July 24, 1989
The Council of the City of Rohnert Park met this date in regular
session commencing at 7:00 p.m. in the City Offices, 6750 Commerce
Boulevard, Rohnert Park, with Mayor Cochran presiding. The open
regular session was preceded by a closed session which commenced
at 7:00 p.m.
Call to Order Mayor Cochran called the regular session to order at approximately
7:40 p.m. and advised that an adjourned regular session convened
at 4:00 p.m. today for a work session on proposed 1989 -90 City
budget. He also informed that a closed session commenced this
evening at 7:00 p.m. to discuss personnel, meet and confer,
litigation matters, and real estate negotiations.

Staff present for all or part of the meeting: City Manager
Callinan, Planning Director Skanchy, City Attorney Flitner,
Administrative Services Director Netter, Assistant to City Manager

Approval of Minutes Upon motion by Councilman Hopkins, seconded by Councilman
Hollingsworth, and unanimously approved, the minutes of the
meeting of July 6, 11, & 18, 1989 were approved as corrected per
Council Member Spiro regarding Planning and Zoning File No. 1326
on page 3 of the July 11, 1989 minutes, stating that even though
she voted to approve before EIR certification, she wanted her
comments to reflect in the record that she felt this was getting
the cart before the horse. .
Approval of Bills Upon motion by Councilman Hopkins, seconded by Councilman
Hollingsworth, and unanimously approved, the bills presented per
the attached list in the amount of $357,689.37 were approved. CDA
bills presented per the attached list in the amount of $300.91
were approved.
Non - agendaed Mayor Cochran queried if any Council member had any non - agendaed
Items items to add to the agenda. No one responded.
Unscheduled Public Mayor Cochran stated that in compliance with State Law (The Brown
Act), anyone in the audience who wished to make a comment may do
so at this time. No one responded.

CONSENT CALENDAR
Mayor Cochran queried if anyone had any questions regarding the
matters on the consent calendar. No one responded.
Acknowledging the City Manager /Clerk's report on the posting of
the agenda.
Parcel Map No. 121 Approval of Parcel Map No. 121 and acceptance of the dedication to
the City for a landscape and sidewalk parcel from Codding
Enterprises, and authorizes the Mayor to execute an appropriate
agreement prior to the parcel map being released for recording.
The location of this parcel map is the area north of Rohnert Park
Expressway between Labath Avenue and Redwood Drive.

89 -112 ROHNERT PARK, CALIFORNIA, OF ITS MULTIFAMILY MORTGAGE REVENUE
BONDS - ENTERPRISE MANOR PROJECT FOR THE PURPOSE OF INDUCING THE
ACQUISITION, CONSTRUCTION, EQUIPMENT AND DEVELOPMENT OF
MULTIFAMILY RENTAL HOUSING WITHIN THE CITY OF ROHNERT PARK AND
AUTHORIZING THE PREPARATION OF VARIOUS DOCUMENTS AND INSTRUMENTS
RELATED THERETO
City Manager Callinan explained that Council had been provided
with copies of an inducement resolution for consideration of a
Multi - Family Mortgage Revenue Bond Issue for the Enterprise Manor
Senior Apartment Project at the- corner of Enterprise Drive and
State Farm Drive (behind Ross Department Store). He stated that
the adoption of this resolution does not commit the City to
proceeding with the bond issue, but simply affirms that the
Council will consider the matter.
City Manager Callinan shared that the City will receive an annual
fee in an amount to be determined which will be in the thousands
of dollars and is currently being discussed, that Council had been
provided with copies of a letter dated July 18, 1989 from
brokerage firm Bateman Eichler, Hill Richards Incorporated
outlining suggestions, and that the City has required and received
a $2,000 non - refundable payment to cover the time expended by
staff in this matter. He introduced Mr. Hoon of Bateman Eichler,
Hill Richards Incorp. who was available to answer questions
from Council.

Discussion followed concerning the risk of the bond of which City
Manager Callinan responded there was little risk due to the
property being held as the security, in addition the issue would
be insured and developers would have to put up substantial amounts
of letters of credit. In addition, the 20% set aside for low
income units was discussed as well as the length of the bonds and
what type of reporting would be made to the city or its housing
authority.
Discussion continued.
Upon motion by Councilman Hopkins, seconded by Council Member
Spiro, and unanimously approved, Resolution No.89 -112 was adopted.

