2003/05/27 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETINGS MINUTES for: CITY COUNCIL COMMUNITY DEVELOPMENT COMMISSION May 27, 2003 Tuesday The Concurrent Meetings of the City of Rohnert Park for the City Council and the Community Development Commission met this date in Regular Session for a regular meeting to commence at 6:00 p.m. in the Council Chambers, 6750 Commerce Boulevard, Rohnert Park, with Mayor Flores presiding. CALL TO ORDER /PLEDGE OF ALLEGIANCE: Mayor Flores CALLED the Regular Session to order at 6:00 p.m. and led the pledge of allegiance. ROLL CALL: Present: (5) Councilmembers Mackenzie, Spradlin, and Vidak- Martinez; Vice Mayor Nordin; and Mayor Flores Absent: (0) None Staff present for all or part of the Work Session: City Manager Leivo, Finance Director Lipitz, and Director Public Safety Bullard. 1. WORK SESSION - 2003 -04 BUDGET: 1. Status Reports /Staff Presentations by City Manager Leivo and Finance Director Lipitz: Staff gave oral reports on the following topics. Council questions and comments included the following: Retiree Medical Reserve: Number of City retirees currently; need for an $800,000 yearly deposit to keep the reserve up. General Fund Reserve: Schedule for library sale; Possibility of library not selling; What is a normal reserve for Rohnert Park ?; What happens if Rohnert Park depletes its General Fund Reserve? Capital Replacement Reserve: Possibility of Public Works taking over certain janitorial services /need to buy equipment; Obligation to pay for CAD -RMS (Computer -Aided Dispatch- Records Management System). *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES May 27, 2003 Page(2 ) Infrastructure Reserve: What about CDBG funds ?; Undergrounding of utilities; Keep an eye on critical areas - overlay and slurry seals for streets, Scout Hut in A Park. City Hall Certificates of Participation: Possibility of redesigning City Hall to be a mixed -use building; Timeline for Economic Development Strategy work by consultant; Need to seek advice from City Attorney and bond counsel re mixed -use City Hall issues; Can recreation revenues generate sufficient return on investment if bond monies used for recreational facilities? Public Safety Overtime: DISTRIBUTION AND REVIEW of staff report re "Examination of Overhiring; Authorized Strength vs. Overtime Costs" by Director Public Safety Bullard. Will hiring more staff give a realistic picture ?; How many additional officers are needed ?; Status of recruitment efforts. City Manager Leivo reviewed fiscal figures for City -owned surplus properties for the 2003 -04 budget. 2. Public Comments: None. 3. Council Discussion /Direction /Action: Councilmembers shared their perspectives, including the following: Councilmember Mackenzie: Proceeds from sale of surplus properties should go into the reserves. Need to proceed with the budget in the context of the Economic Development Strategy. Councilmember Vidak- Martinez: Get General Fund Reserve back to $2.6 million; pay off CAT -RMS. Put money into Infrastructure and Capital Replacement reserves; take care of City's aging facilities. Replace Public Safety overtime with paid staff. Review return -on- investment opportunities for Certificates of Participation. Mayor Flores: Replenish Retiree Medical Reserve. MAYOR'S REPORT ON CLOSED SESSION: Mayor Flores reported that no action would be taken this evening regarding any Closed Session matters as listed on the agenda. 3. RESOLUTION FOR ADOPTION: 2003 -117 HONORING MICHAEL GRICE AS HONORARY CITIZEN OF THE CITY OF ROHNERT PARK Upon MOTION by Councilmember Vidak- Martinez, seconded by Vice Mayor Nordin, and UNANIMOUSLY APPROVED, Resolution 2003 -117 was ADOPTED. Mayor Flores read and presented said resolution to Mr. Grice. 4. SCHEDULED APPEARANCES /PRESENTATIONS: 1. Presentation expressing appreciation to Michael Grice: Council presented Mr. Grice with a poster, two lifetime passes to Spreckels Performing Arts Center, and two lifetime memberships to the 511 Club. Mr. Grice expressed his gratitude to the Council for their support of the arts over the years, and he discussed his plans for the future. Councilmembers thanked Mr. Grice for his professionalism, his technical and artistic expertise, and his dedication to the PAC during his many years of service to the City. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES May 27, 2003 Page(4 ) 2. Presentation expressing appreciation for contribution to the Animal Shelter: Mickey Zeldes, Rohnert Park Animal Shelter Supervisor, came forward and expressed gratitude for a contribution totalling $210,117.73 ..Lrom the Estate of Florence I. Brannon. Ms. Zeldes discussed the Animal Shelter's plans for a separate cat isolation area, reflooring, exterior painting, screening in the dog room, finishing open walls, shade in the dogs' play yard, an intercom system, and another 1000 -hour employee. Mayor Flores DIRECTED STAFF to summarize Ms. Zeldes' recommendations and present them for Council consideration. 3. Special Announcement by Mayor Flores: Mayor Flores ANNOUNCED that Vice Mayor Nordin's son, Adam, a 2003 graduate of Rancho Cotate High School, has been accepted into the United States Military Academy at West Point. Council commended Adam on his achievement, and Adam came forward and thanked his family and the community. Vice Mayor Nordin expressed congratulations to the entire graduating class of Rancho Cotate High School. 4. Fred Brokaw representing the Education Foundation of .Cotati /Rohnert Park, requesting City Council to extend closing date of the Rohnert Park Stadium to include their annual event, "Spice Up the Night Chili Cook- Off," scheduled this year on October 11th: Mr. Brokaw requested an extension of the closing date through October 12th, rather than September 30th, and he discussed how the Chili Cook -Off has grown into a community event over the past five years. He also talked about efforts to find a new location for the event. Council Discussion /Direction /Action: Council CONCURRED to DIRECT City Manager Leivo to consult with Redwood Equities per the request and to report back to Mr. Brokaw with a response. 5. Presentation by representative of Folsom Investment Group regarding expressed interest in purchase of Rancho Feliz Mobilehome Park, APN 143- 391 -032: City Manager Leivo reported that staff received a call this afternoon indicating that Folsom Investment Group is withdrawing their proposal. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES May 27, 2003 Page(5 ) 5. PUBLIC COMMENT: Mayor Flores stated that in compliance with State law, The Brown Act, members of the public wishing to make a comment may do so at this time, limited to 3 -5 minutes per appearance, with a 30- minute limit. 1. Bob Fleak, 157 Parque Recrero, GSMOL Associate Regional Manager - North Bay Area, was recognized and asked Council to keep in mind that the sale of Rancho Feliz Mobilehome Park to anyone other than the nonprofit Millennium Housing will not protect affordable housing. He noted that the City would otherwise have to defend Ordinance 494 against the bottom -line profiteering of private industry. 2. Becky Rishe, 8739 Laurelwood, President -Elect of the Rotary Club of. Rohnert Park and Cotati, was recognized and requested that Council act now to restrict the issuance of permits for the sale of fireworks within Rohnert Park to organizations and clubs that benefit the youth in Rohnert Park. She discussed the Rotary Club's service and vocational budgets and the revenues that a Fireworks Ordinance would generate for local clubs /organizations. Ms. Rishe emphasized the need for the Council to act quickly since permitting has already begun for next year's sales. At the suggestion of Councilmember Vidak- Martinez, Council CONCURRED to DIRECT STAFF to draft a Fireworks Ordinance for Council consideration within the next month. 3. Eric Greenband, San Gabriel Place, was recognized and requested that Council act immediately to address the problems in Sunrise Park, particularly after the shooting death of a young man this weekend. Mr. Greenband outlined the growing safety issues and gang problems within the park over the years, and he recommended removal of the basketball hoops and making Sunrise Park a residents -only, alcohol -free park. Councilmembers shared their opinions on this matter. 