1990/06/12 City Council MinutesRohnert Park City Council Minutes June 12, 1990 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Hollingsworth presiding. Call to Order Mayor Hollingsworth called the regular session to order at approximately 7:20 p.m. and led the pledge of allegiance. He advised that a closed session commenced this afternoon at 4:30 p.m. to discuss litigation matters, personnel matters and real estate negotiations. Roll Call Present: (4) Councilmembers Cochran, Eck, Spiro and Mayor Hollingsworth Absent: (1) Councilmember Hopkins (attending ABAG meeting) Staff present for all or part of the meeting: City Manager Callinan, City Attorney Flitner, Director of Administrative Services /Assistant to the City Manager Netter, Assistant to the City Manager Leivo, and Community Resource Specialist Vander Vennet. Approval of Minutes Upon motion by Councilman Cochran, seconded by Councilmember Spiro, the minutes of May 22, 190 were unanimously approved. Approval of Bills Upon motion by Councilman Cochran, seconded by Councilman Eck, the bills presented per the attached list in the amount of $1,161,521.56 and CDA bills presented per the attached list in the amount of $998,443.30 were approved by the following vote: AYES: (3) Cochran, Eck, and Hollingsworth NOES: (0) None ABSENT: (1) Hopkins ABSTAIN: (1) Spiro Non - agendaed items Mayor Hollingsworth queried if any Councilmember had any non - agendaed items to add to the agenda. Councilman Cochran requested to add a Cultural Arts item under matters from Council. Unscheduled Public Mayor Hollingsworth stated that in compliance with State appearances Law (The Brown Act), anyone in the audience who wished to make comment may do so at this time. Howard Boggs Howard Boggs, 5430 Commerce Boulevard, referenced the item later on tonight's agenda under the City Manager's Report regarding the Commerce Boulevard tree landscaping 1 Rohnert Park City Council Minutes June 12, 1990 plan. He said the two rows of trees recently planted 25' to, 30' apart will grow 25' to 30' tall and will substantially screen out the 101 freeway from the view of the businesses along Commerce Boulevard. He distributed copies to Council of questionnaires from all the merchants in which 100% responded that the freeway exposure is critical to the success of each business, none were in favor of screening out the 101 freeway from the view of the businesses, 86% were against the planting of any vegetation that would obstruct the view of a business _from the freeway, and 60% were in favor of limiting all plantings between Commerce Boulevard and the 101 freeway to widely separated small clusters located so as not to obstruct the freeway visibility of any retail business and to restrict planting heights not to exceed a maximum height of 6 feet at maturity. Mr. Boggs also distributed to Council copies of a letter dated June 12, 1990 from Ken Butler, Executive Director of the Rohnert Park Chamber of Commerce and shared the contents therein (a copy of which is attached to the original set of these minutes). The same concern of Chamber members was expressed regarding the newly planted trees along Commerce Boulevard. The number one reason for having businesses on that part of Commerce Boulevard is for freeway exposure. Gerald Kohler Gerald Kohler, 371 Bonnie Court, said he also has a business on Commerce Boulevard. He questioned the planning process of the recently planted trees in this section of town that was specifically designed for freeway exposure to the businesses located there. Arthur Anderson Arthur E. Anderson of Valley Village Mobile Home Park, distributed copies to Council of his questions regarding the Green Book agreement (a copy of which is attched to the original set of these minutes). He provided an additional copy of his questions to City Attorney Flitner stating that due to his impaired hearing, he was requesting a response in writing on same. Mayor Hollingsworth gave instructions to make Mr. Anderson's letter part of the record and said City Attorney Flitner would respond to Mr. Anderson's questions in writing as requested. George Horwedel, 7669 Camino Colegio, requested to speak on the item to reconsider televising Council meetings later on tonight's agenda. No. 90 -120 A RESOLUTION AUTHORIZING AND APPROVING A GRANT DEED TO CODDING ENTERPRISES (for a portion of land near Redwood Drive) Director of Administrative Services /Assistant to City Manager Netter explained the resolution. Upon motion by Councilmember Spiro, seconded by Councilman Eck, Resolution No. 90-120 was adopted by the following vote: AYES: (3) Eck, Spiro, and Hollingsworth NOES: (0) None ABSENT: (1) Hopkins ABSTAIN: (1) Cochran Discussion followed confirming the need to approve the dollar amount of the offer to Codding Enterprises for the land referenced in the resolution. A motion was made by Councilman, c� econded by Councilmember Spiro, and approved by the following vote, the amount of $8.50 per square foot as the sales price offered to Codding Enterprises for the land referenced in Resolution No. 90 -120, and