A RESOLUTION ACCEPTING COMPLETION AND DIRECTING ENGINEER TO FILE NOTICE OF COMPLETION,(Pumps and Controls for Wells 19, 20 and 21, 'Project 'rlo. 1980 -31) March 22, 1982 The Council of the City of Rohnert Park met this date in regular session commenting-at 7:24 p.m.'it"ihe City Offices, 6750._Commerce;Boulevard, Rohnert Park, with Vice Mayor Hopkins presiding. The regular session was preceded by an executive session which commenced at 7:'00 p.m, and at which all Councilmen, except Mayor Cavalli, and City Manager Callinan and City Attorney Flitner were present and which was held to discuss litigation matters. a� Call to Order Vice Mayor Hopkins called the meeting of the regular session to order at approximately 7:24 p.m. and led the pledge of allegiance. Roll Call Present. (4) Councilmen Hollingsworth, Roberts.. Stewart and Hopkins Absent: (1) Mayor Cavalli (recovering from heart surgery) Staff present for all or .part of the meeting: City Manager Callinan;, City Engineer Brust, Planning Director Skanchy, Direc`tor'of Public Safety Dennett, Recreation Director Pekkain and City Attorney Flitner. Approval of Minutes Upon motion of Councilman Hollingsworth, seconded by Councilman Roberts, and unanimously approved, the minutes of March 8'and March 15, 1982 were approved as submitted. Approval of Bills Upon''motion of Councilman Hollingsworth, seconded by Councilman Roberts;`and unanimously approved, the bills presented per the attached list in the amount of $413,092.43 were approved. Non - Agendaed Items City Manager Callinan requested that time be allotted under the Scheduled Public Appearances section of the agenda for Mike Levy, President of the National Association of Letter Carriers, and Dan Demiglio,, representative of the National Association of Letter Carriers to speak regarding animal control. BALCH, JR, Resolution No. 82 -63 A RESOLUTION DETERMINING UNPAID ASSESSMENTS AND PROVIDING FOR ISSUANCE OF BONDS (Snyder Lane North, Project No. 1980 -24) Resolution No. 82 -64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK ADOPTING THE 1982 AMENDMENTS TO STATE GUIDELINES FOR CALIFORNIA ENVIRONMENTAL QUALITY ACT Resolution No. 82 -65 RESOLUTION CALLING FOR SEALED PROPOSALS (Public Works Fasteners, Electrical Supplies, Auto Parts, Pipe Fixtures and Miscellaneous Small Tools) Resolution No. 82 -66 A RESOLUTION AWARDING CONTRACT FOR HEATING AND AIR CONDITIONING MAINTENANCE Upon motion of Councilman Roberts, seconded by Councilman Hollingsworth, and unanimously approved, reading of Resolutions Nos. 82 -61 through 82 -66 was waived and said resolutions were adopted. Propane Conversion City manager Callinan referred Council to his Council meeting Bids memo dated March 19., 1982 concerning proposals received for the conversion of twelve Public Safety patrol vehicles from gasoline to propane use. Mr. Callinan recommended that the conversion proposal be re -bid due to the Public Works mainten- ance mechanics preference for one specific unit which only one bidder submitted a proposal. City Manager Callinan further noted that the bidder that submitted a proposal for this specific unit was related to an individual in the Public Safety Depart - ment and was not the lowest bid submitted. Discussion followed. Upon motion by Councilman Roberts, seconded by Councilman Hollingsworth, and approved by the following voice vote, the Council rejected all proposals received for the conversion of twelve Public Safety patrol vehicles from gasoline to propane use, and authorized re- bidding for the conversion to propane specifying a Landi-Hartog unit or equal. AYES: (3) Councilmen Hollingsworth, Roberts, and Hopkins NOES: (1) Councilman Stewart ABSENT: (1) Mayor Cavalli Resolution No. 82 -67 RESOLUTION APPROVING AGREEMENT WITH SANTA ROSA MEMORIAL HOSPITAL AND AUTHORIZING EXECUTION OF DEED City Manager Callinan explained the resolution and agreement referring to his Council meeting memo dated March 199 1982 noting that copies of Santa Rosa Memorial Hospital's proposed agreement had been previously supplied to each Councilman. He introduced Mr. Art Crandall, Administrator for Santa Rosa Memorial Hospital and Mr. Larry Maniscalco the hospital's planner to answer any questions by the Council. Discussion followed. AYES: (3) Councilmen Hollingsworth, Roberts and Hopkins NOES: (1) Councilman Stewart ABSENT: (1) Mayor Cavalli Councilman