1981/10/26 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES October 26, 1981 The Council of the City of Rohnert Park met this date in regular session commencing at.7:00 p.m.; in the City Offices, 6750 Commerce Boulevard,.Rohnert Park, with Vice -Mayor Hopkins presiding. ;.,.The regular session was preceded by an executive session which commenced at 7:00 p.m. ane ^t which all Councilmen, except,Mayor Cavalhi,,.;and City Manager. - Callinan were present and which.was held to discuss personnel and litigatigrn, matters. Call to Order Vice -Mayor Hopkins- called the regular session to order at approximately 7:26 p.m. and led the pledge of allegiance. No. 81 -167;; A RESOLUTION ACCEPTING'COMPLETION,AND DIRECTING ENGINEER TO FILE NOTICE OF COMPLETION,;-(Foothills plater Storage Tank, Project No.-1980-,8) City Manager Callinan referring to his Council meeting memo dated October 22,,.1981 explained,,the resolution. Upon motion of Councilman - Hollingsworth,, seconded by Councilman Roberts, and unanimously approved, reading of Resolution.:No. 81 -1;67. was; waived and said resolution was adopted. Upon motion of Councilman Hollingsworth, seconded by Councilman .:Roberts.,, and unanimously approved, reading of Resolution, No. 81 -168 was waived.and said resolution was adopted. Page 2 October 26, 1981 City Manager Callinan referring to his Council meeting memo dated October 22, 1981 explained Ordinance No. 390. Upon motion of Councilman Hollingsworth, seconded by Councilman Stewart, and unanimously approved, reading of Ordinance No. 390 was waived and said Ordinance was adopted. R. -P. Chamber of City Manager Callinan referred Council to his Council meeting Commerce- Christmas memo dated October 22, 1981 concerning the Rohnert Park Chamber Tree Lane of Commerce's proposal to use the redwood trees in the median of the Rohnert Park Expressway between Commerce Boulevard and State Farm Drive as "Christmas Tree Lane.P9 Carl Moore, Rohnert Park Chamber of Commerce President and Anne Loehr, Executive Director were recognized and explained that they currently had twenty individuals donating approxi- mately $50 each towards the project. Discussion followed upon which City Engineer Brust reported that the cost to the city to provide electricity to the median would be approximately $2,000, and that the electricity bill for running the lights would be approximately $300 per year. Discussion followed. Upon motion of Councilman Hollingsworth, seconded by Councilman Roberts, and unanimously approved., Council approved the instal- lation of lights by the Rohnert Park Chamber of Commerce on the redwood trees in the median of the Rohnert Park Expressway between Commerce Boulevard and State Farm Drive and that the city assist with the program by providing electrical hook -up and automatic timing switch, and loan of equipment to string lights on the trees, the cost of electricity and then to store the lights during the year, and that the Rohnert Park 'Chamber of Commerce repay to the city all of its out of pocket costs within a 1 or 2 year time period from the promotional funds provided by the city to the Chamber each year. Sr. Nutrition City Manager Callinan reviewed his Council meeting memo dated Program October 22, 1981 concerning the Sonoma County Council on Aging's interest in using the Rohnert Park Community Center. Roberta Green, Project Director and Daisy Dolby Board Member were recognized and responded that if the $50 utilities fee were waived it would be used towards 50 additional meals. Discussion followed concerning the number of Rohnert Park residents serviced by the nutrition program. Upon motion of Councilman Roberts, seconded by Councilman Hollingsworth, and unanimously approved, Council went on record as authorizing the use of the Community Center by the Senior Nutrition Program and waived the rental fees for the use of the center, waived any charge for utilities, and authorized the City Manager to work out the necessary details. Armand Silvestri William Taylor Councilman Stewart pointed out that Maurice Seaman was in the process.of moving out,of the area and would not be able to .,.serve on the committee. Transit Matters, City Manager Callinan referred Council to his Council meeting memo dated October 22, 1981 concerning working with the County , to get bus shelters installed at various points in the city. Mr. Callinan pointed out that copies of -City Engineer's letter to Dave. Knight of the Sonoma County Department of Public Works listing locations,at which shelters are desired had been pro- vided to.the'Council. Mr. Callinan indicated that the shelters would cost approximately $2;000 each and that the eight shelters requested would cost approximately $17,000. Funds for the shelters would come from the State Transportation Assistance.Funds available; Upon motion of Councilman Roberts, seconded by Councilman Hollingsworth, and-,,.unanimously approved, Council authorized - the installation of bus.,shelters at the locations per City ,Engineer Brust's..