1989/06/27 City Council MinutesRohnert Park City Council Minutes June 27, 1989 The Council of the City of Rohnert Park met this date in regular session commencing at 7 :00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Cochran presiding. Call to Order Mayor Coc 7 :04 p.m. Roll Call Present: Absent: Late: hran called the regular session to order at approximately and led the pledge of allegiance. (4) Council members Hollingsworth, Hopkins Spiro and Cochran (0) None. (1) Councilman Eck (Time of arrival is noted in these minutes.) Staff present for all or part of the meeting: City Manager Callinan, City Attorney Flitner, Administrative Services Director Netter, Public Safety Director Dennett, Officer Mitchell and Officer Mathis. Approval of Minutes Upon motion by Councilman Hopkins, seconded by Councilman Hollingsworth, and unanimously approved, the minutes of the meeting of June 13, 1989 were approved as submitted except to change the number of Council members present from five (5) to four (4). Approval of Bills Upon motion by Councilman Hopkins, seconded by Councilman Hollingsworth, and unanimously approved, the bills presented per the attached list in the amount of $413,900.74 were approved. Non- agendaed Mayor Cochran queried if any Council member had any non - agendaed Items items to add to the agenda. No one responded. Unscheduled Public Mayor Cochran stated that in compliance with State Law (The Brown Appearances Act), anyone in the audience who wished to make a comment may do so at this time. No one responded. CONSENT CALENDAR Mayor Cochran queried if anyone had any questions regarding the matters on the consent calendar. Acknowledging the City Manager /Clerk's report on the posting of the agenda. Upon motion by Councilman Hopkins, seconded by Council Member Spiro, and unanimously approved, the Consent Calendar as outlined on the meeting's agenda was approved. Redding's Bike Path City Manager Callinan referred to Resolution No. 89 -92 and explained his request to add to the call for bids the planned bike path on the north side of Hinebaugh Creek, east of Commerce Blvd. and adjacent to Cal Skate. He advised that Jim Redding and his associates would pay for the construction of this bike path. The Council indicated approval of the City Manager's request. Cert.of Achievement City Manager Callinan explaned the Certificate of Excellence in of Achievement for Excellence in Financial Reporting advising that Financial Reporting this is the 7th year in a row that the City has received this prestigious award from the Government Finance Officers Association, which is a national organization. He said receipt of the fine job being done by Finance Harrow, his staff, and our Finance Director Harrow was recognized to accept the Certificate Chamber of Commerce Mayor Cochran referred back to the plaque from the Chamber of Award - (continued) Commerce acknowledged earlier in this meeting stating that he wanted to introduce Mr. Ken Butler, Executive Director of the Chamber of Commerce who was in the audience. Mayor Cochran expressed appreciation to Mr. Butler for the special attention given to the City the other night by the Chamber of Commerce. Neighborhood "C" City Manager Callinan referred to copies provided to Council of Stop Signs petition from residents of neighborhood "C" and memo from Traffic Officer Rosengren to Director of Public Safety Dennett regarding the request for placement of a stop sign or speed bumps on the corner of Cielo Circle and Cala Way and pointed out the area on a map on the wall. Mr. Jim Casabella, 1224 Cala Way, was recognized to' represent the neighborhood's request for stop signs at the corner of Cielo Circle and Cala Way explaining the dangerous situation of this particular corner from speeding cars. He stated that the neighborhood, as signified by the sixty (60) signatures on the petition, would appreciate the Council's approval to place stop signs at this corner for reasons of safety to the children there. of Achievement. Mayor Cochran extended congratulations and expressed appreciation for the seventh year in a row for everything Mr. Harrow and the Finance Department has done. Chamber of Commerce Mayor Cochran shared that the City was unexpectedly presented with Award a plaque by the Rohnert Park Chamber of Commerce at their meeting last week acknowledging the City's special contribution to the Chamber of Commerce. Showing the plaque, Mayor Cochran stated that we have accepted this award. Councilman Eck Councilman Eck arrived at this point in the meeting, the time Arrives being approximately 7:09 p.m. Scheduled Public David Eagle, of Earthworm Technology, Santa Cruz, was recognized Appearances and gave explanation regarding recycling of organic waste via the Earthworm Technology use of earthworms and answered various questions from Council. Discussion followed in which