The Council of the City of Rohnert Park mt this date in
regular session commencing at 6:00 p.m. in the City Offices,
6750 Commerce Boulevard, Rohnert Park, with Mayor
Eck presiding.
CALL TO ORDER Mayor Eck called the regular session to order at approximately
6:10 p.m. and led the pledge of allegiance.
Nbyor Eck said a Community Development Agency work session was
held at 5:00 p.m. prior to this regular Council meeting to
discuss project funding priorities.

Approval of Minutes Upon motion by Councilmember Hollingsworth, seconded by
Councilmember Hopkins, the minutes of July 2 and 9, 1991
were unanimously approved as submitted.
Approval of Bills Upon motion by Councilmember Hopkins, seconded by
Councilmember Hollingsworth, and unanimously approved, the
bills presented per the attached list in the amount of
$1,271,232.90 were approved. CDA bills presented per the
attached list in the amount of $705,289.13 were approved.
Uischeduled Public Nhyor Eck stated that in compliance with State Law (The Brown
Appearances Act), anyone in the audience who wished to make a comment may
do so at this time. In most cases under legislation of the
new Brown Act, the Council cannot handle an item without
agendizing. To ensure accurate recording, "Speaker Cards" are
provided at the entrance of the Chamber and unscheduled public
appearances are requested to fill out the cards and present to
recording clerk after speaking.
Tom Deherrera Tom Deherrera, 2320 West College, representative of Gateway
Landscape Construction, Inc. referenced recent "M" Park
bidding procedures, explained the teamwork and efforts
involved to ensure participation of as many interested

subcontractors as possible. He said times are synchronized to
make sure agency requirements and deadlines are met and that
Gateway's bid was submitted to City Hall staff two minutes
before the_2 °CO p.m, deadline.
Mayor Eck said the "M" Park item was scheduled later on
tonight's agenda and would be reviewed further at that time,
Henry Porter Henry Porter, 7217 Camino Colegio, said he coaches a local
women's softball team that is working toward participating in
upcoming national tournament in Spring Boat, Colorado. He
said the team is making efforts toward expenditures of
participation in the nationals via bake sales, raffles, etc.
He reviewed a discussion with Recreation Director Pekkain
regarding the team's request for the Parks and Recreation
Commission to give consideration to waive the $175 fee for
scheduling the Rohnert Park Stadium and the $100 charge for
facility use as the City's contribution toward efforts of the
women's softball team. Since timing of the national
tournament is caught between the next Parks and Recreation
Commission meeting and City Council meeting, he is requesting
waiver of .fees directly from Council for consideration.
Discussion followed.
Mayor Eck explained reasons for referring such requests to the
Parks and Recreation Commission for review. He said it would
be a bit of a gamble on this team's part but recommended that
the team put the money up front in some way such as by credit
card, if necessary, and proceed with the City's established
policy of review by the Parks and Recreation Commission.

Upon motion by Councilmember Hopkins, seconded by
Councilmember Hollingsworth, and unanimously approved, the
Consent Calendar as outlined on the meeting's agenda was
approved.
Presentation to Mayor Eck presented an engraved clock to Nancy Seymour along
Nancy Seymour with a copy of resolution approved on tonight's preceding
consent calendar expressing appreciation to Ms. Seymour for
her many years of service to the City as a member of the
Cultural Arts Commission and Cultural Arts Corporation. He
said the framed /original resolution would be given to her
following approved signature process. Nancy Seymour said she
started working for the City's Cultural Arts in April of 1982
and has served nine years. She thanked Council for its
thoughtfulness extended on her behalf and for the letter of
recommendation written over the Mayor's signature.
Guanella Bros. Walt Guanella referenced copies provided to Council of his
Softball Team letter dated July 10, 1991 requesting approval of a $10,000
grant from the City to help defray costs of sending Guanella
Bros. Softball Team to the I.S.C. World Tournament in Sioux
City, Iowa from August 9 through 19, 1991 and to the A.S.A.
National Tournament in Midland, Michigan from September 6
through 15, 1991. Mr. Guanella reviewed expenses incurred for
these tournaments totaling approximately $33,000 and expressed
appreciation to the City for granting such requests in the
past. He also reviewed the benefits to the City generated
from the worldwide representation of the Guanella Bros.
Softball Team as well as financial benefits from Transient
Occupancy Tax, concessions, percentage of ticket sales, etc.
Discussion followed during which Councilman Reilly asked
about the differences between this team's request and the
previous team's request under tonight's unscheduled public
appearances. Differences between the teams were reviewed

basically referencing the above - mentioned benefits to the
City. City Manager Netter responded to Councilman Reilly's

