CALL TO ORDER: Df the City of Rohnert Park for Community Development Commission session for a regular meeting to the Council Chambers, Rohnert Park, with Mayor Flores Mayor Flores called the regular session to order at 6:59 p.m. and led the pledge of allegiance. ROLL CALL: Present: (4) Councilmembers Mackenzie and Vidak- Martinez; Vice Mayor Reilly; and Mayor Flores Absent: (0) None Staff present for all or part of the meeting: City Manager Netter, City Attorney Strauss, Assistant City Manager Donley, City Engineer Gaffney, Finance Director Lipitz, Public Works Manager Stephens, Management Analyst Fogle, and Engineering Tech Pedroncelli. 1. MAYOR'S REPORT ON CLOSED SESSION: Mayor Flores reported on the closed session which commenced at approximately 6:00 p.m. to discuss matters listed on the agenda attachment, representing an update. LITIGATION MATTERS: 1. Sonoma County Resource Preservation Council v. City of Rohnert Park: Nothing to report. 2. Claim of Patricia Shaffer: Nothing to report. 3. Possible litigation, one case: Council authorized initiating litigation if agreement can be reached on certain terms and conditions. APPROVAL OF CONCURRENT MEETING MINUTES FOR: SPECIAL SESSION - AUGUST 6, 2002 REGULAR CONCURRENT.. CITY MEETINGS - AUGUST 13, 2002 Upon MOTION by Councilmember Vidak- Martinez, seconded by Councilmember Mackenzie, the Special Session Minutes of August 6, 2002, and the Regular Concurrent City Meetings Minutes of August 13, 2002, were UNANIMOUSLY APPROVED AS SUBMITTED, with Vice Mayor Reilly abstaining from the Special Session Minutes of August 6, 2002. 3. COUNCIL COMMUNICATIONS, IF ANY (INFORMATIONAL ONLY): Mayor Flores asked the Councilmembers if there were any informational communications to add to the agenda. *Councilmember Vidak- Martinez INDICATED that she would add a report on the Tanglewood trip. *Councilmember Mackenzie INDICATED that he would add the following three reports: 1. August 21, 2002, meeting in Sacramento regarding homeland security and federal grant dollars. 2. August 25, 2002, informal meeting in Golis Park. 3. August 20, 2002, action taken by the Board of Supervisors regarding greenhouse emission activity. *Mayor Flores INDICATED that he would add the following two reports: 1. Burial of the time capsule for the new library. 2. Special commemorative ceremony on September 11, 2002, at the Cross & Crown Lutheran Church: INFORMATIONAL PURPOSES. 4. YOUTH OF THE COMMUNITY - COMMENTS, IF ANY: Mayor Flores noted that the Youth Leadership representatives will be back before the Council as soon as school is back in session next week. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES August 27, 2002 Page(3 ) Councilmember Mackenzie noted that he left voice messages for the Sonoma State University Associated Student representatives, indicating that the next Council meeting will be on September 24, 2002, and inquiring about any SSU -ASI executive board meetings which the Councilmembers may attend. 5. SCHEDULED APPEARANCE /PRESENTATION: Rebecca Rishe, Chairperson, Sister Cities Committee, re. Calligraphy Show, 12:00 -6:00 p.m., September 15 -18, 2002, Lobby of Snyder Lane Community Center, and, Reception, 6:00 -7:30 p.m., September 16, 2002, Snyder Lane Community Center: Ms. Rishe DISTRIBUTED AND REVIEWED a three -page handout which outlines the schedule and the placement of the Hashimoto visitors. At the request of Ms. Rishe, Mayor Flores DIRECTED STAFF as follows: (1) Prepare two proclamations - one to welcome the visiting committee and one to express the City's gratitude for the exhibition of the calligraphy and the masks; (2) Authorize the purchase of a gift from the City to the Mayor of Hashimoto; and (3) Schedule City staff to work from noon to 6:00 p.m. on Sunday, September 15, 2002, during the calligraphy show. 6. UNSCHEDULED PUBLIC APPEARANCES: Mayor Flores stated that in compliance with State law, The Brown Act, members of the public wishing to make a comment may do so at this time, limited to 3 -5 minutes per appearance, with a 30- minute limit. Item for Consideration: 2002 -200 APPROVING THE LEASE AGREEMENT WITH THE BOYS AND GIRLS' CLUB OF ROHNERT PARK FOR USE OF BENICIA PARK YOUTH CENTER, 7450 SANTA BARBARA DRIVE, FOR A BOYS' AND GIRLS' CLUB City Manager Netter called attention to Section 7 of the lease agreement regarding "Care, Maintenance, and Repair," and he noted that Engineering Tech Pedroncelli is present on behalf of the Boys' and Girls' Club. Council discussion concluded, and, upon MOTION by Vice Mayor Reilly, seconded by Councilmember Vidak- Martinez, Resolution 2002 -200 was UNANIMOUSLY APPROVED with the following amendment: Per Section 7, "Care, Maintenance, and Repair," the amount of $500 of