2002/09/24 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETINGS MINUTES for: CITY COUNCIL COMMUNITY DEVELOPMENT COMMISSION ROHNERT PARK FINANCING AUTHORITY ROHNERT PARK DISTRICT CONCURRENT MEETINGS WORK SESSION MINUTES for WATER AND SEWER RATE STUDY and PROPOSED RATE STRUCTURE September 24, 2002 Tuesday The concurrent meetings of the City of Rohnert Park for the City Council, Community Development Commission, Rohnert Park Financing Authority, and the Rohnert Park District met this date for a work session open to the public to discuss the Water and Sewer Rate Study and the Proposed Rate Structure. The work session commenced at approximately 5:00 p.m. in the Conference Room, 6750 Commerce Boulevard, Rohnert Park, with Mayor Flores presiding. CALL TO ORDER: Mayor Flores called the work session to order at 5:04 p.m. ROLL CALL: Present: (4) Councilmembers Mackenzie and Vidak- Martinez; Vice Mayor Reilly; and Mayor Flores Absent: (0) None. Vice Mayor Reilly arrived at 5:24 p.m. Staff present for all or part of the session: City Manager Netter, Finance Director Lipitz, Public Works Manager Stephens, Finance Services Manager Lauchner, and City Engineer Gaffney. ACKNOWLEDGING THE CITY MANAGER /CLERK'S REPORT ON POSTING THE MEETING AGENDA: Council acknowledged the City Manager /Clerk's Report on the posting of the meeting's agenda. City of Rohnert Park September 24, 2002 UNSCHEDULED PUBLIC APPEARANCES: *CONCURRENT MEETINGS MINUTE; WORK SESSION Page (2) Mayor Flores stated that in compliance with State law, the Brown Act, members of the public wishing to make a comment may do so at this time, limited to 3 -5 minutes per appearance with a 30- minute limit. No members of the public came forward to speak. WATER AND SEWER RATE STUDY and PROPOSED RATE STRUCTURE I. PRESENTATION BY CONSULTANT JOHN FARNKOPF FROM HILTON, FARNKOPF & HOBSON, LLC: Mr. Farnkopf of Hilton, Farnkopf & Hobson DISTRIBUTED AND REVIEWED via a slide show a document entitled, "Water and Sewer Rate Structure Evaluation." Mr. Farnkopf responded to Cotanc,l inquiries regarding low - income discounts, master metering and submetering, and creating incentives for businesses to conserve water. PUBLIC COMMENTS: Members of the public were invited by Mayor Flores to come forward and speak. No members of the public came forward. II. COUNCIL DISCUSSION /DIRECTION: Councilmember Vidak - Martinez RECOMMENDED that staff consider preparing information for the public on *"oeL-e_ seape" "Xeriscape" landscaping techniques. Councilmembers expressed GENERAL AGREEMENT to start off with uniform water and sewer rates. Furthermore, Councilmembers CONCURRED on the following DIRECTIONS TO STAFF: (1) Prepare an analysis with suggestions for a reduced rate structure for mobilehome parks; (2) Prepare a Commercial Rate Comparisons report; and (3) Prepare a report on the available uses of the Operating Fund balance. CALL TO ORDER: Mayor Flores called the regular session to order at 7:17 p.m. and led the pledge of allegiance. WORK SESSION: A Work Session was held at 5:00 p.m. in the Conference Room to discuss the Water and Sewer Rate Study and the Proposed Rate Structure. 1. APPROVAL OF CONCURRENT MEETING MINUTES FOR: REGULAR CONCURRENT CITY MEETINGS - AUGUST 27, 2002 Upon MOTION by Councilmember Mackenzie, seconded by Councilmember Vidak- Martinez, the Regular Concurrent City Meetings Minutes of August 27, 2002, were UNANIMOUSLY APPROVED AS SUBMITTED. Councilmembers CALLED ATTENTION to two matters in the August 27, 2002, Council minutes as follows: (1) Page 13, Item 19, No. 2, Council CONCURRENCE TO AGENDIZE consideration of the City Attorney's opinion of benefit increases and retirement costs related to staff costs to the City. Councilmember Vidak- Martinez noted that said matter should have been on this evening's agenda as noted in the August 27, 2002, minutes, and she requested that it be agendized for the next meeting in October. (2) Page 15, Item 21, No. 1, indication to schedule a Mobilehome Park Subcommittee meeting in early October to assess Rancho Feliz matters. Councilmember Vidak - Martinez and Mayor Flores AGREED to schedule a meeting when Councilmember Vidak- Martinez returns from Washington, D.C., in October. FOR THE RECORD, Councilmember Mackenzie noted that he did request the opinion of City Attorney Strauss as to the City's obligations to its employees and retirees in terms of benefit increases and retirement costs under current laws and contracts. 