1978/05/22 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES May 22, 1978 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Hopkins presiding. The regular session was preceded by an executive session which commenced at 7:00 p.m. and at which all Councilmen and City Manager Callinan were present and which was held to discuss personnel, litigation and meet and confer matters. Call to Order Mayor Hopkins called the meeting of the regular session to order at approximately 7:45 p.m. and led the pledge of allegiance. Roll Call Present: (5) Councilmen Beary, Carbone, Roberts, Stewart and Hopkins Absent: (0) None Staff present for all or part of the meeting: City Manager Callinan, City Attorney Flitner, Planning Director Skanchy, Personnel Director Albright, Administrative Assistant Stanton, and College Intern Zimmerman. Approval of Minutes Upon Motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, the minutes of May 8, 1978 were approved as submitted. Approval of Bills Upon motion of Councilman Carbone, seconded by Councilman Roberts, and unanimously.approved, the bills per the attached list in the amount of $388,628.20 were approved as submitted. Addition of Non- City Manager Callinan requested an addition to the City Agendaed Items Manager's Report section of the agenda of Resolution No. 78 -75 Accepting Public Improvements and Authorizing the Release of Bonds for Country Club Estates, Subdivision No. 1, Unit A. C O N S E N T C A L E N D A R: City Manager Callinan referred the Council to his memo dated May 18, 1978 to the City Council for explanation of all the matters on the Consent Calendar. Resolution No. 78 -72 RESOLUTION DETERMINING TO UNDERTAKE'PROCEEDINGS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE ACQUISITION AND CONSTRUCTION OF IMPROVEMENTS WITHOUT PROCEEDINGS UNDER DIVISION 4 OF THE.STREETS AND HIGHWAYS CODE (Transport Avenue Extension, Rohnert Park. Project No.'1977 -4) Upon motion of Councilman Beary, seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 78 -72 was waived and said resolution was adopted. Resolution No. 78-73 A RESOLUTION APPOINTING ENGINEER AND ATTORNEYS (Transport Avenue Extension, Rohnert Park Project No. 1977 -4) Upon motion of Councilman Beary, seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 78 -73 was waived and said resolution was adopted. Resolution No. 78 -74 A RESOLUTION OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVEMENTS (Transport Avenue Extension, Rohnert Park Project No. 1977 -4) Upon motion of Councilman Beary, seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 78 -74 was waived and said resolution was adopted. Page 3 May 22, 1978 Unscheduled Public Mr. Dick Dethridge, 855 Santa Dorotea Circle, was recognized Appearances and explained .-that his property bordered the former "school siteP° in Neighborhood S °D" and that at the time of purchase, he was told that 20 ft. had been taken off his lot for the proposed: site. He would like to purchase this 20 ft. back from the developer if this site is rezoned. Mayor Hopkins asked City Manager for information on this. City Manager Callinan informed that he had found out just today from Mr. David,Bliese that some of the residents bordering on "the site:may wish to purchase the extra footage to bring their lot sizes up to the size of other lots in the neighborhood. Discussion followed. Mr. William C. Fennone, 6098 Deborah Court, was recognized and informed that he was president of the Rohnert Park Homeowners Coordinating Council, and presented a compromise concerning the former school site in Neighborhood I'D" (a copy of which is.attached to the original set of these minutes) asking that an additional 3..2 acres be added to Santa Dorotea Park_ along with the proposed addition of 1.8 acres, making a total addition of 5 acres to the park. Mr. Gerald,Schlvetter, 6089 Daphne Court, was recognized and asked what could be done about the o'used car lot" that is apparent on the northwest corner of the Rohnert Park Expressway and Country Club Drive intersection, where privately owned vehicles are parked and put up for sale. City Manager Callinan informed that he was familiar with this and that the. Department of Public Safety had reported that there was not in the City Code to prohibit this but that he would have City Attorney Flitner check into this matter to see what could be done. Mr.'Frank Gleason, 6043 Della Court, was recognized and stated that he feels the city has a good planning record overall but thinks the lots in the proposed plan for the former school site in Neighborhood "D "P are too small, particularly lots 1, 2, 3, 4 and 33.. He also suggests that the city purchase lot 29, which has a storm drain/ utility access on its east side, for green space and would like to see a "better plan for this site. Mr. John Lund, Jr., 176 Adele Avenue, was recognized and informed that he was a condidate for Congress and asked the support of Rohnert Park residents. Councilman Roberts Councilman Roberts left the Council Chambers at this point Leaves in the meeting, the time being approximately 8:03 p.m. Page 4 May 22, 1978 Councilman Roberts Councilman Roberts returned at this point in the meeting, Returns the time being approximately 8:05 p.m. Councilman Stewart commented that the compromise requested by Mr. Gilliam C. Fennone of adding 5 acres on to the existing park site, at no cost to the city, would