July 10, 2001
Tuesday
The concurrent meetings of the City of Rohnert Park
for the City Council, Community Development Commission,
Rohnert Park Financing Authority, and the Rohnert
Park District met this date for a work session open
to the public to discuss the 2001 -02 Budget. The
work session commenced at approximately 5:00 p.m.
in the City Offices, Conference Room, 6750 Commerce
Boulevard, Rohnert Park, with Mayor Mackenzie presiding.
CALL TO ORDER:
Mayor Mackenzie called the work session to order at
approximately 5:04 p.m.
ROLL CALL:
Present: (4) Councilmembers Reilly and Spiro;
Vice Mayor Flores; Mayor Mackenzie
Absent: (1) Councilmember Vidak- Martinez
Staff present for all or part of the meeting: City
Manager Netter, Assistant City Manager Donley, City
Engineer Gaffney, Planning and Community Development
Director Kaufman, Recreation Director Barry, Finance
Director Lipitz, Personnel Manager Robbins, Director of
Public Safety Miller, Public Works Manager Stephens,
City Attorney Strauss, Finance Services Manager Lauchner,
and Fire Commander Cassel.
Mayor Mackenzie noted that Councilmember Vidak- Martinez
would be unable to attend due to an ill family member.

ACKNOWLEDGING THE CITY MANAGER /CLERK'S REPORT ON THE
POSTING OF THE MEETING'S AGENDA:
The Council acknowledged the City Manager /Clerk's report
on the posting of the meeting's agenda.
UNSCHEDULED PUBLIC APPEARANCES:
Mayor Mackenzie stated - -that in compliance with . -State law,
the Brown Act, citizens wishing to make a comment may
do so at this time, limited to 3-5 minutes per appearance
with a 30- minute limit. No citizens came forward to
speak at this time.
ITEMS FOR DISCUSSION AND /OR ACTION:
I. PROPOSED 2001 -2002 GENERAL FUND BUDGET:
a) REVIEW BUDGET /BUDGET MEMO, INCLUDING CHANGES IN
REVENUES, EXPENDITURES AND RESERVES: City Manager
Netter DISTRIBUTED copies of the Budget Memo for
July 24, 2001, to Councilmembers and staff, as
well as "Budget Changes for Fiscal Year 2001 -02"
and the "Rohnert Park Chamber of Commerce
Economic Development Contract." Finance
Director Lipitz shared the contents of the Budget
Memo, and staff responded to Council questions.
Council discussion concluded, and upon MOTION by
Councilmember Spiro, seconded by Mayor Mackenzie, a
motion (1) to restore the General Fund Reserves to a
minimum of 10 (ten) percent and (2) to make said motion
part of the Public Hearing and formal adoption of the
Budget at the July 24, 2001, City Council meeting, was
APPROVED 4 -0 -1 with Councilmember Vidak- Martinez absent.
Finance Director Lipitz then shared comments on the
La Habre tax case, and Vice Mayor Flores REQUESTED a
formal report from City Attorney Strauss regarding the
perceived risk of challenges arising from the La Habre
case.
b) REVIEW SURPLUS LAND INVENTORY AND POSSIBLE SALES:
Assistant City Manager Donley gave an overview of
his staff report regarding surplus land inventory
and possible sales, provided to the Councilmembers
in the Work Session packets.

Councilmember Spiro REQUESTED (1) a report from City
Attorney Strauss on the possible sale of each of the
parcels, and (2) a detailed report from the Planning
Commission on each of the full and /or remnant parcels.
Council discussion concluded, and upon MOTION by
Vice Mayor Flores, seconded by Mayor Mackenzie, a motion
was made to go forward with the sale of the full parcels
as designated in the staff report. A FRIENDLY AMENDMENT
from Councilmember Spiro to split Parcel No. 5 as
designated in the staff report was accepted by the maker
of the motion and the second. Said motion was
APPROVED 4 -0 -1 with Councilmember Vidak- Martinez absent.
c) REVIEW ECONOMIC DEVELOPMENT PLAN - SCHEDULE AND
TIMELINE: Assistant City Manager Donley reviewed
his staff report regarding the Economic Development
Strategy Timeline as provided to the Councilmembers
in the Work Session packets.
Councilmembers CONCURRED with the Economic Development
Strategy Timeline as outlined in the staff report.
II. REVIEW OTHER FUNDS IN BUDGET:
City Manager noted that due to time constraints, "Other
Funds in the Budget" would be reviewed and discussed at
the next Budget Work Session at 5:00 p.m. on Tuesday,
July 24, 2001, prior to_the.City Council meeting. j .
City Manager Netter DISTRIBUTED "Water Fund and Sewer
Fund Revenue Requirements /Rate Increases Charts" for
COUNCIL INFORMATION and REVIEW.
III. COUNCIL GOALS /GOAL SETTING - CONTINUATION OF
STRATEGIC PLANNING PROGRAM - DATES:
City Manager Netter indicated that the proposed Economic
Development Plan should satisfy Council goals /Strategic
Planning program goals. He noted that said topic will be
discussed at the next Budget Work Session on July 24,
2001, prior to the Council meeting.

