CHEMICAL UNITS%(For "W' Park) Rohnert Park City Councii'Minutes -2°- September 13, 1982 Ordinance for AN ORDINANCE OF THE ROHNERT PARK CITY COUNCIL AMENDING Introduction `ORDINANCE NO. 201 AND CHAPTER 5.12 OF THE ROHNERT PARK MUNICIPAL'CODE CONCERNING BUSINESS LICENSES Upon motion of Councilman Hollingsworth, seconded by Councilman Roberts, and unanimously approved, reading of Resolutions Nos. 82 -150 through 82 -152 and the ordinance for introduction was waived and said resolutions were adopted and said ordinance was introduced. Chamber of Commerce City Manager Callinan advised the Council that the Presi- dent, James Fisher, of the Rohnert Park Chamber of Commerce had requested that the 'matter of the new proposed agreement be 'deferred until the next regularly scheduled Council meeting to enable the Chamber Board of Directors to consider the proposed agreement more thoroughly. Council concurred. Resolution No. 82 -153 A RESOLUTION AWARDING CONTRACT FOR JANITORIAL MAINTENANCE (For Community Center) City Manager Callinan explained''tlie'resolution. Upon'motion of Councilman Hollingsworth, seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 82 =153 was waived and said resolution was adopted; Pedestrian Safety Award Mrs. Hildegard Beering, Administrative Assistant with the California State Automobile Association, was recognized and stated that the City of Rohnert'Park was again'-the recipient of the Pedestrian Safety'Citation Award and presented same to Mayor Hopkins and Public Safety Lieu- - tenant Jack Shields, who was present. Mrs. Beering noted that this is the third year in a row that the City of Rohnert Park had been presented with the award and commended the city for a job well done.. Filament Street Mr. H.'G. Pon, 4983 Filament Street, Rohnert Park, presented the Council with copies of a petition signed by residents of Filament Street and requesting that the name be changed to "Felicia Court." Discussion followed. Upon motion of Councilman'Hollingsworth, seconded by Councilman Roberts, and unanimously approved, the Council went on record as being in support of the street name change and directed that staff'do whatever was necessary to implement the change. Councilman Stewart At this point in the meeting, Councilman Stewart arrived, arrives the time being appi`oximately 7 :11 p.m. Communications Communications per the attached outline were brought to the attentioin'of the City Council. No action was taken on any communication unless specifically noted in these minutes. Rohnert Park'City Council Minutes -3- September li, 1982,'' City Manager's Report: Warm Springs Dam 5 � , Councilman Cavalli arrives Sunrise Park dedication Meeting Night Change City Manager,Callinan advised the Council that the federal governmentr.,had to put a hold, on projects such as the Warm Spring`s' Dam recreation facilities and that in order to im; plement the recreation facility the federal government was proposipi that the local government would be required to cortrli ute half the cost of construction and would also have ;toy maintain and operate the facilities. Upon motion of Councilman Roberts, seconded by Councilman Stewart', and unanimously approved, the Council directed that a letter be sent ove'r'-the Mayor's signature to the federal government expressing. their .support, of the Warm Springs,Dam Recreational,Facility project and urging the £ede'ra,f government to reconsider its recent decision and to build and operate the recreation facilities. City'Attorney s Report: Hewlett Packard lawsuits 5 � . At.this point in the meeting, the time being approximately 7 .'15 p.m.,.Councilman Cavalli arrived. City Manager Callinan` stated that a firm decision should be D made'as to whether or nottthe dedication ceremonies for Sunrise Park should be held. Discussion followed. It was the concensus'of the Council that the dedication be cancelled. City Manager Callinan informed the Council of a,,suggestion to change the Council, meeting.night'to'another night during the week during; football season. No action was taken. City Attorney Flitne'r said that he expected the court to H render a decision on the HP lawsuits by Monday, September 20th and is hopeful that the decision would be in the city's and Hewlett Packard's. favor. City Manager Callinan advised the Council that Mr. and Mrs. Jim Clark had attended the trial each day and thanked them publicly for their support,.Mayor Hopkins also thanked the Clarks on behalf of the