1978/02/14 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES February 14, 1978 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Beary presiding. Call to Order Mayor Beary called the meeting to order at approximately 7:00 p.m. and led the pledge of allegiance. Roll Call Present: (5) Councilmen Eck, Hollingsworth, Hopkins, Roberts, and Beary Absent: (0) None Staff present for all or part of the meeting: Asst. to the City Manager Albright, City Attorney Flitner, Director. of Public Works /City Engineer Brust and Finance Director Charbonneau. Approval of Minutes Upon motion of Councilman Hopkins, seconded by Councilman Eck, with Councilmen Beary and Hollingsworth abstaining, and un- animously approved, the minutes of January 23, 1978 were approved as submitted. Approval of Bills Councilman Hopkins made a motion, which was seconded by Councilman Eck, that the bills presented per the attached list be approved as submitted. Discussion followed concern- ing supplies /materials purchased from firms outside the city limits. Councilman Hopkins amended his motion to approve the bills and direct staff to research purchasing supplies /materials in Rohnert Park based on competitive prices. Councilman Eck indicated he would accept same as a friendly amendment to the motion. s� The motion to approve the bills, as amended, was unanimously approved. CITY i OFFICES TELEPHONE EQUIPMENT Resolution No. 78-19 RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK CONSENT - ING TO THE SUBSTITUTION OF ROHNERT PARK DISPOSAL OOMPA NC N'Y , T FOR REDWOOD EMPIRE DISPOSAL CORPORATION IN GARBAGE COLLECTION AGREEMENT Upon motion of Councilman Eck, seconded by Councilman Roberts, and unanimously approved, the reading.of Resolution Nos. 78-15 through 7,8-19, as listed on the Consent Calendar section of the meeting's agenda, was waived and said resolutions were adopted. Ordinance No. 345 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING TITLE 17 OF THE ROHNERT PARK MUNICIPAL CODE (Zoning Map Change, A. P. No. 143-330-13) Upon motion of Councilman Eck, seconded by Councilman Hopkins, and unanimously approved, reading of Ordinance No. 345 was waived. Mayor Beary stated that due -to a possible conflict of interest he would abstain from voting on the matter. Upon motion of Councilman Hollingsworth, seconded by Councilman Hopkins, and approved by the following roll call vote, Ordinance No. 345 was adopted. AYES: (3) Councilmen Holl-ingsworth, Hopkins and Roberts NOES: (1) Councilman Eck ABSTAIN: (1) Mayor Beary Rancho Cotate High Mr. Anthony Carbone, 7169 Barbi Lane, was recognized and com- School Stadium Lights mented on previous requests for the installation of lights at the Rancho Cotate High School Stadium. Mrs. Bernice Soldavini, 536 Baron Drive, was recognized and read a letter, a copy of which is attached to the original set of these minutes, from the Rancho Cotate High School Boosters Club endorsing and urging installation of high school stadium lights. Page 3 February 14, 1978 Mr. Carbone was again recognized and informed that the Cotati- Rohnert Park Unified School Board of Trustees had, by a motion duly made and adopted, directed its administration to work out an agreement with the City to initiate the installation of said lights. Mr. Tony Carbone, Jr., 7169 Barbi Lane, and Mr. Dave Guttig, 7225 Circle Drive, were recognized and presented a copy of a petition signed by 1,086 students of Rancho Cotate High School expressing their desire that "Stadium Fund" monies be used for the installation of stadium lights at the Rancho Cotate High School field. Mr. Carbone was again recognized and commented that he hoped installation of the stadium lights could proceed in light of the above presentations. Mr. Bob DeWan, 7517 Beverly Drive, was recognized and offered to acquire the services of a lighting engineer to prepare the layout for the stadium lights, suggested that the City pur- chase the materials and supplies and solicit bids for labor in installing the fixtures. Mayor Beary expressed the Council's appreciation to those individuals having spoke concerning the high school stadium lights. Ordinance Re. Playing City Attorney Flitner explained a proposed ordinance prohibit- on Streets ing playing ball or riding skateboards on city streets. Dis- cussion followed. Upon motion of Councilman Eck, seconded by Councilman Hollingsworth, and unanimously approved, the City Council did not introduce the proposed ordinance. Project No. 1977 -16, Asst. to the City Manager Albright advised that, in accordance Benecia.Park Parking with the State's request, the review of bids and award of Lot contract for the Benecia Park parking lot project should be deferred to the Council's February 27th meeting. Upon motion of Councilman Hopkins, seconded by Councilman Eck, and. unanimously approved, consideration of Project No. 1977-16, Benecia Park parking lot, was deferred to the February 27th Council meeting. Parks and Recreation Asst. to the City Manager Albright, referring to City Manager Commission Apt. Callinan's February 10th memo, informed that copies of all the "fact sheets" submitted by individuals interested in being appointed to the Parks and Recreation Commission had previously been supplied to each Council member. Mayor Beary opened the public hearing concerning an appoint- ment to the Parks and Recreation Commission to fill the vacancy created with the resignation of Mr. James Gilfether. Page 4 February 14, 1978 Councilman Hopkins made a motion to close the public hearing6 Councilman Eck seconded the motion. Discussion followed during which Mayor Beary indicated that he would like an opportunity to question each of the applicants. Councilman Eck withdrew his second. The motion died for lack of a second.. Mayor Beary