approved by the following vote: AYES: (3) Eck, Spiro, and Hollingworth NOES: (0) None ABSENT: (1) Hopkins ABSTAIN: (1) Cochran Scheduled Public Barbara Graves of the North Bay Health Resources Center Appearance: in Petaluma, and Bruce Davidge of Hewlett Packard "Responsible Hos- Company shared contents of a report on "The Responsible pitality Project" Hospitality Project" copies of which had been provided to the Council prior to tonight's meeting. She stated that the Responsible Hospitality Project's "Community Covenant" had been developed to respond to the risks associated with drinking and driving. The Covenant reflects the assumption that problems associated with drinking and driving are community problems and will only be solved with broad community involvement. A coalition has recently gone public with a "Community Covenant" that sets voluntary standards for the sale, service, and consumption of alcoholic beverages. Ms. Graves asked the Council for a resolution of support for the "Community Covenant." She also asked the Council to give consideration to sponsorship by the City according to guidelines in the above - referenced materials. Discussion followed during which it was pointed out that n W Rohnert Park City Council Minutes June 12, 1990 such businesses as the Red Lion Inn and Hewlett Packard Company have participated in training sessions and fully support this program. A motion was made by Councilmember Spiro, seconded by Councilman Cochran, and unanimously approved, for a resolution of support to be prepared for adoption on the next City Council agenda Consent Calendar, and to require - authwrize staff to participate in training programs of "The Responsible Hospitality Project." Ordinance No. 525 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING ORDINANCE NO. 383 AND TITLE 10 OF THE ROHNERT PARK MUNICIPAL CODE (Vehicles and Traffic) Director of Administrative Services /Assistant to the City Manager Netter explained the ordinance which sets at 25 miles per hour= the speed limit on Roberts Lake Road. Upon motion by Councilman Cochran, seconded by Councilman Eck, and unanimously approved, Ordinance No. 525 was introduced. Animal Shelter Assistant to the City Manager Leivo explained that Task Force copies had been provided to Council of an outline dated June 1, 1990 from the Animal Shelter Task Force regarding "Proposed Animal Shelter Design Features." Marguerite Kugler gave a presentation to the Council on behalf of the Animal Shelter Task Force. She shared contents of a report to the Council from members of the Task Force regarding the proposed new animal shelter for Rohnert Park. (A copy of this report is on file in the City Offices.) The Task Force has visited four animal shelters in the Bay Area, as well as obtained information on many other shelters, has reviewed written information, and visited two animal experts at the University of California in Davis. The Task Force has progressed to the stage of formulating specific animal shelter design recommendations. Ms. Kugler concluded the Task Force report by asking the Council to authorize the City staff to enter into negotiations for the following: 1) Hire an architect to prepare a schematic design followed by construction drawings; 2) Look into the possibility of hiring Moira Fitzgerald, Head of the U.C. Davis Teaching Hospital, as a consultant regarding items donated to the shelter that would result in financial savings; 3) Hire a professional fundraiser to outline a plan of action to raise money toward this project. The estimated cost of these tree items is $20,000 to $25,000. She explained that F.A.I.R.E. has been doing volunteer work at the Rohnert Park Animal Shelter for over 5 years and it is Rohnert Park City Council Minutes June 12, 1990 the desire of F.A.I.R.E. to continue participation in this project as outlined in the report presented this evening. Council concurred that the recommendations of the Animal Shelter Task Force should be incorporated into the upcoming budget for consideration in the annual budget hearings process. Animal Shelter Assistant to the City Manager Leivo explained that Proposals copies had been provided to Council of a resolution for consideration to approve an agreement for animal control shelter operation and maintenance with a staff report on two proposals received from 1) Friends of the Animals in the Redwood Empire (FAIRE) in the amount of $79,000; and 2) WPR Shelley & Associates of Sonoma in the amount of $59,000. Jan Brewer; former director of the Humane Society of Sonoma County, is associated with WPR Shelley & Associates. Mr. Leivo said copies were also provided to Council of his memo dated June 12, 1990 regarding_ WPR Shelley and Associates' references. Holly Blue, 1312 Gold Way, explained details of FAIRE's volunteer involvement with the animal shelter over the past six years, the benefits of being a non - profit organization, and the logic behind the dollar amount of the proposal submitted by FAIRE. Council acknowledged the beneficial contributions that FAIRE volunteers have provided to the animal