$eptember 22, 1981 letter to the County at an estimated cost of $17,000, being financed from State T.ransportatiori Assistance Funds. Route 82 city Manager Callinan reported that Route 82 had been estab- lished by Golden Gate the handicapped with buses that aceomodate wheelchairs. Proposed Contract- City Manager Callinan referred Council to his Council meeting Golden Gate & County memo dated October 22, 1981 concerning the proposed agreement •1981 -82 Service between the County and Golden Gate for transit service for 1981 -82. Mr. Callinan pointed out that as the result of the reduction -in bus service_ and.:.the County's and City's stand against Golden Gate,,Rohnert Park would .receive $23,444 of Transportation Development Act Funds that Golden Gate tried to obtain. Mr. Callinan indicated that staff had reviewed the agreement. and had no .suggestions, Mr. Callinan solicited comments or suggestions from the Council of which there were .none. Councilman Hopkins expressed concern regarding the number of empty buses on Route 76 running along Adrian and Arlen Drive. City.Manager Callinan indicated he would check into the.matter. File No.,.0146 -James Councilman Stewart left the,Council Chambers at this point in Goldstein, Rancho, the meeting the time being approximately 8 :16 p.m. due to Feliz Mobile Home possible conflict of interest concerning File No. 0146. ,Park Conversion to Condominium Page 4 October 26, 1981 City.Attorney Flitner advised the Council that he had given an opinion to Councilman Stewart that she could make a presentation before the Rohnert Park Planning Commission re- garding this item. Since that time Mr. Flitner had reconsidered his opinion and felt that the advise he had given Mrs. Stewart was incorrect. If any Councilmen felt he was or would be influenced by Mrs. Stewarts remarks before the Planning Commission or the fact that Mrs. Stewart had appeared before the Planrfng Commission then that Councilman should abstain from any diliberation of the matter. Planning Director Skanchy explained the staff report regarding the application of James Goldstein to convert Rancho Feliz mobile home park from an owner /rental type park to an individual lot condominium park. Mr. Skanchy referred to site plans on display and referred Council to Planning Commission staff re- ports dated May and August 22, 1981. Mr. Skanchy read the conditions required in the Planning staff report in regards to the conversion. City Manager Callihan reviewed with Council his Council meeting memo dated October 22, 1981 concerning the conversion and reviewed the written communications received. Bill Geary, Vice - President of Carlsberg Financial was recognized and indicated that he was responsible for preparing the tenta- time map. He explained the request. Lawrence Harvey, 111 Madrigal was recognized and expressed his support of the conversion. Mr. Harvey indicated that Mr. Goldstein had not used scare tactics in seeking support of the conversion. He recommended Council give the developer the chance to see if they could get at least 600 of the project sold in order to go ahead with the tentative map. Delmar Kooken, 163 Madrigal was recognized and indicated that he was in. opposition of the proposed conversion. Mr. Kooken pointed out that his mother was a resident in the park and on a fixed income which would not enable her to buy her space if.she wanted to. Mr. Kooken also reminded the Council that there were others in the park to consider such as the handicapped and elderly who could not possibly come up with the money to,buy their space and in turn would be forced out with no place to go. Council inquired of Mr. Geary whether there was a cost of living increase built into the conversion. Mr. Geary answered no. Bob Henry, 8290 Lancaster Drive was recognized and said the reason for the city's not being able to receive grant monies towards the purchase of spaces in the conversion project was it doesn't have an approved housing element. Mr. Henry indi- cated that GSMOL and PG &E support the ideas of the conversion. Mr. Henry also indicated that if an individual could not afford to purchase their space that there would be other persons in other mobile home parks that would possibly want to make a trade. Page 5 October 26; 1981 Arlen Shappiro, 75 Madrigal was recognized and asked Council to consider the potential for displacement of those individuals who were not in a position to purchase their spaces. Mr. Geary reiterated that in order for the proposed tentative map'to become final the project would have to have at least 60% of the spaces purchased; that if at least 60% of the spaces were not sold then the conversion would not be able take place. Discussion followed. Darrell Ashley, 154 Madrigal was recognized and reported that he had purchased his mobile home due to the apartment complex he had been living in had been converted to condominiums. Mr. Ashley expressed that,he did not want-to be forced out of his