Tuesday
The concurrent meetings of the City of Rohnert Park
for the City Council, Community Development Commission,
Rohnert.Park Financing Authority, and the Rohnert
Park District met this date for a work session open
to the public to discuss water issues and the Canon Manor
West Assessment District. The work session commenced at
approximately 5:00 p.m. in the City Offices, Conference
Room, 6750 Commerce Boulevard, Rohnert Park, with Mayor
Mackenzie presiding.
CALL TO ORDER:
Mayor Mackenzie called the work session to order at
approximately 5:00 p.m.
ROLL CALL:
Present: (3) Councilmember Vidak- Martinez;
Vice Mayor Flores; Mayor Mackenzie
Absent: (2) Councilmembers Reilly and Spiro.
Councilmember Reilly ARRIVED at 5:35 p.m. Councilmember
Spiro ARRIVED at 6:04 p.m. for the Water Meter
Installation Plan portion of the Work Session.
Staff present for all or part of the meeting: City
Manager Netter, Assistant City Manager Donley, City
Attorney Strauss, City Engineer Gaffney, Finance
Services Manager Lauchner, and Planning and Community

The Council acknowledged the City Manager /Clerk's report
on the posting of the meeting's agenda.
UNSCHEDULED PUBLIC APPEARANCES:
Mayor Mackenzie stated that in compliance
the Brown Act, citizens wishing to make a

Farnkopf & Hobson provided to the Councilmernbers
in the Work Session packets.
b) Presentation of Final Report and Recommendations
Mr. John W. Farnkopf, Hilton, Farnkopf & Hobson:
Mr. Farnkopf DISTRIBUTED a "Water and Sewer Rate
Study" packet. He then gave a slide show
presentation and responded to Council questions.
Councilmember Reilly REQUESTED a comparison analysis
of the water and sewer rates of other 'Local cities.
c) Public Comments: Members of the public were invited
to share comments at this time.
1. Craig Harrington was recognized and asked about what
the impact would be on the water and sewer rates if
growth, specifically housing, does not occur at the
rate predicted.
Mayor Mackenzie REQUESTED a staff report for an annual
water and sewer rate review process to be prepared by the
Council meeting on August 28, 2001.
2. Jim Cronin was recognized and inquired into the
financial impact of the water connection fees on
current residents. City Manager Netter noted that
the next presentation on the water meter installation
plan would cover that topic.

d) Council Discussion /Action: As noted above.
II. WATER METER INSTALLATION PLAN:
a) Staff Report /Comments: City Manager Netter gave
a brief overview of the "Water Meter Installation
Plan" provided to Councilmembers in the Work Session
packets.
b) Presentation of Final Report and Recommendations -
Mr John Nelson, Water Resources Management: Mr.
John Nelson and staff shared a summary of the
contents of the Final Report and responded to
Council inquiries. Mr. Nelson DISTRIBUTED AND
DISCUSSED the contents of the following two
handouts: (1) "Capital Costs "; (2) "Annual Costs
and Portion that is New to Budget (1,2)."
c) Public Comments: At this time, no members of the
public desired to share comments.
d) Council Discussion /Action: Council CONCURRED TO
SET A PUBLIC HEARING at the Council meeting on
August 28, 2001, to consider the recommendations as
outlined in the "Water and Sewer Rate Study" and the
"Water Meter Installation Plan."
CANON MANOR WEST ASSESSMENT DISTRICT
III. CANON MANOR WEST ASSESSMENT DISTRICT:
a) Staff Report /Update: Planning and Community
Development Director Kaufman DISTRIBUTED two
handouts: (1) "Canon Manor - Recommended Conditions
for Providing Sewer Service "; (2) "Canon Manor -
City of Rohnert Park Issues and Conditions."
b) Review of Key Issues: Planning and Community
Development Director Kaufman, City Attorney Strauss,
and Deputy Director of the Sonoma County Public
Works Department, Dave Knight, responded to Council
inquiries.
c) Public Comments: No citizens desired to share
comments at this time.
d) Council Discussion /Action: Council discussion
ensued and concluded with the following motion:

Upon MOTION by Councilmember Vidak- Martinez, seconded by
Vice Mayor Flores, a motion to include condition Nos.
1, 2, and 2a, added by the City of Rohnert Park for
providing sewer service to Canon Manor as outlined in
the staff report distributed to Council, in the proposed
agreement with the City was UNANIMOUSLY APPROVED with the
following conditions:
1) Subject to determining the number of existing homes
and legal lots as of July, 2001;
2) Subject to including a sewer capacity and
maintenance clause;
3) Subject to including concerns about a pass- through;
4) Subject to indicating that negotiations with the
City of Santa Rosa for extra sewer capacity are
ongoing.
City Manager Netter INDICATED (1) that staff will
research an out -of- service fee; and (2) that staff will
pursue condition Nos. 4 through 7 as outlined in the staff
report regarding conditions added by the City of Rohnert
Park for providing sewer service to Canon Manor.
Upon MOTION by Councilmember Vidak- Martinez, seconded by
Councilmember Reilly a motion to include condition Nos. 4,
5, and 7, added by the City of Rohnert Park for providing
sewer service to Canon Manor and the County Planning
Department conditions as modified by the City of Rohnert
Park, per City and County conditions attached to the
original set of these minutes, as outlined in the staff
report distributed to Council, in the proposed agreement
with the City was UNANIMOUSLY APPROVED.
Council CONCURRED to DIRECT STAFF to prepare the proposed
agreement between the City and Canon Manor for review at
the September 11, 2001, Council meeting before the
Public Hearing on said matter on September 17, 2001.
ADJOURNMENT:

CANON MANOR
RECOMMENDED CONDITIONS
FOR PROVIDING SEWER SERVICE
I. CONDITIONS ADDED BY CITY OF ROHNERT PARK
1. Only existing homes and legal lots as of July 2001 may be served at the
completion of the Geyser Project.
2. Other undeveloped lots and new lots may be served after completion of
Incremental Wastewater Management Plan assuming capacity available
after project meets Rohnert Parks and SSU buildout needs.
2.a. There shall be an inflation provision in the assessment district for sewer
charges to cover increases in the cost of sewer maintenance.
3. There shall be either:
- A provision for the City to take over the water system upon annexation,
or
- The City provides domestic water through this assessment district.
4. The City of Rohnert Park's proposed development standards for Rural
Residential (1 unit /acre) shall be adopted for Canon Manor and Canon
Manor residents shall be provided with the City's land use provisions so
they understand that if the area is annexed to the City, existing uses may
become legal non - conforming. The area could be rezoned to Rural Estate
(2 units /acre) at a later date when wastewater capacity becomes available
and roads are improved to City standards.
5. There shall be a plan to upgrade roadwork to meet City standards within
five years of the first sewer hookup. No new building permits shall be
issued unless a development fee is paid to cover costs of improved paved
roads, street lights, etc. to City standards.
6. As part of this assessment district, street lights shall be provided at all
intersections (at a minimum).
7. There shall be a method to guarantee the City's minimum standards,either:
- They shall be completed up front with this assessment district; or
- Phased -In as follows:
a. existing homes
b. vacant lots pay development fees to upgrade
- either way the County shall guarantee upgrades within five years of first
existing home being connected to wastewater system.

II. CONDITIONS PROPOSED BY COUNTY & MODIFIED BY CITY
OF ROHNERT PARK
1. All improvements provided under the Assessment District, including
sewer, water, and roads, shall be installed and operational.
2. Sewer service shall be provided by the City of Rohnert Park per the agree
d
to phasing plan (see earlier conditions 1 and 2). Applicants for
development shall provide evidence that the applicant and City have
entered into an agreement to provide sewer service to the parcel. The
owner shall obtain a sewer connection permit from the City and pay all
required sewer connection fees.
3. Water service shall be provided by the Penngrove Mutual Water
Company. A "will- serve" letter from the Penngrove Mutual Water
Company shall be submitted to PRMD, stating the Water Company's
ability and willingness to provide water service to the proposed
development, and that the applicant and the water supplier have entered
into an agreement for water service. (See earlier condition #3 above)
4. Lots which do not have frontage on the main Canon Manor subdivision
roads shall be served by an access and public utility easement that is a
minimum 20 feet wide. Access driveways shall be paved.
5. Driveway access shall be provided consistent with Fire Safe subject to
review and approval by PRMD.
6. The Canon Manor West subdivision shall have a "Z" (Second Unit
Exclusion) combining zoning district adopted to with the County General
Plan.
7. Property owners shall execute an agreement in a form acceptable to
County Counsel indicating that they (and future owners) will not oppose
future annexation to the City of Rohnert Park and agree to pay all required
fees imposed as a condition of annexation.
8 Property owners will dedicate any necessary easements i.e., right -of-
ways roadways and utilities to City of Rohnert Park upon annexation.