probably be too costly for the developers. She also requested that staff check into the possibility of requiring the developers to sell only to clients who intend to occupy the homes. Discussion followed. -Mr. David Bliese, 6094 Diane Court, was recognized and requested a re- evaluation of lot 29 in the proposed plan for the former school site in Neighborhood "D" because he feels that the storm drain access is hazardous and that this area should be left as an open green space. Discussion followed. File No. 0590 - City Manager Callinan reviewed his May 18th memo to the City Pacific Coast Council concerning Pacific Coast Development Company's Development Co.; application for a General Plan amendment and rezoning for Application for approximately 11 acres located northeast of Santa Dorotea General Plan Circle and south of Dorotea Park for a 33 lot "R1- 8000 -PD" Amendment and subdivision. He also reviewed the results of the survey Rezoning that City Council.requested staff to conduct of Neighborhood `'D" concerning acquisition of site for open space /park purposes through formation of an assessment district or development of 32 -33 homes (a copy of this survey and results is attached to the or set of these minutes). A large majority of the responses approved the development of the site for 32 -33 homes and would be satisfied with the 1.8 acre addition to the existing Dorotea Park site. He reviewed the most recent plan for the site, which was on display at the meeting, and pointed out that the storm drain access at lot 29 was not a problem as long as it was in the set back area and had asked Mr. Michl to put in a footpath along the side boundary of lot 29 from the storm drain access to the street. He also felt that the developers would be open to the request of selling some of the land to the residents bordering the site on Santa Dorotea Circle. City Manager Callinan reported that due to a staff error in mailing out the notices for the hearings on this matter that the City Attorney advised that the matter should be set for additional hearings before the Planning Commission and City Council to avoid any legal challenge regarding sufficiency of notice. Mayor Hopkins asked if Council had any comments. Councilman Stewart commented that the compromise requested by Mr. Gilliam C. Site Plans for Elementary Schools Page 5 May 22, 1978 Page Councilman Stewart made a motion., seconded by Councilman Roberts, of willingness'.to rezone the site according to the presented plan with certain minor changes. Said motion was approved by the following roll call vote: AYES:- (3) Councilmen Roberts, Stewart and Hopkins NOES: (1) Councilman Carbone ABSTAIN: (1) Councilman Beary Councilman Stewart made a motion, seconded by Mayor Hopkins, to require a condition_of sale being to sell only to clients who intend to occupy the residence for at least 1 year. Discussion followed. Councilman Stewart's motion failed by the following roll call vote: .. AYES: (0) None NOES: (5) Councilmen Beary, Carbone, Roberts, Stewart and Hop' ?.ns City Manager Callinan again reported that the Pacific Coast Development Company's application would be reprocessed with new public hearings because of the notices not being mailed in complete compliance with the City Code. City Manager Callinan reviewed his memo of May 18th to the City Council concerning the site development plans for the elementary schools to be developed on Emily Avenue and on Southwest Boulevard in ."Ell and "C9° Neighborhoods. Superinten- dent-James Davidson and Project Architect Schuyler Jefferies were present to explain the plans and answer any questions Council might have. Schuyler Jefferies was recognized and explained that the plans should go out for bidding in 9 to 10 weeks, referring to the renderings on display at the meeting and stated that the proposed opening, date for the schools should be July 1979. Discussion followed. James Davidson was recognized and thanked the Council for their cooperation in this project. Mayor Hopkins Mayor Hopkins left the Council Chamber at this point in the Leaves meeting, the time being approximately 8 :40 p.m., and appointed Councilman.Roberts to preside in his absence. Commission City Manager Callinan reviewed his memo of May 18th to the Appointments City Council concerning the expiration of terms on June 30th in the Planning Commission, Parks and Recreation Commission and Cultural Arts Commission and stated that applications will be accepted until June 15th in preparation for a public hearing to be scheduled at the June 26th City Council meeting. Page C May 22, 1978 Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken on any communications except as specifically noted in these minutes. City Manager's City Manager Callinan reviewed his May 18th memo concerning Report those items as listed under the "City Manager's Report" section of the meeting's agenda. Adrian Drive Bus City Manager Callinan informed that Cotati City Council did Stop not approve the relocation of the northbound bus stop on Adrian Drive immediately north of East Cotati Avenue to a proposed location at 680 East Cotati Avenue, even though Golden Gate Transit was willing to relocate the bus stop. Discussion followed. Mr. Dennis Wellborn, 8020 Adrian Drive, was recognized and informed that the bus stop was located in front of his residence, and the problems he was having with parking, trash, vandalism