4. Katie Klee, 1098 San Francisco Way, was recognized and expressed her concerns with the ongoing gang activities at Sunrise Park. She shared the following suggestions after canvassing the neighborhood: Take down the hoops and suspend basketball for a while; trim and clear the bushes around the courts; make it an alcohol -free park; allow only residents to reserve picnic and field areas; and address the speeding and littering. She urged the Council to act now to make Sunrise Park a residential, community park once again. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES May 27, 2003 Page(6 ) Councilmember Vidak- Martinez LEFT the meeting at 9:13 p.m. due to an early flight schedule tomorrow morning. 5. Bob Blick, 426 Floral Way, was recognized and expressed his opposition to the proposed changes in the sewer rate structure. He noted, after tracking his water use, that such a change in the sewer rate structure is inaccurate and unfairly targets residential customers, especially those with lawns and gardens. 6. Kevin Hughes, 6195 Gabriel Place, was recognized and thanked Council and City staff for already taking steps to address the serious problems at Sunrise Park. He also noted how outraged he was over the recent shooting tragedy at said park. EMERGENCY ITEM: Upon MOTION by Councilmember Mackenzie, seconded by Vice Mayor Nordin, a motion to declare consideration of of formation of a Park Safety Subcommittee to address the urgent safety issues of Sunrise Park and other City parks an emergency item was APPROVED 4 -0 -1 with Councilmember Vidak- Martinez absent. Upon MOTION by Mayor Flores, seconded by Councilmember Mackenzie, a motion (1) to form a Park Safety Subcommittee consisting of Vice Mayor Nordin and Councilmember Vidak- Martinez, (2) to direct said subcommittee to schedule a meeting this week with citizens and staff to address the urgent safety issues related to Sunrise Park, and (3) to further direct said subcommittee to return to the first Council meeting in June with recommendations, along with a FRIENDLY AMENDMENT by Councilmember Mackenzie, accepted by the maker of the motion, to authorize the City Manager to take any steps he deems necessary within the next 48 hours per public safety and health in Sunrise Park and other City parks, was APPROVED 4 -0 -1 with Councilmember Vidak- Martinez absent. Mayor Flores DIRECTED Vice Mayor Nordin to notify interested members of the public as to when this week's meeting with staff and residents will be held. Vice Mayor Nordin LEFT the chambers at 9:24 p.m. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES May 27, 2003 Page(7 ) 7. Bonnie Black, 1065 Hawthorne, was recognized and recommended increased dialog between City Council and the Parks and Recreation Commission in terms of addressing the increasing evidence of crime in the City's parks. She expressed concern over the lack of communication between Council and the Commission, and she noted that the Park and Rec commissioners are very knowledgeable about the parks' programs and needs. Furthermore, she expressed a desire to see outgoing Recreation Director Barry and Public Works Manager Stephens honored for their years of effort and dedication to the City. Councilmember Mackenzie suggested that Sunrise Park be added to the scheduled stops on the Park and Recreation Commission's Annual Park Tour this Saturday. Vice Mayor Nordin RETURNED to the chambers at 9:27 p.m. 8. Mark Galipeau, 272 Adele Drive, was recognized and thanked staff and Council for taking action to remove the ivy from the fence that separates A Pool from the park. As a teacher at John Reed School, he also noted that he would like to see alcohol banned and permits required for special events in the City's parks. 6. STUDENT REPORTS: 1. High School - Youth Leadership of Rohnert Park: Saba Sahouria gave a brief update on the following matters: (1) Leadership training of the Youth Leadership of Rohnert Park and activities of the Environmental Protection Coalition; (2) Plans for the 24 -Hour Relay on May 31 -June 1; (3) Upcoming Senior Week and Rancho Cotate graduation, June 13; and (4) Awards Night at Spreckels tomorrow at 7:00 p.m. Council thanked Saba for his efforts as a youth leader and his articles in The Community Voice, and they wished him well at U.C. Berkeley. 