December 27, 1977
The Council of the City of Rohnert Park met this date in
regular session commencing at 7:00 p.m. in the City Offices,
6750 Commerce Boulevard, Rohnert Park, with Mayor Beary
,presiding.
Call to Order Mayor Beary called the meeting of the regular session to
order at approximately 7:03 p.m. and led the pledge of
allegiance.
Roll Call
Present: (3) Councilman Eck, Hollingsworth, and Beary
Late: (1) Councilman :Roberts (his time of arrival is
specifically noted in these minutes)
Absent: (1) Councilman Hopkins
Staff present for all or part of the meeting: City Manager
Callinan, City Attorney Flitner (his time of arrival is
specifically noted in these minutes), Planning Director
Skanchy and Administrative Assistant Stanton
Approval of Minutes Upon motion of Councilman Hollingsworth, seconded by Council-
man Eck, and unanimously approved, the minutes of December
12 were approved as submitted.
Approval of Bills Upon motion of Councilman Eck, seconded by Councilman Hollings,
worth, and unanimously approved, the bills presented per
the attached list in the amount of $219,833.98 were approved
as submitted. Said total includes $6,475 for the Rohnert
Park Civic Commission.
Adding Councilman Eck requested that time be allotted under "Matters
gon- Agenda,:�d Items from Councilmen" concerning the proposed Foothills Subdivision
File No. 0577 - City Manager Callinan informed of Mr. Charles Kitchen's
Boise Cascade Use Permit appeal of the Planning Commission approval of Boise Cascade
App lication - APPEAL Corporation's application for a use permit for a retail/
wholeoale.lumber, electrical, plumbing supplies and equipment
facility in the 11MLt1 District located on Commerce Boulevard,
approximately 400 feet north of Transport Avenue.
City Manager Callinan City Manager Callinan left the Council Chambers at this

Planning Director Skan.chy described the site plan and eleva-
tions, which were displayed, reviewed his planning staff
report dated December 2, 1977 and subsequent supplement
to same, and the Planning Commission's approval, of the
use permit and architectural review.

Councilman Roberts and City Attorney Flitner arrived at
this point in.the meeting, the time being approximately
7 :10 p.m.
A. wide ranging discussion followed between Council members,
City Manager Callinan and Planning Director Skanchy concern -
ing the proposed 'retail /wholesale lumber yard and its proximity
to residences on ;dexter Circle and the Zoning Code designatioT
of a lumber yard as a conditional use in the "ML" District.
City Manager Callinan reviewed his December 21st memo to
the City Council concerning Boise Cascade Corporation s
use permit application and appeal by Mr. Charles Kitchen.
Discussion resumed concerning the loudness of noise emitted
by the cutting operations of the proposed facility as well
as that of Cal Wood Door and enforcing the City's noise
regulations contained in the Zoning Code.
Mr. Charles Kitchen, 5764 Dexter Circle, was recognized
and presented to Mayor Beary a petition, signed by numerous
residents along Dexter Circle and Doris Drive, and a letter
dated December 27, 1977 from Mr. and Mrs. Val Sabuco, 5750
Dexter Circle (copies of which are attached to the original
set of these minutes).
Mr. Kitchen, with the Mayor's consent, questioned Mr McPhee
of Boise Cascade Corporation concerning anticipated ratio
between retail /wholesale sales, future site expansion,
and anticipated use of adjacent property.
Mr. Kitchen compared the proposed retail /wholesale lumber
facility to the Yeager and Kirk operation in Santa Rosa,
commented on the construction and use of a railway spur,
opioned that the distance between the proposed facility
and nearby residences was less than 1500 feet, commented
on designated uses contained in the City's General Plan
and the Cal Wood Door operation.
Discussion followed between Council members and Mr. Kitchen
concerning noise associated with the operation of a railway
spur, excessive noise and sawdust emitted by Cal-Wood Door
and prevailing northwest winds effecting same.
City Manager Callinan recommended that the City Council
uphold the Planning Commission's approval of the use permit
application of Boise Cascade but with the added condition
that prior to issuance of a building permit for construction
of the spur track, that the City receive written assurance
from Boise Cascade and Northwestern Pacific Railroad that
there will be no loading, unloading, switching, or siding
of cars to or from the main track to the spur track except
during the hours of 6000 a.m. to 8s00 p.m. Discussion,followe
concerning pollutants emitted by Cal Wood Door.