Upon MOTION by Vice Mayor Flores, seconded by Mayor
Mackenzie, with a FRIENDLY AMENDMENT from Councilmember
Spiro accepted by the maker of the motion and the second
to include only the work sessions in the motion, the
Special 2001 -2002 Budget Work Session Minutes of June 8,
2001, and the Special 2001 -2002 Budget Work Session
Minutes of June 20, 2001, were APPROVED AS AMENDED 3- 0 -1 -1,
with Councilmember Reilly abstaining front the Juice 3,
2001, Budget Work Session minutes, and with Councilmember
Vidak- Martinez absent:
Councilmember Spiro added the following language to the
June 20, 2001, Budget Work Session Minutes, on page 3,
Agenda Item No. 1, Subsection 2, after the first
sentence:
"Council discussion included the matter of the
possibility of building affordable housing on
City -owned acreage located on the west side of the
City behind Home Depot and Wal Mart."
Upon MOTION by Councilmember Reilly, seconded by Vice
Mayor Flores, the Minutes of the Regular Concurrent City
Meetings on June 26, 2001, were APPROVED AS SUBMITTED
3 -0 -1 -1 with Councilmember Spiro abstaining and
Councilmember Vidak- Martinez absent.

3. COUNCIL COMMUNICATIONS, IF ANY (INFORMATIONAL ONLY):
Mayor Mackenzie asked the Councilmembers if there were
any informational communications to add to the agenda.
*Mayor Mackenzie indicated that he had three
communications as follows:
1) Thanks to the Rohnert Park Community Band for
an outstanding performance at the July 4th festivities
at Eagle Park.
2) Reminder to the community that Saturday, July 14,
2001, a Neighborhood Traffic Summit will be held
commencing at the Senior Center and featuring
guest speaker Dan Burden from Walkable Communities.
3) INFORMATIONAL NOTE that he will be bringing forward
a REQUEST from Councilmember Vidak- Martinez under
Agenda Item No. 10 to delay the second reading of
the Ordinance No. 667 per the Growth Management
Program until such time as the committee appointed by
the Council to deal with the Growth Management
program and other matters can be reconvened.
4. YOUTH REPRESENTATIVES TO THE CITY COUNCIL FROM HIGH
SCHOOL 2000 -2001 YOUTH OF THE YEAR PROGRAM SELECTIONS:
1. Senior Sean Tate, filling in for Senior Jessica Weddle,
and Junior Tracy Olson were recognized. Senior
Jessica Weddle was not able to attend. Mayor Mackenzie
sent congratulation to Ms. Weddle for her appointment
as student representative to the School Board. The
youth representatives shared the contents of the Youth
Report. Highlights included the following:
(1) Lew Kuehm from Youth Leadership of Rohnert Park met
with S.C.A.Y.D. to discuss the program.
(2) Several events planned this summer for "The
Vision" - bands playing in July 14, July 21, and
August 4, dance planned for August 3.
(3) SUGGESTION to use the empty.field across from
The Vision as a potential site for a skateboard
park and a way to get more teens in The Vision
during the drop -in hours.

5. SCHEDULED APPEARANCE /PRESENTATION:
*Jonah Larkin, 1451 Southwest Boulevard - Municipal Code
regarding skateboarding in commercially -zoned property:
Mr. Larkin discussed the effects of the recent
aggressive enforcement of the Rohnert Park Municipal
Code regarding the ban on the use of skateboards in
commercially -zoned areas and the related fine. He
noted that he is the owner of a business in University
Square, Gone Surfing, that caters to people,
particularly youngsters, interested in board sports.
Furthermore, he described the skateboarding ban in the
Municipal Code as unfair and discriminatory, leaving
youngsters disenfranchised, unable to move freely
within the City on their chosen form of transportation,
and faced with aggressive and questionable treatment
from public safety officers. He touched on the physical,
environmental, and practical benefits of youth
skateboarding, and he talked about the economic impact on
his business from the Municipal Code. Finally, he noted
that the youth of the community have not been able to
constructively address any of the problems of
skateboarding in Rohnert Park, and he urged the Council
to re- examine the Municipal Code in the interest of a
more equitable accommodation for young skateboarders as
well as businesses that cater to youngsters.
Mr. Larkin responded to Council inquiries, and Council
discussion ensued on topics including private property
rights, support of other store owners for changing the
municipal code, and efforts to negotiate a settlement
among University Square business owners.
Council discussion concluded with CONCURRENCE TO
AGENDIZE the following matters for the next Council
meeting on July 24, 2001: (1) Review of the Rohnert
Park Municipal Code section which deals with
skateboards and other forms of vehicular transportation;
and (2) Discussion of enforcement policy by the
Rohnert Park Department of Public Safety with an
invitation for the Department to respond to these
matters at said meeting.