Stewart Councilman Stewart left the Council Chambers at this point Leaves and Returns in the meeting, the time being approximately 8:54 p.m. and returned at approximately 8 :56 p.m. Animal Control Mike Levy, President of the National Association of Letter Carriers was recognized and made a presentation to the Council concerning animal attacks on postal employees. Mr. Levy appealed to the Council to carefully review existing city ordinances regarding animals and possible enforcement of stricter regulations and,fines. Regina Frazier, 4497 Flores Avenue, former,.postal employee was recognized and again related her experiences with a pit bull attack. Mrs. Frazier also appealed to the Council to closely review existing ordinances and regulations pertain- ing to animals, recommending stricter animal containment laws. Maria Me.11ick, Santa Rosa kennel owner was recognized and generally explained the behavior'of several breeds of dogs, but mainly the pit bull. Mrs. Mellick also endorsed stricter leash laws and containment of• animals onj P. ersonal property. Lorraine Swing, 6497 Sequoia Street, Staffordshire terrier (pit bull) owner was recognized and also recommended stricter leash laws and containment'on,personal property. Mario Pompei., Officer of the`Rohnert Park•Post Office was recognized an& read aloud to the Council the United States Post. Offices policy regarding animal attacks. Mr. Pompei recommended the Council review existing animal control ordinances and work with the postal employees in reducing the number of attacks on postal employees. Discussion followed. Director of Public Safety pennett was recognized and informed that of the list of animal attacks' submitted by the post office very few had been reported to the Department of Public Safety. 14r. Dennett emphasized the importance of reporting animal attacks etc. to the Department for follow -up by the Animal Control division. He pledged the city's cooperation. Councilman Hollingsworth recommended formulating a task force of a Council members, postal employee and citizen to review current city ordinances regarding, animal control. Discussion followed. Page 4 March 22, 1982 Steve Dunn, 1054 San Francisco Way was recognized and inquired what penalties a pet owner was charged for animals picked up more than one time. , Frank Houdari, resident was recognized and inquired when the Council would meet again regarding any changes to existing animal control ordinances'. By consensus of the Council, Councilman Hollingsworth was appointed as liason to a task force of postal service repre- .sentatives to review current city ordinances regarding animal control and make'a recommendation to'the City Council. Mrs. Swing was recognized and expressed a desire to participate on the task force. R.P. Men's Softball Bud Rose, Vice-President of the Rohnert Park Men's Softball Association Donation -".,Association was recognized and expressed appreciation to the City'for their.'joint efforts with the men's softball association in upgrading the Bcnecia Park softball field. Mr. Rose pre - sented a check to the Council in the amount of $1,000 for use in further upgrading softball fields in town and stated that the association will continue to make such a donation yearly. Vice Mayor Hopkins accepted the donation on behalf of the City and expressed appreciation to the Men's Softball Association for their contributions. The Council agreed to advance funds (up to $2,000) for the improvement of the softball field on the Rohnert Park Junior High School site with the condition and understanding that the association reimburse the City for same over the next two years. Resolution No. 82 -68 RESOLUTION OF THE ROHNERT PARK CITY COUNCIL ACCEPTING REPORT ##2 OF THE SONOMA COUNTY CULTURAL ARTS PLANNING PROJECT, THE DESIGNATED LOCAL PARTNER UNDER THE CALIFORNIA ARTS COUNCIL'S STATE /LOCAL PARTNERSHIP PROGRAM Clara Brown, Cultural Arts Commission member was recognized and explained the resolution. Upon motion of Councilman Hollingsworth, seconded by Councilman Stewart, and unanimously approved, reading of Resolution No, 82 -68 was waived and said resolution was adopted. City Manager Callinan noted to Mrs'. Brown that Mr. Pompei of the local 'Post Office had expressed'a willingness to allow the displaying of art in the Post Office facility. Public Schools Ed :'14rede, representative of