1989/04/11 City Council MinutesRohnert Park City Council Minutes April 11, 1989 The Council of the City of Rohnert Park met this date in regular session commencing at 7 :00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Cochran presiding. Call to Order mayor Cochran called the regular session to order at approximately 7 :02 p.m. and led the pledge of allegiance. Roll Call Present: (5) Council members Eck, Hollingsworth, Hopkins, Spiro, and Cochran. Unscheduled Public Mayor Cochran stated that in compliance with State Law (The Rrown Appearances Act), anyone in the audience who wished to make a comment may do so at this time. Cable Television George Horwedel, 766 Camino Colegio was recognized and asked if Council could take a closer look at MultiVision Cable contract pointing out several sections in which he felt they might not be in compliance. He stated they were to provide 40 channels by January lst, and as of today there are not 40 channels operating and would like to know why not. He also shared that he noticed that within 90 days of the first anniversary a public hearing may be held in which �4ultiVision Cable shall be present and participate. Mr. 71orwedel gave further comments regarding contract Sections 9.1, 9.5, 9.7, and 9.8 in which he did not feel �tultivision Cable was in compliance. Absent: (0) None. Approval of Minutes Upon motion by Councilman Hopkins, seconded by Councilman Hollingsworth, and unanimously approved, the minutes of the meeting of March 28, 1989 were approved as submitted. kpproval of Bills Upon motion by Councilman Hollingsworth, seconded by Councilman Hopkins, and unanimously approved, the bills presented per the attached list in the amount of $1,172,419.86 were approved. Non - agendaed Mayor Cochran queried if any Council member had any non - agendaed Items items to add to the agenda. City Manager Pro- Tempore Brust reminded Council of invitation provided to each Council member to attend the 100th birthday of Eva Fry at 12:30 on April 14, 1969 at the Senior Dining Site in the Community Center building with ,request to R.S.V.P. if planning_ to attend. Rohnert Park City Council Minutes (2) April 11, 1989 Mayor Cochran directed City Attorney Flitner to write a letter to MultiVision Cable asking them to respond to qtr. Horwedel's Comments. P. G. & E. Sil Cincera, Senior New Business Representative for Pacific Gas Franchise Payments and Electric Company, was recognized and presented Council with P.G. & E.'s franchise payment checks to the City of Rohnert Park in the amounts of $37,388.81 for gas and $124,422.86 for electric. CONSENT CALENDAR Mayor Cochran queried if anyone had any questions regarding the matters on the consent calendar. No one responded. RP Expressway at Stony Point Road) Upon motion by Councilman Hopkins, seconded by Councilman Hollingsworth, and unanimously approved, the Consent Calendar was approved as outlined on the meeting's agenda. Ordinance No. AN ORDINANCE OF THE CITY OF ROHNERT PARK TO REDUCE THE MEMBERSHIP 512 OF THE ROHNERT PARK RECREATION AND PARKS COTIISSION TO FIVE MEMBERS BY ATTRITION AND AMENDING SECTION 2.32.020 OF THE ROHNERT PARK CITY CODE TO SO PROVIDE Upon motion by Councilman Hollingsworth, seconded by Councilman Hopkins, and unanimously approved, Ordinance No. 512 was introduced. Scheduled Public Sonoma County Supervisor Jim Harberson was recognized. He will be Appearance discussing transportation matters and expressed appreciation to Council for the opportunity to do so, however, he'd like to mention first what's happening with open space funds and that he has talked to the Sonoma County Board of Supervisors regarding the possibility of going to a vote of the people as might well be required for purchasing of open space and funding between cities, similar to the way purchases for conservation used to be done. Mr. Harberson mentioned he thought it's a very exciting thing to consider the possibility of having an open space.district in years to come, but feels it's premature to consider it now. Supervisor Harberson referred to the ambulance service stating that this would probably result in a county franchise agreement or master contract and that the matter would probably come back to the Sonoma County Board in 60 days. On transportation issues, Supervisor Harberson stated that some movement on the part of the Sonoma County Transportation Committee has occurred within the last few weeks. He informed that the committee does not feel that there is an adequate transportation plan as yet and are still discussing formation of a transportation authority. ue mentioned that if widening of Highway 101 was to be done funds needed would be approximately $365 million. He further stated that $463 million can be raised with the proposed 1/2 cent sales tax over a twenty year period. Also, he said that the Sonoma County Transportation Council has been requested to come up with a plan to be included and which will have to be approved by a majority vote, and that naturally, thev would like this City Council to sunport the Transportation Committee. Rohnert Park City Council Minutes (4) April 11, 1989 Discussion followed during which Councilman Hopkins said that he thought the transportation authority should work with a five member board like the city's commissions, and that the fifth member should not be the Auditor Controller of the County but