1. Leeshai Lemish 1424 Mathies Place, was recognized and
discussed the traditional Chinese spiritual practice of
Falun Gong and the brutal suppression of its followers
in China. He noted that Falun Gong emphasizes the
principles of truthfulness, compassion, and
forbearance, and he indicated that local practitioners
meet weekday mornings in Plaza Park in Cotati under
the guidance of Mr. Lee, a two -time Nobel Peace Prize
nominee. He called for the City to extend a letter of
support or a proclamation for this peaceful,
nonpolitical practice of Falun Gong and to call for an
end to the suppression of its followers in China. He
noted that a PETITION would be in the lobby for all
supporters to sign.
2. William P. Adams 716 Brett Avenue, was recognized and
referenced and DISTRIBUTED a letter which he had hand -
delivered on July 6, 2001, to the City Manager and
Councilmembers concerning his efforts to get the City
to reset the timers on security lights at City
facilities in order to save electricity. He noted that
he has an electrical degree, and he outlined various
City facilities from pools to parking lots which
need their timers reset during this power crisis to
6:00 a.m. and 8:45 p.m. He indicated that he has
been speaking to City staff for nearly two months to
no avail, and he made a final comment on an encounter
with a skateboarder in front of Rohnert Park Safeway,
noting that some renegade skateboarders give the
majority of skateboarders a bad reputation.

Questions and remarks stemming from the public speakers'
comments included the following:
*Municipal Code creates adversarial relationship between
youth and law enforcement.
*University Square businesses - pizza, donuts, videos,
board equipment - naturally attract youngsters, as well
as its proximity to the only high school in the City.
*Suggestion for University Square businesses to
compassionately reach out to the youngsters to resolve
the situation.
*Several complaints from young skateboarders and parents
regarding aggressive police questioning and harassment of
youngsters with /on skateboards in commercial areas as
well as on public streets.
*Skate park is not the solution to the muni code dilemma.
*Concern among youth about lack of skating facilities in
Rohnert Park and the impact on their lives as far as
constructive recreation.
*Parental concern over the Department of Public Safety's
poorly defined guidelines for the skateboarding "fix -it"
tickets issued to youngsters.
*Skateboarding brings youth all over the community
together for entertainment and transportation, and it
offers an a'Aternative for troubled youngsters.
*Bikers and those on scooters and go -peds on public
streets are seldom harassed as much as skateboarders,
who also have a right to move freely around the City.
*Need for the Municipal Code to protect the safety of the
customers in the parking lot and shopping area of
University Square; daily complaints about skateboarders.
*Economic impact of skateboarders on businesses and
deliveries; need to consider all merchants in the City.
*Liability and insurance issues for University Square.
*Rigorous enforcement of skateboarding laws in Sonoma,
Healdsburg, Petaluma, and Santa Rosa; issue of human -
driven vehicles in municipalities.

8. SKATEBOARD PARK UPDATE:
1. Staff Report: Recreation Director Barry shared the
contents of the staff report provided to Council in
their agenda packets. Director Barry then responded to
Council inquiries.
At this time, Mayor Mackenzie called forward the

opposition to the construction of a Skateboard Park.

Questions and remarks stemming from the public speakers'
comments included the following:
*All skateboarders should not be judged by a few
careless and inconsiderate skateboarders.
*Skatepark offers a place for skateboarders to be
athletic, creative, safe, and constructively
occupied.
*Timely construction of a skatepark would is needed
to respond to the growing number of skateboarders.
*City of Visalia and Templeton offer good examples of
skateparks built with community help.
*There are swimming pools, tennis courts, basketball
courts, soccer fields, and baseball diamonds for
those various forms of recreation.
*There may be various sources of funding such as grants
for alternative modes of transportation.
*The youth have come to the Council for help and
guidance, showing respect for the laws and operations
of the City.
*Approval to skateboard to and from a business without
harassment a possible solution in the short term.
*Youngsters need a park to test out new products, and
local skateboard competitors need a place to practice.

