1982/06/15 City Council MinutesCall to Order Roll Call Approval of Minutes ROHNERT PARK CITY COUNCIL MINUTES June 15, 1982 The Council of the City of Rohnert Park met this date in adjourned regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Cavalli presiding. Mayor Cavalli called the adjourned regular session to order at approximately 7:02 p.m. and led the pledge of allegiance. Present: (4) Councilmen Hollingsworth, Hopkins, Roberts and Cavalli Late: (1) Councilman Stewart arrived just after the meeting was called to order Absent: (0) None Staff present for all or part of the meeting: City Manager Callinan, City Attorney Flitner, Asst. City Manager Albright, Administrative Assistant Jones, Finance Director Netter, Recreation Director Pekkain, and Planning Director Skanchy. Upon motion of Councilman Hopkins, seconded by Councilman Hollingsworth, and unanimously approved, the minutes of May 24, 1982 were approved as submitted. Approval of Bills Upon motion of Councilman Hollingsworth, seconded by Councilman Hopkins, and unanimously approved, the bills presented per the attached list in the amount of $641,601.49 were approved. Non - agendaed items City Manager Callinan requested that time be allotted under the City Manager's Report section of the agenda to present the 1982 -83 Proposed City Budget to the Council. <• !. Resolution No. 82 -102 RESOLUTION APPROVING AMENDMENT TO CUSTODIAL AGREEMENT WITH GREAT WESTERN SAVINGS Resolution No.;82 -103 A RESOLUTION ACCEPTING PARTIAL COMPLETION AND DIRECTING ENGINEER TO FILE NOTICE OF PARTIAL COMPLETION, SUNRISE PARK, RESTROOMS AND PLAY EQUIPMENT, PROJECT NO. 1980 -2 Resolution No. 82 -.104 A RESOLUTION ACCEPTING COMPLETION AND DIRECTING ENGINEER TO FILE NOTICE OF COMPLETION, SUNRISE PARK LIGHTING, PROJECT NO. 1980 -2 Rohnert Park City Council Minutes -Pg. 2 June 15, 1982 Resolution No. 82 -105 RESOLUTION CALLING FOR SEALED PROPOSALS, STORM DRAIN IMPROVEMENTS, COMMERCE BLVD. /STATE FARM DRIVE, PROJECT NO. 1981 --6 Upon motion of Councilman Hollingsworth, seconded by Councilman Hopkins, and unanimously approved, reading of Resolutions Nos. 82- 102.through 82 -105 was waived and said resolutions were adopted. SAS ii Si i °C n iC r. 9a e.' 9rC a. ri '1t 9`C �� iC iG iv is n 5� :e •. a °'e Ordinance No. 400 AMENDING ORDINANCE NO. 201 AND CHAPTER 5.12 OF THE ROHNERT PARK MUNICIPAL CODE CONCERNING BUSINESS LICENSES City Manager Callinan explained that although this ordinance was adopted at the Council Meeting on May 24, 1982 with an amendment to add Laundromats, the language in the ordinance to include same would result,_in.eliminating,:a business license tax on coin, operated laundry machines and recommended that the Council reconsider their,previous adoption of the ordinance so that it could be rewritten to be more specific in this area and leave no room for confusicn,in this regard. Discussion followed. Upon motion of Councilman Hollingsworth, seconded by Councilman Roberts, and unanimously approved, the Council:appr6ved the reconsideration of its action on May 24, 1982.in,,adopting. Grdinance No. 400 with the amendment to include Laundromats. Further discussion followed during which City Attorney.,. Flitner .advised the Council that they did have the authority to reopen the .ordinance if they so wished. City Manager Callinan suggested that the entire ordinance be rewritten to include all points discussed. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, the Council rescinded its previous adoption of Ordinance No. 400 with the understanding that a new ordinance would be brought back to the Council with more specific language. File 0833 -Pro osed City Manager Callinan explained that this matter was Amendment to City Code being presented to the Council with the recommendation re Mechanical and by the Planning Commission for adoption and stated,, Electronic Play Devices that the legally - required notices of the public hearing were duly published. Planning Director Skanchy explained the,.purpose of the proposed amendment to the.Municipal Code, stating that Rohnert Park ..City Council Minutes --Pg. 3 June 15, 1982 it would establish guidelines in the issuance of use permits and special use permits for the placement of mechanical and electronic play devices in commercial and industrial districts. Discussion followed. Mayor Cavalli opened the public hearing concerning the proposed amendment to the Municipal Code regarding placement of mechanical and"electronic play devices. There being no one desiring to be heard and no written communications received, Mayor Cavalli closed the public hearing. Ordinance No. 405 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING THE ROHNERT °PARK MUNICIPAL CODE, SECTIONS 17.26.090, 17.16.100, 17.16.110, 18,.16.120, 17.16.130, 17.18.150 AND'17.18.160 REGARDING 'A CONDITIONAL USE PERMIT FOR MECHANICAL AND ELECTRONIC PLAY'DEVICES IN ALL COMMERCIAL AND INDUSTRIAL DISTRICTS ' Upon motion of Councilman Hollingsworth, seconded by Councilman Hopkins, and unanimously approved by the following voice vote, reading of Ordinance No. 405 was waived 'and said ordinance was introduced. AYES: (5) Councilmen Hollingsworth, Hopkins, Roberts, Stewart and Cavalli NOES: (0) None' File 0834 - Proposed City Manager Callinan explained the proposed amendment Amendment to Zoning to toe Municipal Code. Planning Director Skanchy Ordinance to amend informed the Council that.the''amendment would reclassify Sections 17.16.020, certain permitted uses in commercial and industrial 040, 050, & 060 re zones as conditional uses requiring a public hearing conditional use permits before the Planning Commission before the issuance of said permits. Mr. Skanchy also advised that all notices of the public hearing before `�.e City Council had been duly published. - Mayor Cavalli opened the public hearing concerning the proposed amendment regarding certain permitted uses in commercial zones. Mr. Jim Redding, 7147 Barbi Lane, stated his concerns on changing the permitted uses to conditional uses. He stated that he felt this action would bring about unnecessary pressures from various groups. There being no one else desiring to speak and no written communications received, Mayor Cavalli closed the public hearing. Discussion followed. Rohnert Park City Council Minutes -Pg. 4 June 15, 1982 Ordinance No. 406 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING THE ROHNERT PARK MUNICIPAL CODE, SECTIONS 17.16.030, 17.16.040, 17.16.050, AND 17.16.060 BY DELETING CERTAIN PERMITTED USES AND ADDING THEM TO THE CONDITIONAL USE CATEGORY Upon motion of Councilman Stewart, seconded by Councilman Roberts, and the following roll call vote, reading of Ordinance No. 406 was waived and said ordinance was introduced. AYES: (3) Councilmen Hollingsworth, Roberts and Stewart NOES: (2) Councilman Hopkins and Mayor Cavalli Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken cn any ccmmunication except as specifically noted in these minutes. Stadium Vandalism Councilman Roberts cited a letter regarding vandalism to the Rohnert Park Stadium and was advised by City Manager Callinan that a later communication had been received and that the Council would be provided a copy of same. Mayor Cavalli referred to a letter written by Recreation Director Pekkain regarding the same matter. Project Status Reports Mayor Cavalli inquired about the closing reports of three projects; namely, No. 1979 -17, Water Storage Tank - Snyder; No. 1980- 11 -Jr. High Tennis Courts; and No. 1982 -01 -RP Stadium Windwall. Discussion followed. City Manager's report: City Manager Callinan stated that Finance Director 1982 -83 Proposed Budget Netter" had copies of the proposed budget to pass out to the Council and commended all of those persons who had worked so diligently to finalize same. Mr. Callinan also remarked that the "reverse bail -out" being considered by the State Legislature could have a great impact on the budget. Discussion followed. It was the concensus of the Council that it would hold a budget work session on Monday, June 21, 1982 at 7 :00 p.m. in the City Offices to study the budget closely. City Attorney's report: City Attorney Flitner advised the Council that the Hewlett