Tuesday
The concurrent meetings of the City of Rohnert Park for
the City Council, the Community Development Commission,
and the Rohnert Park Financing Authority met this date in
regular session for a regular meeting to commence at
8:00 p.m. in the City Offices, 6750 Commerce Boulevard,
Rohnert Park, with Mayor Mackenzie presiding.
CALL TO ORDER:
Mayor Mackenzie called the regular session to order
at 8:08 p.m. and led the pledge of allegiance.
ROLL CALL:
Present: (5) Councilmembers Reilly, Spiro, and
Vidak- Martinez; Vice Mayor Flores; and
Mayor Mackenzie
Absent: (0) None
Staff present for all or part of the meeting: City
Manager Netter, City Attorney Strauss, Public Works
Manager Stephens, Associate Planner Bendorff, City
Engineer Gaffney, and Recreation Director Barry.
WORK SESSION - WATER ISSUES:
A Work Session was held at 5:30 p.m. in the Conference
Room to discuss the following matters:
*California Urban Water Conservation Council -
Memorandum of Understanding (MOU)
*Best Management Practices
*Council discussion /questions
Council reviewed and discussed DISTRIBUTED materials
regarding the "BMP Implementation Summary" and the "MOU for
Impairment: Next Steps for Demand Management Survey
Responses as of 9- 27 -01." Council discussion centered
around the possibility of dual -line users, the need for
additional staff time, and retrofit issues.

WORK SESSION - CITY STAFFING:
A Work Session was held at 6:12 p.m. in the Conference
Room to discuss the following matters:
*Recruitment /Selection Public Safety Officers
Personnel Manager Robbins and Sergeant Sweeney reviewed
and discussed the following topics per the DISTRIBUTED
agenda: Current staffing, changes in personnel in 2001,
anticipated changes in personnel in 2002, recruitment,
team, recent development /current programs, academy recruit
program - Spring 2002, and long -term recruitment/
retention. Council discussion centered around the
retention of female officers, the requirement for fire
and police academy certificates, and the possibility of
an Academy Recruit Program by Spring of 2002.
1. MAYOR'S REPORT ON CLOSED SESSION:
Mayor Mackenzie reported on the closed session which
commenced at approximately 6:30 p.m. to discuss matters
listed on the agenda attachment, representing an update.
PERSONNEL MATTERS:
1. City Manager Annual Evaluation: Not yet completed;
to be continued at next Closed Session.
LITIGATION MATTERS:
1. Claim of Iry Sutler: Nothing to report.
2. Stager v. City of Rohnert Park: Nothing to report.
S. Las Casitas v. City of Rohnert Park: Mayor
Mackenzie and City Attorney Strauss will represent
the City Council at a mediation meeting on
November 26, 2001.

REGULAR CONCURRENT CITY MEETINGS - SEPTEMBER 25, 2001
Upon MOTION by Vice Mayor Flores, seconded by
Councilmember Vidak- Martinez, the Skate Park Special
Meeting Minutes of September 21, 2001; the Budget Work
Session Minutes of September 25, 2001; and the Regular
Concurrent City Meetings Minutes of September 25, 2001,
were UNANIMOUSLY APPROVED AS SUBMITTED with the following
exceptions as noted: Councilmember Spiro abstaining from
the Special Skate Park Meeting of September 21, 2001; and
Councilmember Reilly abstaining from the Budget Work
Session and Concurrent City Meetings Minutes of
September 25, 2001.
3. COUNCIL COMMUNICATIONS, IF ANY (INFORMATIONAL ONLY):
Mayor Mackenzie asked the Councilmembers if there were
any informational communications to add to the agenda.
* Councilmember Vidak- Martinez referenced the "Sonoma
County Operational Area Emergency Operation Plan," and
she noted that staffing issues at the Department of
Public Safety are holding up the development of a draft
plan for the City. She SUGGESTED that the process be
expedited, and Council CONCURRED to DIRECT STAFF to
report back on the state of the City's draft plan.
*Mayor Mackenzie thanked everyone who arranged and
participated in the Red Cross BBQ fundraiser on Sunday,
October 7, 2001, at Alicia Park.
4. YOUTH HIGH SCHOOL REPRESENTATIVES TO THE CITY COUNCIL
FROM YOUTH LEADERSHIP OF ROHNERT PARK PROGRAM:
1. Review of New Youth Leadership of Rohnert Park Program
Plan by Sonoma County Adult and Youth Development
(SCAYD)-: Mayor Mackenzie referenced a communication
from SCAYD, provided to the Council in their agenda
packets, regarding how SCAYD intends to revamp the
program to better serve the youth leaders in terms of
gaining an understanding of city government and
identifying leadership roles /responsibilities.
Councilmember Vidak- Martinez noted that the youth
leaders will attend meetings approximately once a
month, will stay till 9:00 p.m., and will give more
in -depth presentations.