living space again. He felt that rrany would be uprooted by the conversion. City Manager Callinan City Manager.Callinan'left the Council Chambers at this Leaves and Returns point in the meeting the time being approximately 9 :04 p.m. and returned at approximately 9:06 p.m. Carl Hodgson, 95 Madrigal was recognizd and spoke in favor of the application and requested that the developers be allowed to at least survey the,-,mobile home park to establish space sizes and lot lines. Mr. Geary indicated that the.mobile home park was set up for 300 lots but that the conversion project would consist of only the existing 294 lot 'spaces° Mr. Geary noted that the sales price of each lot would be based upon the size and location of the space. Bill Langford, 132 Madrigal spoke in opposition to the application. Andy Provost, Rancho Feliz resident was recognized and indicated that he had just purchased his coach and was not in. a position financially to purchase the space. Jim Redding, 7147 Barbi Lane was recognized and pointed out that if the Council went'ahead` and approved the tentative map and all conditions were met conceivably the final map would be recordable. He questioned the validity of the 60% sale of the park's spaces as a condition prior to final map approval. Mr. Redding-.emphasized the importance of considering the tentative map approval before making any kind of decision. Lawrence Harvey was again recognized and indicated that those spaces which could not be bought by the'toach owner would probably be bought by investors which would in turn rent the space out. Delmar Kooken was again: recognized and questioned whether the age of a coach would determine whether or not the coach could stay on the space or-not.' He expressed that he would hate to see persons buying their spaces and be forced to take them off later because of the coaches age. Page 6 October 26, 1981 I Mary Jane Ashley, 154 Madrigal was recognized and expressed opposition to the conversion pointing out that if she could afford to purchase a home she would not be renting a space and living in a mobile home. There being no one else desiring to be heard, the Council closed the public input, Councilman Roberts made a motion, which was seconded by Councilman Hollingsworth, to deny the conversion of Rancho Feliz Mobile Home Park to a condominium park. Discussion followed concerning problems with approving the tentative map and displacement of coaches /individuals unable to purchase spaces. Linda Prentice, 7 Loredo Street jumped up in the audience. ..and expressed opposition to the conversion. Councilman Roberts made a motion, seconded by Councilman Hollingsworth, and unanimously approved by the following voice vote, to amend the previous motion to deny without prejudice the application for tentative map to allow Rancho Feliz Mobile Home Park to be converted to a condominium park. AYES: (3) Councilmen Hollingsworth, Roberts and Hopkins NOES: (0) None ABSENT: (2) Councilmen Cavalli and Stewart Recess Vice -Mayor Hopkins called a recess in the meeting at approxi- mately 9:35 p.m. Reconvene The meeting was reconvened by Vice -Mayor Hopkins at approximately 9:46.p.m. with all Council members, except Mayor Cavalli., present. File No. 0815- City Manager Callinan referred Council to his Council meeting Genesis Fellowship memo dated October 22, 1981 concerning the application of Church Genesis Fellowship, Inc. to operate a church and education andreligious book store ministry in the existing building at 5801 Redwood Drive in the limited industrial district. City Manager Callinan noted that the Planning Commission on October 8th denied said use. Mr. Callipan briefly reported the uses of the existing buildings adjacent to the proposed church location. Richard Anderson, 847 Santa Dorotea was recognized and expressed the church's desire to temporarily locate at 5801 Redwood Drive. Upon motion of Councilman Hollingsworth, seconded by Councilman Hopkins, and unanimously approved, Council went on record as having no objection for temporary use of,5801 Redwood Drive by Genesis Fellowship, Inc. and-directed staff to initiate the necessary appropriate amendment to city zoning regulations to allow church use in industrial zoned areas subject to the issuance of use permit. ..Page 7 October 26, 1981 Community Center Due to the lateness of the- hour;.it was unanimously agreed by Update the Council that the matter of the athletic facility and the performing arts theater update be deferred to the next regular- ly scheduled meeting. SB230"Changing City Manager Callinan referred Council to his Council meeting Election Dates:, memo dated October 22, 1981 concerning SB230 which allows cities to change their election date so that the elections may be consolidated with the other major elections. Discussion followed. Communications Councilman Hopkins made a motion, seconded by Councilman Hollingsworth,`,and unanimously approved directing staff to prepare an ordinance that would set "municipal