inquired if Mr. Peter L. Brotsch was present in the audience. No one responded. Mr. William Jacobi, 7653 Burton Avenue, was recognized and responding to Mayor Beary, expressed his opinion that the City had one of the finest, recreation programs available -to the youth and adults of the community, that as a Parks and Recreation Commissioner he would pursue improvements and expansion to the baseball fields and swimming facilities. Mr. Jacobi expressed his desire to continue to work with the youth of Rohnert Park. Mr. Alan Kostelnik, 5774 Dexter Circle, was recognized and responding to Mayor Beary, praised the present recreation activities program and expressed his desire to take part in the planning and development of recreation programs, commenting that there were areas of the program that could be improved. Mr. Donald Lehnhoff, 839 Lancewood Court, was recognized and responding to Mayor Beary, expressed that, in his opinion, everything was progressing well relative to recreation programs and that he desired to help with the planning of same,, Mr. James Henley, 1051 Golf Course Drive, was recognized and l responding to Mayor Beary, expressed his opinion that Rohnert Park doesn't take a back seat to anyone insofar as recreation programs and facilities are concerned,, noted that the neighborhood parks were being improved and congratulated both the Planning and Parks and Recreation Commission for community park planning and development. He commented on the develop- ment of the community and recreation center, analysis of the existing program of community activities, endorsed the concept of developing a "nature park" on the Rapoza property, expanded bicycle/pedestrian paths, cross country jogging circuit, installation of picnic tables, etc. Mr. Henley informed that he would like more areas set aside in Rohnert Park especially for jogging. Mayor Beary inquired if Messrs. George Geister and Dennis Sturdevant were present in the audience. No one responded. Mayor Beary closed the public hearing. Councilman Eck made a motion, which was seconded by Council- man Roberts, to appoint Mr. James Henley to the Parks and Recreation Commission to fill the vacancy createdbj the resignation of Mr. James Gilfether. Said motion failed by the following roll call vote: Page 5 February 14, 1978 AYES: (2) Councilmen Eck and Roberts NOES: (3) Councilmen Hollingsworth, Hopkins and Beary Upon motion of Councilman Hollingsworth, seconded by Council - man Hopkins, and unanimously approved by ,a roll call vote, Mr. William Jacobi was appointed to the Parks..and Recreation Commission to fill the vacancy created by the resignation of Mr. James Gilfether. Mr. Jacobi was recognized and expressed his appreciation at being able to serve on the Parks and Recreation Commission. Resolution No. 78 -20 RESOLUTION DESIGNATING, AUTHORIZING AND APPROVING INSTALLATION OF STOP SIGN Director of Public Works /City Engineer Brust reviewed his January 5, 1978 memo report concerning the Southwest and Commerce Boulevard intersection and various alternatives in trying to develop better channelization at subject inter- section. Mr. Brust informed that staff recommended the installation of a third stop sign, westbound on Southwest Boulevard. Discussion followed. Councilman Eck Leaves Councilman Eck left the Council Chambers at °this point in and Returns the meeting, the 'time being approximately 7:50 p.m. and returned at approximately 7:52 p.m. Upon motion of Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, Councilmen Hollingsworth and Hopkins were appointed to a committee in order to meet and confer with staff concerning better channelization of the Southwest /Commerce Boulevards intersection. Upon motion of Councilman Hollingsworth, seconded by Council- man Roberts, and unanimously approved, reading of Resolution No. 78 -20 was waived and said resolution was adopted. Virginia Bell Mayor Beary commented that Mrs. Bell would be unable to attend tonight °s meeting; because of a prior commitment, therefore, would appear at the February 27th meeting. Resolution No. 78-21 RESOLUTION RESCINDING RESOLUTION NO. 78 -09 AND CALLING FOR SEALED PROPOSALS (Rohnert Park Community and Recreation Center, Phase II, Project No. 1977 -14) Upon motion of Councilman Eck, seconded by Councilman Hollingsworth, and unanimously approved, reading of Resolu- tion No. 78--21 was waived and said resolution was adopted. File No. 0542 - Director of Public Works /City Engineer Brust described the Country Club Estates revised final map,which was displayed,.for Country Club Subdivision No. 8, Estates Subdivision No. 9, Unit B. Unit B, Revised Final Map Councilman Eck made a motion, which was seconded by Council- - man Hopkins, to approve the revised final map for Country Club Estates Subdivision'No. 8, Unit B, and authorized the Mayor to execute an appropriate subdivision agreement prior Page 6 February 14, 1978 to the map being released for recording with the understanding that in approving the final map the City is not guaranteeing sewer and w-,ter service. Mayor Beary, after speaking with City Attorney Flitner, advised that due to a possible conflict of interest he would abstain from voting on the matter. No action was taken on any communications except as specifically noted in these minutes. Unemployment Insurance Asst. to the City Manager Albright referred to City Manager Callinan's memo to the Council, dated February 9, 1978, concern. ing AB 644, Unemployment Insurance, and various options as to how the City desires to participate in said program. Discus- sion followed between City Council members with Finance Director Charbonneau participating, Mrs. Mary Stewart, 578 Lorraine Court, was recognized and questioned participation of public employees who are employed