CALL TO ORDER: Df the City of Rohnert Park for Community Development Commission session for a regular meeting to the Council Chambers, Rohnert Park, with Mayor Flores Mayor Flores called the regular session to order at 6:30 p.m. and led the pledge of allegiance. ROLL CALL: Present: (4) Councilmembers Mackenzie and Vidak- Martinez; Vice Mayor Reilly; and Mayor Flores Absent: ( 0 ) None Staff present for all or part of the meeting: City Manager Netter, City Attorney Strauss, Assistant City Manager Donley, Building Official Braun, and Recreation Services Manager Miller. 1. MAYOR'S REPORT ON CLOSED SESSION: Mayor Flores reported on the closed session which commenced at approximately 6:00 p.m. to discuss matters listed on the agenda attachment, representing an update. APPROVAL OF CONCURRENT MEETING MINUTES FOR: WATER & SEWER RATE WORK SESSION - SEPTEMBER 24, 2002 REGULAR CONCURRENT CITY MEETINGS - SEPTEMBER 24, 2002 Upon MOTION by Councilmember Mackenzie, seconded by Councilmember Vidak- Martinez, the Water & Sewer Work Session Minutes of September 24, 2002, and the Regular Concurrent City Meetings Minutes of September 24, 2002, were UNANIMOUSLY APPROVED AS AMENDED: Vice Mayor Reilly: Regular Meetings Minutes, Page 13, Item 15, Number 2, amend "Vice Mayor Flores" to read "Vice Mayor Reilly." Councilmember Vidak - Martinez: (1) Work Session Minutes, Page 2, Item II, amend "zero- scape" to read "Xeriscape"; and (2) Regular Meetings Minutes, Page 9, Item 10, Number 3, under "Councilmember Vidak- Martinez," in second bullet, change "admits" to "acknowledges," and delete fourth bullet, which reads, "Would like to see this evening's recommendations to CourseCo occur in order to keep resident golfers here." 3. COUNCIL COMMUNICATIONS, IF ANY (INFORMATIONAL ONLY): Mayor Flores asked the Councilmembers if there were any informational communications to add to the agenda. Councilmembers indicated that they had no communications. 4. YOUTH OF THE COMMUNITY - COMMENTS, IF ANY: Mayor Flores invited any youth of the community to come forward and share comments. No youths responded. 5. SONOMA STATE UNIVERSITY ASSOCIATED STUDENTS, INC., REPRESENTATIVE: 1. Recognizing SSU ASI Representative Jamie Holian: ASI Representative Holian was not present. 2. SCHEDULED APPEARANCES /PRESENTATIONS: 1. Presentation of resolution to State Farm Insurance, extending appreciation and recognizing its many years of service to the City: Mayor Flores read and presented the resolution to Shirley Gordon, Vice President of Operations for State Farm in Rohnert Park. Ms. Gordon shared brief comments. 2. Robert Abramson for United Nations Day, Thursday, October 24, 2002, and United Nations Flag Week, October 21 -26, 2002: Mr. Abramson requested that Council issue a proclamation honoring the United Nations on United Nations Day. He SUBMITTED a United Nations flag and also requested that Council fly the flag during United Nations Flag Week from October 21 -26. Furthermore, he shared brief comments about the key role of the United Nations in world affairs, and he DISTRIBUTED a flier to Council regarding the United Nations Association Film Festival on November 2, 2002, at Santa Rosa Junior College. 7. UNSCHEDULED PUBLIC APPEARANCES: Mayor Flores stated that in compliance with State law, The Brown Act, members of the public wishing to make a comment may do so at this time, limited to 3 -5 minutes per appearance, with a 30- minute limit. 1. Mike Harrow, 5748 Dexter Circle, was recognized and called attention to the issue of the master metering of mobilehome parks and the consequent inability of mobilehome park residents to lower their water bills by lowering their usage. He suggested that Council address the suggested flat rate structure for master - metered mobilehome parks. 2. Amie Spradlin, 5795 Dexter Circle, was recognized and expressed concern with the proposed 42- percent rate hike for water and sewer for mobilehome park residents. She noted that many mobilehome park residents are on fixed incomes and such a hike would be a burden. She also expressed opposition to the water /sewer reserve account in terms of it being maintained at the expense of the City's lower and fixed income citizens. She urged the Council to review the possible rate hikes and to continue speaking with the water /sewer rate consultants regarding said matter. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES October 8, 2002 Page(4 ) 3. Charles Kitchen 4457 Hollingsworth Circle, was recognized and expressed his concern with the proposed 42- percent increase in water /sewer rates for mobilehome park residents, as well as the issue of master metering in the mobilehome parks. He noted that if he gets elected to Council and said rate hikes go through, he will organize a recall movement. 4. Greg Nordin, 4590 Fairway Drive, was recognized and expressed concern about the proposed 42- percent water /sewer rate increase for mobilehome park residents. He suggested that the Council contact the cities of Windsor and Healdsburg to learn about their approved plans /ordinances which allow people who qualify for fixed incomes, particularly those who live in mobilehome parks, to receive a significant reduction in their water fees. At this time, Councilmember Mackenzie directed the public speakers to the Council directions as outlined in minutes of the September 24, 2002, Water and Sewer Rate Study and Proposed Rate Structure Work Session. *************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** 8. Staff Report: City Manager Netter gave a brief overview of the staff report, and City Attorney Strauss responded to Council inquiries regarding the City's liability. 2. Council Discussion /Action: a. Ordinance for Introduction: No. 689 AMENDING CHAPTER 6.08.010 OF THE ROHNERT PARK MUNICIPAL CODE, ALLOWING CERTAIN EXCEPTIONS TO "ANIMALS PROHIBITED IN CERTAIN AREAS" Upon MOTION by Vice Mayor Reilly, seconded by Councilmember Mackenzie, Ordinance for Introduction No. 689 was UNANIMOUSLY APPROVED with DIRECTIONS TO STAFF, per Vice Mayor Reilly's suggestion and Council concurrence, to remove the word "fenced" in the phrase "city- sponsored fenced dog park." b. Set Public Hearing date on October 22, 2002, to consider adoption of this ordinance: INFORMATIONAL PURPOSES. DEPARTMENT OF PUBLIC SAFETY MATTER RE MOTORIZED SCOOTERS - CONSIDERATION OF ASSOCIATED CODES AND REGULATIONS, INCLUDING PROPOSED AMENDMENTS TO THE ROHNERT PARK MUNICIPAL CODE FOR CERTAIN CHAPTERS OF TITLE 10, VEHICLES AND TRAFFIC: 1. Staff Report: City Manager Netter summarized the contents of the staff report. 2. Council Discussion /Direction: Council CONCURRED TO DIRECT STAFF to formulate Municipal Code amendments Der motorized scooters with the following Council recommendations /requests: (1) Information /pictures regarding the modification of exhaust systems; (2) Addition of the regulations per the C.H.P. memo in the staff report; (3) Clarification of enforcement issues; and (4) Consideration of educating youngsters on the safe and legal use of said scooters. Furthermore, Council CONCURRED with Councilmember Mackenzie's suggestion to have the Bicycle Advisory Conunittee review the use of motorized scooters on bike paths and provide recommendations to the Council. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES October 8, 2002 Page(9 ) City Manager Netter indicated that said amendments to the Municipal Code will be ready for Council review at the first Council meeting in November. At the suggestion of City Attorney Strauss, Council CONCURRED TO DIRECT STAFF to provide more information at that time on recent legislation concerning electric personal- assisted devices. ANNOUNCEMENT: At this time, City Manager Netter stated that he received a packet of information regarding Agenda Item No. 9, the Off -Leash Dog Proposed Revision to the Rohnert Park Municipal Code. Said packet includes a proposal for an off -leash dog park in designated areas of Golis Park, letters of support, a petition, and surveys. City Manager Netter noted that he would supply copies of said packet to the Councilmembers as requested by the individuals who submitted the packet. 13. GENERAL PLAN IMPLEMENTATION PROGRAM - MATTERS RELATED TO THE GENERAL PLAN PROCESS, IF ANY: 1. General Plan Implementation Oversight Committee, October 1, 2002, meeting: Councilmember Vidak- Martinez shared comments about aspects of the apartment buildings planned for Rohnert Park y Expressway as follows: (1) The applicant's proposal related to the City's Inclusionary Zoning Ordinance - 15% low income and a donation to Burbank Housing for another 7% very low income; (2) The applicant's cost issues with said proposal and the staff's suggestion of having 7% very low income housing as the City's requirement. Councilmember Mackenzie shared comments on the City's.Growth Management Ordinance and the cap on the number of housing units, the potential impact on the City's General Plan Environmental Impact Review, and the implications of special consideration regarding a financial donation to very low income housing and its clear connection with the project. City Attorney Strauss responded briefly to Council questions, and Councilmembers Vidak- Martinez and Mackenzie noted that they would be meeting next on Tuesday, October 29, 2002, to further consider the above - listed matters. 