• Large revenue increases are needed each year
• 129% cumulative revenue increase over planning period
• Even with large increases, City's water rates compare well with
neighboring communities
• Fund balance declines but meets minimum target by fifth year
• Connection fee revenue is appropriate for current level of expansion -
related capital projects

Tuesday
The concurrent meetings of the City of Rohnert Park for
the City Council, the Community Development Commission,
and the Rohnert Park Financing Authority met this date do
regular session for a regular meeting to commence at
7:30 p.m. in the City Offices, 6750 Commerce Boulevard,
Rohnert Park, with Mayor Mackenzie presiding.
CALL TO ORDER:
Mayor Mackenzie called the regular session to order
at 8:00 p.m. and led the pledge of allegiance.
ROLL CALL:
Present: (5) Councilmembers Reilly, Spiro, and
Vidak- Martinez; Vice Mayor Flores; and
Mayor Mackenzie
Absent: (0) None
Staff present for all or part of the meeting: City
Manager Netter, City Attorney Strauss, Assistant City
Manager Donley, Planning and Community Development
Director Kaufman, City Engineer Gaffney, Director Public
Safety Miller, and Finance Director Lipitz.
WORK SESSIONS:
Work Sessions were held at 5:00 p.m. in the Conference
Room to discuss Water Issues, and at 6:30 p.m. to discuss
Canon Manor West Assessment District.

Mayor Mackenzie reported on the closed session which
commenced at approximately 7:40 p.m. to discuss matters
listed on the agenda attachment, representing an update.

2. South County Resources Preservation Committee vs.

2. APPROVAL OF CONCURRENT MEETING MINUTES FOR:

Upon MOTION by Vice Mayor Flores, seconded by
Councilmember Vidak- Martinez, the 2001 -2002 Budget Work
Session Minutes of July 24, 2001, and the Regular
Concurrent City Meetings Minutes of July 24, 2001, were
UNANIMOUSLY APPROVED AS SUBMITTED.
3. COUNCIL COMMUNICATIONS, IF ANY (INFORMATIONAL ONLY):
Mayor Mackenzie asked the Councilmembers if there were
any informational communications to add to the agenda.
*Vice Mayor Flores INDICATED that he sent a memo to
the Councilmembers today about the formation of a
Council committee, which will be brought up under
"Matters from \for Council."
*INFORMATIONAL NOTE: Mayor Mackenzie noted that the
California Junior Miss competition and related activities
will be going on this week in the City.
4. YOUTH REPRESENTATIVES TO THE CITY COUNCIL:

a. Introducing Pam Madden and Kecia Kaiser of Sonoma
County Associates for Youth Development ( SCAYD), as
the new coordinators of the Youth Leadership of
Rohnert Park Program, for report on this
coordination transition: Lew Kuehm from the former
"Youth of the Year Program" shared brief comments
and introduced Ms. Madden and Ms. Kaiser, the SCAYD
coordinators for Youth Leadership of Rohnert Park.
Ms. Madden DISTRIBUTED an informational packet to
Council, and she and Ms. Kaiser briefly discussed
the new program and INVITED the Councilmembers to
attend any of the Youth Leadership's meetings as
noted in the packet.
b. Council Discussion /Direction: Councilmember
Vidak- Martinez SUGGESTED, in accordance with the
meetings held to create a foundation for the Youth
Leadership program, that the Councilmembers prepare
a list of topics that the Youth Leaders should
report on during their City Council presentations and
direct those ideas, if any, to Ms. Madden and Ms.
Kaiser. Council CONCURRED TO DIRECT STAFF to
prepare commendations and recognition for Mr. Lew
Kuehm for all of his efforts over the years with the
Youth of the Year Program, as well as recognition
for members of the former Youth of the Year Steering
Committee.
2. Recognizing Youth Representatives: Seniors Lauren
Charles and Tessa Rosichan were not present. Junior
Mark Stalbein was recognized.
*Youth Re-port/Comments,--if any: The Youth Leader
shared brief comments. Highlights of the Youth Report
included the following:
(1) Discussion of creating a survey to determine what
games and programs are currently available at the
Recreation Center.
(2) Discussion of developing teen - related activities
for the Recreation Center.
Mayor Mackenzie RECOMMENDED that the Youth Leaders refer
back to some past surveys that were done around the time
of the Youth Summit.