shelter. Raymond Shelley of WPR Shelley and Associates responded to Council's questions regarding his past experience and qualifications confirming that he had not specifically run an animal shelter but felt his experience in dealing with wild life as well as his educational background and experience in business management qualified him to deal with the specifics of the animal control shelter. WPR's association with Jan Brewer, former Director of the Humane Society, is on a consultant basis. Discussion follower] during whi%h ASSiStant to the City Manager Leivo responded to Council's questions regarding the wide spread margin of the two bids. Concerns were expressed regarding the background and experience ob both proposals. Consideration was given to defer this matter until such time as the City Attorney had had an opportunity to review the matter and clarify the City's options regarding the bid proposals. City Attorney Flitner explained bid procedures and legal obligations confirming that if the lowest bidder is not qualified, it may be rejected but that the basis for rejecting would need to be factual and not based on conjecture or feelings. A motion was made by Councilman Cochran, seconded by 0 Rohnert Park City Council Minutes June 12, 1990 Councilmember Spiro, to accept FAIRE's proposal for maintenance and operation of the Animal Control Shelter due to the fact that WPR Shelley & Associates does not have the background experience in running an animal shelter. Said motion failed approval by the following roll call vote: AYES: (2) Cochran and Spiro NOES: (2) Eck and Hollingsworth ABSENT: (1) Hopkins Mayor Hollingsworth stated that the tied vote gives the Council some time to give further consideration to this matter and that it could be considered at the next Council meeting. RECESS Mayor Hollingsworth declared a recess at approximately 8 :50 p.m. RECONVENE Mayor Hollingsworth reconvened the meeting at approxi- mately 9:00 p.m. with all Councilmembers present except Councilman Hopkins. Youth & Family Director of Administrative Services /Assistant to City Services Manager Netter introduced Kathy Vander Vennet, stating that she has recently been hired to fill the newly created position of Community Resource Specialist. Community Resource Specialist Vander Vennet shared her objectives for the next year and updated the Council on *Community Outreach for the progress of the She has Youth had the opportunity to meet with citizens interested in Youth and Family services and with Councilmember Spiro. She stated these meetings have helped clarify immediate program goals. She discussed the information and referral services program which should be in operation within six months. Mrs. Vander Vennet addressed the task of remodeling a portion of the Codding Center, stating that rather than undertake a thorough remodeling this year, she recommends determining space needs as the Youth and Family program develops. Mrs. Vander Vennet also said she has been working with Reverend Tharpe to find a new home for "T's" Academy. However, the School District has decided not to contract with "T's" Academy and therefore Reverend Tharpe must look at other options. He has asked the City to stop any further search since there will not be a need for classroom space during the next academic year. As a matter of record, she said while "T's" Academy had space in the Codding Center building, there was not one complaint from anyone in the area about the students or the school and that the work that Reverend Tharpe did N Rohnert Park City Council Minutes June 12, 1990 with the students will be sorely missed. Mayor Hollingsworth referenced a day spent at "T's" Academy by Councilmembers and complimented the Academy's activities and good behavior of the students. The Council agreed that "T's" Academy has been a big help to the community's young people. Mayor Hollingsworth confirmed that the efforts toward youth and family services would continue on a committee basis during further developmental stages. Performing Arts Center Director of Administrative Services /Assistant to City Manager Netter said staff has continued to meet with Campaign Cabinet Members regarding the continuation of the Performing Arts Center endowment campaign, advising ay that the next Cabinet meeting is scheduled for Frid, June 15th. Staff is currently working with the Cabinet and Community Counselling Services, Inc. (CCS) for a smooth transition of the fundraising program's files and records. He informed that applications have been received for the recently created position of Performing Arts Center Development Director which staff is currently reviewing and assessing to select the top candidates for an interview, after which staff hopes to make a selection and have the position filled no later than June 30th. Cultural Arts Director of Administrative Services /Assistant to City Commission Manager Netter said that three (3) letters of resignations resignation have been received from Cultural Arts Commissioners Millie Hamill, George Williams, and Grace Gilbert. Millie Hamill