interest was confirmed by the Council regarding earthworm recycling, concluding that further study of the matter would be necessary before making a decision. Resolution No. A RESOLUTION DESIGNATING, AUTHORIZING, AND APPROVING THI 89-99 INSTALLATION OF STOP SIGNS (At the Cielo Circle and Cala Way intersection) Upon motion by Councilman Hopkins, seconded by Council Member Spiro, and unanimously approved, Resolution No. 89 -99 was adopted, Cultural Arts Facility City Manager Callinan introduced Theatre Manager Michael Gric( expressing appreciation for the progress he's made regarding thf Cultural Arts Facility (Theatre) in the short time that he's beer here. Promotional Video Theatre Manager Grice referred to the copy of his June 14, 1989 memo provided to the Council relative to preparing a promotional video which would be used to advertise the upcoming opening of thi theatre and offered to answer questions regarding this matter, There were no questions from the Council. Upon motion by Councilman Hollingsworth, seconded by Councilmat Hopkins, and unanimously approved, the preparation of F promotional video to advertise the upcoming opening of the Cultural Arts Theatre was authorized. Symphony Orchestra Theatre Manager Grice referred to the copy of his June 15, 1989 memo provided to the Council regarding an arrangement that he has worked out with the Sonoma State University Symphony Orchestra tc become the symphony orchestra the City's theatre and explained thf contents therein. He answered questions from Council regardin€ costs, explained projected income from percentage of ticket sales, and confirmed plans to have a lecture nrinr to tha .,..a„4n- of «.._ theatre to generate interest. Theatre Manager Grice introduced J. Karla Lemon, recommender Conductor of the symphony orchestra. Ms. Lemon answered questions from the Council regarding her background and experience. Discussion followed. Upon motion by Council Member Spiro, seconded by Councilman Hopkins, and unanimously approved, the organization of the Rohnert Park Symphony Orchestra as recommended by Theatre Manager Grice and to hire the conductor on a renewable one to two year contra was approved. Rohnert Park City Council Minutes (5) June 27, 1989 Fire Sprinklers Director of Public Safety Dennett introduced Officers Mitchell and Mathis who gave a presentation concerning the Department's recommendation that fire sprinklers be included in new single family residences, paired single family residences and duplexes. It was shared that all other new buildings in town are required to have sprinklers installed. Slides were shown revealing fire damages to various buildings, charts showing percentages for types of fires, locations of occurrence and causes, as well as showing examples of sprinkler installations. Discussion followed during which it was suggested that the issue of recommending the installation of fire sprinklers in single family residences is important enough to schedule a public hearing. City Manager Callinan advised that staff is in the process of updating the city's building codes, and proposed that fire sprinklers be required for all new buildings and that the City encourage owners to retrofit existing buildings. City Manager Callinan was directed by the Council to include the requirement of fire sprinklers for all new buildings in the update of the building codes and to make sure the public is properly notified regarding this matter in preparation of a public hearing to be scheduled on the new codes. Planning and Zoning City Manager Callinan explained that in the absence of Planning Director Skanchy who was on vacation, he would explain the Planning and Zoning matters. File No. 1253 City Manager Callinan explained that Council had been provided with copies of the staff report regarding Park Estates Subdivision, File No. 1253 and that this matter was discussed at the last Council meeting regarding their request to exempt the thirty —three (33) lots in this subdivision from needing a building permit allocation because the lots will be built on an individual lot (custom homes) basis over approximately four (4) years. Discussion followed during which it was asked if sewer complications could come up later from other builders to which City Manager Callinan said the calculated flow is so minuscule it will hardly be noticed. Councilman Eck asked if the city could be at any risk with other builders as a result of granting this request to which City Manager Callinan responded no. Upon motion by Councilman Hollingsworth, seconded by Councilman Hopkins, and unanimously approved, the Park Estates Subdivision lots, File No. 1253, were exempted from the building permit allocation process. Rohnert Park City Council Minutes (6) June 27, 1989 File No. 1325 City Manager Callinan explained that File No. 1325 gives consideration to rezoning a 2.5 acre