Police Association's recent event of which $1,000 to $2,000
had been requested.
A motion was made by Councilman Hopkins, seconded by
Councilmember Spiro, to authorize the expenditure of a $10,000
grant as requested by Guanella Bros. Softball Team and
approved by the following vote:

Mayor Eck said this ordinance was introduced at the previous
Council meeting following the scheduled public hearing and
would be considered for adoption at this time by a roll
call vote.
Councilmember Spiro said she would like to see this Real
Property Transfer Tax increased in stages as mentioned at the
previous Council meeting.
Upon motion by Councilman Hollingsworth, seconded by
Councilman Hopkins, Ordinance No. 540 was adopted by the
following roll call vote:

Ordinance No. 541 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING CHAPTER 6.20

THE LICENSING OF CATS, FEES FOR SUCH LICENSING AND PENALTIES
FOR FAILURE TO LICENSE
Mayor Eck said this ordinance was introduced at the previous
Council meeting following the scheduled public hearing and
would be considered for adoption at this time by roll
call vote.
Upon motion by Councilman Hollingsworth, seconded by
Councilmember Spiro, and unanimously approved by roll call
vote, Ordinance No. 541 was adopted.

Proposed "M" Park City Manager Netter said the resolution for consideration
Improvements, regarding award of contract for proposed "M" Park improvements
Project No.1989 -14 was continued from the July 9-th meeting due to .a. letter
protestin; the bid opening an& explained details as outlined
in tonight's Council Meeting Memo. He referenced copies
provided to Council of other letters received and on file from
contractors supporting the low bidders' timeliness, a couple
of letters from other contractors challenging same, and said
letters were also on file in Public Works Department
confirming that the tun lowest bids were received in a timely
manner by a City representative prior to the 2:00 p.m.
deadline. W. Netter said staff discussions with the City
Attorney resulted in the two options for Council consideration
as listed on the agenda.
City Attorney Flitner explained the two options and discussed
the ramifications of each.
Discussion followed during which confirmation was given by
staff to Council inquiry that the facts indicate that the low
bid was received by a City representative prior to the 2:00
p.m. deadline. City Engineer Brust responded to Council
inquiry that the bid notices do not specify a particular
office or room as part of the requirements for receiving bids
at City Hall.

Upon motion by Councilman Hollingsworth, seconded by
Councilmember Spiro, and unanimously approved, reading of
Resolution No. 91 -149 was waived and said resolution was
adopted.
Rent Appeals Board 1) Appeal of Landlord Petition No. 91 -01 - City Manager Netter
said this appeal was continued to July 25th at 2:00 p.m. due
to not having sufficient votes to proceed with the appeal and
referenced details of the item as explained in the Council
Meeting Memo.
2) Rejecting Vern Smith resignation - City Manager Netter
referenced copies provided to Council of letter of resignation
dated July 11, 1991 received from Rent Appeals Board Member
Vernon P. Smith and said staff recos rejection of this
resignation at this time due to the need of an active
Commissioner in order to continue the above- referenced appeal
and other Rent Appeals Board matters. Mr. Netter said staff
also recommends that Council not accept any further
resignations until such time as new members are researched
and appointed. Discussion followed.

Sonoma County Para- City Manager Netter referenced copies provided to Council of
transit Committee Fact Sheet dated July 21, 1991 from Linda Branscomb for

Discussion followed during which Council extended compliments
to Ms. Branscomb and commended her for efforts taken in the
preparation of her application with references.
A motion was made by Councilmember Spiro, seconded by
Councilman Hopkins, and unanimously approved, to appoint
Linda Branscomb to the Sonoma County Paratransit Coordi-
nating Committee.
Property Abatements: 1) 7608 Blair Avenue - City Engineer Brust said the repair
work at 7608 Blair Avenue continues to move along at a rapid
pace. The interior is almost completed, workers should be
putting carpet down by next Monday afterwhich the exterior
repairs will be completed.
2) 7711 Blair Avenue - City Engineer Brust said all abatement
items as listed have been completed at 7711 Blair Avenue. The
owner is proceeding with extensive remodeling on the interior
which is the reason now that the property is still
uninhabitable. A driveway parking area has also been put in
alongside the building.
City Manager Netter said it is staff's recommendation that
Council accept the owners appeal as requested as all items as
noted in the original abatement notice have been completed.
By doing this, all the abatement proceedings would cease.
A public hearing has been set on tonight's agenda. The
presence of John Milliken, property owner, was acknowledged.
Discussion followed.
Public Hearing Mayor Eck opened the public hearing at approximately 6:50 p.m.
There being no one desiring to speak, Mayor Eck closed the
public hearing.
A motion was made by Councilman Hopkins, seconded by
Councilman Hollingsworth, and unanimously approved, to accept
this property owner's appeal and stop the abatement
proceedings as recommended by staff.
Proposed Intermediate City Manager Netter said copies were provided to Council of
School EIR Final Environmental Impact Report dated July 16, 1991 for the
Proposed Intermediate School at Snyder Lane and Keiser Avenue
which was prepared for the Cotati- Rohnert Park Unified School
District by Earth Metrics Incorporated. Mr. Netter said
copies were also provided to Council of several letters on
file in the City Manager's office in protest to the above -
referenced proposed site for the new middle school as follows:
Scott Callow, Registered Environmental Health Specialist
and Karen Callow, 1445 Parkway Drive, dated July 1, 1991;

