ROHNERT PART: CITY COUNCIL MINUTES January 9, 1978 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Vice - -Mayor Hopkins presiding. Vice -Mayor Hopkins called the meeting of the regular session to order at approximately 7:02 p.m. and led the pledge of allegiance. Present: (3) Councilmen Eck, Hollingsworth and Hopkins Late: (2) Councilmen Roberts and Beary (whose time of arrival is specifically noted in these minutes) Absent: (0) None Staff present for all or part of the meeting: City Manager Callinan (his time of arrival is specifically noted in these minutes), City Attorney Flitner, Planning Director Skanchy and Director of Public C•Torks /City Engineer Brust. Appr-oval of Minutes Upon motion of Councilman Hollingsworth, seconded by Council - man Eck, and unanimously approved, the minutes of December 27, 1977 were approved as submitted. Approval of Bills Upon motion of Councilman Eck, seconded by Councilman Hollings -, worth, and unanimously approved, the bills presented per the attached List in the amount of $425,183.34 were approved as submitted. Rl; solution No. 78 -01 RESOLUTION OF THE ROHNERT PARK CITY COUNCIL REJECTING THE CLAIM OF CARL J. ANDERSON Upon motion of Councilman Ec':, seconded by Councilman Hollinp- worth, and unanimously approved, reading of Resolution No. 78 -01 was waived and said resolution was adopted. Resolution No. 78-02 RESOLUTION CALLING FOR SEALED PROPOSALS (Benecia Park Parking Lot, Project No. 1977-16) Upon motion of Councilman Hollingsworth, seconded by Council - man Eck, and unanimously approved, reading of Resolution No. 78 -02 was waived and said resolution was adopted. Ordinance No. 344 Vice -Mayor Hopkins indicated that consideration of Ordinance No. 344 concerning Capital Outlay Fund Fees would be deferred until later in the meeting. Councilman Ro erts Councilman Roberts arrived at this point in the meeting, Arrives the time being approximately 7:05 p.m. Youth Employment Yv. Roy Logsdon, Rancho Cotate High School E cvk Experience progs.ara 137^ Coordinator, was recognized and referring to his letter dated December 5, 1977 addressed the City Council concerning: the 1'~•,78 Summer Youth Employment- Program, student placement, .Hnancial assistance and noted that the 1978 program costs had been reduced. Page 2 January 9, 1978 Upon motion of Councilman Eck, seconded by Councilman Hollings- worth, and unani-mously approved, the Council approved a contribtuion of $600.00,towards the 1978 Summer Youth Employ- Program. New Golf Course Name Discussion was held regarding Mountain Shadows name of new golf course. Upoh,motion of Councilman Hollingsworth, seconded by Council- man Eck, and unanimously approved, the City Council agreed not to change the Mountain Shadows name of the new golf course because of the hardship such action would place on the developer in relationship to the expenditures made in connection with advertising the course. Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken on any communications unless specifically noted in these minutes. James (.':')ilfether­ Upon motion of Councilman.Eck, seconded by Councilman Hollings- Resigration from Parks worth, and unanimously approved, the City Council requested & Fecreation Commission that a Certificate of Appreciation be forwarded to James Gilfether who had resigned from the Parks and Recreation Commission. Parks & Recreation Councilman Eck, referring to item No. 15 of the communication: Depart-ment outline, requested that the record show the Council's appreciF. Lion for the Parks and Recreation Department's efforts with respect to the cooperative use/supervision of the Sonoma State College gym facilities on Thursday night. Mayor Beary and Mayor Beary and City Manager Callinan arrived at this point City Manager Callinan in the meeting, the time being approximately 7:21 p.m. AT-rive Mayor Beary assumed chairing of -the meeting. Ordinance No. 34LN AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING 0 1 OF ORDINANCE 322 (1977) AS IT AMENDED 9 1 OF ORDINANCE 190 (1971) AS AM1,NDED ALSO KNOWN AS SECTION 15.40.020 OF CHAPTER 15.40 OF THE ROH14ERT PARK MUNICIPAL CODE (Construction Fees) City Manager Callinan explained the ordinance. Upon motion of Councilman Eck, seconded by Councilman Roberts, and unanimously approved, reading of Ordinance No. 344 was waived and said ordinance was introduced. File No. 0578 - Debra Councilman Eck suggested that consideration of Debra Homes's Homes, Foothills Sub- application for rezoning, precise dclielopment plan, tentative division ma for the proposed Foothills p, and architectural review � Subdivision be Oeferred until 7:30 p.m. as scheduled on the agenda. Resolution No. 78 -03 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING AN AGREEMENT WITH C & L ENTERPRISES (The Park Club, Planning File No. 0494) Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and approved by the following voice vote, reading of Resolution No. 78 -03 was waived and said resolution was approved. Mayor Beary stated for the record that he was doing some sub- contracting work for C & L Enterprises and, therefore, would abstain from