had informed staff that Joan Williams also resigned at the Commission's June 6th meeting. Mr. Netter explained that Council had been provided with copies of letters of resignation. He also stated that Council has been provided with copies of a letter from the remaining members of the Cultural Arts Corporation expressing regret over the recent resignations and outlining plans regarding the Corporation and Commission. Discussion followed during which Cultural Arts Commission liaison, Councilman Cochran, said this would be an opportune time to examine more closely the possibility of consolidating the Cultural Arts Corporation and Commission and reducing the size of the Board to five members to be consistent with other City commissions and that consideration could be given at this time to the Corporation and Commission members being the same individuals and function in the same manner as the Community Development Agency of the City Council. Nancy Seymour, 7831 Beverly Drive, Cultural Arts Commission member, referenced the June 8th letter Rohnert Park City Council Minutes June 12, 1990 provided to the Council and shared details contained therein. She advised that the remaining four Cultural Arts Commission members were present tonight and advised that there is a lot of enthusiasmm left on the Board. She requested the Council to delay a joint meeting with the Cultural Arts Commission until August, at which time all members will have prepared proposals regarding a workable plan and necessary reforms in order to continue to serve the arts community of Rohnert Park as originally intended. Council concurred. Motion was made by Councilman Eck, seconded by Councilman Cochran, andunanimously approved, to accept the resignations of Cultural Arts Commission /Board members Hamill, and George and Joan Williams as submitted and to send appropriate letters. Financial Assistance Councilmember Spiro explained that copies had been to Local Organiza- provided to Council of a memo from Council Committee Eck tions and Spiro regarding a draft policy on Allocation of Funds for Community Promotion that would establish criteria and guidelines for the expenditure of funds to local non - profit groups, associations, local sports teams and sports groups, and others and explained the contents therein. Attachments to the memo included "Draft Policy A - Requests During Budget Process" with application form and "Draft Policy B - Requests for Funds by Sports Teams, Sports Groups and Other Associations Not Approved During Budget Hearings" with application form. Council Committee Member Eck said an effort was made toward the basic simplicity of the policy to provide advance notice to Council of financial requests as well as a screening device to assure the organizations, teams, etc. are Rohnert Park oriented. He said the recommended amount of $700 maximum was based on an average of last .year's contributions. Discussion followed during which qualifying factors were considered such as winning teams of local leagues and /or sectioned by such leagues to be included in the Draft Policies, the recommendation of receiving input from the Parks and Recreation Department, and the need to establish a policy at tonight's meeting in order to respond to the upcoming request of the girls' softball team which was deferred from the previous Council meeting. RP Girls Softball Tracey Rohnert Council has ear $3,000 be in E Poueu, 5760 Dolores Drive, representing the Park Girls' Softball League, responded to questions regarding additional funds the team ned from various efforts totaling approximately to $4,000. She submitted a completed Draft Policy B application form on behalf of the Rohnert Park Girls' Softball League. A motion was made by Councilman Eck, seconded by Councilmember Spiro, to approve the maximum amount of $700 to the girls softball team since the criteria of the proposed policy had been met. Councilman Eck withdrew his motion. Councilmember Spiro withdrew her second. A motion was made by Councilman Cochran, seconded by Councilman ak, to amend the Draft Policies to state qualifications that a team must either win a Rohnert Park league or be recognized by its organization. Discussion followed in which Council reconfirmed the need for the Parks and Recreation Commission to review the Draft Policies and make recommendations prior to Council approval. Councilman Eck agreed that recommendations from the Parks and Recreation Commission would be beneficial and withdrew his second to Councilman Cochran's motion. Said motion died for lack of a second. Mayor Hollingsworth said that since the team's financial need is delayed until the end of July, Council could also delay action on the request until such time as the policy is revised and approved, possibly by the next Council meeting. A motion was made by Councilman Eck, seconded by Councilman Cochran, and unanimously approved, to approve the application form for allocation of funds for community promotion subject to minor editorial revisions by staff. A motion was made by Councilman Cochran, seconded by Councilmember Spiro, and unanimously approved, to send both draft policies for allocation of funds for community promotion to the Parks and Recreation Commission for review and recommendations. 