Julia Parker, 1466 Parkway Drive, dated July 18, 1991; and,
Caryl Fuller, Rohnert Park, dated July 18, 1991. City Manager
Netter said a letter has beer drafted over the Mayor's
signature to the School District expressing support'for the
project as it is a necessity for the proper education of
Rohnert Park youths, but also noting the various inpacts of
the project and that the School District would have to address
and mitigate the impacts.
Discussion followed regarding the complexities of EIRs,
appreciation for the relatively new School Board and efforts
involved in probable first time experience in dealing with
EIRs which includes the need to allow for adequate notices and
time during meetings for public input. Acknowledgment wnS
made regarding serious problems that could have developed
time -wise if the School Board had not acted as quickly as it
did regarding this proposal for the middle school.
Mayor Eck expressed concerns regarding safety to bikers at the
proposed site and acknowledged receipt of a couple phone calls
regarding this matter. He said the City has no legal position
to participate in the decisions regarding this matter which is
currently necessary for the School Board to struggle with and,
therefore, it is important that Council express its concerns
with information in the EIR and very clearly spelling out
mitigations, and that all is planned prior to entering into a
service agreement with the School District.
Solid Waste Matters City Manager Netter referenced copies provided to Council of
letter dated July 12, 1991 from County of Sonoma Department of
Public Works with attached draft agreement regarding the Joint
Powers Agency (JPA) to Deal With Waste Management Issues (Wood
Waste, Yard Waste, Household Hazardous Waste, and Public
Education) which is tentatively scheduled for review by the
Board of Supervisors on July 30, 1991. He said a staff report
was also provided to Council outlining details of the
referenced draft agreement and that staff was available to
respond to Council questions regarding same. Mr. Netter said
these items have been provided for Council's information and
the matter does not require action at this time.
Discussion followed during which Assistant to the City Manager
Leivo responded to Council questions regarding details within
the referenced draft agreement. Concerns were expressed
regarding the composition of the Joint Powers Agency and the
votes referred to on page three, second paragraph.
A motion was made by Councilman Hollingsworth, seconded by
Councilman Reilly, and unanimously approved, recommending that
the vote requirement of the Joint Powers Agreement for the
Waste Management Issues be changed to a two- thirds vote of the
members for action on major issues as opposed to requiring a
unanimous vote of total membership for such approvals, and
that each agency have one member (one member - one vote).

Mountain Shadows City Manager Netter said copies were provided to Council of

Permit for Temporary Concession Stand and shared contents
therein (copy attached to original set of these minutes).
At its recent July 18th meeting, the Planning Commission made
the conditions listed in the above - referenced memo part of the
Use Permit requirements. Discussion followed.
A motion was made by Councilman Hollingsworth, seconded by
Councilman, and unanimously approved, to grant the use of the
temporary concession stand at Mountain Shadows North Golf
Course as recommended by staff and depending upon outcome of
survey from neighbors that border the area.
Proposed Formation of
City Manager Netter said copies were provided to Council of
Street Light /Lana-
resolutions for consideration regarding Proposed Formation of
scape Assess.Dist.
the City of Rohnert Park Street Light and Landscape
Maintenance Assessment District (Pursuant to Landscape and
Lighting Act of 1972), memorandum dated July 17, 1991 from
City Attorney outlining necessary steps in the formation of
such a district, and shared contents of staff report from
Finance Director Harrow indicating annual costs of maintaining
the parks and landscaping areas throughout the City as well as
operating costs to run the street light program. Mr. Netter
indicated that this proposal was submitted in light of the
budget deficit and indicated approval of this benefit
assessment would assist the general fund and avoid dipping
deeply into reserves. Mr. Netter said public notices have
been posted in the local newspaper and a lot of press has been
printed over the past few weeks on this proposal. A public
hearing has been scheduled at this time regarding this matter.
Discussion followed during which City Attorney Flitner and
City Manager Netter responded to various Council questions
regarding legal requirements, the Five Year Projection
prepared by Finance Director Harrow of which copies were
provided to Council, and the possibility of revenue short
falls even with such developments as the Price Club, Wal -Mart,
Home Depot, etc. Also reviewed were staging possibilities and
the time line to secure this benefit assessment for the 91 -92
tax rolls, and the application of the tax on a per parcel or
per unit base.
Public Hearing Mayor Eck opened the public hearing at approximately 7:21 p.m.
Paul P. Gregorian Paul P. Gregorian, 5739 Davis Circle, said the tax problem in
the federal, state and municipality governments has become an
issue no one wants to mention and the same applies to this
agenda item. If citizens want to enjoy all the privileges
and /or assets provided, it should be incumbent upon everyone