portion of Commerce Blvd. right -of -way located east of and contiguous to U.S. 101 Freeway, west of properties fronting on the east side of Commerce Blvd., extending from Cascade Court on the north to the southerly property line of 5700 Commerce Blvd. on the south from "A" (Agricultural) district to M -LIP-D (Limited Industrial /Planned Unit Development) district. Discussion followed in referance to the city leased sign placed at the above - described location regarding legalities, specific versus directional signs, multiple requests from other businesses, comments from previous minutes, and developing codes, if necessary, for the display of more logos. Public Hearing Mayor Cochran opened the public hearing at approximately 8 :14 p.m. and asked if there was anyone in the audience wishing to speak. regarding this matter. Howard Boggs, 5430 Commerce Blvd., was recognized asking if this will open "Pandora's Box" and create problems regarding businesses putting up bill boards, etc. Carl Calvin, 1070 Civic Center, was recognized and shared that as a representative of the Chamber of Commerce, such a sign does benefit the entire community, that signage is important to their members, and that they would encourage a more generic sign if other motels and such are added. Mayor Cochran closed the public hearing at approximately 8 :17 p.m. City Attorney Flitner addressed the legalities of this matter in response to questions raised during the discussion regarding the possibility of the State's intervention, or if the City's ordinance would fail expressing that hopefully it would hold, that it's conceivable these arguments might need to be faced, but that from his experience to take advantage of the opportunity is appropriate. Further discussion followed regarding having signs in both north and south bound directions, the number of spaces on the signs, the use of logos, concluding with the Council directing City Manager Callinan to send letters to Assemblyman Hauser and Senator Nielsen to encourage legislation toward signs on right of way where they belong as well as the need for local jurisdiction regarding city property. Rohnert Park City Council Minutes (7) June 27, 1989 Ordinance No. AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING TITLE 17 OF THE 514 ROHNERT PARK MUNICIPAL CODE ZONING MAP CHANGE - CITY OF ROHNERT PARK Planning File No. 1325 Upon motion by Councilman Hopkins, seconded by Councilman Hollingsworth, and unanimously approved, Ordinance No. 514 was introduced with a friendly amendment by Councilman Hollingsworth regarding the design on the signs involved on this property to be limited to Gas, Food and Lodging with the use of company logos and the invitation to those businesses who want to put their names under the sign to do so. Recess Mayor Cochran declared a recess at approximately 8:28 p.m. Reconvene Mayor Cochran reconvened the Council meeting at approximately 8 :36 p.m. with all Council members present. File No. 1323 City Manager Callinan explained that Council had received copies of Planning Staff Report and referred to pictures on the wall regarding File No. 1323-Discovery Office Systems -Site Plan and Architectural Review for 3,200 sq. ft. second story addition to Discovery Office System building located on southeast corner of Redwood Drive adjacent to U.S. 101 Freeway, stating that the applicant was in the audience. Discussion followed during which Mayor Cochran complimented the excellant improvement to the building and asked if there were plans to widen Redwood Drive to which City_ Manager Callinan responded that staff is working with the State on the possibility of a contribution of funds and that a State -City cooperative agreement should come before the Council shortly. Councilman Eck referred to item #2 in the Planning Staff Report stating that the plans for landscaping should be more specific than saying "the landscaping in the front of the property be spruced up to include shrubs and trees ". Upon motion by Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, File No. 1323 was approved with an amendment to submit a definite landscape plan to the Planning Commission for review and approval. Mr. Jim Groom and Mr. Michael Moore, representatives of Discovery Office Systems, were recognized a gave assurance that very thorough landscaping plans have been submitted to the Planning Commission and worked out all the way to Hinebaugh Creek. Mr. Moore stated that it was a matter of re -doing all the landscaping with the construction, if approved, and that with all the vandalism and destruction, there was no sense in putting it in beforehand. Rohnert Park City Council Minutes (8) June 27, 1989 File No. 0577 City Manager Callinan referred to plans displayed on the wall an( copies of Planning Staff Report provided to Council regardinf Yardbirds of California, File No. 0577, Site