Mrs. Virgina Bell, 5233 Daniel Court, was recognized and
questioned the validity of whether or not the community
needed the type of facility proposed by Boise Cascade explain-
ing that lumber and related supplies could be purchased
.either: in nearby Cotati, Petaluma or Santa Rosa. Mrs.
Bell generally commented on the the "ML" District and its
effect on future single single family development. Mrs.
Bell also explained that recently some overnight guests
commented on the foul odor in the air.
Mr. Dan McPhee, General Manager for Boise Cascade Corporation's
Building Materials and Operations, was recognized and explained
that his firm was mindful of the concerns expressed by
residents. lie generally commented, on limited cutting opera -
tions, describing the cutting area, equipment used and
noise associated with same, switching of cars /trains, antici-
pated number of railway cars to be used per year and suggested,
that approval and utilization of the railroad spur track
be withheld until an agreement is reached between Boise
Cascade and the City.
A wide ranging discussion followed between City Council
members, Mr. McPhee, City Manager Callinan and Planning
Director Skanchy concerning the amount of noise associated
with the operation of a retail /wholesale lumber facility,
traffic generated by same, General Plan land use designations,
height of storage, storage sheds, planting trees along
the railroad tracks, trucking operations, number of employees.
sales tax and property tax revenues, and possibility of
locating the facility in the City's "MG" District on the
west side of South Santa Rosa Avenue.
Mr. Virigina Bell was recognized and asked if a survey
had been prepared to determine the potential market for
a retail /wholesale lumber facility. She expressed concern
that if the Boise Cascade application was approved for
the a'ML" District that other heavy industrial uses would
develop in the area.
Mr. McPhee informed that a study had been prepared for
the Boise Cascade Corporation which showed there was a
substantial market for the proposed lumber facility.
City Manager Callinan informed that both the letter from
Mr. and Mrs. Val Sabuco and petitions signed by numerous
residents objected to the proposed application of Boise
Cascade.
Mr. Nicolary, 5757 Dexter Circle, was recognized and informed
that he lives behind the Cal Wood Door factory, that when
the. prevailing wind blows towards his home the noise emitted
by the factory is as loud as at the point of origin. He
expressed his opinion that the noise generated by the proposed
lumber facility would be similar unless the structure was
completely enclosed.

Mrs. Nicolary,,5757 Dexter Circle, was recognized and informed
that a decible reading of 40 had been recorded when the
Cal Wood Door blowers were initially turned on and that
no one could sit in her backyard, let alone entertain there,
while the blowers were in operation. She also informed
that the decible reading had been taken by the Cal Wood
Door night supervisor and that presently a determination
is being made how much dust is generated by the factory.
Discussion followed concerning mitigating the noise generated
by the proposed lumber facility cutting operations by enclos-
ing the structure and its dust collection system.
Councilman Eck made a motion, which was seconded by Councilman
Roberts, to deny the use permit application of Boise Cascade
Corporation for a retail/wholesale lumber facility to be
located on Commerce Boulevard until such time as the
firm gives the City a clear indication of what the noise
levels will be and until Boise Cascade indicates how they
will comply with Condition No. 7 of the planning staff
report. Discussion followed.
Councilman Eck's motion was approved by the following roll
call vote:

File No. 0579 - City Manager Callinan reviewed his December 21st memo to
;lames Groom, Site Plan the Council concerning James Groom's appeal of Planning
and Architectural Commission denial of site plan and architectural review
Review of Warehouse- for a proposed 6,000 square foot warehouse building in
APP A'11 the 11MG11 District located on east side of South Santa Rosa
Avenue, west of U.S. 101, adjacent to Gates Acoustinet.
Planning Director Skanchy described the site plan and eleva-
tions, which were displayed, and reviewed his planning
staff report dated December 2nd.
City Attorney Flitner City Attorney Flitner left at this point in the meeting,
Leaves the time being approximately 8:37 p.m.
City Manager Callinan informed that staff recom-r,.iended that
Mr. Groomis appeal be denied based on the structure's appear
ance and setback and noted that the Planning Commission
denied subject application on December 8, 1977.
Mr. James Groom was recognized and generally commented
on landscaping surrounding the proposed structure, noting
that the proposed use and zoning were in conformance with
the General Plan; that no noise, odor, etc. would be
associated with same, and commented on the aesthetics of
the proposed structure. He opioned that the suggested
40 font setback from South Santa Rosa Avenue, contained
in the planning staff report, wasn't a reasonable condition
of approval. Discussion followed between City Council
members., staff and Mr. Groom.