and people sitting on his car while waiting for the bus. He requested Council to approve the relocation or removal of this bus stop. Discussion followed. Mayor Hopkins Mayor Hopkins returned at this point in the meeting, the Returns time being approximately '8;50 p.m. : Councilman Carbone made a motion, seconded by Councilman Stewart, to authorize the Public Works Department to remove this bus stop. Councilman Beary made a motion, seconded by Councilman Roberts, to amend Councilman Carbone's motion to give sufficient notice before removing the bus stop. City Manager Callinan informed that the city could request Golden Gate Transit to remove the stop so they could then give their passengers sufficient notice. This was accepted as a friendly amendment to Councilman Carbone's motion which was then approved by the following roll call vote: AYES: (5) Councilmen Beary, Carbone, Roberts, Stewart and Hopkins NOES: (0) None Wastewater Treatment City Manager Callinan reviewed his May 18th memo to the Update City Council. and informed that in subparagraph b., line 3 should read "is keeping all of its treated effluent..." 1978 -79 Budget City Manager Callinan informed that the 1978 -79 budget would be prepared sometime in June and asked Council to submit any additional funding requests. Mayor Hopkins suggested that staff provide copies of the last two budgets to Councilmen Carbone and Stewart. Page 7 May 22, 1978 Ambulance Service City Manager Callinan informed that Cadle's Mercy Ambulance Service and Brown's Ambulance Service were going to submit proposals for a cooperating plan for ambulance service by the end of the month. Country Club Estates, City Manager Callinan informed that now all public improvements Subdivision No. 1, have been completed in Country Club Estates, Subdivision No. 1, Unit A Unit A, and recommended release of the bonds. Resolution No. 78 -75 RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS AND AUTHORIZING THE RELEASE OF BONDS FOR COUNTRY CLUB ESTATES SUBDIVISION NO. 1, UNIT A Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No. 78 -75 was waived and said resolution was adopted. Founder's Day Golf Councilman Beary made a motion, seconded by Councilman Tournament Roberts, and unanimously approved, to request the Chamber of Commerce to sponsor the annual Founder's Day Golf Tournament. Founder's Day Parade Councilman Beary suggested that staff seek an organizer, to insure the occurrance of a Founder's Day Parade, since the American Legion organizer withdrew last week. Councilman Stewart suggested staff contact Dr. Sayer at 6950 Commerce Boulevard regarding organization of parade. Rohnert Park /Cotati Councilman Beary asked of the possibility of getting into Consolidation Rohnert Park that small part of Cotati at East Cotati Avenue and Adrian Drive that is surrounded by Rohnert Park. City Manager Callinan informed that it was possible but needed the approval of the property owners and the City of Cotati. City Attorney Flitner informed that this was the same general area of concern in the Environmental Impact Report lawsuit between Rchnart Park and Cotati. Discussion followed. Southwest Boulevard Councilman Stewart asked about the berm in Southwest at Railroad Crossing Boulevard at the railroad crossing and wanted to know its purpose and comment on the fact that cars, approaching it rapidly, hit the berm and fly up off the road, which seems to be an after school activity. City Manager Callinan explained that this area has been left for a right --of -way for widening of Southwest Boulevard and would have City Engineer Brust look into a possible correction of this situation. A developed property is to the best advantage of the home owners. We do not need additional park space because of the agricultural land surrounding. School and park not needed at this time. Too much to tell in 2 lines. The park would have just as many` "city -wide" benefits as any other park unless its use is limited to "DS9 section Other people from other areas certainly use the park. If there aren't children to consider building a school for, how can a park for them be justified? Construction and lot size are comparable to existing homes If homes are built, don't establish a precedent limiting 2,story homes to certain lots!! There are sufficient open space areas now existing in Rohnert Park.' We feel the park is Large enough and the homes would add to Rohnert Park. It would also help with taxes. Anything but subdivision. We are over taxed for parks now. Present park and 1.8 acre will be adequate for `''D" neighborhood. Expenditure for school "yes" ® park "no ". We have too much undeveloped "open land" in 4'D" section now. Unsightly weeds causing fire hazard. If the city does acquire this open land, then the assessment district should only include those properties closely affected by the "open land" not the entire I'D" section'. Acquisition of same '# acres later will be 2-3 times as much, hold property for use to ;benefit all Rohnert Park citizens. Rohnert Park does not have an adequate sewer system now. There should be a little open space. Assess the entire park just like every time in the past. Question, why only I'D" section would be assessed? If this is big enough for "a Junior High this would be my preference. Would like the proposed park addition used for parking for park. What we have now cannot be considered a park.