3. YOUTH OF THE COMMUNITY - COMMENTS, IF ANY: Mayor Flores called forward a member of the public interested in speaking at this time. 1. Brad Carson 1343 Middle Brook, was recognized and DISTRIBUTED AND REVIEWED an informative packet, including two C.D.'s and a concurrent resolution, regarding Falun Gong, a peaceful and nonviolent form of personal belief and practice with millions of adherents in the People's Republic of China and worldwide. He thanked Council for its past support of Falun Gong, and he requested Council consideration of resolution aimed at ending the persecution of Falun Gong practitioners. 5. SONOMA STATE UNIVERSITY ASSOCIATED STUDENTS, INC., REPRESENTATIVE: 1. Recognizing SSU ASI Representative Jamie Holian: ASI Representative Holian was not present. 2. SSU ASI Report /Comments, if any: None. 6. SCHEDULED PRESENTATIONS: 1. Mayor's Acknowledgement of the Chamber of Commerce's presentation to Joe Netter, "In Recognition of Your Contributions to the Business Community as a Member of the Board of Directors /Rohnert Park Chamber of Commerce 1997 - 200111: Mayor Flores presented City Manager Netter with his award of recognition. 2. SCHEDULED PUBLIC APPEARANCES: 1. M Wayne Thush, 4400 Hollingsworth Circle - Golf Course Matter /Private Carts: Mr. Thush called forward Mr. Jim Pekkain, former Rohnert Park Recreation Director, who asked that the City renegotiate the private cart issue with CourseCo to allow all resident owners of carts, current and future, the right to use their carts on the golf courses. Mr. Thush DISTRIBUTED AND REVIEWED an informational packet to the Councilmembers, consisting of correspondences, a transcript, surveys, charts, and a petition. He discussed the impact of CourseCo's present golf cart policies on the residents, on the local businesses, and on CourseCo's business as well. Finally, he SUBMITTED pictures to the Council of golf- cart - related improvements to properties on the north and south courses, and he urged the Council to renegotiate the golf cart policy with CourseCo and to obtain profit /loss data from CourseCo for Council review. At this time, Councilmembers shared their questions and comments on the issue. Council CONCURRED (1) to AGENDIZE the matter of renegotiations with CourseCo concerning the use of privately -owned golf carts for the second Council meeting in October and (2) to request profit /loss data from CourseCo for Council review. 2. Abel Sagon, 4668 Fairway Drive - Foxtail North Golf Course Matter /Construction Issues: Mr. Sagon and his wife expressed grave concerns over golf course reconstruction issues, including the loss of privacy and the lake view behind their home, the loss of trees, the increase in errant balls that hit their home, notification issues, drainage concerns, and, finally, both the unsightly pump station and the well site often used for urination on the golf ,.,_,,,rse hPr;,,� tbe;r home. Thev requested that Council take a closer look at the homeowner's point of view in terms of the golf course renovations. At this time, Councilmembers shared their questions and comments on the issue. Council CONCURRED TO AGENDIZE consideration of reconstruction issues for the second Council meeting in October with a fully updated staff report. Furthermore, Mayor Flores DIRECTED STAFF to look into the drainage problems and the well site issue, and he SUGGESTED that the Golf Course Oversight Committee review areas on the golf courses for additional trees. *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES September 24, 2002 Page(5 ) 8. UNSCHEDULED PUBLIC APPEARANCES: Mayor Flores stated that in compliance with State law, The Brown Act, members of the public wishing to make a comment may do so at this time, limited to 3 -5 minutes per appearance, with a 30- minute limit. The following members of the public expressed various concerns over the following matters: (1) CourseCo's proposal to raise rates on both courses, even as the renovation of the north course remains unfinished; (2) CourseCo's contractual restrictions on the use of privately -owned golf carts; (3) The property issues surrounding the golf course renovations that have left small hills and berms obstructing the golf course homeowners' views of the lakes and the fairways; and (4) The poor condition of the south course despite its recent renovation. 