Council discussion concluded with CONCURRENCE on
several matters: (1) To proceed with staff's
recommendation per the Staff Report from Recreation
Director Barry; (2) To consider funding options, legal
and liability issues related to skateboarding in
streets, input from the Chamber of Commerce and the
business community, master planning for a larger
skate park, and community involvement at a later
Council meeting; and (3) To encourage interested citizens
to attend the Parks and Recreation Commission meeting on
Monday, July 16, 2001, and to bring written materials
outlining their suggestions for a skate park.
RECESS: Mayor Mackenzie declared a recess at
approximately 9:42 p.m.
RECONVENE: Mayor Mackenzie reconvened the Council at
approximately 9:55 p.m. with all of the
Councilmembers present except Councilmember
Vidak- Martinez.
9. STUDENT HOUSING CO- SIGNING REQUIREMENT:
*City Attorney Status Report /Update: City Attorney
Strauss gave a brief overview of her memo of July 3,
2001, and she responded to Council questions.
At this time, Mayor Mackenzie called forward a citizen
who submitted a speaker card for this item:
1. Seann Pridmore, 909 Civic Center Drive #2, was
recognized and referred City Attorney Strauss to
Mr. Dennis Harris at Sonoma State University as he
conducted a Housing Needs Assessment for the students
at SSU during the building of the new complex. He
recommended gathering the data from Mr. Harris to
help determine the viability of a co- signing
ordinance.
Council discussion concluded with CONCURRENCE (1) to
have a legal analysis from City Attorney Strauss by
the July 24, 2001, Council meeting, and (2) to have
a complete staff report back by the first Council
meeting in August to attempt to put together an
ordinance before September, 2001.

EXTEND COUNCIL MEETING:
Upon MOTION by Vice Mayor Flores, seconded by Mayor
Mackenzie, a motion to extend the meeting past 10:00 p.m.
to finish necessary agenda items was APPROVED 4 -0 -1 at
approximately 10:05 p.m. with Councilmember
Vidak- Martinez absent.
10. PLANNING AND ZONING MATTERS:
1. File No 2001 -015 - Second Reading of Ordinance Addinq
Chapter 17 66, Growth Management Program, to the Rohnert
Park Municipal Code:
a. Staff Report: Mayor Mackenzie prefaced the staff
report with Councilmember Vidak- Martinez' REQUEST
that this matter be returned to the General Plan
Committee for further discussion. Planning Director
Kaufman then shared the contents of the staff report,
and she made two additional clarifications:
1) Page 5, Section 17.66.040, Item 2, add the
following language: "in the year they are to be
phased "; and add a statement at the end of the
ordinance indicating that development agreements
will be encouraged.
2) Page 6, Section 17.66.050, Item A, second to last
sentence, remove the word "constricted" and add
"with final discretionary approvals."
b. Public Comments: At this time, Mayor Mackenzie
called forward a citizen interested in speaking on
this item.
1. Erik Koenigshofer, 2389 Bohemian Highway, Sonoma
County, was recognized and thanked staff for taking
into consideration the various comments from interested
parties. He suggested, if the matter were to be
referred back to the Subcommittee, that they consider
further clarification of the trigger cap as well as
the definition and treatment of the various types of
housing for the elderly, particularly independent
living facilities. He recommended focusing on the
issue of ratio and how to calculate independent living
units to the annual allocation.

c. Council Discussion /Action:
Ordinance for Adoption:
No. 667 ADDING CHAPTER 17.66, GROWTH MANAGEMENT PROGRAM,
TO THE ROHNERT PARK MUNICIPAL CODE
Councilmember Reilly REQUESTED further clarification from the
committee on assisted living units and carryover units.
Upon MOTION by Vice Mayor Flores, seconded by Mayor
Mackenzie, a motion to refer the ordinance back to the
Council Subcommittee for further review to be brought