to meet the challenge and pay the deficit created by the
growing number of benefits. The only way to do this is to
raise-taxes., Therefore, rather than ,use._ z QSPr -ves, �41y not
face the realities of the day and increase the takes in a fair
way so that everyone can benefit. It is better to pay for the
needed services than to reduce important necessities like the
continued maintenance and repairs of parks and roadways.
Barbara J. Cowens Barbara J. Cowers, 285 Adele Avenue, said she agreed with
previous statement by Councilmember Spiro that the per parcel
charge is not fair and, if established, the ruling should be
to pay per unit because of the various types of high density
units on a parcel compared to parcels with single dwellings.
She said with the raising of water rates as well as all the
other fees, and now consideration to raise taxes, citizens are
being taxed to death. Even though there are many like herself
who can probably afford to pay an additional $50, there are
those on limited incomes who singly cannot afford it. There
are some that do eat dog food for survival even here in
Rohnert Park which is terrible. Ms. Cowen said she knows
these taxes have to be done, but thought more study should be
done first with mre adequate notices to the public to provide
mrare opportunity to participate with input since most have not
reviewed the matter and do not know about it.
George Horwedel George Horwedel, 7669 Camino Colegio, said he was at the last
meeting during which Council was talking about excluding
condos and apartments from this assessment because of
providing their own facilities. He said the square footage of
the average two bedroom condo does not come up to that of a
four bedroom home. Consideration should also be given to the
fact that condo residents are paying for most of their
services like landscaping, pools, play areas, etc., therefore,
condos and apartments should have lower rates if this
assessment district is formed.
Tim Danesi Tim Danesi, 6400 Meadow Pines Avenue, said he currently rents
a condo in which $50 per month of his rent pays for parks and
lights in that area and a portion of the rent also pays for
landscaping. If landlords /property owners are required to pay
more, rents will have to be increased which means condo
residents and apartment renters will end up being hurt the
mast. This is a tax and it is unequal. The charges should
be based on sites rather than per parcel.
There being no one further desiring to speak, Mayor Eck closed
the public hearing at approximately 7:30 p.m.
Councilmember Spiro said she understood the concerns expressed
during the public hearing for condos /apartments as far as
landscape maintenance and other facility provisions go, but
where roadways and street lights are concerned, everyone
should be levied proportionately.

Councilman Hollingsworth said there is a tendency to operate
under a panic because of thinking the deficit might be more
than anticipated. but felt consideration- of this item is being
rushed because of the 1991 -92 tax roil deadline. He suggested
delaying action on this item for one year which would provide
the needed time to address all the issues.
A motion was made by Councilman Hollingsworth, seconded by
Councilman Reilly, to delay action on the formation of this
assessment district.
Councilman Hopkins said the formation of this assessment
district could be enacted six months after Council's review
of the six month financial summary, to see if this assessment
is necessary.
Mayor Eck acknowledged that the inclination of this discussion
is to delay action on this item. He said it is always nice to
put off this kind of decision but felt nervous about the
City's finances, that if projections are right, the City will
not have the reserves in the future to balance the budget.
Mayor Eck said that within a few years he thought consumers
wi l l be facing market prices for services and will leave to pay
for them if they want services. He said he viewed the
formation of this assessment district as a way of beginning
the process and strongly suspected that, if no action is taken
on the matter tonight, it would only be delaying the
inevitable. Increasing taxes is not popular, but at some
point the decision will have to be made because you can't have
it both ways. Anytime there is any kind of user tax
proposal, there will be controversy about fairness.
Mayor Eck said he would be willing to go into the City's
reserves this year but decisions would have to be made
regarding alternatives for the next year. He said the matter
should be clarified for the record that this item was not
rushed, and as a precaution that it not reflect rushing next
year, this proposal should be brought to Council's attention
in six months so the matter will have been reviewed prior to
the next budget review. The City cannot continue to eat
into its reserves, as the reserves are depleted to the
bear minimum.
Councilman Reilly said he agreed completely with the comments
Of Councilman Hollingsworth regarding this matter. W. Reilly
said he would be more in favor of looking at this item after
all the inequities are worked out.
City Engineer Brust said tonight's resolutions for
consideration regarding this item does not adopt the district
but simply adopts the intention to do so at the next Council
meeting. Staff would have sufficient time to provide Council
with additional information as requested. The Engineer's
Report can be changed to zero amount and in the meantime