election dates on the first Tuesday after'the first Monday in June of even numbered years. Communications per the attached outline were brought to the attention of the'City Council. No action was taken on any communications except as specifically noted in these minutes. City Manager's Report City Manager Callinan referred the Council to his Council meeting memo dated October 22;:1981 for explanation of all the matters on the City Manager's report section of the meeting's agenda.. Rent Adjustments- 136 - Referring to his Council meeting memo City Manager Callinan Santa Alicia Drive reported that as the result of�-a follow -up to the proposed rent adjustment at 136 Santa Alicia Drive the rents will :e !.rolled: back' to, a much lower increase than was proposed "Discussion followed. Senator Nielsen °s Reception Sr. Citizen Drop -in Center Dedication Fireman's Fund- Novato Swimming Pool Cover Bids City Manager Callinan reported of a reception for Senator Nielsen scheduled for October 27th at the Community Center at 4,00 p.m, • ,s City Manager Callinan reported that "the dedication of the new Senior Citizen Drop -In Center was scheduled for 11000 a.m, on November 4th. City - Manager Callinan referred to his memo regarding the construction of a large new Fireman's Fund facility being built in Novato. Mr, Callinan reported that the facility . wa's'planned to house some 5,000 employees. Mr. Callinan pointed out that Marin County was not planning to provide housing for said employees thus`Sonoma County would more than likely carry the 'burden. Mr. Callinan expressed that the cities- within Sonoma County should do something to force Marin County to provide medium priced housing. Discussion followed concerning the possibility,of setting up a Meeting with representatives`of!Marin County regarding housing. City Manager Callinan'.repor -ted on staff soliciting quotes. for swimming pool covers for Alicia and Benecia pools. Mr. Callinan recapped proposals received and staff comments recommending that the covers be re -bid. Council concurred. Page 8 October 26, 1981 File No. .0762- City Manager Callinan distributed to the.Council a copy of the Hewlett Packard city staffxeport on the proposed Hewlett.Packard Project on which suggested changes submitted by Hewlett Packard repre- sentatives had been made. SB215 City Manager Callinan gave a report on SB215, 2� gas tax increase, indicating that it was now law. Mr. Callinan re- ported on the city's anticipated revenues fox 1982 -83 and 1983 -84 from SB215. -, Solid Waste Advisory City Manager Callinan noted a vacancy to the Solid Waste Board Advisory Board with the resignation of Mayor Tony Carbone. Mr.,Callinan reminded of a meeting of same on October 29th at 2:00 p.m. at the County Center. He inquired as to whether any Council member wanted to serve on the advisory committee. Upon motion of Councilman Roberts, seconded by Councilman . Hollingsworth, and unanimously approved,. Council authorized the _City Manager to designate a staff member as the city's representative on the Solid Waste Advisory Board. Police Radios City Manager Callinan informed that proposals for Public Safety radios had been solicited and even though Motorola was second low bidder that award would be made to that firm because of its product reliability and because of the lack of record of performance of the low bidder, Empire Communications, and because of the recommendation from the city communications equipment service firm. National League of City Manager Callinan reported on a National League of Cities Cities Conference conference in Detroit, from November 28th through December 2nd. Upon motion by Councilman Roberts, seconded by Councilman Hollingsworth, and unanimously approved, the Council authorized the City Manager to approve any Council member desiring to so do to attend the National League of Cities Conference in Detroit from November 28th through December 2nd., .. It was suggested that a resolution listing all the conferences to be authorized by the Council be prepared for adoption so that.the matter would not have to come to Council each time. Matters from Councilmen Councilman Stewart reported that she might be leaving the state to go.to.Miami next week for personal business. Mobile Home Councilman Stewart reported that the Rancho Verde Mobile Committee Home Park was transitioning to an all adult park. She asked for City Attorney Flitner to clarify what constitutes an adult. Discussion followed. Housing Meeting City Manager Callinan recommended that Council and staff hold a meeting on the topic of housing. Discussion followed. Sonoma County Library Councilman Stewart pointed out that she was no longer a member Committee of the Sonoma County Library Committee yet was still receiving information concerning,meetings, etc. Council directed staff Page 9 October 269 1981 to notify the Sonoma County Library Committee that Councilman Roberts was the representative and that he should be receiving all correspondence.