5. SCHEDULED APPEARANCES /PRESENTATIONS:
*Acknowledging American Planning Association (APA),
Northern Section, California Chapter, presentation of
AWARD OF MERIT - COMPREHENSIVE PLANNING TO CITY OF
ROHNERT PARK FOR ROHNERT PARK 2020 GENERAL PLAN: Mayor
Mackenzie acknowledged the award, and City Manager
Netter noted that said Award of Merit will be hung in
the Planning Director's office.
6. UNSCHEDULED PUBLIC APPEARANCES:
Mayor Mackenzie stated that in compliance with State law,
The Brown Act, citizens wishing to make a comment may do
so at this time, limited to 3 -5 minutes per appearance
with a 30- minute limit.
1. Al Barr, 5746 Dexter Circle, was recognized and
DISTRIBUTED A PACKET with a cover letter and two
versions of a proposed noise ordinance to the Council.
He noted that he had been before the Council on
March 27, 2001, to discuss drafting such an ordinance,
and he REQUESTED TO AGENDIZE said draft ordinances
for the Council meeting on August 28, 2001.
Council CONCURRED TO AGENDIZE a discussion of how to
proceed with the noise ordinance matter for the next
Council meeting on August 28, 2001.
2. Stella Spring, 936 Civic Center Drive, was recognized
and INVITED Councilmembers and interested citizens to
attend Monday night meetings of the newly formed Skate
Park Coalition of Rohnert Park, at 6:30 p.m. at the
Community Center. She thanked the Council and the
Department of Public Safety for their support, and she
noted that efforts are underway to find corporate
sponsors and businesses willing to help raise funds.
She conveyed the enthusiasm of the youth in obtaining
skate park designs from different companies, and she
expressed some concern over The Vision Teen Center area
as a possible skate park site in terms of the risks
posed by cars leaving on emergency calls

3. Jonah Larkin 1451 Southwest Boulevard, was recognized
and noted that he is the owner of Gone Surfing. He
called for the youth of the City to come to the Skate
Park Coalition meetings and to volunteer to help raise
funds. He DISTRIBUTED to the Council a PETITION,
ATTACHED TO THE ORIGINAL SET OF MINUTES, with over 350
signatures in support of a skate park facility in
Rohnert Park. Furthermore, he expressed his support
for the Community Center location.
4. Terriann McGowan, 1040 San Francisco Way, was
recognized and expressed her support for the Snyder
Lane location for a skate park as landscaping plans
can block it from the street. She noted that the
noise factor for the new library from a skate park,
as well as emergency vehicles travelling in and out of
a new exit by the Department of Public Safety, pose
problems for the Teen Center skate park site. She
REQUESTED that any local businesses willing to take a
jar to help raise funds for the skate park facility
call her at 585 -9164. She discussed the growing
popularity of skateboarding, and she indicated that
several local youth are in the highest ranks of the
skateboard competitors in northern California.

Mayor Mackenzie asked if there were any questions about
the matters on the Consent Calendar, which were explained
in the City Manager's Council Meeting Memo. The Mayor

City Manager Netter's recommendation. Furthermore, City
Manager Netter DEFERRED the Cash /Investments Preliminary
Report to the next Council meeting on August 28, 2001.

City Manager Netter discussed staff's recommendation to
reject the low bidder for this project due to
nonresponsiveness and to proceed with the next lowest
bidder, North Bay Construction.
Upon MOTION by Councilmember Spiro, seconded by
Councilmember Vidak - Martinez, Resolution 2001 -167 was
UNANIMOUSLY APPROVED.