Resolution No. A RESOLUTION ACCEPTING AND APPROVING PROPOSAL FROM ROBINSON, MILLS .
No. 89 -113 & WILLIAMS (Re. Civic Center and Public Safety Building) PROJECT C
City Manager Callinan explained that Mathew R. Mills of Robinson,
Mills & Williams, Architects was in the audience representing the
architectural firm being engaged to do the Civic Center Master
Plan and provide architectural services for the Public Safety
Building and that copies had been provided to Council regarding
revised proposals offering several options for consideration.
City Manager Callinan shared that staff has been working with the
architects on some changes in the contract and has settled on the
terms; therefore, formal approval of the agreement for
architectural services should be considered.
Mathew R. Mills of Robinson, Mills & Williams, Architects was
recognized stating that he was the architect in charge of this
project and referred Council to above mentioned copies of
proposals provided to Council for consideration. He said that
basically they provided three alternatives: Project A - Public
Safety building only; Project B - Public Safety and City Hall al'
at once; and Project C - Designing all now, but going forward onl,
with construction of Public Safety building now and plan the
construction of City Hall later.
Discussion followed during which members of the Council queried
Mr. Mills on the various alternatives, costs and other variables
within each proposal. Extensive discussion continued on
alternative A which was construction of the Public Safety Building
only and alternative C which was to construct the Public Safety
building and master plan the City Hall site. Mr. Mills indicated

Safety, but consider the preliminary plans for a City Hall and
take into consideration a portion of City Hall's design that may
be compatible with the Public Safety Building to eliminate
duplication when the City Hall builing is eventually completed.
In addition, if the Council opted for option C, the Council could
dictate on just how far the architects went with the City Hall
portion of the project. Option C becomes a very flexible plan in
terms of what is to be designed and to what extent the Council
feels is necessary. Discussion continued concerning the
architectural fees between option A, B, and C.
Jim Redding, 7147 Barbi Lane, was recognized from the audience in
that he stated the Council should consider completion of the
Public Safety building to get a feel of these new architect's
style and design before committing to the second phase of t'-
project, i.e. City Hall.

Mayor Cochran explained that Resolution No. 89 -114 through 89 -118
were reviewed by Council in the closed session at 7:00 p.m. prior
to tonight's open session.
Resolutions were provided to Council for consideration and
ratification of Memorandums of Agreement with the Rohnert Park
Peace Officers' Association (RPPOA), the Sonoma County
Organization of Public Employees (SCOPE) - Dispatchers /Office
Assistants; (SCOPE) - Maintenance Workers, approves an outline for
certain conditions of employment, fringe benefits and salary
adjustments for non - represented employees and authorizes
additional benefits for key City positions. Separate reports were
provided to the Council outlining the key terms and conditions of
these new agreements.
Upon motion by Councilman Hopkins, seconded by Councilman Eck, and
unanimously approved, Resolution No. 89 -114 through No. 89 -118
were adopted.

Empire Tow Service City Manager Callinan explained that Council had been provided
with copies of documents relating to tow service, specifically an
ordinance establishing tow service requirements that will affect
future received and the tow service agreement with Empire Tow
Service, of which both documents were recommended for approval.
He said that the ordinance for introduction would give the
Director of Public Safety the guidelines needed to function
properly, that it would require tow trucks to be within 5 miles of
the intersection off the Expressway and Highway 101, and that it
is modeled after the City of Healdsburg. City Manager Callinan
mentioned the two different companies of Jack Roscoe discussed at
previous meetings and said that he thought in good faith one of
them should be allowed on the rotation, and that if the Council
found this acceptable, the resolution of same should be adopted.
Councilman Hopkins Councilman Hopkins left the council chamber at approximately

City Manager Callinan confirmed to Councilman Hopkins and
Councilman Eck "s concerns regarding the five mile limit that all
existing tow services will be "grandfathered ".
Council Member Spiro referred to the requirement of fencing so
that towed cars will not be seen and asked how this can be
enforced for companies that are located outside the city. City
Manager responded that the enforcement is possible because it's
part of the agreement and Mayor Cochran said that if they don't
provide the fence it would be a breach of contract.