Packard lawsuits depositions on the Hewlett Packard lawsuits had been taken and stated that August 22, 1982 had been set as a trial date. Rohnert Park City Council Minutes -Pg. 5 June 15, 1982 Ghilotti Bros. lawsuit City Attorney Flitner said the lawsuit had been filed out of Sonoma County which may constitute an illegal filing and advised that he is investigating same. Billboard lawsuit City Attorney Flitner stated that a decision on this matter should be received shortly as it is over the 90 day `deadline period. Matters from Councilmen: Councilman Hopkins enlightened the Council on the LCC Conference in Legislative Issues Conference in Sacramento that'was Sacramento held June 14 & 15 and stated that the State may be taking revenues away from the cities in an effort to try to balance the State budget. LCC Conference in City Manager Callinan reminded the Council that the Monterey registration deadline is rapidly approaching for the League of California Cities Mayors and Council Executive Forum to be held in Monterey July 7 through the 9th and noted it has always been one of the most enlightening conferences offered by the LCC. Commission Appointments Councilman Stewart requested that the various commission appointments for terms expiring June 30th be deferred until she returns from her upcc�iing personal trip. Upon motion of Councilman Hopkins, seconded by Councilman Hollingsworth, and unanimously approved, the commission appointments were deferred for 30 days and it was unanimously agreed to`ekt6hd all current commissioners' terms until July %30,'1982 Adjournment to Closed At this point in the meeting, the time being approximately Session 8:08 p.m. Mayor Cavalli adjourned the regular open session and announced that a closed session would he held. Mayor Cavalli advised that the regular open session would be reconvened immediately following the closed session. Reconvene Reflections General Municipal Election Canvass of Votes Mayor Cavalli reconvened the regular open session at approximately 8 :25 p.m. and explained that the closed session was held to discuss personnel and litigation matters. Mayor Cavalli recapped some of the accomplishments of the City during the past year. City 'Manager `Callinan informed the Council of the results of the recent election and announced the number of votes received by each Council candidate. Mr. Callinan also publicly commended all of the candidates who ran for the Council!vacancies and thanked them for their interest in the community. Discussion followed. Rohnert Park City Council Minutes -Pg. 6 June 15, 1982 Resolution No. 82 -106 A RESOLUTION DECLARING RESULT OF GENERAL MUNICIPAL ELECTION HELD IN THE CITY OF ROHNERT PARK ON JUNE 8, 1982. City Manager Callinan explained the resolution. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution No. 82 -106 was waived and said resolution was adopted. Oath of Office Deputy City Clerk Roberts administered the Oath of Office to Councilmen -Elect Arthur Hollingsworth and Mary Stewart. Selection of Mayor Upon motion of Mayor Cavalli, seconded by Councilman Pro- Tempore Hopkins, and.unanimously approved, Councilman Roberts was appointed by the City Council to serve as Mayor Pro- Tempore (Vice - Mayor). Selection of Mayor Upon motion of Councilman Hollingsworth, seconded by Mayor Cavalli, and unanimously approved, Councilman Hopkins was appointed by the City Council to serve as Mayor. Councilman Cavalli.turned the gavel over to Mayor Hopkins. Mayor Hopkins,assumed chairmanship of the meeting and expressed appreciation on behalf of the Council to Councilman Cavalli and presented him with a desk set in appreciation of his service as Mayor. Mayor Hopkins introduced some former Councilmen and former Mayors who were present in the audience as follows: Dale Foust, Jimmie Rogers and Tony Carbone. He also recognized James Stevens and Bettie Basye as Council candidates. Adjournment There being no further business the meeting was adjourned at approximately 8 :40 p.m. to an adjourned meeting on June 21, 1982 at 7:00 p.m. and all were invited to stay for refreshments.