by tax supported organizations in the unemployment insurance program, Discussion followed between Council members and Mrs. Stewart concerning the National Municipal Institute of Law Officers' lawsuit challenging the federal mandate requiring public agencies to participate in the unemployment insurance program. Upon motion of Councilman Hollingsworth, seconded by Council- man Roberts, and unanimously approved, the City Council went on record as choosing alternate No. 4 "Local Public Entity Employees Fund", as described in City Manager Callinants February 9, 1978 memo. Wastewater Update Director of Public Works/City Engineer Brust generally commented on the City's request to have the Regional Water Quality Control Board consider lifting the cease and desist order against Rohnert Park, placing dams in the Laguna de Santa Rosa to hold treated wastewater and program whereby farmers and dairymen can use the treated wastewater for Page 7 February 14, 1978 irrigation purposes. Discussion followed concerning operation /maintenance cost of the irrigation system used during summer and fall 1977. Councilman Hollings -. Councilman Hollingsworth returned to the Council Chambers at worth Returns this point in the meeting, the time being approximately 8:20 p.m. Supervisorial Districts Asst. to the City Manager Albright reviewed City Manager Callinan's February loth memo to the Council concerning supervisorial districts and pointed out which areas of Rohnert Park are within the 2nd or 3rd districts (as shown on a map which was displayed). Discussion followed during which Council_ members requested that the legal ramifica:- tions relative to the new supervisorial districts and its effect on registered voters being able to vote for a Board of Supervisors representative be scheduled for discussion at the next Council meeting. Elementary Schools - Asst. to the City Manager Albright reviewed City Manager Site Plans and Archi- Callinan's February loth memo to the City Council pertaining tectural Renderings to site plans and architectural renderings for the proposed two new elementary schools which were recently reviewed by the Planning Commission. Public Safety Vehicles Asst. to the City Manager Albright reviewed City Manager Callinan's February 10th memo to the Council concerning public safety vehicles. Discussion followed. The Council authorized purchasing five vehicles for the Department of Public Safety as outlined in February 8th memo from Director of Public Safety Dennett. Well Nos. 15 & L6 Director of Public Works /City Engineer Brust, referring to City Manager Callinan's memo of February loth, generally commented on progress in'developing Well Nos. 15 and 16. Councilman Eck Leaves Councilman Eck left the Council Chambers at this point in and Returns the meeting, the time being approximately 8:32 p.m. and returned at approximately 8:34 p.m. Northern Public Safety Asst. to the City Manager Albright, referring to City Manager Building Dedication Callinan's memo of February 10th, commented on progress in planning the Northern Public Safety Building's dedication. Discussion followed. Benecia Park Amphi -- Asst. to the City Manager Albright reviewed City Manager theatre Callinan's February loth memo to the Council relative to the amphitheatre the Cultural Arts Groups would like to have developed behind the community center on Burton Avenue. Discussion followed during which the City Council indicated that it would hold a joint meeting with the President of the Cultural. Arts Group to discuss the matter further. City's New Information Asst. to -the City Manager Albright displayed the City's Envelope new information envelope especially designed to hold various information disseminated at the time residents sign -up for utility service. Page 8 February 14, 1978 Bingo Ordinance Mayor Beary initiated a discussion concerning introducing an ordinance that would allow non-profit civic organizations to hold bingo games. Discussion followed. Upon motion of Mayor Beary, seconded by Councilman Hopkins, and unanimously approved, the City Council directed City Attorney Flitner to prepare an ordinance that would permit non-profit civic groups in the community to have "bingo" functions. Correctional Facility Councilman Hollingsworth brought to the Councilts attention a letter from the State Department of Corrections concerning the feasibility of locating a medium to minimum security women's correctional facilit- in Rohpert Park. Councilman Hollingsworth suggested that the Council solicit public input concerning the concept. Wastewater Irrigation Mayor Beary informed that he and City Engineer Brust had Project appeared before the Board of Supervisors concerning construct- ing dams in the Laguna De Santa Rosa to' ' 'hold treated wastewate2 for irrigation. Discussion followed. Upon motion of Mayor Beary, seconded by Councilman Eck, and unanimously approved, the City Council directed that a letter be sent to Supervisor Koenigshofer advising him that complaints concerning the odor related to damming treated wastewater in the Laguna de Santa Rosa should be referred to the City for follow-up. Cotati-Rohnert Park Councilman Roberts advised that the Cotati-Rohnert Park Unified School District Unified School District had moved the installation of high re. Stadium Lights school stadium lights from No. 7 to No. 1 on its list of priorities. ABAG General Assembly Councilman Hopkins briefly commented on the ABAG General Assembly meeting which he had attended. We further request a priority of satisfaction of this concern be number one and by itself. All other priorities ;.s would be required to upgrade the athletic field to meet the needs of the variety of sports and endeavors would be separate from the iss,.-e of a lighted stadium.