2. Other, if any: None. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINU`T'ES October 8, 2002 Page(10) 14. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Water Advisory Committee upcoming negotiation session on October 28, 2002 -,Council Direction: Councilmember Mackenzie discussed the three major topics, as outlined below, of the interest - based bargaining sessions with the Sonoma County Water Agency (SCWA), and he called for Council direction prior to the next negotiating session on October 28, 2002. a. Governance (Voting) b. Membership allowing Windsor and /or Marin to be full members c. Conservation Funding kept jointly with Sonoma County Water Agency (SCWA) or separate with each individual agency Council Discussion /Direction: Mayor Flores REQUESTED the recommendations of the Council Water Subcommittee for review at the Council meeting on October 22. At the suggestion of Councilmember Mackenzie, Council CONCURRED TO DIRECT STAFF to circulate a staff paper among the Councilmembers to gather input on the three issues and discuss them at the Council meeting on October 22. Vice Mayor Reilly shared his perspectives as follows: (1) Governance - supports a super majority vote; (2) Windsor /Marin - show how they will earn their full membership; (3) Conservation funding - however it is set up, make sure there are guarantees that agencies get their full percentage back on a timely basis. Councilmember Mackenzie shared final comments on the Windsor /Marin memberships, and Councilmember Vidak- Martinez REQUESTED a staff report on the history of Marin Municipal and related issues. 2. Performing Arts Center Subcommittee meeting, September 26, 2002: Councilmember Vidak- Martinez shared comments on her interest in linking the Performing Arts Center with the Green Music Center in an entrepreneurial effort as part of an economic development plan. Mayor Flores discussed the status of the digital PAC sign, an upcoming review of the relationship between the City and the Green Music Center, and efforts to retain the California Junior Miss program in Rohnert Park. Councilmember Mackenzie noted that the PAC season has begun. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES October 8, 2002 Page(11) 3. Council Executive Subcommittee meeting, October 1, 2002: Mayor Flores commented on the following matters: (1) Councilmember Vidak- Martinez will attend the next meeting; (2) Need for Channel 22 area to be cleaned up; (3) Submission of the L.A.F.C.O. application to exclude the 170 -plus acres south of Valley House Drive. 4. Consideration of assignment of pre- development review of the City Center Mixed Use project by Economic Development Subcommittee: City Manager Netter requested Council consideration of said assignment to the Economic Development Subcommittee, and Assistant City Manager Donley shared brief comments on the status of the City Center Mixed Use project. Council discussion concluded with Council CONCURRENCE to assign pre - development review of the City Center Mixed Use project to the Economic Development Subcommittee on an interim basis, and then, with a full Council, to reaffirm or change the review assignment in December. 5. Open Space District /Small Farms Initiative - Farm land on the north city limits border adjacent to Snyder Lane - Board of Supervisors meeting, November 1, 2002: Councilmember Mackenzie spoke about a pilot program by which the Open Space District leases land for agricultural production. He specifically discussed the Board of Supervisor's recent consideration of a lease arrangement with a small farmer north of Park Estates, the Park Estates Citizens' Group's concerns regarding traffic on Snyder Lane in terms of the proposed farm stand, and the issue of building oversight into the leases if the pilot program proves successful here. 6. Other, if any: None. 15. TRANSPORTATION MATTERS: 1. Sonoma County Transportation Authority (SCTA), October 7, 2002: Councilmember Mackenzie reported on two matters: (1) Direction from SCTA that its representatives again request that $160 million of federal funds be earmarked for the Marin- Sonoma Narrows project; and (2) the ongoing problems, especially with the State Historical Planning Office and the issuance of EIR's, in terms of getting Highway 101 projects to the construction stage. *City Council /Community Development Commission City of Rohnert Park October 8, 2002 2. EMPLOYEE BENEFITS /RETIREMENT COSTS - CONSIDERATION OF THE CITY'S OBLIGATIONS TO ITS EMPLOYEES AND RETIREES IN TERMS OF BENEFITS /RETIREMENT COSTS UNDER CURRENT LAWS AND CONTRACTS: 1. City Attorney Report: City Attorney Strauss summarized the contents of the staff report. 