Plan an( Architectural Review for 23,800 sq. ft. addition to existing retail building, 63,000 sq. ft. warehouse building, 10,000 sq. ft, office building, 1,600 sq. ft. employee fitness center, and plant nursery on two parcels totaling 8.12 acres located on the northeast corner of Commerce Blvd. and Cascade Court (former site of BMC West Building Supplies). Discussion followed in which the requirement for street trees or Commerce Blvd. was confirmed by City Manager Callinan. Upon motion by Councilman Hopkins, seconded by Council Membet Spiro, and unanimously approved, File No. 0577 as approved by the Planning Commission was approved. Mayor Cochran asked if the applicant was present and if he desired to make any comments at this time. Mr. Dave Wieldraayer, Store Manager of Yardbirds of California w recognized and stated that he would be willing to answer questions from the Council. In response to a question regarding the opening date, Mr. Wieldraayer said they would like to be open by Octobet 15, but would more likely be November or December. Shopping Center on City Manager Callinan referred to map displayed on the wall and Southwest Blvd. & explained the blight to the neighborhood regarding the condition Adrian Dr. of the shopping center on Southwest Blvd. and Adrian Driv,. He shared that he had received a call from Mrs. Fredericks, owner of the A & W property, who said there's a possibility of another restaurant going in there. City Manager Callinan suggested the Council form a sub- committee to contact property_ owners regarding upgrading this shopping center and see what can be done to vremedy the situation before it gets much worse. Mayor Cochran asked for volunteers for the shopping center sub-. committee to which Councilman Eck and Council Member Spiro responded. History of Small Lots City Manager Callinan referred to map displayed on wall and copies of memo provided to Council (a copy of which is attached to the original set of these minutes) from Planning Director Skanchy regarding Small Lot Subdivisions and reviewed the contents therei^ and previous concessions made to compensate for the small lots. Rohnert Park City Council Minutes (9) June 27, 1989 Discussion followed expressing concerns about possible municipal code deviations regarding the approvals made to allow for the small lots concluding with Council directing City Manager Callinan to advise staff to clarify "good cause" language. Garbage, Rubbish & City Manager Callinan explained that a copy of the resolution Refuse Collection draft regarding garbage rates was provided to the Council for review prior to the meeting. He said that a tentative agreement had been reached with Rohnert Park Disposal (Empire Waste Management) via City staff and members of the City Council's sub - committee (Eck & Hollingsworth) meetings with representatives of Rohnert Park Disposal relative to the company's request for an adjustment of city imposed rates for garbage collection and disposal. He shared that the last time the rates were adjusted was October 1st and November.ist., 1985 and that as a condition of any rate adjustment, the company will be required to provide the automatic service; that is the 90 gallon container type service in single family areas, institute a recycling program starting with single family districts but then going city-wide, and also providing a hazardous materials removal program. Councilman Hollingsworth referred to the draft resolution copies provided to Council regarding garbage rates and commented on the contents therein. Councilman Eck suggested that due to the significant changes being considered, a public hearing should be scheduled and possibly work sessions considered with exposure by the news media regarding the City's interest in entering into recycling in a big way. Discussion followed. City Manager Callinan introduced representatives of Rohnert Park Disposal, namely Tom Walters, Manager, Patricia Pisenti and Kevin Walbridge. Mr. Walters and Mr. Walbridge answered various questions from Council and explained details of the garbage collection operation concluding with the statement that they would do everything they could to make a smooth transition. Upon motion by Councilman Hopkins, seconded by Council Member Spiro and unanimously approved, to endorse in concept the proposed resolution setting new garbage rates and schedule a public hearing at the next regular meeting was approved. Sonoma County Councilman Eck gave comments regarding the plans and programs of Transportation the Sonoma County Transportation Committee (SCTC) relative to Committee sales tax increase election and referred to copies of documents provided to Council from SCTC Chairman Jim Harberson and Growth Management Subcommittee Chairman Tim Smith and shared the contents therein regarding U. S. 101 Corridor Committee recommendations, Rohnert