10 Rohnert Park City Council Minutes June 12, 1990 Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken unless specifically noted in these minutes. City Manager's report: City Manager Callinan said staff is working on the Tree Landscaping Plan Commerce Boulevard landscape plan which plan should be on Commerce Blvd. completed by the next meeting and will assist in discussions with the Council on this matter. Library Carpet Director of Administrative Services /Assistant to City Manager Netter said the library is definitely in need of improvements and that Dave Sabsay, Director of the Sonoma County Library main branch, has called for bids on this project. He has informed the City that the lowest bidder came in at approximately $7,000 over the City's approved budget for this item and he is requesting approval of the overage so that the contract could be let. City Manager Callinan confirmed that infrastructure maintenance funds could be used for this project. A motion was made by Councilman Cochran, seconded by Councilman Eck, and unanimously approved, to use the reserve for infrastructure maintenance funds to cover the costs of the library carpeting and flooring project. Southwest Blvd. Director of Administrative Services /Assistant to City Shopping Center Manager Netter referenced plans on display for the Southwest Blvd. Shopping Center which are to be reviewed by the Planning Commission and then subsequently will be presented to the property owners for a plan or program to dress up the area. He said consideration for abatement of the A & W building is on the upcoming Planning Commission agenda. Discussion followed during which it was confirmed that the recycling bins near Crown Market should be removed if on site operators cannot be provided. So. County Winegrowers City Manager Callinan advised that representatives of Tourism Facility the Sonoma Winegrowers Association were present tonight to review proposed plans for a tourism facility with consideration to use part of the Roberts Lake area. Linda Johnson of the Sonoma County Winegrowers Association referenced an architectural drawing on display and explained plans to promote Sonoma County wines. She explained the need for a feasible, quality location that would also provide an educational program that would bring understanding to the industry. She stated that the only similar facility is in Bordeaux, France and advised that 70% of California tourists come to tour the wineries and that this would provide a central informational and educational locations. She 11 Rohnert Park City Council Minutes June 12, 1990 also stated that this would be an opportunity to host people from all over the world and requested the Council's support of the plans as presented tonight. Mayor Hollingsworth appointed a Council Committee of Councilman Cochran and Councilmember Spiro to work with the Sonoma County Winegrowers Association regarding plans for the tourism facility. He requested John Nance, Architect, to explain to the Council his rendering of the proposed plans and explained that Mr. Nance was the architect who brought the Red Lion Inn to Rohnert Park. John Nance, Architect, referred to drawings on display and described the design which would be compatible to the existing Red Lion Inn. Discussion followed during which it was pointed out that bed taxes could be a funding source for this type of project. Council agreed that details should be worked out between the Council Committee and the Sonoma County Winegrowers Association and brought back to the Council for further consideration. Household Hazardous Director of Administrative Services /Assistant to City Waste Cleanup Manager Netter reported to the Council the results of the Household Hazardous Wastes Cleanup held on June 2nd. He said it was successful but expected next year to have a greater participation and would work on publicizing the event more extensively. SSU Joint Meeting City Manager Callinan asked if the Council to place additional items on the agenda for the upcoming joint meeting with Sonoma State University on June 19th. Suggestions were made by Council to include northern dorms in the discussion at the meeting, bringing a copy of the new General Plan, review of the Copeland Creek bike path, and the traffic lights on Petaluma Hill Road. Veale Lawsuit City Manager Callinan informed that Mr. Veaie has withdrawn his appeal of the Veale lawsuit. Price Club City Manager Callinan asked it was the desire of the Council for staff to negotiate with the Price Club and to discuss any financial assistance. Parks & Recreation City Manager Callinan advised that the joint meeting Commission Joint Mtg. with the Parks and Recreation Commission was rescheduled and would be held on June 25th at 6:00 p.m. at the Red Lion Inn due to the necessity to cancel the June 5th meeting because of the Primary Election. Golis Park Tennis Councilman Eck