voting on the matter. AYES: (4) Councilmen Eck, Hollingsworth, Hopkins and Roberts NOES: (0) None ABSTAIN: (1) Mayor Beary Resolution No. 78 -04 RESOLUTION ACCEPTING EASEMENT DEED (Drainage Easement though THE PARK CLUB) Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and approved by the following voice vote, reading of Resolution No. 78 -04 was waived and said resolution was adopted. AYES: (4) Councilmen Eck, Hollingsworth, Hopkins and Roberts NOES: (0) done ABSTAIN: (1) Mayor Beary File No. 0578 - City Manager Callinan informed of Debra Homes's application Debra Homes, Foothills for zoning change, precise development plan, tentative map Subdivision and architectural review for a proposed single family sub - division to be.located on.the southeast corner of Rohnert Park Expressway and Snyder Lane. He informed -that the Plan- ning Commission recommended approval of the proposed project, and that copies of all communications had been distributed to Council members. Planning Director Skanchy reviewed his planning staff reports, and described the.plan and tentative map and elevations which were all displayed. Mayor Beary declared the public hearing open to consider Debra Homes' application for rezoning and precise development plan review for the 137 single family lots Foothills Sub- division located on the southeast corner of Rohnert Park Expressway. and Snyder Lane. Page 4 January 9, 1978 City Manager Callinan read the fol.lowing coimunicat ions: 1. Postcard from Elaine Trowbridge expressing opposition to the proposed project 2. Letter from Nore Thiesfeld, Sonoma State College, dated January 9, 1978, expressing opposition to the proposed project 3. Letter from Cotati-Rohnert Park Unified School District, dated January 6, 1978, concerning school district boundaries Mr. Mary S)oiland, Chairmman of the Long-Range Planning Committee for Cross and Crown Lutheran Church located on Snyder Lane, was recognized and generally commented on development in the area of the church and the proposed project's "down-zoning". Mr. Soiland, speaking on behalf of the congreation, went on record as being in favor of the proposed project. Mary Stewart ! 578 Lorraine Court, was recognized and inquired if the Council was considering.45, 50 or 60 foot wide lots for the proposed single family subdivision. City Manager Callinan informed that the Planning Commission had approved 45 foot wide lots for the proposed development that was before the City Council for its consideration. Mrs. Stewart expressed that she would like to have the Caincil be thoughtful in'its consideration of the lot coverage in relationship to approving either 4500, 5000, or 6000 square foot lots and explained that she would like to feel free to comment after having heard staff's recommendation concern- ing same. City Manager Callinan explained that staff recommended a lot width of 60--65 feet and that the Planning Commission had approved 45 foot wide lots. There being no one further desiring to be heard, Mayor Beary closed the public hearing. Art Condiotti, President of Debra Homes, was recognized and commented that the planning staff report had fully covered the proposed development and offered to answer any questions. Discussion followed concerning Camille Enterprises' (File No. 0199A) development plan for a high density multiple far,iily project for the subject property. Ordinance No. 344 AN 0RDITWTCE OF THE CITY OF ROHNERT PARK AMENDING TITLE 1.7 OF THE ROHNERT PARK MUNICIPAL CODE (Zoning Map Change, 1% P. No. 143-330-13) Page 5 January 9, 1978 Councilman Hollingsworth made a motion, which was seconded by Councilman Hopkins, to waive the reading of Ordinance No. 345 and introduce said ordinance. Councilman Eck made a moti.on,to table the motion to introduce Ordinance No. 345 until the proposed project's lot size had been discussed further. Said motion died for lack of -a second. Mayor Beary stated for the record that he was doing some sub-contracting work for Debra Homes and, therefore, would abstain from voting on the matter. Councilman Eck asked City Attorney Flitner if Mayor Beary could still chair the discussion even though he was abstaining because of a conflict. Mayor Beary indicated he thought he had a possible conflict. City Attorney Flitner opioned that Mayor Beary could still chair the discussion and action. Discussion followed during which, in view of the letter from Sonoma State College and at Councilman Hopkins request, City Attorney Flitner ruled that Councilman Eck had no conflict of interest in voting on the proposed development even though he is a Sonoma State College employee. Councilman Hollingsworth's original motion to waive the reading and introduce Ordinance No. 345 was approved by the following roll. call vote: AYES: (3) Councilmen Hollingsworth, Hopkins and Roberts NOES: (1) Councilman Eck ABSTAIN: (1) Mayor Beary Councilman Eck made a motion to approve Debra Homest precise development plan for the Foothills Subdivision (File No. 0578) with 6000 square foot lo's subject to those conditions contained in the planning staff reports dated December 16 and 22. Mr. Condiotti