2. SSU - Sonoma State University Associated Students, Inc.: No representative present. FINANCIAL REPORTING AWARDS: 1. Accepting "Certificate of Achievement for Excellence in Financial Reporting" Award from the Government Finance Officers Association for City's Comprehensive Annual Financial Report for Fiscal Year ending June 30, 2002 (21st consecutive year) - Sandra M. Lipitz, Finance Director: and 2. Recognition of the Award of Financial Reporting Achievement to Sandra M. Lipitz, Finance Director: Mayor Flores presented Finance Director Lipitz with the award, and Council commended her for her efforts. The Mayor noted that Accountant /Auditor George Raymond will also be receiving a financial reporting achievement award. 8. SEWAGE SYSTEM REGULATIONS AND WATER SYSTEM PROPOSED FEES - CONSIDERATION OF PROPOSED FEE INCREASES: 1. Staff Report: Finance Director Lipitz DISTRIBUTED AND REVIEWED the staff report via a slide show presentation. 2. Public Hearing: Mayor Flores OPENED the Public Hearing at 9:47 p.m. City Manager Leivo included in the Public Hearing letters from Bob Blick, Leland Colb, and John Hudson. Mayor Flores included and read a letter from Ruth Greenstein, a widow who uses little water and objects to subsidizing the water and sewer use of large families. The Mayor noted that he would distribute copies of Ms. Greenstein's letter to the Council. 1. Len Carlson, Rancho Grande, was recognized and expressed his concerns with the master metering of mobilehome parks. He said the master meter system gives residents little incentive to conserve water while paying for the park owner's usage as well, in terms of the Laundromat, swimming pool, and clubhouse. Mayor Flores DIRECTED STAFF to look into Mr. Carlson's concerns per the master meters. Presentation by Ron Bendorff, Associate Planner: Associate Planner Bendorff gave a brief staff report, and staff responded to Council questions. 2. Council Discussion /Action: Motion to receive and file: Upon MOTION by Councilmember Mackenzie, seconded by Councilmember Spradlin, a motion to receive and file the Annual Policy Review of the Growth Management Program was APPROVED 4 -0 -1 with Councilmember Vidak- Martinez absent. 13. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Water Issues Subcommittee, May 20, 2003, meeting: Mayor Flores gave updates on Section 7 consultation, Santa Rosa Plain Groundwater Study, recent bond activities, Russian River Watershed Association, and commercial water meters. 2. Water Advisory Committee Negotiation, May 19, 2003, meeting: City Manager Leivo gave a brief report on disputes with the Marin Municipal Water District and its commitment to preserve the Koho salmon population. 3. SSU Students - Rohnert Park City Center Project, May 21, 2003, meeting: Councilmember Mackenzie shared brief comments on the presentation by the SSU students, and he recommended that the Economic Development Strategy consultant get a copy of the project. City Manager Leivo shared additional comments and noted that a copy of the project is available at City Hall. 4. Other informational items, if any: Vice Mayor Nordin reminded Council of the 24 -Hour Relay on Mav 31st to June 1st. 16. CITY MANAGER'S REPORT: 1. Reorganization of Public Works Department: and 2. Reorganization of Recreation Department: City Manager Leivo gave an oral report on the reorganization of the two City departments. FOR THE RECORD, Councilmember Mackenzie stated that it would be unwise and extreme for the City to let go of the Public Works Director and /or the Recreation Director and to essentially still have a scheme with managers and supervisors. He said that while he acknowledges it is the City Manager's responsibility to consider such matters, he still feels that the City should have been looking at line items of the budget first and then making determinations and recommendations in terms of letting go of senior management officials in the City of Rohnert Park. ***************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** 17. PUBLIC COMMENT: Mayor Flores called forward any members of the public wishing to speak. 1. Bob Blick, 426 Floral Way, was recognized and thanked Council and staff for incorporating his ideas about winter -based sewer rates into the sewer fees.