said there seems to be a sound problem at Courts the Golis Park tennis courts. City Manager Callinan responded that staff is contacting an acoustical firm that will review the matter and make recommendations for a solution. Televising Council Mayor Hollingsworth stated that the matter to reconsider Meetings televising City Council meetings had been deferred from the May 22nd meeting and would proceed at this time. Linda Branscomb, 21 Anne Way, referred to her letter which was submitted to the Council at a previous meeting and shared the contents therein favoring televised Council meetings in consideration of various types of people who are unable to attend. She said she had collected approximately 200 signatures from residents who were in favor of televised Council meetings. George Horwedel, 7669 Camino Colegio, distributed to Council copies of correspondence from various individuals and organizations in favor of televised Council meetings including a recommendation from the City of Novato and shared the contents therein. Attached to the correspondence was the list of 200 signatures previously mentioned. (Copies are attached to the original set of these minutes.) Discussion followed during which the Council reviewed the pros and cons of televised meetings, confirmation was given by the City Attorney that such previous decision by Council could be reconsidered, possible consideration of this matter could be made at some point in the future, and concluding that further investigation would be necessary before making any decisions. Assistant to the City Managdr Leivo confirmed that franchise negotiations with the Multivision Cable TV Corp. are in process, that there has been a delay because of Consultant carl Pilnick's surgery, and that direction from Council would be needed within a couple of months. Brown City Manager I am writing on behalf of a few individuals who are interested in introducing Community access television to Rohnert Park. The City of Novato has televised its city council and planning com- mission meetings since 1985. While the City of Novato has not conducted a survey to determine the number of viewers, word of mouth indicates that numerous citizens watch the community access channel. Getting information from a primary source is the main argument for televising public meetings. Because of the number of sensitive issues generated from City Hall it is essential that the community get first hand information. Televising public meetings further that process. Staff has also worked diligently to encourage individuals and non- profit groups to use the community access station. The station can be used as an information referral service for the high schools and senior citizens. Further, Chambers Cable provides a 24 hour message board for advertising non- profit programs or events. The City of Novato uses a small percentage (12 %) of its franchise fe:esto cable cast public meetings and has greatly benefited from the additional exposure. With increasing demands placed on working families, many don't have time to drive down to City Council meetings, but the are often willing to tune into community access television. I encourage Rohnert Park to seriously consider televising public meetings, and recommend Cox Cable getting involved to assist you with the project. The cable company may help defray start up costs and provide you with good low cost options. Please don't hesitate to call me if you need my further information. It was stated by one council member that all the public had to do to voice their concerns was to come down and present them. Theoretically this might be true, practically, however, it is not. Many residents of Rohnert Park commute and have conflicting schedules. Some people (1 was almost one of these) work nights and are unable to attend council meetings. Working mothers may have trouble getting child care. Then there are those who work full time, go to school and /or have families. Life is not a static condition. Everyone's circumstances are a little different. To be truly accessible to all, televised broadcasts which could be taped and played back later, is a solution. A tape lending library could be created. With T.V. coverage people could prioritize which issues are most important to them. You would know what more of what your constituents fee! and could better represent them. A better educated and more informed electorate is more likely to take part in local government. Television could be the connecting link for those who feel cut off from government. suggest that you speak with the City of Novato, which has been televising for over three years, regarding the pros and cons. I was told by the City that they get instant input. People will often jump in their cars and drive to City Hall if an issue sparks their interest. It was suggested by Council members that both the Council and the public would become "showoffs" for the cameras. That may be true, in the beginning, but I'm sure Council and residents are mature enough to get used to the cameras and go on as normal, after a few months.