Ordinance No. 515 AN ORDINANCE ESTABLISHING TOWING SERVICE REQUIREMENTS
Upon motion by Councilman Hollingsworth, seconded by Councilman
Eck, and unanimously approved, Ordinance No. 515 was introduced.
Rohnert Park City Council Minutes (7) July 24, 1989
Ordinance No. 514 City Manager Callinan recommended the ordinance for adoption,
No. 514, be deferred to next meeting. City Attorney Flitner
concurred. This ordinance was held over from the last Council
meeting at the request of City Attorney Flitner because he wanted
to check with State officials on some concerns regarding zoning of
said property. He will give an update at the next Council meeting
regarding the status of this ordinance and whether the Council
should proceed with its adoption.
Ordinance No. 516 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING THE ROHNERT PARK
MUNICIPAL CODE, TITLE 15, BUILDING AND CONSTRUCTION, TO ADOPT THE
UNIFORM BUILDING CODE, 1988 EDITION; THE UNIFORM HOUSING CODE,
1988 EDITION; THE NATIONAL ELECTRICAL CODE, 1987 EDITION; THE
UNIFORM PLUMBING CODE, 1988 EDITION; THE UNIFORM MECHANICAL CODE,
1988 EDITION; THE UNIFORM FIRE CODE, 1988 EDITION; THE UNIFORM
CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, 1988 EDITION AND
THE UNIFORM SWIMMING POOL, SPA AND HOT TUB CODE, 1988 EDITION; AS
AMENDED, AND ADOPTING OTHER REQUIREMENTS
City Manager Callinan explained that the ordinance for
introduction has been prepared with copies provided to Council
which amends the Rohnert Park Municipal Code to update various
building codes, housing codes, electrical codes, plumbing codes,
mechanical codes, fire codes, abatement of dangerous buildings,
uniform swimming pools, spas and hot tubs codes and other
requirements as necessary. The State of California has adopted
these updated codes and the cities generally follow suit in their
updates. In addition to some on -going changes the City has made
in the codes, this ordinance requires fire sprinklers in all new
buildings. This is accomplished by updating a provision of the
fire code.
Discussion followed in which Council concurred that a public
hearing will be held on August 22, 1989 to consider the ordinance.
Upon motion by Councilman Hollingsworth, seconded by Councilman
Hopkins, and unanimously approved, Ordinance No. 516 was
introduced.
Recess Mayor Cochran declared a recess at approximately 8:17 p.m.
Reconvene Mayor. Cochran reconvened the Council. meeting at approximately;,
8:24 p.m...with all Council members present.
Planning and Zoning Planning Director Skanchy suggested File No. .1300_ ,Northwest.,_
File No. 1300 Rohnert.Park (Roberts Lake Road) be- deferred until later..in: the
meeting as the consultant had not yet arrived. Council concurred. !:

City Bike Path Plan City Manager Callinan explained that Council had previously
requested that the Planning Department look at the overview of the
City's bike paths.
Planning Director Skanchy referred to maps on the wall and
explained the proposed bike path plan pointing out that the solid
lines represented the existing bike paths and the broken lines
represented the proposed plan.
Discussion followed with several comments from Council concerning
the proposed funding of bike trails from the proposed sales tax
initiative, as well as comments on the need for more bike paths
for the north /south direction within the City. In addition, some
consideration should be made for a bike route from Scandia on the
west side of town to the east side where all the residential units
are located. It was suggested that City Engineer Brust look into
the possibility of planning for more north /south bike paths whic'
may include using some of the golf course area or State,
Farm Drive.
Discussion continued.
Planning and Zoning Planning Director Skanchy explained File No. 1300 regarding the
File NO. 1300 Northwest Rohnert Park Programmed Draft Environmental Impact
Report and referred to maps on the wall showing Wilfred Avenue
Interchange and included approximately 78 acres of planned zoned
commercial. He shared that the e -Pr OjeCt COI1S1StS OI RObert5 Lake
Road, which will connect Golf Course Drive in Rohnert Park with
South Santa Rosa Avenue to the north, commercial development of
areas on both sides of Golf Course Drive and an area to
the west of Highway 101 which is served by Redwood Drive
and Wilfred Avenue.
Planning Director Skanchy shared that on July 13, 1989 the Rohnert
Park Planning Commission held a Public Hearing to consider the
Northwest Rohnert Park programmed DEIR and that after the public
testimony was taken, the Planning Commission closed the public
hearing and continued discussion on said document until July 20,
1989 in order to give Mr. Elgar Hill, Consultant, sufficient time
to respond to all written and verbal comments submitted by the
public and other agencies. On July 20, 1989, Mr. Elgar Hil2
presented to the Planning Commission his prepared responses to the
various comments on the draft enviornmental impact report. At the
completion of Elgar Hill's presentation, the Planning Commission
adopted Resolution 89 -10 recommending to the City Council that