was recognized and informed that the houses shown on the site plan were not drawn to scale rand, therefore, could be 35-36 feet in width. Discussion followed between City Council members, City Manager Callinan and Planning Director Skanchy concerning pedestrian and bicycle paths/open space and maintenance and vandalism associated with same. Councilman Eck's motion died for lack of a second. Councilman Hopkins made a motion, which was seconded by Councilman Roberts, to approve Debra 'Homes' precise develop- ment plan for the Foothills Subdivision (File No. 0578), as recominended by the Planning Commission and subject to those conditions contained in the planning staff reports dated December 16 and 22. Page 6 January 9, 1978 Discussion followed concerning ingress/egress at the develop- ments' easterly intersection with Rohnert Park Expressway, lot size width, pedestrian and bicycle path, and allotment under the City's growth management program. Councilman Hopkins' motion to approve Debra Homes' precise development plan for the Foothills.Subdivision (File No. .0578) was approved by the following roll call vote: AYES: (3) Councilmen Hollingsworth, Hopkins and Roberts NOES: (1; Councilman Eck ABSTAIN: (1) Mayor Beary Planning Director Skanchv explained the tentative map for subject subdivision. Upon motion of Councilman Hopkins, seconded by Councilman Hollingsworth, an-1 approved by the.following roll call vote, Debra Homes' tentative map for the Foothills Subdivision (File No. 0578) was approved as approved by the Planning Commission subject -to those conditions' contained in the planning staff reports dated December 16 and 22. Discussion followed concering provision for 5/811 siding and during which Mr. Condiotti commented on same. Councilman Hollingsworth sec)nded Councilman Hopkins' motion to approve Debra Homes' application for architectural review with the added condition that the developer. provide 5/811 siding throughout the subdivision. Councilman Hopkins accepted the additional condition as a friendly amendment. Councilman Hopkins' motion, as amended, to approve Debra Homes' application for architectural review for the Foothills Subdivision as approved by the Planning Commission with conditions in the planning staff report and the added condit:b. requiring 5/811 siding was approved by the following roll call vote: AYES: (3).Councilmen Hollingsworth, Hopkins, and Roberts NOES: (1) Councilman Eck ABSTAIN: (1) Mayor Beary counciaman Hom.ings- Councilman Hollingsworth left the Council Chambers at this worth Leaves ?point in the meeting, the time being approximately 8:30 ' p.m. Page 7 January 9, 1978 New Golf Course Name Mayor Beary initiated a discussion. concerning the identity problems associated with naming of the new golf course and its close proximity to the existing municipal course. Dis- cussion followed. Councilman Hollings- Councilman Hollingsworth returned to the Council Chambers worth Returns at this point in the meeting, the time being approximately 8:31 p.m. The City Council agreed that the naming of the new golf course should le referred to the golf course committee for its consideration and input solicited from the golf pro and developer prior to coming back to the Council for its consideration. City Manager's Report City Manager Callinan, referring to his January 5, 1977 memo, reviewed 1) unemployment insurance, and 2) March municipal election. City Manager Callinan distributed, copies of the 1976-77 Financial Reports (audit report) for the City of Rohnert Park, Rohnert Park Civic Commission and General Revenue Sharing Funds prepared by Pisenti and Brinker CPA's. City Manager Callg.nan invited comments from the Council concerning his annual performance review. A brief discussions followed. C-4•-Y Attorney's Report City Attorney Flitner briefly commented on the Anderson "cat house" case and preparation of a ordinance relating to spur railroad tracks. Mayors, and C_)Lricilmenls City Manager Callinan polled the Council as to which of Assn. Meeting its members would be attending the January 12th Mayors' and Councilmen's Association meeting. Mayor Beary and Councilmen Hopkins and Roberts indicated they would attend. Drainage-Rancho Sonoma Councilman Roberts inquired about a resident who he had referred to the City Offices concerning foundation flooding in his home on San Francisco Court. City Manager Callinan advised that City Engineer Brust and Building Inspector Logue had inspected the home and were following up on the matter. Street Lights, Councilman Roberts advised that the street light fixture was missing from a pole at the intersection of Santa Dorotea Circle and Davis Circle. Discussion followed, with Mr. Ralph Fitch of P.G. & E. participating, during which City Engineer Brust informed that the subject light fixture had been removed because it wasn't working properly. Virginia Bell re. Mrs. Virginia Bell, 5233 Daniel Court, was recognized and CounciIii-,an Eck expressed appreciation for the fine job/attitude of Councilman Eck while serving an the Council and that she was sorry he would not be a candidate for re-election.