1. Jim Pekkain Rohnert Park Suggestions for dealing with the various matters included the following: (1) Postpone the rate increases until both courses are in good operating condition; (2) Improve food service and the restrooms for the golfers; (3) Create an indoor eating area for the golfers on weekends when a wedding is scheduled; (4) Do cost comparisons with Bennett Valley; (5) Work towards renegotiations and /or a compromise with CourseCo; and (6) Use the Golf Council and the Golf Course Oversight Subcommittee in efforts to address the above - mentioned problems. *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES September 24, 2002 Page(6 ) At this time, Mayor Flores called forward another member of the public for an unscheduled public appearance. 11. Al Barr, 5746 Dexter Circle, was recognized and DISTRIBUTED AND REVIEWED a letter from Daryl G. Berns, an Assistant Plant Manager and 30 -year construction industry veteran, and a copy of Revision 4 of the Proposed Noise Ordinance. Mr. Barr discussed the test he conducted with Mr. Berns in terms of finding an alarm audible at 200 feet, but not more than 500 feet. He noted the revisions in his proposed noise ordinance in response to City Attorney Strauss, and he asked that Council reconsider the matter at an upcoming Council meeting. At the request of Councilmember Mackenzie, Director Barry provided an update on the status of the skate park site. 2. Off -Leash Doti Proposal: Staff Report: Recreation Director Barry gave a brief overview of the staff report, and staff responded to Council inquiries. Councilmember Mackenzie SUGGESTED that the Golis Park dog group be present at such time that Council considers the proposed off -leash dog ordinance. 3. Foxtail Golf Club Rate Increase Proposal: Staff Report: Recreation Director Barry summarized the contents of the staff report and DISTRIBUTED AND REVIEWED a document entitled, " Foxtail Golf Club - Maximum Cost of Golf." Director Barry indicated that CourseCo has been notified of the City's remaining work tasks regarding the south course to be completed by the end of October, and he stated that he will be returning with a full status report on the south course at the second Council meeting in October. Council Discussion /Direction: Councilmembers shared their perspectives. Highlights of Council comments and questions included the following: Mayor Flores: *Recommends that CourseCo not increase the rates until such time as the local golfers are generally satisfied with the golf course improvements. *With a 40 -year contract, both the City and CourseCo need to look to the future. Vice Mayor Reilly: *Comparison rates need to be checked. *Is it appropriate to compare Foxtail's fees under its current playing conditions? *Calls for stronger relationship between City staff, Council, and CourseCo, as well as more oversight and more involvement from the City. Council CONCURRED on two matters: (1) TO DIRECT STAFF to report back on the implementation of the City's recommendations to CourseCo regarding the south course; and (2) TO DIRECT the Golf Course Oversight Committee to prepare an analysis with regard to the comparability of golf course fees. At this time, Mayor Flores called forward members of the public interested in speaking on this issue. 1. John Theilade, General Manager, Foxtail Golf Club, was recognized and stated that CourseCo recognizes that there are problems with the greens. He discussed the fungus that had affected the greens, as well as the fact that new greens and a new irrigation /drainage system was not included in the scope of work for the south course. He explained that those are in -house projects that CourseCo has been prioritizing and working on for over a month. He reiterated that CourseCo is addressing the problems and that they take their relationship with the City and with the golfers very seriously. Finally, he noted that CourseCo does have plans to try to redo the pro shop and snack bar area in response to client concerns. 2. M Wayne Thush 4400 Hollingsworth Court, was recognized and indicated that he did double -check the comparison rates put forth by CourseCo and that they are accurate. Finally, he commended Recreation Director Barry for being responsive and timely in addressing his inquiries. 