City,Council and remarked that he ad, mired.their dedication to their city. Sleeping in Cars City Attorney Flitner stated that he did receive sample ordinances from the League of California Cities regarding t'h.zs matter and „that he would.,have an ordinance to present to the City .Council at the next meeting. Mortgage Bond lawsuit City Attorney Flitner noted that the City Council had been r.s provided withcopies of communications regarding the lawsuit by the gity of San Bruno and advised that the suit had been dropped by that city. Joint Meeting with-' City Manager Callinan informed the Council that the City City of Cotati of Cotati Council had suggested September 15th as a possible date for a joint meeting. Discussion followed. Rohnert Park City Council Minutes -4- September 13, 1982 It was the consensus of the 'Council that September 15th was an acceptable date for their joint meeting and directed the City Manager to contact the City of Cotati to work out the details. Public Telephones in Councilman Stewart queried as to whether there has been a parks response to City Manager Callinan's letter to the telephone company regarding a suggested change in telephone equipment in public parks.''City Manager Callinan advised that a letter is on its way and that a representative had told him that one drawbadk to the suggestion is the noise level in such places. Pacific Telephone Tour Order of Agenda ,Items Planning and.Zoning Matters. File 0762 - Hewlett Packard Company- Precise Development Plan & Architectural Review 'City Manager Callinan reminded the Council of the tour of the Pacific Telephone facilities in Santa Rosa to be held on Friday, September 17th, 11:30 a.m. until 1 :30 p.m. Mayor Hopkins advised 066 audience that some of the agenda items were being discussed out of the order in which they appeared on the printed agenda since the meeting was ahead of schedule and the Council wanted the Planning and Zoning Matters section to be as close to the time published as possible to afford anyone who wished to speak on any of those'items an opportunity to do so during the scheduled public hearings. City Manager Callinan stated that this item had been continued from the August 23, 1982 City Council meeting and that the notices of the public hearing had been duly published. Planning Director Skanchy updated the Council on the Hewlett Packard Company'application for precise development plan and architectural review for the overall master plan And Phase I of development and noted that the Council had received copies of all the Planning Commission reports, Planning Staff reports, resolution, and all other pertinent data related to the project. Mr, Skanchy advised that all conditions contained'in the previously adopted Resolution Ito. 81 -180 would be applicable'to the Phase I of development of the project. Pointing out site plans on display, Planning Director Skanchy described the landscaping, building, parking areas and all other details regarding the proposed project. Mr. Ethan Cliffton, architect for the Hewlett Packard Project, was recognized and further explained the Mas er Plan for the proposed project and detailed parking and landscaping plans, describing trees, shrubs and various other plant materials`to be used on the project site. Mayor Hopkins opened the public hearing concerning File -No. 07,62, Hewlett Packard.Company application for precise development plan,and architectural review. Dale McCarty, 579 Anson Avenue, Rohnert Park, spoke on behalf of the Citizens for Community Choice organization and requested that:the Council postpone any decision,on; the, ' ma * tter until.a ruling Is handed down from the judge ,for the Hewlett Packard.Proj,ect EIR lawsuit.., Discussion followed. There being no one else desiring to be heard and no written communications ;received, Mayor Hopkins closed the public hearing.. Councilman Hollingsworth asked for an explanation as to exactly what effects the Phase I would have on the community as far as wastes and water were concerned. .Mr. Rit Keiter, General Manager of Hewlett Packard Company, advised ,the Council that ther_.e would be no danger of a "gray water" problem on the site and that the activities of the company would .indeed be conducted in a clean, safe manner so as; not. to ,effect the environment. Further discussion followed. Resolution No. 82 -154 „ RESOLUTION OF-.TAE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING PRECISE DEVELOPMENT PLAN AND