Council can adopt the resolutions which would then allow for
Public notices to be published and provide the opportunity for
citizen input on the isa.,e.
The above motion by Councilman Hollingsworth, seconded by
Councilman Reilly, to delay action on the formation of this
assessment district with amendment stipulating that it be
reviewed again in six months, was approved by the following
roll call vote:

Councilman Hollingsworth suggested that staff re- evaluate the
way things are done and be more thorough. Don't replace
something unless absolutely necessary and conserve wherever
possible. He said he understands where staff is coming from,
but it may become necessary not to do a project. It would
be better to slow the process down and take the time to
figure out how things can be done.
RECESS Mayor Eck declared a recess at approximately 7:45 p.m.
RECONVENE Mayor Eck reconvened the Council meeting at approximately
7:54 p.m. with all Councilmembers present.
Proposed Adjustments City Manager Netter said a public hearing had been set at this
to Various City Fees time regarding proposed adjustment to various City fees and
charges. He referenced copies provided to Council of separate
staff reports for each proposal as well as resolutions for
consideration and ordinances for introduction pertaining to
same. He said several of these fees /charges have not been
increased for a number of years and that staff was available
to answer questions regarding these proposed adjustments.
Public Hearing Mayor Eck opened the public hearing at approximately 7:55 p.m.
Jack Beagle Jack Beagle, 529 Lorraine Court, said he would like to know
the amount of the City's development fees, referenced recent
article in City Newsletter regarding the establishment of
Community Development Agency (CDA) for the benefit of
establishing funds without tax increases or tax increments on
assessed value until property is sold, and asked why couldn't
some of the CDA funds be used for the shortfall.
City Manager Netter responded that the proposed increase for
development fees per acre is from $12,000 to $15,000 and that
the date of last increase was July 1988 which was also the
last date of increase for sewer service connection fees as
well as special water connection fees. Councilmembers
responded that CDA funds must be used only as specified in the
Redevelopment Plan and as required by State law. General fund
expenditures are not authorized..

to be in Council's position at this time with the many

but if :� keep charging the developers, there will be even
worse problems. There has already been a 33% increase in the
price of housing and what attracted businesses to Rohnert Park
in the first place was affordable housing. Businesses decided
to come here because housing was 15% lower. To increase taxes
and /or fees is self- defeating and will only drive business
away that the City is hoping for since the people are already
being over taxed and further charges will only prevent the
needed shopping. This also puts a greater burden on the
services that are already being cut which will only create the
need to start building more homeless shelters faster. Life is
not fair and there is no easy answer, but the City should look
for a more applicable place to increase fees since everyone
knows the builders will have to pass the increases on to the
people. In response to Council inquiry regarding suggestions
for a better solution, Nis. Gallagher said it would be better
to cut back on services, turn out lights, and examine such
energy conservation areas rather than take this easy route of
increasing fees and charges which will drive business out of
the area. She concluded her comments by stating that user
fees make a little more sense because 1% to someone making
$20,000 is a lot more compared to someone making $200,000.
Mayor Eck questioned the 30% escalation in cost of housing
being related to various City fees and charges, since these
have not been increased since 1988. He mentioned the example
of issuing bonds for capacity expansion and said the whole
issue is more complicated than it appears.
Dave Nbchel Dave Nbchel, 6050 Commerce Blvd., said affordable housing
seems to continue to be the main issue and realtors want to
enact certain things regardless of what others think. He said
he thought these fees should be even higher as it does not
seem new construction is paying its fair share as far as
covering the costs of infrastructure involving additional
maintenance of streets, etc. He said the City will be faced
with the cost of extensive repairs and staff should make sure
the fees are sufficient to cover these costs.

Discussion followed during which staff responded to various
Council questions regarding total impact of all fees collected
if City were developed to full capacity with confirmation that
all funds amounting to approximately $4.2 million were
earmarked to the various special accounts, confirmation that
staff is in the process of preparing a report specifying the
breakdowns, and that the purpose for raising these development
fees is to offset the cost of providing services.