they certify said draft EIR and adopt mitigating conditions at
their scheduled meeting of July 24, 1989. (Council was provided
with copies of the minutes of the Planning Commission meeting of
July 13 & 20, 1989, correspondence from various agencies, and
responses to the correspondence by Mr. Elgar Hill pertaining to
the D.E.I.R.)
Elgar Hill, EIR Consultant, was recognized and referred Council to
copies provided of the document mentioned above regarding
Northwest Rohnert Park Program EIR /Responses to Written Comments
and shared contents therein. He concluded his presentation
stating that the freeway is now at virtual capacity a peak hours
without the project, that there would not be major differences on
local roads outside the area, that no one knows the schedule at
this time, and that the level of accuracy of about 20% is the
level of confidence of the traffic study.
Discussion followed during which Council Member Spiro asked how
far the Roberts Lake Road street is from the actual lake
expressing concern because of the proposed bike paths along there
which could be dangerous to which Mr. Hill responded about 100 ft.
at the nearest point and that there's enough room for trees along
the lake. Mr. Hill explained the drainage use of right of way
that would be up to 50 ft. wide but would still have enough room
to ensure a safe distance, and that there was previous suggestions
to push the road further east which would have presented the
problems to which Council Member Spiro referred.
Council Member Spiro inquired about when Cal Trans proposes to
fully improve the Wilfred Avenue interchange including the
underpass.
City Manager Callinan responded that they've been working with
local State legislature, that they are working in stages and that
the State is now doing the first stage of widening ramps, etc. and
that, hopefully, they will get the State to put in the overhead
ramp at sometime. Mayor Cochran said that he and City Engineer
Brust went to the Sacramento meeting and felt they were successful
in representing this matter. City Manager Callinan said that as
Mr. Hill pointed out, they are trying to accomplish this, however,
not being on the interstate system is the reason it's so
complicated to get funds.
Further discussion followed regarding contents of the EIR report.

Public Hearing Mayor Cochran opened the public hearing at approximately 9:10 p.m.
and asked if there was anyone in the audience wishing to speak
regarding this matter.
Elizabeth Eddins of Sierra Club, 829 A St. Helena Avenue, Santa
Rosa was recognized and stated she was representing Harvey Bell,
700 Lindsay Avenue, Rohnert Park. She shared comments regarding
File No. 1300 from her letter to Rohnert Park City Council dated
July 24, 1989 regarding responses to comments on the NWRP EIR not
meeting the requirements set forth in the CEQA guidelines (a copy
of which is attached to the original set of these minutes).
Charmaine Padilla, 252 Fig Court, was recognized and shared
objections to this plan stating that the traffic problem is out of
hand, and referred to the similar problem of Hearn Avenue and Todd
Road in Santa Rosa. She stated that she did not think the plan
could go on at this point, that it didn't sound like Cal Trans
works too well, and that this would be jumping the gun.
There being no one further desiring to speak, Mayor Cochran closed
the public hearing at approximately 9:15 p.m.
Discussion continued as it pertained to Cal Trans improvements of
the Wilfred Avenue Interchange project.
City Manager Callinan recommended that the Council certify the
report and if they didn't feel there was enough information
provided to ask for more on that particular area.
Council Member Spiro said that she understood there were other

and these projects maybe should have waited for the EIR approval.
City Manager Callinan responded that the plan can be imposed on as
it progresses and when it becomes necessary, that things get
mitigated incrementally, and that pending projects were approved
conditional upon certification of the EIR.
Councilman Hopkins said that if the council members thought the
EIR report was adequate, to vote yes, that it has nothing to do
with the particular projects, and that this was as good an EIR as
he had seen.
Councilman Eck shared that he thought the EIR report was good
compared to some he had read, that what bothered him was it's not
taken seriously from the point of using it as a planning document,
that he had the feeling that doing the EIR was only to meet State
requirements rather than do actual planning, and that he thought
the process should be protested. Discussion continued.