City Attorney Flitner City Attorney Flitner returned at this point in the meeting,
Returns the time being approximately 8:45 p.m.
Councilman Eck made a motion that the appeal /applicarion
of Mr. James Groom for a warehouse on South Santa Rosa
Avenue be continued until the next regular Council meeting.
Said motion died for lack of a second.
Discussion continued during which the Council memebers
indicated their concern with the aesthetics of the proposed
building.
Upon motion of Councilman Eck, seconded by Mayor Peary
and unanimously approved by a roll call vote, the City
Council denied, without prejudice, the appeal of Mr. James
Groom of the Planning Commission's denial of site plan
and architectural review' for a warehouse to be located
on South Santa Rosa Avenue.
Councilman Hollings- Councilman Hollingsworth left the Council Chambers at this

Nursery Stock Mr. Peter D. Bailey, 7491 Adrian Drive, was recognized
and inquired about the nursery stock acquired from Firestone
Nursery in Paradise.
City Manager Callinan explained that most of the stock
had•been planted and generally commented on the possibility
of selling some of the surplus stock to residents.
Architecturai/Deisgn Mr. Jim Redding, 7147 Barbi Lane was recognized and generally
Review commented on providing for more landscaping, larger setbacks
and better designed structures along South Santa Rosa Avenue.
Mr. Redding, responding to a question from City Manager
Callinan, explained that his firm hoped to attract office/
warehouse structures for the °4ML" District located east
of Commerce Boulevard, north of Hinebaugh Creek and west
of the Northwestern Pacific Railroad tracks, and reflected
on the undesirable aspects of having spur railroad tracks
and also the basis for establishing the 70 decible limit
contained in the Zoning Code.
Discussion followed during which City Attorney Flitner
was directed to draft a proposed amendment to the zoning
regulations section of the Municipal Code to regulate installa
tion of spur railroad tracks within the City.
Cal Wood Door City Manager Callinan informed that the various complaints
and /or alleged violations by Cal Wood Door would be investi-
gated by staff.
City Space deeds City Manager Callinan initiated a discussion concerning
the future space needs for the City's administrative offices
and /or future civic center site. Discussion followed.

Mayor Beary declared a recess at this point in the meeting,
the time being approximately 9 :20 p.m.
Reconvene
Mayor Beary reconvened the meeting at approximately 9 :25
p.m.
City Offices
City Manager Callinan explained that because of increased

growth and activity in the community, staff recommended
that the present telephone system be expanded by acquiring
G.C.E. equipment as described in Asst. to the City Manager
Albright and Administrative Assistant Stanton's memo dated
December 21, 1977 to City manager Callinan.
Upon motion of Mayor Beary, seconded by Councilman Eck,
and unanimously approved, the. City Council authorized the
installation of:G,C.E. telephone equipment in the City
Offices.
Communications
Communications per the attached outline were brought to
the attention of the City Council. No action was taken
on any communications unless specifically noted in these
minutes. -
Cotati Building
City Manager Callinan informed that the City's part -time
Inspector
building; inspector, Ed De Long, had been recommended to
the City of Cotati for employment as its Building Inspector
Expressway Widening
City Manager Callinan informed that City staff members
had meet with Sonoma County Public Works Director Don Head
and Asst. Director of Public Viorks John Morelli concerning;
the widening of Rohnert Park Expressway between Commerce
Boulevard and Snyder Lane,
Resolution No. 77 --204
RESOLUTION SETTING RATES FOR PLAY AT ROHNERT PARK MUNICIPAL
GOLF COURSE
City Manager Callinan explained the amount of anticipated
revenue to be derived from the increased golf course rates,
informed that he had a meeting with Golf Professional Bill
Ross concerning compensation, and explained the proposed
resolution which supersedes Resolution No. 77-201 adopted
by the City Council on December 12, 1977®
Upon motion of Councilman Roberts, seconded by Councilman
Hollingsworth, and unanimously approved, the reading of
Resolution No. 77 --204 was waived and said resolution was
adopted.
Management Employees
City Manager Callinan reviewed his December 22, 1977 memo
Pay Rates
to the City Council concerning pay rate changes for certain
management personnel and fringe benefits provided in various
other cities. Discussion followed.
Councilman Eck made a motion, which was seconded by Council- -
man Roberts, to defer consideration of the recommended
pay rate adjustments for management personnel until the
1978 -79 budget sessions. Said motion failed by the following