the' Luther Burbank Masonic Lodge Month No. 752 was recognized and urged the Council to join in the proclamation of April 1982 as Public Schools Month. PROCLAMATION SETTING THE MONTH OF APRIL, 1982 AS "PUBLIC SCHOOLS MONTH" AND URGING SUPPORT THEREOF Director of Public Works /City Engineer Brust gave a presen- tation concerning the water situation in Rohnert Park noting that Rohnert Park and Sonoma County has an abundant supply of water. Mr. Brust referred the Council to site plans on display depicting "locations of the City's wells currently in operation and reported on production of same. Director Brust reported of the meeting held with representa- tives of the State Department of Water Resources to discuss the State's draft report, noting that it was still to early to quote from the report since it is still only a draft. Mr. Brust drew a picture of and explained the water basin which is located under Rohnert Park. Discussion followed. is ... Recess Vice Mayor Hopkins.called a recess at this point in the meeting,.the time being approximately 8:50 p.m. Reconvene s :.. Vice Mayor Hopkins reconvened the meeting at approximately 9:00 P.M. Weed Abatement City Manager Callinan referred Council to his Council meet- ing memo dated March 19, 1982 concerning notices to destroy weeds having been sent out to property owners and residents. PRr. Callinan pointed out that the matter was duly noticed for public hearing. Vice Mayor Hopkins opened the public hearing concerning notices to destroy weeds. There being no one desiring to be heard and no written communications received Vice Mayor Hopkins closed the public hearing. Resolution No. 82 -69 RESOLUTION ORDERING CITY,MANAGER OF THE CITY OF ROHNERT PARK TO ABATE NUISANCES EXISTING WITHIN THE CITY OF ROHNERT PARK City Manager Callinan explained the resolution referring to his memo dated March 19, 1982. Upon motion of Councilman Hollingsworth, seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 82 -69 was waived and said resolution was adopted,. Water Situation:- Update City Manager Callinan referring to his Council meeting memo dated 14arch 22, 1982 reported of a meeting with himself, Director of Public Works Brust, Councilman Hollingsworth and representatives of the State Department of Water Resources and the Sonoma County Water Agency concerning Rohnert Park's water situation. Mr. Callinan indicated that Director Brust was present to update the Council on the City's water - situation. Page 6 March 22, 1982 File No. 0146- Rancho City Manager Callinan referred to his Council meeting memo Feliz Mobile Home Park dated March 19, 1982 concerning Council's request for recon- sideration of File No. 0146, James Goldstein's application for tentative map approval to convert the Rancho Feliz Mobile Home Park to a condominium park. Mr. Callinan also noted per Council's directive that notices were mailed to all Rancho Feliz addresses informing residents of the meeting, Councilman Stewart Councilman Stewart left the Council Chambers at this point in Leaves the meeting, the time being approximately 9:21 p.m, due to a conflict of interest, City Manager Callinan noted receiving two letters in opposition of the conversion. Discussion followed. Councilman Hollingsworth made a motion, seconded by Councilman Hopkins, to approve James Goldstein's application for tentative map approval to convert the Rancho Feliz Mobile Home Park to a condominium park subject to the conditions as outlined by the Planning Staff report and subject to proof of interest and loan qualification of 600 of the owner occupied mobile homes in the park prior to approval of the final map. Further discussion followed. Bill Jones, a Rancho Feliz resident was recognized and inquired the percentage of interested residents in the park in favor of the conversion. City Manager Callinan responded with the statistics previously provided to the city by the applicant. Further discussion followed. Councilman Roberts Councilman Roberts left the Council Chambers at this point in Leaves the meeting the time being approximately 9:L46 p.m. in order to stop the motion from being acted on and said motion died. Adjournment Due to the leaving of Councilman Roberts, resulting in the lack of a quorum, Mayor Pro Tempore Hopkins adjourned the meeting at approximately 9:49 p.m. to March 23, 1982 at 12:00 noon in the City Offices. t ATTE ,T P .