Planning staff report dated June 27th, 1991, Earth Nbtrics
responses to the written and verbal comments made at the
Planning Commission public hearing on June 27, 1991, Planning
Comnission minutes and all correspondence pertaining to the
draft EIR, Planning staff report for the precise Development
Plan and Architectural Review for the Home Depot Project,
Resolution 91 -9 recommending that the Council certify the EIR,

Ordinance pre- zoning subject property. Mr. Skanchy explained
that the closing date for the Planning Commission to receive
public comments regarding this matter was June 28, 1991.

City Manager Netter said copies were provided to Council of
resolution for consideration in regard to certifying the Final

EIR dated July 1991. He distributed to Council copies of
pages 2.12, 2.28, 2.32, 3.19 and 6.5 of the City's General
Plan and shared contents therein from the referenced sections
regarding Land Use, Open Space and Circulation. Mr. Netter
also reviewed the traffic mitigations and other mitigation
measures as outlined in the EIR. Mr. Netter said Bryan
McElroy, Consultant for Earth Metrics Incorporated, was
present at tonight's Council meeting to answer questions.
Discussion followed during which City staff and Earth Nbtrics
Consultant Bryan NbElroy responded to various Council
questions regarding sphere of influence, consistency with
General Plan, mitigation measures, traffic levels of service,
Caltrans responsibilities, and logic of a scaled down version
of Home Depot. Mr. McElroy reviewed consideration given to
alternatives and said it was debatable if scaled down size
would reduce number of trips even though EIR traffic formula
is figured at so many trips per thousand square feet.
Public Hearing Mgyor Eck opened the public hearing at approximately 8:50 p.m.
Shawn Kilat Shawn Kilat, 1172 Hailey Court, said she questioned the rapid
rate of development of the area between Rohnert Park
Expressway and Golf Course Drive along the freeway. She felt
the City should wait before allowing Home Depot to build and
should wait and see what real impacts occur given the already
approved development before building more. She said traffic
improvements should be made first.
Dave Nbchel Dave Nbchel, 6050 Commerce Blvd., said he agreed completely
with the previous speaker. He referred to concerns regarding
traffic and said staff seems to take Caltrans concerns too
lightly. The traffic analysis is consistent with Consultant
Elgar Hill statement that the EIR's analysis concludes only
the need for traffic lights but installation of traffic lights
will not make any difference on the traffic problem,
especially as it exists even now when driving down Commerce
Blvd. at 5:00 p.m. He said none of the roads in this area are
ones to be widened and reviewed several examples of traffic
problems currently in the neighborhood and related to the
freeway. Mr. Nbchel said this EIR does not address these
problems in any way and doesn't consider other complications
that will magnify like the little bumpy rural roads with
driveways that back out onto the roads and have open culverts
to deal with as well. The only reason these aren't worse now
is there's not much traffic on these rural roads. He did not
feel the EIR gave adequate response to these traffic comments
and said he hoped Council would send this EIR back to Earth
Metrics for further review. Mr. Nbchel said he had nothing
against Home Depot, but thought this location at this time is
not the place for it.

A motion was made by Councilman Hopkins, seconded by

the Home Depot EIR which is consistent with the law.
Mayor Eck expressed concerns regarding consistency with
General Plan and mitigation problems. He said two
alternatives he would consider would be a scaled down version
or another location which could be done but suspected would
not be a very attractive consideration. Mayor Eck said as he
read this EIR, he was not aware that Home Depot was marching
right in on the heels of Wal -,'vhrt and Price Club and these
should be looked at with consideration as a regional problem.
He said further consideration should be given to dealing
with effects of traffic on Redwood Drive on Cotati and
that several impacts are already compounding.
Discussion followed during which pros and cons regarding
impacts on a scaled down model were reviewed.
Councilman Hollingsworth said he did not think the LOS levels
would be changed at all even if the project were scaled down,
that if the City goes with the project, it should go with it
as is which would contribute to maintaining the quality of
life in Rohnert Park. In regard to comments about this
development coming about rapidly, W. Hollingsworth said this
was not something planned just recently since Council
indicated over twenty years ago that this would be done. In

cities which average $154 per capita. These projects will

Councilmember Spiro referenced comments at previous Council
meetings in which it was acknowledged that Caltrans does not
come up with funds for projects until needed which is a
terrible way to get things done, but that's the way it is.
She said that perhaps consideration could be given to staging
smaller projects after the development of these major ones.

design and said he areatly preferred it as conirAred to the
design of the previously approved project and clarified that
his reasons for voting against this project had nothing to do