ARCHITECTURAL REVIEW .. -FOR HEWLETT PACKARD COMPANY OVERALL MASTER PLAN AND PHASE I; OF DEVELOPMENT Upon motion of ,Councilman Hollingsworth, seconded by Councilman Stewart, and unanimously approved, Resolution �N.o. 82 -154 was unanimously ,adopted by title. Councilman.Hollingsworth Councilman Hollingsworth left.the chambers at approximately leaves 8002 p.m. and returned at 8 :05 p.m. File No.,0841°-Cofego City Manager Callinan advised the Council that the applicant Enterprises - General had submitted letter requesting an indefinite continuance Plan Amendment, Rezoning, of this matter and noted ,that the public hearing is a Precise Development Plan, continunation.,from the C?ty Council meeting of August 23, and Architectural Review 1982. Mayor Hopkins opened the public hearing on File No. 0841, Cofego Enterprises; for consideration of the General Plan Amendment, rezoning, and Precise Development Plan and Architectural Review for a 200 unit condominium project. Rohneit, Park City Council Minutes -6- File 0788- Cofego Enterprises-Precise Development Plan and Architectural Review Water Conservation Regional Wastewater System September'13, 1982 There being hb one desiring to be heard and no further written communications received, Mayor Hopkins closed the public hearing. Discussion followed. Upon motion of Councilman Cavalli, seconded by Councilman Roberts, and unanimously approved, File No. 0841, Cofego Enterprises, was denied without prejudice. Planning•Director Skanchy advised the Council that the public hearing on'this matter had been duly noticed and that the Council had been provided with copies of all Planning Staff and Planning Commission reports concerning same. Mr. Skanchy then proceeded to describe the project while pointing out the site plan on display. Discussion followed. Mayor Hopkins opened the public hearing on File 0788, Cofego Enterprises, application for Precise Development Plan and Architectural Review fora 8,200 square foot retail commercial building to be located in the Towne Center Shopping Center. Mr. Richard Codding of Codding Enterprises was recognized and informed the Council that Cofego would be willing to use an alternate choice of wall material for their building to coincide with the existing buildings in the shopping center and also to provide landscaping. There being no one `further desiring to speak and no written communications received, Mayor Hopkins closed the public hearing. Discussion followed. Upon motion of Councilman Hollingsworth, seconded by Councilman St eWa%ty ai%- u unanimously ap proved,., File No. 0788, Cofego Enterprises, precise development plan and architectural review application was approved subject to conditions imposed by the Planning Commission but without the requirement for the masonary wall and with the condition -that codding enterprises will ptt in heavy landscaping. City Engineer Brust reported to the Council that the County is participating in a water conservation program which will consist of '(1) advertising: radio; billboards, etc.; (2) the distribution of water conservation kits to all residents in the County; and (3) courses to be taught to schoolteachers who in turn will educate children on water usage. Mr. Brust stated that 75% of the costs for mailing the kits will be picked up by the State and the remaining costs will be covered by the Sonoma County Water Agency. The only cost to the City of Rohnert Park will be employee time. City Manager Callinan informed the Council of a Sonoma County Board of Supervisors meeting to take place on September 14, 1982 and the topic of the Regional Wastewater System holding Rohnert Park City Council Minutes °7- September 13, 1982 pond being on their agenda. Mr. Callinan urged anyone interested in this matter to attend the meeting and to express support so that a grant for this project is not lost. Brown Family Reception City Manager Callinan advised that the Cultural Arts Corporation reception being held in City Hall that night was to honor the Mel Brown family and invited everyone to participate in same. Adjournment There being no further business Mayor Hopkins adjourned the open session at approximtely 8 :31 p.m. and announced that the Council would be holding a closed session to discuss personnel and litigation matters. Closed Session The Council met in closed session with all Councilmembers, City Manager Callinan, and City Attorney Flitner present. Personnel and litigation matters were discussed.