At the suggestion of Councilmember Spiro, Council
CONCURRED (1) to DEFER THIS ITEM to the next Council
meeting on July 24, 2001; and (2) to get a copy of an
article entitled "'Catch 22' of contradictory public
policies perpetuates housing crisis in Sonoma County"
from the May /June 2001 Homebuilders' Association News
(HBA) magazine for further review and consideration by
the Council. Mayor Mackenzie agreed to furnish a copy
of the article to staff for distribution to the
Councilmembers.
13. SPRECKELS PERFORMING ARTS CENTER MATTER -
CONSIDERATION OF PROPOSED LIGHT - EMITTING DIODE SIGN
WITH U.S. HIGHWAY 101 FRONTAGE AND TERMS AND
CONDITIONS FOR USE OF SIGN:
1. Staff Report: City Manager Netter shared the contents
of the staff report. Assistant City Manager Donley
came forward to respond to Council inquiries regarding
permits for the sign.
Mayor Mackenzie called forward a citizen interested in
speaking on this matter:
1. William P. Adams,_ 716 Brett Avenue, was recognized and
shared comments on the long sight distance of the
reader board sign located on U.S. 101 near the Marin
Civic Center. He noted that it will be important to
be able to dim the sign lights at night to prevent
visual overload.
2. Council Discussion /Action:
Council discussion concluded, and upon MOTION by
Councilmember Spiro, seconded by Vice Mayor Flores,
a motion to proceed with staff's recommendation per the
staff report was APPROVED 3 -1 -1 with Councilmember
Reilly dissenting and Councilmember Vidak- Martinez
absent.

At the suggestion of Councilmember Reilly, Council
CONCURRED to have staff report back on the operation of
Teen Councils /Commissions, including a review of the
Santa Rosa and Petaluma models.
16. 2001 -2002 PROPOSED BUDGET:
1. Presenting & Distribution: Mayor Mackenzie noted
that the Proposed Budget for FY 2001- 2002 was
distributed this afternoon, as well as a report
on the possible sale of surplus lands and a
schedule and timeline for an economic development
plan for the City.
2. Results of July 10 Budget Work Session: Mayor
Mackenzie gave a brief overview of the Budget
Work Session, noting that the City will proceed
with the sale of six full parcels as well as
implementation and scheduling of an economic
development plan.
3. Formal Public Hearing scheduled for July 24 2001:
INFORMATIONAL ONLY.
4. Council Discussion /Direction: City Manager Netter
reminded the Council that the next Budget Work
Session will be held at 5:00 p.m. on July 24, prior to
the Council meeting, to discuss the balance of the

17. SONOMA COUNTY GRAND JURY, 2000 -2001 FINAL REPORT:
1. Final Sonoma County Grand Jury Report 2001 -

2001, and he noted that it will be available to the
public tomorrow.

INDICATED that staff will prepare a joint response for
himself and the City Council for review at July 24

He noted that said response will include a response to
a carryover topic regarding citizen complaints from
last year.

19. TRANSPORTATION MATTERS:
1. Sonoma County Transportation Authority (SCTA), July 9
meeting: Mayor Mackenzie reported on three matters:
(1) Wilfred Avenue overcrossing - construction may
begin as early as 2004 -2005; (2) SCTA adopted
Countywide Transportation Plan by acclamation and with
the support of the various interest groups; (3) Next
meeting will be September 9, 2001.
2. Other, if any: None.
20. TRAFFIC- CALMING WORKSHOP, 8:00 A.M. - 4:00 P.M.,
SATURDAY JULY 14, 2001, SENIOR CENTER:
1. Proposed Agenda - Consultant Dan Burden: Mayor
Mackenzie referred Council to the agenda in their
packets. He advised all neighborhood residents
seeking assistance with traffic problems to attend
the workshop.
2. Council Comments /Suggestions: None.
21. COMMUNICATIONS:
Communications per the attached outline were brought to
the attention of the Councilmembers.
* Councilmember Reilly directed Council to Item 7, letter
from Paul Stutrud, resident, about Chamber of Commerce
support and certain golf course concerns. Councilmember
Reilly REQUESTED MORE INFORMATION FROM STAFF regarding
two items raised in the letter: (1) The issue of the use
of the golf courses to walk on as a public open space and
how that is handled; and (2) The reference to some bronze
plaques that are now missing.

23. CITY MANAGER'S REPORT:
1. Results /Comments on Department Head Retreat: City
Manager Netter gave a brief report on the retreat,
and he DISTRIBUTED the notes prepared by Public
Works Manager Stephens during the retreat.

Netter ANNOUNCED that the City Picnic will be held
Friday, July 20, 2001, starting at 3:00 p.m., at
Honeybee Park. He noted that he would get notices to
the Councilmembers.
24. OTHER UNSCHEDULED PUBLIC APPEARANCES:
At this time, Mayor Mackenzie called forward any
citizens wishing to speak.
1. William P Adams 716 Brett Avenue, was recognized and
reiterated his concern regarding security lights at
City facilities and overgrown vegetation blocking
traffic signals. He REQUESTED to speak to City Manager
Netter and /or City Attorney Strauss to pursue an
immediate response to these problems through the
appropriate City departments.