Mayor Beary made a motion, which was seconded by Councilman
Hollingsworth, to waive the reading of Resolution No. 77 --
205 and adopt same. Said motion failed by the following
roll call vote:

Discussion followed.
Upon motion of Councilman Roberts, seconded by Mayor Beary,

Water Wells Update City Manager Callinan disseminated copies of Director of
Public Vlorks /City Engineer Brust's December 27th memorandum
regarding the progress in developing Well Nos. 14, 15 and 16,
Temporary Clerk City Manager Callinan solicited the Council's reaction
Dispatcher to hiring Chuck Raye, a clerk dispatcher of the volunteer
police auxiliary,who is presently on disability due to
an on the job injury and who could be be trained as a clerk
dispatcher as part of his rehabilitation with the costs
for same being covered by an insurance firm. Discussion
followed.
Upon motion of Mayor Beary, seconded by Councilman Roberts,
and unanimously approved, the City Council authorized the
hiring of Chuck Raye to be trained as a clerk dispatcher
as outlined by City Manager Callinan.
Election-Consolidating City Manager Callinan requested that the Council authorize
Precincts the Sonoma County Election Department to consolidate precincts
for the March 1978 elec Lion.,

Foothills Subdivision
Councilman Eck initiated a discussion concerning Debra
Homes' proposed Foothills Subdivision.
Upon motion of Councilman Eck, seconded by Councilman Roberts
and unanimously approved, the City Council called up for
its review Debra Homes' application for rezoning, precise
development.plan, tentative map, and architectural review
for the Foothills Subdivision (File No. 0578).
Illegal Signs- Councilman Roberts noted that Albertson's displayed a banner
Albertsons type sign which is prohibited by the zoning code. City
Manager Callinan indicated he would take care of the matter.
Golf Course/Northwestern Upon motion of Councilman Hollingsworth, seconded by Council-
Pacific Railroad Tracks man Roberts, and unanimously approved, the City Council
authorized that a tree planting program be initiated along
the east side of the Northwestern Pacific Railroad tracks
in order to screen the industrial area from the golf course
end nearby residences.

Upon motion of Councilman Roberts, seconded by Councilman
Eck, and unanimously approved, the City Council authorized
the Sonoma County Election Department to consolidate precincts
for the March 7, 1978 General Municipal election as it
deemed necessary.
Northern Public Safety
City Manager Callinan informed that a gasoline pump had

and that the City would seek restitution for damages from
the juveniles' parents. lie requested Council authorization
to have security chain link fencing installed at the facility.
Discussion followed. .
The Council authorized the installation of chain link fencing
at the Northern Public Safety Facility.

City Manager Callinan disseminated copies of a letter from
C & L Enterprises
C & L Enterprises, dated December 23, 1977, concerning
Apartment Complex
drainage improvements installed at its apartment project
on East Cotati Avenue.
Discussion followed during which the Council authorized
staff to work out an agreement with C & L Enterprises to
solve the drainage problem and stipulated that same would
be presented for Council consideration at its next meeting.
Wastewater Treatment
City Manager Callinan informed that the City of Rohnert
of the Technical Advisory Committee
park had called a meeting
concerning the completion of the Llano sub-regional wastewater
treatment plant and the possibility of having the cease
and desist order lifted because of increased flow in the
Russian River.
Cat Case-

City Attorney Flitner requested that the city Council hold

house" case, i.e. the Anderson case.

Clint Mosher City Manager Callinan informed that long-time resident
Clint Mosher had suffered a stroke and was convalescing
in the Oakland Kaiser Hospital.
Eugene Williams City Manager Callinan informed that Sonoma County Clerk
and Registrar of Voters Eugene Williams had passed away.
The Council indicated that and card and/or flowers should
be sent to Mr. William's family.
Executive Session Mayor Beary adjourned the meeting at approxmately 10:15
p.m. to anexecutive session with all Councilmen, except
Councilman Hopkins, City Manager Callinan and City Attorney
Flitner present and which was held to discuss a litigation
matter, i.e. the Anderson cat case.
Adjournment Upon conclusion of the executive session, there being no
further business, Mayor Beary adjourned the meeting in
memory of Eugene Williams at approximately 10:23 p.m.