Upon MOTION by Vice Mayor Flores, seconded by

City Manager Netter gave a brief overview of the ownership
situation regarding the South Course of the Rohnert Park
Municipal Golf Course. He noted staff's recommendation to
designate this item as an emergency item in order to keep
the loan process moving in regard to the current golf
course renovations by CourseCo. Furthermore, the City
Manager DISTRIBUTED copies of Resolution 2001 -178 to
the Councilmembers.
Upon MOTION by Vice Mayor Flores, seconded by
Councilmember Spiro, a motion to declare consideration of
Resolution 2001 -178 as an EMERGENCY ITEM was
UNANIMOUSLY APPROVED.
Upon MOTION by Councilmember Spiro, seconded by Vice

FOR THE RECORD, Councilmember Reilly noted that

1. Presentation by Architects, Fischer - Friedman Associates:
Assistant City Manager Steve Donley introduced
Mr. Friedman, who, along with the landscape architects,
gave a presentation of the final architectural design
and drawings of the proposed Council chambers and
first /second floors of City Hall. Fisher - Friedman
staff DISTRIBUTED "Palm FAQ's" to the Council, and they
responded to various Council inquiries, particularly
regarding energy - saving measures and civic building
designs. Councilmember Spiro REQUESTED that security
be provided for the dais and Mr. Friedman stated that
he would refer to a security consultant.
2. Council Discussion /Action: Council CONCURRED to
proceed with the architectural design and the bid
process for City Hall.
10. COMMUNITY DEVELOPMENT COMMISSION MATTERS - 2001 -2002
CDC BUDGET:
1. Staff Report: City Manager Netter briefly outlined
the Proposed CDC Budget 2001 -2002 for the Council.
He explained the reasons for one modification on
page 6 in which the $1 million allocated for the golf
course improvements will be split into two categories,
the bond fund and the tax - increment fund. City Manager
Netter and Finance Director Lipitz then responded to
Council questions.

Vice Mayor Flores raised two issues: (1) He expressed his
desire for the City not to have to approve the consultants
for the different proponents of a Specific Plan; and (2)
He expressed his preference that approval of a Specific
Plan Area amendment be done by resolution rather than by
ordinance in the interest of saving staff time and
simplifying the process. Planning Director Kaufman
responded as follows: (1) The term "City- approved will
be removed as all work done during the EIR process will
ultimately be reviewed by the City's consultants; and
(2) Approval of Specific Plan Area amendments shall be
corrected to reflect that they will be done by resolution,
rather than ordinance, as was the original intention.
b. PUBLIC HEARING:

13. WATER ISSUES:
1. Results of August 14 Work Session for (a) Water & Sewer

*Set PUBLIC HEARING ON AUGUST 28, 2001: Mayor
Mackenzie gave a brief overview of the water issues
as covered in the Work Session, and Council
noted its CONCURRENCE TO SET THE PUBLIC HEARING FOR
WATER ISSUES ON AUGUST 28, 2001.
2. Water Wasting Ordinance - Consideration of proposed
ordinance relating to wasting of water: City Manager
Netter gave a brief overview of the proposed ordinance,
and he noted that he wants the City Engineer to
review said ordinance. Councilmember Reilly pointed
out some editorial errors in the ordinance, and he
SUGGESTED (1) adding a definition of the City's water
delivery system; and (2) reviewing the watering
systems at various City facilities.

15. COUNCIL COMMITTEE AND /OR OTHER REPORTS:
1. Mayors' & Councilmembers' Association General Meeting,
July 12: Mayor Mackenzie recited the various
appointments, and he noted that the report on the
State budget negotiations and funding for local
governments was not encouraging.
2. Mayors' & Councilmembers' Association Executive Board
Meeting, August 9: Councilmember Reilly, who attended
for Mayor Mackenzie, noted that there was a
presentation on the status of the Sonoma -Marin Area
Rail Transit (SMART) and a discussion of the cost
of individual meals for Councilmembers attending
Mayors' & Councilmembers' Association meetings. Vice
Mayor Flores STATED that he will attend the next
meeting on September 13, 2001, as the Mayor noted
that he would be unable to attend due to work
commitments.
3. Rohnert Park Wellness Center (RPWC) Subcommittee,
July 25 Meeting: Councilmember Spiro noted that
direction was given to Kisco to increase the affordable
housing component portion of the project and to return
to a meeting with the City on August 23, 2001, to work
out the remaining details before presenting the
proposal to the City Council.