2. Council Discussion /Direction: Councilmember Vidak- Martinez and Mayor Flores commented on recruitment and retention of competent employees. Councilmember Mackenzie reiterated that his desire in requesting the legal opinion was not to take away all benefits from city employees /retirees, but rather, in light of the City's current and predicted budgetary shortfall, to review any possible ways to reduce the burden on the budget by having employees and retirees pay part of the costs of their health and /or retirement benefits. Furthermore, he noted that the City Attorney's report was clear in its response to his inquiry. 17. COMMUNICATIONS: Communications per the attached outline were brought to the attention of the Councilmembers. Councilmember Vidak- Martinez re e -mail from M. Councilmember Mackenzie re communication from Linda Tracy, Chamber of Commerce: At the suggestion of mA(rkPn7; P . Council CONCURRED TO DIRECT STAFF to invite the new manager of the Chamber of Commerce to make a scheduled appearance before the Council in the near future. 18. MATTERS FROM /FOR COUNCIL: 1. Veterans' Day, November 11, 2002 - Community Event: Mayor Flores DISTRIBUTED AND REVIEWED a handout outlining a proposed public ceremony honoring the veterans of war. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES October 8, 2002 Page(13) Council Discussion /Direction: Council CONCURRED TO DIRECT STAFF to follow through on Mayor Flores' proposed ceremony. 2. Other informational items, if any: a. Appointment to Sonoma -Marin Area Rail Transit Board of Directors: Councilmember Mackenzie expressed an interest in said appointment, and Council CONCURRED to promote him. Mayor Flores stated that he would report back on the criteria/ selection process for that appointment after the Mayors' & Councilmembers' Association meeting on October 10, 2002, at which time the matter will be considered. b. Mayors' & Councilmembers' Association Working Committee meeting on October 16, 2002: Councilmember Mackenzie noted that he would attend and report back on said meeting. 19. CITY MANAGER'S REPORT: 1. Salamander Protection Area, September 24, 2002, meetings - Fish and Wildlife Services accepting written testimony on proposed protections for the salamander until October 22 2002 for March 22 2003, deadline to resolve listing question: City Manager Netter gave a brief update on the Salamander Protection Area. Proposed letter from Mayor /Action Item: At the recommendation of City Manager Netter, Council CONCURRED TO DIRECT STAFF to send the proposed letter regarding the proposed listing of the Sonoma County Population of the California Tiger Salamander. 2. Willis Avenue traffic concerns in vicinitv of In & Out Burger /Tesoro - Update: City Manager Netter reviewed the staff report and indicated that staff is reviewing alternatives to the traffic problems in that area. 3. Ballot Measure public education efforts - Update: City Manager Netter directed Council to the copies of the informational brochures provided in the agenda packets. City Attorney Strauss responded to Council questions. 4. I would like to request that one of the City Council members offer an amendment to the minutes of that teeting to correct an incorrect statement that has been attributed to me (page 4). 'he final sentence of the minutes that relate to my scheduled public appearance regarding the golf cart issue states that I urged the ;ouncil "to obtain profit/loss data from CourseCo for Council review." This is completely erroneous. My comments included the tatement that CourseCo had been given ample opportunity already to provide such data to the Parks & Rec Commission and that ;ourseCo refused to do so. I asked the City Council to avoid the temptation to request additional data from CourseCo, but the City ,ouncil decided to do so against my wishes. 'lease correct the minutes of that meeting to reflect that it was not I, but members of the City Council who decided to go against ay wishes and request additional info from CourseCo, and to delay a decision until Oct 22nd. .7hank you.
