilman Cavalli, seconded by Councilman Carbone, and�unanimously',approved, reading of Resolution No. - 80 -225 was waived and said resolution was approved. Pioneer Baseball Team City Manager Callihan referred Council to his Council meeting memo dated D,ecember'18, 1980 concerning declining to exercise the city's right of first refusal on the sale of the Pioneer Baseball Team's'ownership for that portion that Dr. Leonard is selling'and``on the team being incorporated. Discussion followed. Upon motion of Councilman Cavalli, seconded by Councilman Hopkins, and unanimously approved, the Council declined to exercise'its ''first right of refusal to buy the Pioneer Baseball Team and directed City Attorney Flitner to respond to Dr. Leonard's letters regarding the first right of refusal and incorporating'. R.P. Jr. High Field City Manager Callinan distributed to Council copies of a map Fencing Removal outlining the existing fencing at the Rohnert Park 'Junior, " High School field previously used by the Pioneer Baseball team. Mr. Callinan recommended that the fencing behind the bleachers be removed. Upon motion of Mayor Stewart, seconded by Councilman Hopkins, and unanimously approved, Council approved removal of the ex- terior fencing behind the bleachers at the Rohnert Park Junior High School field previously used by the Pioneer Baseball team. Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken on any communications except as specifically noted in these minutes. Page 8 '"December 22, 1980 East Cotati /Adrian City.Manager Callinan asked.the'Coun'bil members to personally -'Planters', ` inspect the planters at East Cotati'Avenue and Adrian Drive, He indicated than they were in 'need Of repair and that staff was considering repairing the planter on the west side of the intersection and removing the one on the east side. He indi- cated.that he -would ask: -the Councils approval once the Council members had had a chance toy inspect the planters. Proposition l/ SB 174 Swimming Pool Operation Sonoma 'Racquet Club R.P. Expressway Westerly City Manager Callinan reported on the anticipated revenue funds to be received from Proposition 1 and SB 174, City Manager Callinan initiated discussion concerning the pos- sibility of soliciting proposals for the operation and mainten- ance-of the city's swimming pools >`` Discussion followed. It was the consensus of the Council to authorize staff to solicit proposals for'the operation and maintenance of the city. . Is swimming pools although the -Council expressed reservations con -'' cerning the pools not being directly operated by city personnel. City Manager Callinan reported that he had again toured the Sonoma Racquet Club development and that just about everything noted or listed on the November 24th walk- through has been taken care of. City Manager Callinan reported on the recent Board of Supervisors meeting concerning the deletion of the'Rohnert Park Expressway Westerly of the County's General Plan. He referred the Council to the Ddcember. '11th letter sent to the Board. of Supervisors concerning the matter A brief discussion followed. Employees Housing City Manager Callinan reported that he-had met with represen- Assistance tatives of S.C.O.P E . 'concerning the Emplo ee Housin Assistance Lawrence & Assoc; Holiday Time Off Councilman Roberts Leaves Y g program which is being developed in order to comply with the Memorandum of Understanding. He indicated that the meeting would be scheduled for further Council consideration after the input is received from S.C.0.P.E. City Manager Callinan briefly discussed the proposal submitted by Lawrence & Associates,, Inc. for a comprehensive employees assistance program that is to provide counseling services. He indicated that the matter would;be scheduled later for Council discussion and action. City Manager Callinan noted that in previous years. Council has declared the day after Christmas or New Years, if such holidays fall on a Thursday, as holidays. fie informed that the city's operation would continue but that those clerical and other employees not covered under S.C.O >P.E. and R.P,P.O >A< wishing to take either day off may do so with the Councils approval. Discussion followed. Councilman Roberts left the Council Chambers at this point in the meeting the time being approximately 10°47 p.m. Page 9 December 22, 1980 Upon motion of Councilman Hopkins, seconded by Councilman Cavalli, and approved by the following roll call vote, Council declared the day after Christmas or New Years a holiday for those employees wishing to take either day off may do so, so long as it does not affect the city's operation. AYES: (3) Councilmen Carbone, Cavalli and Hopkins NOES: (1) Mayor Stewart ABSENT: (1) Councilman Roberts Councilman Roberts Councilman Roberts returned to the Council Chambers at this Returns point in the meeting the time being approximately 10:49 p.m. Price Index Councilman Carbone informed that the matter of obtaining a price index for the Sonoma County area was well received by the Mayor's and Councilmen's Association and that the matter should be scheduled on their agenda if the city requests it by letter. Cultural Arts City Manager Callinan reminded the Council of the two vacancies Vacancies on the Cultural Arts Commission. City Attorney's City Attorney Flitner advised that an amendment to the Municipal Report Code regarding the speed limit on Commerce Boulevard will be on the next Council agenda. Para - Transit Mayor Stewart inquired if any members of the Council desired Coordinating Council to serve on the Para - Transit Coordinating Council. At no response Mayor Stewart indicated that she would so inform the Para - Transit Coordinating Council. Agendaed Items Councilman Hopkins initiated discussion concerning putting long running items towards the end of the agenda of the Council meetings. Discussion followed. Unscheduled Public Bill Adams, 184 Madrigal was recognized and inquired the Appearance status of the rent review board. Council advised Mr. Adams that the matter would be referred to the Mobile Home Advisory Committee for review and comment.