estimated cost per item for certain repairs shall remain the responsibility of the City, with the addition of a section, by City staff, indicating that the cost for any damage to the facility caused by negligence of the tenant or lack of proper oversight by the tenant shall be the responsibility of the tenant. Item for Consideration: 2002 -202 CHANGING STREET NAME OF STREET ADJACENT TO NEW LIBRARY BETWEEN CITY HALL DRIVE AND ROHNERT PARK EXPRESSWAY TO "COMMUNITY PLACE" Action DEFERRED to second Council meeting in October. Mayor Flores suggested giving Council an opportunity to consider some names for the street, and Councilmember Vidak- Martinez recommended issuing a public request for ideas for a name for said street. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES August 27, 2002 Page(6 ) At the recommendation of Mayor Flores, Council CONCURRED (1) to DEFER said item to the second Council meeting in October; and (2) to INVITE members of the public to submit to City Hall suggested names for said street prior to the second Council meeting in October, at which time Council will consider the recommended names for the street. *************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** EMERGENCY MOTION: Resolution for Consideration: 2002 -203 AUTHORIZING THE FINANCE DEPARTMENT TO RELEASE CHECKS FROM AUGUST 24, 2002, THROUGH SEPTEMBER 23, 2002, AND BRING FORWARD FOR APPROVAL ON SEPTEMBER 24, 2002 City Manager Netter requested Council consideration of said matter as an emergency item. Upon MOTION by Vice Mayor Reilly, seconded by Councilmember Mackenzie, a motion to declare consideration of Resolution 2002 -203 as an EMERGENCY ITEM was UNANIMOUSLY APPROVED. OTHER RESOLUTION FOR CONSIDERATION: 2002 -204 AWARD OF CONTRACT, GOLF COURSE WATERLINE, PROJECT NO. 2002 -05 City.Manager Netter shared the contents of the staff report. Upon MOTION by Councilmember Vidak - Martinez, seconded by Councilmember Mackenzie, Resolution 2002 -204 was UNANIMOUSLY APPROVED. 9. WATER ISSUES: 1. Presentations by Dan Carlson, Capital Projects Coordinator - City of Santa Rosa and Dave Smith, Merritt Smith Consulting: *Geysers Recharge Project - Update *Incremental Recycled Water Program - Review *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES August 27, 2002 Page(7 ) and 2. Council Questions /Answers: Dan Carlson shared a slideshow on the Geysers Recharge Project; Dave Smith and Ed Brauner discussed the Incremental Recycled Water Program. All three speakers responded to Council comments and questions. Per the geysers project, Council inquired about monitoring for future leaks, seismic measures, and the status of Cal Pine. Per the recycled water program, Council asked about future growth in the region, habitat, and the California toxics rule. At the suggestion of Councilmember Mackenzie, Mayor Flores DIRECTED staff and Council to forward all suggestions and comments regarding alternatives to be considered in the City's EIR to City Manager Netter for presentation at the September 19, 2002, Board of Public Utilities screening. Furthermore, Councilmember Mackenzie (1) REQUESTED a color copy, electronic or print, of this evening's water presentations to allow Council to thoroughly consider the matter prior to the September 19 Board of Public Utilities screening; and (2) REQUESTED that his concerns about upstream discharge be conveyed by City Manager Netter at the September 19, 2002, Board of Public Utilities screening. 10. NOVEMBER 5, 2002, ELECTION MATTERS CONSIDERATION OF SUBMITTAL OF REBUTTAL ARGUMENTS: 1. Ballot Measures - Submittal of rebuttal arguments (deadline August 29, 2002) for: Telephone Communications and Video Services Tax Council Discussion /Action: City Manager Netter shared some minor changes to the City's rebuttal to the Sonoma County Taxpayers' Association's argument as follows: (1) First paragraph, second sentence, change "found" to "generated "; (2) First paragraph, last sentence, change order to "maintenance of streets and parks "; (3) Second paragraph, last sentence, change "than" to "of "; and (4) Fourth paragraph, second sentence, change "taxes" to "tax." *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES August 27, 2002 Page(8 ) Councilmember Vidak - Martinez recommended (1) Removing the first phrase of the second sentence; (2) Highlighting the facts regarding the City's low number of employees per resident, low commercial refuse service rates, and low business license tax rates; and (3) Adding in and highlighting the names of the two cities, Cotati and Cloverdale, over which Rohnert Park ranks seventh in terms of returns on property taxes and sales taxes in Sonoma County. Mayor Flores indicated that he would speak to the Board of Directors of the Sonoma County Taxpayers' Association regarding their argument and any further action. Vice Mayor Reilly referenced the August 13 minutes and recommended laying out the facts in the rebuttal. At the suggestion of Vice Mayor Reilly, Mayor Flores DIRECTED STAFF to fax a draft of the final rebuttal argument to the Councilmembers for further consideration prior to the deadline of August 29, 2002. 