MITIGATION MEASURES SET FORTH IN THIS RESOLUTION AND IN THE FINAL
ENVIRONMENTAL IMPACT REPORT

Hollingsworth, Resolution No. 89 -120 was adopted by the following

Resolution No. A RESOLUTION OF AWARD OF CONTRACT ROBERTS LAKE ROAD PROJECT 87 -15
89 -121
City Manager Callinan explained that the resolution for
consideration was for an award of contract for Roberts Lake Road
Project No. 1987 -15 and that this item was carried over from the
Council meeting of June 19, 1989 where bids were opened. The
project includes construction of the Roberts Lake Road from Golf
Course Drive to South Santa Rosa Avenue and also the development
of a commuter parking lot in the southerly portion of the project
area adjacent to the railroad. He shared that five (5) bids were
received ranging from a high bid of $1,624,585 to a low bid of
$1,276,077.70 submitted by Northbay Construction. THe engineers"
estimate was approximately $1.6 million. Award of this contract
has been delayed waiting for the conclusion and certification of
the EIR for the Roberts Lake Road area and the westerly portion of
the City. With the EIR certified and approved by the City
Council, awarding of this contract to Northbay Construction in the
amount of $1,276,077.70 is recommended.
Councilman Eck made a motion not to award the contract at this
time and have staff come back with a report on the cost for only
providing access to and development of the commutor parking lot.
Said motion died for lack of a second.
Discussion followed on the distance of the new road to the lake
and child safety and whether barriers would be necessary. It was
suggested that safety requirements be incorporated as construction
progresses.
Discussion continued on the safety concerns, possible financing
for barriers, signalization of the intersection of Commerce Blvd.
and Golf Course Drive and the new on /off ramps at that
intersection.

Councilman Councilman Hollingsworth left the Council Chamber at approximately
Hollingsworth Leaves 9:35 p.m.
Council Member Spiro made a motion, seconded by Councilman Eck, to
have City Engineer Brust sit down with Council at the next meeting
to review Roberts Lake Road, to which Councilman Hopkins made a
friendly amendment to have Council Member Spiro and Councilman
Hollingsworth meet separately with City Engineer Brust to review
this matter, and report back to Council. All Council agreed.
Councilman Councilman Hollingsworth returned to the Council Chamber at
Hollingsworth Returns approximately 9:37 p.m.
Upon motion by Councilman Hollingsworth, seconded by Councilman
Hopkins, and unanimously approved, Resolution No. 89 -121 was
approved and adopted per the following vote:

NOES: (1) Eck

Sonoma County Mayor Cochran gave an update on the Sonoma County Transportation
Transportation Committee - Proposed Sales Tax Initiative commenting that the
Committee cities have been blamed for dragging their feet when reports have
not yet been received, that before October it a City Council
majority is needed to approve a concrete initiative that's going
on the November ballot and that that's just not going to happen.
Councilman Eck said that a sense of humor is good as he gets a
little disturbed regarding a lot, of blame that's being passed on
to the cities that haven't yet received anything.
City Manager Callinan gave brief comments on Rohnert Park
population projections.
Councilman Eck explained that copies had been provided to Council
regarding the final 101 Corridor Summary Report stating that he
did not know whether to endorse it or suggest changes, that the
final meeting will be on August 15, 1989, and suggested asking for
public comment. Councilman Hopkins asked if others had seen
John Belshaw's comments. Mayor Cochran said this matter should
be placed on the agenda for the next couple of meetings.
Council concurred.
Communications Communications per the attached outline were brought to the
attention of the City Council. No action was taken unless
specifically noted in these minutes.
Bike Path via City Manager Callinan referred to copies of correspondence
School District provided to Council dated April 25, 1989 from Mr. Steve Bailey of
McBail Corp. to Cotati - Rohnert Park Unified School District that
was not on the agenda regarding a bike path along the north side
of the University Park Subdivisions on the School District and
City properties stating that the developer has given the School
District $45,741.55 and that the School District will do
the project.
Councilman Eck said that since the concept was already approved,
to so state as part of this meetings minutes. Council concurred.
So.Co.Transportation Mayor Cochran asked if anyone could attend the Sonoma County
Committee Meeting Transportation Committee meeting tomorrow at 11:30 a.m. to which
City Manager Callinan said that City Engineer Brust would be
able to attend.
City Attorney's City Attorney Flitner said that litigation matters were covered in
Report the closed session at 7:00 p.m. tonight prior to commencement of
this open session.
Matters from Council: Mayor Cochran explained that the.Cable TV Report was not ready and
Cable TV Report asked this matter to be carried aver to the next council meeting.
Meetings Mayor Cochran reminded the Council of the following open house and
meetings: 1) REMIF Open House, August 4, 1989, 2) League of
California Cities Redwood Empire Division President Dominichelli's
request for agenda items for August 26, 1989 in Crescent City, and
3) National League of Cities Annual Congress of Cities, November
25 -29, 1989 in Atlanta, Georgia requesting that Council members
notify City Manager's Secretary L.Roberts of interest to attend.
City Employee Housing Councilman Hopkins gave comments regarding the possibility of
helping City employees to buy or acquire housing, and that he will
be discussing this issue at the California Cities Redwood Empire
Division meeting on August 26, 1989 in Crescent City. He said he
thought this would have to be a recruiting tool in the future,
that if we want employees to live here, there will have to be some
way of helping.

Constitutional Council Member Spiro extended appreciation to Judd Snyder for
Amendment having made the Council aware of some people we support
inadvertently, and referring to the recent letter to President
Bush regarding the flag burning issue and supporting an amendment
to change the constitution, thought the Council members were
voting with hearts and emotions. She said when we took office,
the oath was taken to preserve and protect the Constitution and
quoted a great French writer and philosopher who said, "I
disapprove of what you say, but I'll defend to the death your
right to say it ".
Council Member Spiro made a motion to reconsider Council's
position on supporting an amendment to the Constitution regarding
the flag burning and write another letter to President Bush
accordingly.
Discussion followed concluding with Councilman Ec1

mowers on the golf course early in the mornings to which City

noise regulations and not run the mowers before 7:00 or 7:30 a.m.

'AyTe, request that the City Council riot certify this EIR as adequate because
there has not been enough time for interested agencies and individuals to
review the FEIR., and be-cause some of the responses to comments:- do riot
meet the requirements- set forth in the CEQA guidelines.
TJI-ie response-- to comments-were first available last Thursda7 evening, JL*j
0, at the planning commission meeting. Even though copies of the FE IR
,%7ere not.. vailable on the 2 Oth., the planning commission certified it as
adequate. S )ome of us would like to review the FE I R in more detail than the
planning commission did. I have not 7et received a copy of the FEIR., and I
doubt other interested parties have.
Standards for responses to comments are set forth in 'Section 1 0 8 V 11 of the
CEQA guidelines. Some of the responses to the NV%TRP EIR do not meet these
standards.
1;1 The response to -comment 03 states that the population /employ ment
assumptions were taken from "new general plans under stud; ? ". Rohnert
Park does not have a new general plan 'Linder studT and an assumptions
based on the emsting general plan are erroneous for reasons stated in the
Sierra Cl b 's comment. on the DE I R. Therefore comment #6 has not been
adequa teI TT responded to, nor has comment * 10.
The response to comments 4112 and `3 1 is inadequate because it does not
address in detail a significant issue ignored in the DEIR. This response is a
conclusor�r statement. that does not present any factual information about
the exdSting and future supplies of water.
The response to comment * 13 is inadequate because it does not directl7
address the comment. There has obviouslv been no reasonable anal7sis done

of the sewage disposal issue raised in the comment.
4) The response W comment 2 states that no new information has been
presented to change the discussion of growth inducing impacts. This is not
true. In the Sierra Club's comments it is clearl7 stated that the Rohnert Park
Cieneral Plan is outdated and has interna1177T inconsistent element-;. The DE I R