Meeting Jim Lyons, Real Estate Manager for Home Depot, said Home Depot
now operates 45 stores in California and 150 stores
nationwide. Changes for Home Depot in Rohnert Park include
preparing for an outdoor sales area to carry outdoor products
which is new for Home Depot and therefore will be
experimentation. There is very effective competition in this
area which presents a real challenge for the Home Depot team
to put together effective efforts. Representatives of Home
Depot think they are up to the challenge and also think the
City will be proud of the store.

human nature element of preference to park in front of a store
versus. ;o_ing to the side, targeting local residents uc
employees with the possibility of approximately 20% that might
be otherwise for necessary department head experience, and
consideration to provide employee transportation to help with
traffic and parking problems.
Public Hearing Mayor Eck opened the public hearing at approximately 9:26 p.m.

whether or not there would be signage and, if so, how high. He
also asked about parking lot lights and what was being done
about confining light to the site and gave the new Shell
Service Station as an example of lighting interference to

Planning Director responded to Mr. Nbchel's concerns and said
the only sign will be the illuminated sign on the building and
confirmed there would be parking lot lights.

than up or out to prevent neighborhood or airway interference.
Mayor Eck said he agreed with Councilman Reilly's comments
that this is a mach better design than the other previously
approved project.

Grand Opening /Dedication of the Community Outreach for Youth &
Families Center which is scheduled for October 18th, 1991.
She explained that a sub-committee was formed which is working
on this event and is requesting Council's approval of $750 to
assist in this endeavor.
Discussion followed during which Mayor Eck said he could only
see one item that needed changing; specifically, that the Vice
Mhyor should be the Master of Ceremonies and that the Nhyor
could then be free to make other comments, which has been the
City's practice for openings in the past.
A motion was made by Councilmember Spiro, seconded by
Councilman Reilly, and unanimously approved, to approve the
COYF Grand Opening /Dedication schedule and budget allocation
of $750.00 with Mayor Eck's friendly amendment regarding
above modifications.
2) Review of Recommended By -Laws - Community Resource
Specialist Kathy Vander Vennet said copies were provided to
Council of COYF recommended By -Laws for review with
explanation details in tonight's Council Nbeting Memo. City
Manager Netter comented that he had made some changes which
are shown in pencil on City Council's draft.
Discussion followed on issues of voting members and non - voting
members, the size of the committee and residency requirement
of voting members. Comparisons were made with other
established City commissions and committees.
Councilmember Spiro said the expertise of those involved in
COYF efforts included a variety of backgrounds such as School
Board representative, Senior Citizen representative, etc., and
that the Committee actually needs to be even larger to cover
all areas of concern and asked if it would suffice that COYF
members have businesses in Rohnert Park to be voting members.
Mayor Eck said there was no problem with having any number of
Ex- Officio members of which could be non - voting members.
Councilmember Spiro explained her interest to remain an active
member of this committee and said she could not see the
difference betwean the structure of CDYF Committee and the
Sister Cities Committee. Councilman Hopkins pointed out the

difference in the make -up of the Sister City Committee and
said this kind of interest comes and goes as people come and
go and that such an arrang-ement =uld not work: fc--- other t ypaz
of committees. Councilman Hollingsworth said a difference is
that there is a full time staff person for COYF and it is a
function of the City budget, which is different from the
Sister City's Committee.
Councilman Hopkins recannended that COYF Committee have as
many Ex- Officio mmmbers as it wants but that the 11 voting
members be conPrised of a majority of Rohnert Park residents
with requirement that the Chair and Vice Chair be residents.
Councilman Hollingsworth said the only way to allow for non-
resident voting members would be that COYF Committee recommen-
dations come to Council for approval. Discussion continued.
Councilman Hollingsworth said Council should come back to the
review of this project at a later date.
Councilman. Hopkins said it appears Council's recommendation is
that COYF voting members should have to submit COYF
recommendations to City Council for review including further
review of the voting structure. He said consideration could
also be given to each Council member appointing one more
person to the COYF Committee to ensure full Council
representation as is done with other committees /commissions.
Councilman Hollingsworth said he would also reconTmnd that
Councilmember Spiro remove herself from the Board and act as
Council liaison wherein she could continue to provide input,
in order to conply with other established City committees
and commissions.
Mayor Eck said the COYF Committee should go through City
established channels which is through staff to the City
Manager up to City Council.