Park City Council Minutes (10) June 27, 1989 proposed use of funds, proposed election date, and proposed Growtt Management Plan. Councilman Eck said that hopefully the 101 Corridor matter will be on the Council agenda so it can act on it at the next meeting. Mayor Cochran gave comments regarding the liaison Technical Advisory Committee (TAC) stating that it would be meeting tomorrow afternoon and Thursday and that so far the committee has voted to put the sales tax issue on the November ballot and for the 1 cent versus the 1/2 cent sales tax. Discussion followed regarding concerns over the inaccuracy of population figures, using building unit numbers versus population numbers, the need for public hearings and the possibility of State mandates versus local control. Upon motion by Councilman Eck, seconded by Councilman Hollingsworth, and unanimously approved, for this Council to adopt a formal position that it is interested in the SCTC sales tax proposal but can't respond appropriately on it by August 1st and wants the election date delayed and to have further discussione, and public hearings. Further discussion followed. Sonoma County City Manager Callinan referred to copies of his memo provided to Hazardous Waste the Council regarding the Hazardous Waste Management Plan in which. Management Plan it was explained that the Council had been provided with a copy of the June 16th transmittal letter from the County Public Health Department transmitting a copy of the Sonoma County Hazardous Waste Management Plan. No action was taken unless specifically noted in these minutes. city Manager Callinan brought to the Council's attention correspondence from Chairperson Janet Nicholas of the Sonoma County Board of Supervisors regarding the invitation to the next scheduled County /Cities meeting on July 17, 1989. City Manager Callinan referred to his memo to Mayor Cochran and Councilman Eck sharing Petaluma City Manager John Scharer's invitation to a meeting on June 28, 1989 at the City of Santa Rosa Municipal Services Center regarding the Sonoma Count - Transportation Commission's proposal for the sales tax electio. and its various components. Rohnert Park City Council Minutes (11) June 27, 1989 City Manager Callinan brought the Council's attention to correspondence from Bay Area Air Quality Management District regarding the recently adopted Waters Bill (AB 3205) going into effect on July 1, 1989. City Manager's City Manager Callinan referred to the Council Meeting Memo for Report review of the first five items listed on the agenda of the City Manager's report regarding (1) Roberts Lake Road bid results, (2) CDA payment to City, (3) Ambulance service update, (4) Price Club update, and (5) Hazardous Materials Response Unit update (a copy of which is attached to the original set of these minutes). High School Track Team- City Manager Callinan brought to the Council's attention a request from the Cotati- Rohnert Park Unified School District for payment of one -half of the cost of plaques, that is $250.95, that were obtained to commemorate winning of the championship by the Rancho Cotate High School track team. He pointed out that even though the track team representatives did not appear before the City Council as is customary, it has been past practice to split the cost with the School District for the championship teams. Upon motion by Councilman Hopkins, seconded by Councilman Hollingsworth, and unanimously approved, the payment to Cotati- Rohnert Park Unified School District in the amount of $250.95 representing one -half of the cost of plaques obtained for the championship Rancho Cotate High School track team was authorized. Norrbom's Ambulance City Manager Callinan advised the Council of_a letter received today indicating that Norrbom's Sonoma Ambulance Service will cease operations in Rohnert Park on July 1st, at which time another ambulance company headed by Richard S. Pearce who worked for Norrbom's would commence operations. City Manager Callinan indicated that unless the Council felt otherwise, he was going to allow Mr. Pearce's company to commence operations provided they post the necessary insurance certificates with the city, but that he would also require them to subsequently apply for and receive a Certificate of Public Convenience and Necessity from the City. The Council concurred with City Manager Callinan's approach. City Attorney's City Attorney Flitner shared that he talked with the Rent Control Report Board about the consideration being given to rent a judge, that the board is favorable, though the cost has not been ascertained and may be split. He said the rent a judge has all the attributes of a judge, but in order to be prepared, the matter is on the Court Calendar but is trailing. He said that Councilman Eck, Councilman Hollingsworth and City Manager Callinan have been subpoenaed to