2. Public Education Plan for Ballot Measures: City Manager Netter shared the contents of the staff report and referred Council to the informational pamphlet provided in the agenda packets. Council Discussion /Action: indicated that the latest Education Action Plan for her satisfaction. City Attorney Strauss version of the Public the Ballot Measures meets 11. LOCAL LAW ENFORCEMENT BLOCK GRANT FUNDING - CONSIDERATION OF EXPENDITURE OF LOCAL LAW ENFORCEMENT BLOCK GRANT FUNDS TO CONTINUE PARTIAL FUNDING OF A COMMUNICATIONS SUPERVISOR FOR THE ROHNERT PARK DEPARTMENT OF PUBLIC SAFETY: 1. Council Discussion /Action: Resolution for Consideration: 2002- AUTHORIZING AND APPROVING THE SALE OF CITY -OWNED REAL PROPERTY LOCATED AT 6600 HUNTER DRIVE, APN 143 - 051 -035 (OLD LIBRARY LOCATION) Action DEFERRED to the next Council meeting. 16. GENERAL PLAN IMPLEMENTATION PROGRAM - MATTERS RELATED TO THE GENERAL PLAN PROCESS, IF ANY: 1. Status Report on General Plan Implementation: City Manager Netter referred Council to Planning Director Kaufman's memo in the agenda packet. Council had no questions about the memo. 2. Consideration of requesting a review of the City's Housing Element by the Greenbelt Alliance and the Non - Profit Housing Association of Northern California: Council discussion concluded with general AGREEMENT between Mayor Flores and Councilmember Vidak- Martinez to decline requesting a review of the City's Housing Element by the above -named organizations. Councilmember Mackenzie recused himself from any vote on this matter due to his position with the Greenbelt Alliance. 3. General Plan Implementation Oversight Committee Special Meeting with Board of Supervisors, 2:00 p.m., August 28, 2002: INFORMATIONAL PURPOSES. Councilmembers Vidak- Martinez and Mackenzie noted that they will be attending said meeting. 4. Other, if any: a. Citizens' Advisory Committee /subcommittees' recommendations per the General Plan Update: Councilmember Mackenzie reported that the Sonoma County Board of Supervisors' took no action yesterday on a memo from the Citizens' Advisory subcommittees regarding agricultural tourism and agricultural processing. He noted that he shared brief comments on the water resources and the circulation and transit elements, and he asked the Council to pay close attention to the Citizens' Advisory Committee policy recommendations over the next few months. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES August 27, 2002 Page(12) 17. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Channel 22 Subcommittee August 17, 2002, meeting: Vice Mayor Reilly and Mayor Flores noted that the following items were discussed: Current and future land uses around the facility, the City's support for Channel 22, the use of the antenna, the City's desire to help increase their radio station broadcast area, the need to clean up the storage area, and, finally, the intervention of Congresswoman Woolsey along with a letter of support from the City in an effort to focus the identification /advertisements of the station more on Rohnert Park. 2. Water Subcommittee, August 27, 2002, meeting: Councilmembers Vidak- Martinez and Mackenzie reported briefly on the following three matters: (1) Revised rainfall figures and the impacts on drainage and plans for dealing with controlling storm waters; (2) Upcoming information from the Russian River Watershed Association; and (3) SCWA request that Councilmembers Vidak- Martinez and Mackenzie be part of a lobbying group to go to Washington, D.C., on the week of October 7th to meet with federal representatives, particularly on the issue of funding of mitigation projects to reduce soil erosion around the community and other areas. 