A resident and neighbor of the referenced location spoke from
the audience said it would be possible to obtain a new
petition from surrounding neighbors, if Council desires, since
signers of the previous petition did not realize consent for
the RV in the driveway as a living unit would be for such an
extended period of time. He said the neighbors have
worked for a long time to get the neighborhood in nice
shape and they do not want this distraction.
A motion was made by Councilman. Hollingsworth to direct City
Attorney to advise Kathleen Burnham to cease and desist from
RV living unit in driveway located at 1154 Emily Avenue as it
is in violation of City ordinance now that the City has a
registered opposition, seconded by Councilman Reilly with
friendly amendment for staff to make every effort toward
assisting in recommended alternatives, and friendly armndwnt
by Mayor Eck to direct the referenced letter over the Mayor's
signature rather than directly from City Attorney, said ration
was unanimously approved.
Commmications Communications per the attached outline were brought to the
attention of the City Council. No action was taken unless
specifically noted in these minutes.
Growth Article in City Manager Netter shared contents of item #17 on tonight's
Press Demmcrat Communication List regarding recent Press Democrat Article
entitled "Santa Rosa Council OKs Growth /South" and said
copies were also provided to Council of map showing the
referenced area. He asked if Council wanted to react to this
matter at this time.
Discussion followed during which concerns were expressed
regarding interest to keep the land designated as open space
and comments were made regarding spheres of influence as
reviewed in General Plan process.
A motion was made by Councilman Hopkins, seconded by
Councilman Reilly, and unanimously approved, to write a letter
to the City of Santa Rosa expressing this Council's concern
regarding the announced future intentions being considered by
Santa Rosa relating to annexation south and open space
designations as connected with Rohnert Park and signified in
recent updated General Plan.

City Manager's Report:1) Naming of R Park - City Manager Netter indicated that the
"R" park needed naming and that. the parks and Recreat on-
Comnission recommended the neighbors have an opportunity to
name it if Council did not have a name it desired. Council
comments concluded it was too late tonight to have creative
thoughts and further consideration would be given to this
matter at another time.
2) TRANs Issue update - City Manager Netter referenced copies
provided to Council of letter dated July 10, 1991 from Sutro &
Company regarding the TRANs Issue and said the City
anticipates making $33,000 on this transaction instead of the
estimated projection of $40,000 which was not quite as much as
previously anticipated, but the City still will make money on
this program.
3) SW Blvd. Shopping Center update - City Manager Netter said
progress is still being made toward cleanup efforts at the
corner of Southwest Boulevard Shopping Center. The property
owner has been notified and Public Works crews have cleared
the area around the fence.
4) City Manager Netter said he was informed today that
the Burbank Housing Project was approved by the State in
the amount of $1,390,000. Mayor Eck indicated that the
timing for this approval was a record as far as Burbank
Housing is concerned.
City Attorney's Report: City Attorney Flitner said he had nothing further to report
at this time.
Matters from Council: 1) Mayor Eck said the reception with the Cities of Rohnert
Park and Cotati, and the School District for welcoming the new
School District Superintendent is scheduled at the Performing
Arts Center from 4:30 p.m. to 6:30 p.m., July 30, 1991.
2) Mayor Eck said Rohnert Park Day at the Sonoma County Fair
will be tomorrow, Wednesday, July 24, 1991.
3) Councilman Hopkins asked that the item "Staging of
Co mercial Development" be put on the next agenda.
4) Hazardous Materials meeting - Councilman Reilly said it
looks like Sonoma County will be developing a stabilization
facility to address hazardous materials generated in
Sonoma County.

5) Mayor Eck referenced recent Transit Authority meeting and
Jim Harberson's r?njP.ctt. to I= ±hop Pacific
Right of Way on the next agenda. He asked if Rohner Park
plans to support the issue and is the City willing to proceed
with acquiring the railroad right of way. Mayor Eck said
this item should be placed on the next Council agenda.
City Engineer Brust said once the City purchases the railroad
right of way, it takes on all the liabilities connected with
it which also includes taking on all the environmental
problems involved and is, therefore, a big issue. He
confirmed agreement with the Mayor that it should be scheduled
on a Council agenda.
Unscheduled Public Mayor Eck asked if anyone in the audience wished to make an

Shadows Golf Course Use Permit
for Temporary Concession Stand DATE: July 18, 1991

The City Council previously discussed approval for a temporary
concession stand on the Mountain Shadows North Course, east of
the Red Lion Inn.
Approval of this temporary facility was conditioned as follows:
1. Review by the Planning Commission and approval of a
temporary use permit.
2. The structure must have a tile roof to match the Red Lion
Inn tile.
3. Proper landscaping must be provided.
4. The neighbors that border the area must be notified of the
temporary facility (prior to approval by the City Council).
5. This temporary facility is only approved with the agreement
that American Golf will budget, in its upcoming year (-March
1992), a permanent facility and begin construction -irr -the
early part of their fiscal year which begins March 1992.
The design of this permanent structure will be approved by
both the Planning Commission and the City Council.
Paul, at your Planning Commission meeting of July 18th, gl-e-ase
make these items a condition of approval for the use permit.