11. AFFORDABLE HOUSING LINKAGE FEES FOR NON - RESIDENTIAL DEVELOPMENT: 1. Council Discussion /Direction: and Mayors' & Councilmembers' Working Group - Participation: Councilmembers shared their comments /questions as follows: Councilmember Vidak Martinez - With whom is Sonoma County comparing itself ?; Councilmember Mackenzie - In general in favor of the countywide approach; and Vice Mayor Reilly - Creation and existence of the fee is vital to what the City needs to do for housing projects. Staff Report: City Manager Netter gave an overview of the staff report. 2. Staff Report: Planning and Community Development Director Kaufman shared the contents of the staff report provided to Council in the agenda packets. b. Council Discussion /Action: Council discussion concluded with Council CONCURRENCE to reject the application at this time until concerns with regard to the community separator in that area, the formation of the infrastructure financing plan, and some other issues are adequately addressed. Vice Mayor Reilly suggested that the applicant consider directly challenging the disputed community separator with the County Board of Supervisors. 14. GENERAL PLAN IMPLEMENTATION PROGRAM - MATTERS RELATED TO THE GENERAL PLAN PROCESS, IF ANY: 1. General Plan Implementation Oversight Committee-_ Results of Special Meeting with Board of Supervisors, August 28, 2002: Councilmember Mackenzie reported that there was general agreement to go forward with the concept of the banking idea and the community separator fund and /or bank. Water Advisory Committee Meeting, September 9 2002: City Manager Netter referred Council to City Engineer Gaffney's Meeting Report provided in the agenda packet. Councilmember Mackenzie indicated that the Council Water Subcommittee will be meeting prior to the negotiating sessions and will come to Council for input throughout the interest - based bargaining sessions. City Manager Netter responded to Vice Mayor Reilly's concerns about the poor notification with regard to the September 23, 2002, negotiating session. At the suggestion of Vice Mayor Reilly, Council CONCURRED TO DIRECT STAFF to prepare a letter to the Water Advisory Committee, requesting proper notification of the meetings, specifically the negotiating sessions, with an agenda, sent to the appropriate City staff /department /committee. 2. Council Executive Subcommittee Meeting, September 10, 2002 - Update: Mayor Flores reported on several items per the agenda as follows: (1) Economic development matters; (2) Desire to solicit Council support to have City sponsor Veterans' Day ceremony; (3) Desire for Golf Course update in October; (4) Reminder about Founders' Day activities on September 28, 2002; (5) Desire for Rancho Feliz update and Mobilehome Park Subcommittee to meet in October; (6) Desire to solicit Council support for retaining Junior Miss Program in Rohnert Park. Sonoma County Transportation Authority (SCTA), September 9, 2002, meeting: City Manager Netter referred Council to City Engineer Gaffney's Meeting Report provided in the agenda packet. Councilmember Mackenzie noted that he will be chairing the next SCTA meeting on October 7, 2002, and that he will report back to Council. 2. Other, if any: None. 17. COMMUNICATIONS: Communications per the attached outline were brought to the attention of the Councilmembers. Mayor Flores called attention to the letter from the Governor's Office expressing regret for not being able to attend the gala function for the new library. The Mayor expressed his appreciation that the Governor's Office took the time to reply, and he noted that the City will be making all the necessary adjustments before the library is turned over to the county library system. 18. MATTERS FROM /FOR COUNCIL: 1. Specifically, he called attention to the issue with the carpet not adhering to the cement and how that matter will affect the opening of the library, pushing it up to December, or February as a worst case scenario. 4. _California Tiger Salamander Listing as Endangered Species - Upcoming Meeting: INFORMATIONAL PURPOSES. City Manager Netter referred Council to Planning Director Kaufman's staff report of September 24, 2002, and City Attorney Strauss responded to Council questions. S. Incremental Recycling Water Program (IRWP) Screening Report: City Manager Netter reported that the Board of Public Utilities met last Thursday and rejected both the recharge and the storage plans /options about injecting into Rohnert Park's aquifer.
