1982/08/09 City Council MinutesCa11 to Order ROHNERT PARK CITY COUNCIL MINUTES August 9, 1982 The Council of the City of Rohnert Park met this date in regular` session commencing. at 7 :20 - p,.m.. in ,the . j,. City'Offices; 6750- 'C6mmerce Boulevard, Rohnert Park, with Mayor Hopkins presiding.. The regular session was preceded by'& closed session which commenced at 7:00 p.m. and at which all Councilmen and City Manager Callinaii and City Attorney Flitner were present :.. and which was held to'discuss personnel and litigation matters. Mayor Hopkins called the meeting of the regular session to order at approximately 7:20 <p.m. and led the pledge of allegiance. Roll Call Present: (5) Councilmen- Cavalli, Hollingsworth, Roberts Stewart and Hopkins Absent: (0) None (Mayor Hopkins directed that Councilman Stewart be shown as present even,' though she was not yet ;in the Council chambers but•'was still talking to City Attorney Flitner in the closed session. Staff present for all or part'of the meeting: City Manager Callinan, City Attorney Flitner, City Engineer Brush and Planning Director Skanchy. Approval of Minutes Upon.motion of Councilman Cavalli, seconded by Councilman .,: Hollingsworth, and unanimously "approved, the minutes of duly 26'and Auguste 4, 1582 were approved as submitted. Approval of Bills Upon motion of Councilman Roberts, seconded by Councilman Hollingsworth, and unanimously approved, the bills presented pet-the attached list in the'a�ount of ` $428,366.21 were approved. a . Resolution No. 82 -135 C O N S E N T C A L E N D A R City Manager CAllinan referred to his Council Meeting Memo dated August*6,,1982 for explanation of all the matters on the Consent Calendar. Councilman Hollingsworth requested that-Resolutions Nos. 8� -139 and' 82 -140 be removed from the'Consent Calendar for separate ccsnsideration. Councilman Stewart: Councilman Stewart took her seat in the Council chambers enters at this point in the meeting. Resolution No. 82 -139 RESOLUTION APPROVING UTILITY AGREEMENT WITH HEWLETT PACKARD COMPANY City Manager Callinan explained the resolution. Discussion followed. Upon, - motion of.C,ouncilman Cavalli, seconded by Councilman Hollingsworth, and unanimously approved, reading of Resolution No. 82 -139 was waived and :said resolution was adopted. Resolution No. 82 -140 . RESOLUTION AUTHORIZING ACQUISITION OF MICRO- COMPUTER FOR USE IN STORES OPERATION City Manager Callinan explained the resolution. Discussion followed. Upon motion of Councilman Roberts, seconded by Councilman Hollingsworth, and unanimously approved, reading of Resolution No. 82 -140 was waived and said resolution was, adopted. File 0839 - Burger King City Manager Callinan stated that this matter was being Corp. review of brought before the Council in accordance with its application previously expressed policy of wanting to review applications for development on major roadways in the city. Planning Director Skanchy explained the site plans on display and noted that Council had previously been provided with the Planning Commission and Planning staff reports covering same. Mr. Skanchy also Rohnert Park City Council Minutes -Pg. 3 August 9, 1982 said that the project had been given approval by the Planning Commission subject to conditions and modifications. Discussion: followed Mr. Mike Hussel, Site .Devq,�opment Engineer for the Burger King Corporation, was recognized and explained the type of ffencing they had planned to use around the restaurant was to be railroad ties with shrubbery. Discussig4 .followed. Mrs Howard Boggs, Commerce Boulevard, Rohnert Park, spoke in favor of a masonary, wall being built, especially on the property facing south. Mr, Michae.l Libby,,1126A Slater St., Santa Rosa, was recognized and said he felt the rustic look of the railroad ties would be attractive. Mr*. Jim-Redding, 7147 Barbi Lane, Rohnert Park, was recognized and.urged the Council to support staff's position on the requirement .of a masonary or slumpstone wall. Dis,oussion,f;ollowed. .; ; s j Councilman.Roberts made a motion, seconded by Councilman Hollingsworth,•and, unanimously approved, to approve the, application of Burger King Corp. to construct a .drive-in: restaurant on a 1.14,,acre parcel located on the west side of Commerce Boulevard, south of and adjacent to Hinebaugh.,Creek subject to conditions,.and modifications. imposed by the Planning Commission with. the modification,-to the.one condition regarding fencing that :the fence ,be::.a masonary. wall to be placed on the north, south and west property lines rather than the railroad ties as approved by the Commission and that signs be allowed on the:west. side of the building in addition to the signs approved by the Planning Commission and also that the low profile, detached sign on Commerce Blvd. be allowed to be 8 feet in height measured from finished grade of sidewalk. 'y i 6.OF THE ROHNERT PARK MUNICIPAL CODE AS THE SAME RELATES TO VICIOUS DOGS AND THE CONTROL THEREOF City Manager Callinan explained the ordinance. Mr. Callinan advised that postal representatives had been notified of the meeting and were invited to attend same. Rohnert Park City Council Minutes -Pg. 4 August 9, 1982 Mr. Michael Libby, President of the National Association of Letter Carriers, was recognized and discussed the proposed ordinance. He thanked the Council for considering the matter. Discussion followed. City Manger Callinan informed the Council o -.f'a recent Supreme Court decision that allows the city to raise its occupancy tax without a two - thirds vote of the electorate and that a Resolution should be adopted to rescind those resolutions previously adopted to place the issue on the ballot in the`November 2, 1982 election. Upon motion of Councilman Roberts, seconded by Councilman Hollingsworth,''and approved by the following roll call vote, reading of Ordinance No. 408 was waived and said ordinance was introduced by the following roll call votes AYES: (5) Councilmen Cavalli, Hollingsworth, Roberts, Stewart and Hopkins NOES: (0) None Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken on any communication unless specifically noted in these minutes. Cash Report Councilman Hollingsworth inquired as to why there was such a large sum of money in the Exchange Bank at only 5 -1J4o when it might be placed in a higher interest earning account. Mr. Greg Malaby, an employee of Great �,Ibstern Savings, was recognized and explained the workings of a "sweep account." City Manager Callinan advised that he would investigate and report back. joint Meeting with City Manager Callinan reminded Council that during the City of Cotati negotiations on the Hewlett Packard Agreement with the City of Cotati it was suggested that a joint meeting be held in the near future to discuss matters of mutual interest and concern. Discussion followed. Upon motion of Councilman Stewart, seconded by Councilman Hollingsworth, and unanimously approved, it was agreed that a joint meeting of the Cotati City Council and Rohnert Park City Council would be held.. Sleeping in Cars City Attorney Flitner advised that he had contacted the League of California Cities for sample ordinances regarding sleeping in cars and hoped to report back to the Council regarding same in the near future. Hewlett Packard Matters from Council: Chamber Board "Tug of Adjournment City Attorney Flitner discussed the latest progress of the lawsuits on the Hewlett Packard Project. It was the concensus of the City Council to accept the challenge to the "Tug of Wart° during the Founder's Days festivities in September provided they would be able to recruit enough people to even up the sides.