appear in court for the Rent Control matters of which City Attorney Flitner said he will try and get them out of this as their attendance doesn't seem necessary. Rohnert Park City Council Minutes (12) June 27, 1989 City Attorney Flitner updated the Council on the cases regardin Harris' condo, Young's easements, and Crane's propert acquisition. City Attorney Flitner shared that he attended a recent meetin regarding growth control and referred to a book by Attorney Da. City Attorney Flitner shared information regarding the possibiliti of any council member's interest to acquire stock in the new banl that's being formed in the City. He referred to the Political Reform Act which says you can't participate in a matter if there', interest in financial outcome, but could not give a blanket opinion referring to the Fair Political Action under the Reforn Act that will give protection if formally requested saying he would be glad to write and get a written opinion if so desired b} the Council. City Attorney Flitner said he thought if a Council member bought stock, it would be necessary to abstain, that it does not apply if there's no interest now or for twelve months prior. Matters from Council: Acknowledgment was given to the joint meeting with County Joint Meeting _ Sonoma and Santa Rosa City Council on July 17th, 1989 at 8:30 a.m. Softball Tournament Councilman Hopkins requested that the minutes reflect that he would like to be the City's representative at the Hopkins —Girls Softball Tournament, Elk Grove, Ca. on July 8th and 9th, 1989 stating that he would not be submitting any expenses for his attendance to this event. The Council concurred with the request. Sonoma County Fair Mayor Cochran encouraged Council members to attend the Sonoma County Fair, Rohnert Park Day on July 26th, 1989 as has been done in years past. Flag Burning Councilman Hollingsworth asked if the Council would like to support Congress's vote (440 to 5) to make some changes regarding the constitutionality of desecrating of the American flag in view of the recent Supreme Court decision.. Upon motion by Councilman Hollingsworth, seconded by Councilman Hopkins, and unanimously approved, to support Congress in making Constitutional change regarding the desecration of the U.S. flag and to direct a letter to the President and our Representatives accordingly was approved. Rohnert Park City Council Minutes (13) June 27, 1989 Diving Insurance Councilman Eck expressed concerns regarding diving tower insurance referring to a recent article in the San Francisco Chronicle which said diving tower insurance is impossible to get and stated that since we'll have a fairly substantial diving facility we should be looking into this matter. City Manager Callinan explained the liability coverage through R.E.M.I.F. covers everything that's not specifically excluded and that the new policy is in effect as of July 1st. Discussion followed. General Plan Council Member Spiro gave comments regarding the League of Cities' Correction from Community Service Committee and that it has a committee on growth 7/11/89 meeting; : management recommending that local government do the planning for Council Member Spiro all growth problems in the county. stated that the comments herein were quotes from the League of Cities' Community Service Committee and not her own. Sonoma County Fair Council Member Spiro referred to the underprivileged children that will be sent by the City to the Sonoma County Fair saying that Annette Lyons has offered to make arrangements for locating the children and get them to the fair. Mayor Cochran learned that the City is not a member of the U.S. Conference of Mayors stating that when the City Manager joins, the Mayor can always be a voting member. City Manager Callinan said he would check into the population requirement for joining to which Mayor Cochran said it was 30,000 and with such issues as agricultural, drugs, etc. coming up, it will be important to be able to vote. Directory /Network Council Member Spiro commented on the recent California League of Cities' meeting which included speakers from Berkely regarding youth centers and networking and putting together organizations within cities that can provide a place where people can go to get things done with consideration being given to a directory. She said more information should be coming out shortly on this matter. Mary Webber, 725 Lincoln Avenue, Cotati, was recognized and aske if the City had plans in the new future regarding upgrading bik paths referring specifically to the way the bike path ends in mi air on Commerce Blvd. and is very dangerous to bikers. Discussion followed concluding that even though the locatioi referred to by Mary Webber was in Cotati, the City needs to lool at the overview of bike paths. The Council instructed Cit, Manager Callinan to follow up accordingly.