3. Other, if any: a. Tanglewood Trip: Councilmember Vidak- Martinez shared brief comments on her tours of the area and interviews with local business people in an effort to help prepare Rohnert Park for the coming of the Green Center within the next two or three years. FOR THE RECORD, Councilmember Vidak- Martinez stated that she paid her own way to Tanglewood and that it was not at City expense. Councilmember Mackenzie REQUESTED a meeting of the Economic Development Subcommittee sometime in October. *City Council /Community Development Commission City of Rohnert Park August 27, 2002 • MI� to) Z • *CONCURRENT MEETINGS MINUTES Page(13) Communications per the attached outline were brought to the attention of the Councilmembers. No Smoking in Tot Lots /Playgrounds: Councilmember Vidak- Martinez called attention to a memo from the Proposition 10 Commission, stating that smoking in tot lots and playgrounds is prohibited as of January 2, 2002. City Manager Netter noted that he would look into the matter of posting said law at all City tot lots and playgrounds. Letter from Scott's Office Equipment: Councilmember Vidak- Martinez called attention to Mr. Scott's letter and asked that Council /staff be more diligent about shopping locally and supporting local businesses. New Library matters: Mayor Flores reminded Council of the 5:00 p.m. deadline, Thursday, August 29, for their comments /artifacts for the time capsule. He noted the library fundraiser on Friday, August 30, and the ribbon - cutting /public viewing on Saturday, August 31, from 11:00 -3:00 p.m. Mayor Flores also invited Councilmembers to prepare comments for the Saturday function. 19. MATTERS FROM /FOR COUNCIL: 1. Petaluma Argus- Courier News Column: Councilmember Mackenzie noted the decentralization of some County services to Petaluma City Hall. At the suggestion of Councilmember Mackenzie, Council CONCURRED TO DIRECT staff to prepare a letter to the Board of Supervisors, requesting consideration /support for the decentralization of some County services to the City of Rohnert Park as well. 2. Request for opinion of Benefit Increases and Retirement Costs: At the suggestion of Councilmember Mackenzie, Council CONCURRED TO AGENDIZE for the next Council meeting consideration of the City's obligations to its employees and retirees in terms of benefit increases and retirement costs under current laws and contracts, including an opinion from the City Attorney on said matters. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES August 27, 2002 Page(14) 3. League of California Cities' Annual Conference, October 2-5,2002, Long Beach Convention Center: INFORMATIONAL PURPOSES. Climate Protection Campaign: Councilmember Mackenzie reported on the inventory and target - setting work being done countywide on this campaign. He expressed an interest in having County staff, City of Santa Rosa staff, and SSU staff work cooperatively on the inventory and target- setting aspect of the campaign to keep the impact on City staff to a minimum. b. California State Plan - National Granting Program monies: Councilmember Mackenzie reported on a meeting he attended in Sacramento last Wednesday, August 21, regarding the disbursement of monies coming to the State of California through the national granting program. He asked that the Department of Public Safety follow these grants closely at the time of the first round of grants. c. Golis Park meeting: Councilmember Mackenzie and Vice Mayor Reilly gave a brief report on the informal meeting held in Golis Park on Sunday, August 25, to review the Department of Public Safety's plans for the problems at Golis Park. 20. CITY ATTORNEY'S REPORT: 1. Review of Mayor Rotation Resolution No. 2000 -99: City Attorney Strauss reviewed the contents of her staff report. Council Discussion /Direction: Council discussion concluded with Council CONCURRENCE TO AGENDIZE for the first meeting in November consideration of the mayoral rotation, including language from the City Attorney regarding resigning Councilmembers. 2. Status of Rancho Feliz Management: City Manager Netter reported on the following three matters: (1) Storage area cleaned out again; (2) 2003 budget monies set aside for improvements at Rancho Feliz; and (3) Ongoing discussions with potential new management companies. Councilmember Vidak- Martinez and Mayor Flores INDICATED they would schedule a Mobilehome Park Subcommittee meeting in early October. 2. Costco Grand Opening, September 18, 2002: City Manager Netter reported that the notices to the residents of the Rohnert Park have been sent in the mail. He noted that he would get more details about the September 17, 2002, special preview of Costco for the City's dignitaries. 3. Other informational items, if any: a. R.E.M.I.F. Conference: City Manager Netter noted that he would be away at the R.E.M.I.F. conference from September 11 -13, 2002. b. Amber Alert System: City Manager Netter noted that he received a call from Cal Trans regarding the City's interest in using the new reader board sign for the Amber Alert System. c. Department of Public Safety matters: City Manager Netter reported on two items: (1) Deployment of the City's two motorcycle officers; and (2) Upcoming celebration at the Department of Public Safety for the training officers returning from the academy. 22.