Furthermore, Vice Mayor Flores added that Kisco would
be returning to the August 23 meeting with their
proposal to incorporate elements of assisted living
in the project. Mayor Mackenzie noted that the
Wellness Center matters would be brought to the Council
at the September 11, 2001, meeting.
4. Executive Subcommittee, August 6 Meeting: Mayor
Mackenzie reported that the Subcommittee met and
discussed matters on the agenda, with nothing of
note to report.
EXTEND COUNCIL MEETING:
Upon MOTION by Councilmember Spiro, seconded by Vice
Mayor Flores, a motion to extend the meeting past
10:00 p.m. to finish necessary agenda items was
APPROVED 4 -0 -1 at approximately 10:00 p.m. with
Councilmember Vidak- Martinez absent.
5. Other, if any:
a. ABAG Executive Committee: Councilmember Spiro
reported that she has been appointed to a regional
committee, Cal -Fed, that deals with water issues.
She noted that she was unable to attend the first
meeting on August 4, but that she will report on
matters in the upcoming meetings.
16. TRANSPORTATION MATTERS:
1. Sonoma County Transportation Authority (SCTA),
August 13 Meeting: Mayor Mackenzie noted that no
meeting was held on August 13, and that the next
meeting will be on September 10, 2001.
2. Rail Station Site Selection - Report: Mayor
Mackenzie DIRECTED THE CITY MANAGER to begin staff work
to consider a rail site, particularly near the
developing Civic Center, and said staff work should
be communicated to SMART in a timely manner.
3. North Coast Railroad Authorit (NCRA) - Review of NCRA
responses to frequently asked questions: Mayor
Mackenzie reported on several matters: (1) The Board of
Directors will meet again tomorrow; (2) Line
inspections up to Windsor have not been completed; (3)
Rail service to Windsor could start as early as
September, 2001.

At the suggestion of Councilmember Reilly, Council
CONCURRED TO AGENDIZE the matter of creating a
policy on staffing and a formula for salary
comparisons.
2. League of California Cities' Conference, Sacramento,
Wednesday - Saturday, September 12 -15, 2001: Mayor
Mackenzie noted that City Manager Netter and City
Attorney Strauss will be attending the conference
and will report back to the Council.
3. Founders Day Parade and Community Unity Celebration,
11.00 a.m. - 4.00 p.m., Saturday, September 22, 2001:
Mayor Mackenzie noted that Mr. Paul Golis, one of the
founders of Rohnert Park, will be the grand marshal
of the parade.
4. Other informational items, if any:
a. Formation of a Council subcommittee: Vice Mayor
Flores shared comments on the formation of a
Council subcommittee that would attempt to gain an
understanding of issues where the Council may be
able to assist the Department of Public Safety and
the Director of Public Safety in improving their
working relationship, possibly in terms of program
support and acquisitions. Council discussion ensued,
and Councilmember Reilly SUGGESTED having a
mechanism such as a subcommittee for all of the City
departments. Council CONCURRED TO AGENDIZE the
matter of the formation of a Council subcommittee
for the August 28, 2001, Council meeting for
discussion by the full Council.

1. Budget Update: City Manager Netter noted that the
Budget Report for July and August of 2001 will be
ready by the middle of September, 2001. The City
Manager then DISTRIBUTED a staff report from Finance
Director Lipitz entitled, "Status of Fiscal Year
2001 -2002 Revenue Projections," and he briefly
summarized projections for property tax, sales tax,
transient occupancy tax, and motor vehicle in -lieu
tax.
2. Millennium Housing - First Quarterly Report Ending
June 30 2001 for Mobile Home Park Revenue Bonds -
(Las Casitas de Sonoma - Series 2001 A &B): City
Manager Netter shared the contents of the First
Quarterly Report for Millennium Housing, and he
noted that the Council will continue to receive
said reports on a regular basis.
3. 2001 Supervisorial Redistricting: City Manager Netter
shared the contents of Ms. Tamara Davis' letter, and
he highlighted a minor change in Option 1.
4. Trione Offer to Sonoma Countv to donate land near
Rohnert Park for use as a regional soccer center:
City Manager Netter brought the Trione offer to the
attention of the Council. Mayor Mackenzie noted that
the proposed land is approximately to the north of
Crane Canyon.
5. Other informational items, if any: City Manager Netter
indicated that he may take some days off next week.