should be another official elected at large from the Cities or County area. Councilman '[opkins also suggested that they should go for 1 cent sales tax versus 1/2 cent saying that the 1/2 cent will not be enough to solve the problem and people should understand that doing a job half way is not good. County Supervisor Harberson replied that he feels that state and federal highways should be maintained by state and federal funds, but realizes the fact that local funding is being forced by the State. Mayor Cochran commented that the amount would be dependent on the population base so why not concentrate on getting the peoples' votes. Councilman Eck expressed appreciation to County Supervisor Harberson for coming to tonight's meeting and also referred to the strategy of a sales tax for transportation and that he thinks there's only been one passed so far that is based on roads only, that the question should be dealt with regarding county -wide growth management as well as Northwestern Pacific Railroad right of way, and that he thought something should be put.in the plan to allow for some funding,, and there would be advantages if an integrated package could be put together. Resolution No. RESOLUTION ORDERING CITY MANAGER OF THE CITY OF ROHNERT PARK TO 07 -J4 ABATE NUISAN(: r'S EXISTING W1 "1 "Hl�a THE CITY OF ROFi�IETZT PARK Weed Abatement City Manager Pro- Tempore Brust advised that pursuant to a Council directive given on February 28th, Notices to Destroy Weeds have been published and a public hearing has been scheduled at this meeting to give an opportunity to the public to comment concerning this matter. After the scheduled public hearing the resolution listed on the agenda is to be considered for adoption. Public Hearing Mayor Cochran opened the public hearing at approximately 7:37 p.m. on proposed Resolution No. 89 -54. There being no one desiring, to speak, Mayor Cochran closed the public hearing. Upon motion by Councilman ?lollingsworth, seconded by Councilman rck, and unanimously approved, Resolution Nlo. R9 -54 was adopted. Rohnert Park City Council Minutes (5) April 11, 1989 Public Safety Public Safety Director Dennett stated that Council had been 1988 Annual Report provided with a copy of the Department of Public Safety 1988 Annual Report and distributed two amended pages regarding corrections to the report. He then elaborated on some of the information contained therein and made himself available to answer any questions the Council had concerning the report. Discussion followed regarding the annual report and some newspaper articles on crime being up in Rohnert Park with the conclusion that this might have to do with population increase and that crime is up all over the nation, but that percentage wise Rohnert Park is no higher than the average. Councilman Hollingsworth and Council Member Spiro expressed appreciation to the Department of Public Safety for the good job they are doing. Council concurred. Planning and Zoning: City Manager Pro - Tempore Rrust informed the Council that File No. File No. 1308 1308 concerns a city initiated rezoning of city land on the west side of the freeway, that Planning staff is preparing a Negative Declaration for this matter, and inasmuch as the Planning Commission has not yet acted on said Negative Declaration, that it is to be continued. Paratransit City Manager Pro- Tempore Brust referred to a letter from the Coordinating Sonoma County Paratransit Coordinating Committee stating that Committee Council had been provided with a copy of same. The letter is requesting appointment of a city representative, requesting a senior citizen or someone that is disabled. Mr. Rrust advised that Ann Kennedy, an active senior citizen and member of the City's Senior Advisory Commission, has expressed interest, in being considered for appointment, and that staff recommeds her appointment. Upon motion by Councilman Hopkins, seconded by Council Member Spiro, and unanimously approved, the appointment of Mrs. Ann Kennedy to the Sonoma County Paratransit Coordinating Committee was approved. Setting Garbage Rates Director of Administrative Services Netter shared that negotiations are not completed in regard to a resolution for consideration on setting garbage and rubbish or rubbish collection rates. He stated that if negotiations are finalyzed that this matter will be placed on the April 25 meeting agenda. Discussion followed. Councilman Eck advised he had obtained a model ordinance at a recycling conference in Yosemite and made changes to apply to Rohnert Park. He stated that he thinks it's only a matter of time before such would apply across the state, and distributed copies of same to Council. Rohnert Park City Council Minutes (6) April 11, 1989 By concensus of the Council, it was agreed to direct staff to have Empire Waste Management Co. review a copy of Councilman F.ck's resolution and schedule on the next Council meeting. Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken unless specifically noted in these minutes. Councilman Hopkins referred to a letter from The Creamery Store extending an invitation to participate in the fifth annual butter churning contest that has become a part of the Petaluma Butter and Egg Days celebration that will take place on Saturday, April 29th. Commenting on the victory of the Rohnert Park City Council in last year's contest, Councilman Hopkins said he would be there this year and encouraged the other City Council members to attend also. Councilman Eck suggested our City Council might want to give some kind of counter challenge and Councilman Hopkins mentioned a cow milking contest might be a possibility to consider. City Manager's City Manager Pro - Tempore Brust pointed out that Cultural Arts Report: Commissioner Millie Hamill was in the audience and requested that Multi - Cultural the City Council be reminded of the invitation extended to them to Festival attend the Rohnert Park Multi - Cultural Festival on April 29 -30, 1989 at the Community Center. City Attorney's City Attorney Flitner stated he had no report for this meeting. Report Matters from Council Council Member Spiro shared she would like to comment on concerns she had regarding the General Plan up date. Council Member Spiro General Plan Review said she thought they should be actively implementing the General Plan review, that waiting is not practical. She said she did not feel it was a question of whether or not amendments were made, that the point made by City Manager Callinan was excellent, but that in response to his comments the fact that we don't have sewers, etc. should not relieve us from the responsibility of doing the plan. Council Member Spiro said she thought the creativity that comes from lots of people is good, that if there is a larger number of people involved you would have diverse thinking on the committee. She said the Chair of the committee and the Vice -Chair could be elected by the committee versus being Council appointed. Rohnert Park City Council Minutes (7 ) April 11, 1989 Council Member Spiro said the other idea she wanted to comment on was regarding the majority and minority report that there are a couple of factions that may not feel represented regarding open space and that it seems to her it would be appropriate to proceed as in a public hearing process. Council Member Spiro said she would like to propose to the Council that they set a work shop date tonight, establish goals, policies and directives, that they could he requesting applications from citizens in order to make selections and at the same time re- design the make up of the plan to proceed. Mayor Cochran stated that he wasn't sure he was at the same meeting because he understood it was never the intention to stop the process saying the Council heard the City Manager say we were going to slow the process down. Mayor Cochran said he thought Council Member Spiro's report had merit, but was not sure it was the most practical approach, adding that he thought a 15 member board would be the most effective. Councilman Eck said he'd probably support the general notion of an out reach to see how many would want to participate, and did agree that this process is not on hold. Councilman Hollingsworth reminded that the Council directed the City Manager to come back with those elements that we need to address to make sure we are not in violation in any area and that the process is moving forward. He said that at this point in time he's not prepared to take any action until reviewing City Manager's report. Councilman Hopkins stated that the City Manager would be back from vacation on April 17th and that the City Attorney needs to be looking at this in regard to a language up date of the general plans. City Attorney Flitner stated he had previously given Council his opinion and there's no question housing element needs to be up- dated as it has been five years since last done, and the noise element needs to be addressed with regard to land use, that that's going to become a matter of opinion but thinks there will be those who disagree. City Attorney Flitner made the point that there's a difference between the two terms, referring to general plan and sphere of influence. General discussion followed in which Council concurred to wait for City Attorney's report to be given at the first meeting in May. Recycling; Councilman Fck commented on the latest legislation regarding recycling. Rohnert Park City Council Minutes (8) April 11, 1989 Swim Center Councilman Hollingsworth said the first draft of ERA's feasibility report on the swim center would be in the committee's hands at their May 2nd meeting, and that City Council would be able to review the draft at their May 9th meeting_ He stated ERA is expected to present their final findings on .June 5th. niscussion followed. Freeway overpass Councilman Hollingsworth acknowledged that work has started on the freeway overpass and that there's going to be traffic problems and that the construction of Roberts Lake Road would help. City Manager Pro- Tempore Brust said he does know of the problem and has talked to Cal Trans who has assured him they will do their best. He also advised that the EIR is still being prepared and that City Manager Callinan has indicated there might be some funding problems. Discussion followed from which an update on the status of Roberts Lake was requested for next Council meeting. Lewis Kuehm, 1406 Gregory Court, was recognized and gave comments regarding Founder's Days referring City Council to yellow sheet distributed to them showing the dates set as Sept. 22, 23 and 24. He said the Founder's Days Committee would appreciate a proclamation regarding this event. Mayor Cochran stated it was his intention to prepare a proclamation.