2. Recognizing Youth Representatives:
*Youth Report /Comments, if any: No Youth Report.

Mayor Mackenzie noted that any youth in the community
who desires to focus attention on a specific issue has
the opportunity to do so during this very specific "Youth
Comments" portion of the City Council agenda.
5. SONOMA STATE UNIVERSITY ASSOCIATED STUDENTS, INC.,
REPRESENTATIVE:
1. Recognizing SSU ASI Representative Travis Tabares:
ASI Representative Tabares was recognized and noted
that he DISTRIBUTED copies of The Star to the Council.
2. SSU ASI Report /Comments, if any: ASI Representative
Tabares reported on several events /issues, with
highlights including the following:
(1) ASI to work with Chamber of Commerce to advertise
SSU students as volunteers, helpers, and partners
in the community;
(2) High attendance at past forums on terrorism;
(3) Benefit Tee- Shirts for Red Cross fundraiser still
available - order form DISTRIBUTED to Council;
(4) Fall Festival this weekend at SSU;
(5) Skating event, Saturday, October 14, 2001, to raise
money for Children's Miracle Network;
(6) 5th Annual Halloween Bash, Thursday, October 25,
2001;
(7) Hands Across the County, Saturday, October 27, 2001
(8) Blood Drive sponsored by JUMP, Wednesday,
October 31, 2001 - informational handout for JUMP
DISTRIBUTED to Council;
(9) Update on men's soccer and women's volleyball
Mayor Mackenzie noted that he was invited and will be
attending the Senate faculty meeting at SSU this Thursday,
October 11, 2001, at 3:00 p.m.

6. SCHEDULED APPEARANCES /PRESENTATIONS:
1. Recognizing Ed Grossi, Neadho Wholesale Nursery, for
his contribution of 39 Pink and White Dogwood Trees for
use as color accent plants in various Park locations
throughout the City: Mayor Mackenzie called Mr. Grossi
forward, and he presented him with a Certificate of
Recognition and thanked him for his generous
contribution to the City.
2. Robert Abramson for United Nations Day, October 24,
2001, and United Nations Flag Week, October 22 -27,
2001: Mr. Abramson, Co- President of the U.N.
Association of Sonoma County, came forward and noted
the Association's request for a proclamation and
permission to fly the U.N. flag, SUBMITTED to the
City Manager, October 22 -29, 2001. He also
DISTRIBUTED a flier about a U.N. Day Program,
regarding the humanitarian crisis in Iraq and the
effects of U.N. sanctions, on Saturday, October 20,
2001, at the First United Methodist Church in Santa
Rosa. He closed with comments about the U.N. Security
Council's and the U.N. General's strong condemnation of
the recent terrorist attacks against the United States.
3. Reverend Sam Tharpe for Annual Thanksgiving Dinner
invitation and Council consideration of $500
contribution for this annual event: Reverend Tharpe
came forward and thanked Councilmembers for their
past participation in the Annual Thanksgiving Dinner,
and he invited all members of the community to come
and participate in the event, which includes bringing
meals to shut -ins.
*Council Discussion /Action:
Upon MOTION by Councilmember Spiro, seconded by
Councilmember Reilly, a motion to direct staff to continue
its annual $500 contribution to the Annual Thanksgiving
Dinner was UNANIMOUSLY APPROVED.
At this time, Reverend Tharpe noted that fundraising
efforts for T's Academy have nearly been exhausted, and
he REQUESTED Council consideration to permit him to
place portables on his property in order to start school
in the fall. Council CONCURRED to AGENDIZE the matter
for full discussion, and Council DIRECTED STAFF to
prepare a report on the status and feasibility of the
matter.

4. Chamber of Commerce Update on Holiday Lights Event,
November 29, 2001: Recreation Director Barry came
forward and introduced Ms. Robin Bleckwehl, chairperson
of the Holiday Lights Committee. She discussed how
the event has outgrown the Community Center and will be
held in the Sports and Fitness Center this year,
thereby nearly doubling the costs. She noted that in
light of the recent events in America, this year's
event will include a celebration of American tradition.
She responded to a Council inquiry and outlined several
of the major expenses, ranging from the staging to
lighting, a sound system, entertainment, and
refreshments.
Vice Mayor Flores SUGGESTED having the City sponsor an
ornament that could be sold with the proceeds going toward
the event. Council CONCURRED to DIRECT Ms. Bleckwehl to
return in two weeks and report back with a more detailed
account of the growth of the event and suggestions for
fundraising.
At this time, Ms. Bleckwehl DISTRIBUTED a flier for
Octoberfest to the Council and invited everyone to the
event on Saturday, October 20, 2001, from 6:00 to
10:00 p.m. at the Sonoma County Wine & Visitors' Center
in Rohnert Park.
7. UNSCHEDULED PUBLIC APPEARANCES:
Mayor Mackenzie stated that in compliance with State law,
The Brown Act, citizens wishing to make a comment may do
so at this time, limited to 3 -5 minutes per appearance
with a 30- minute limit.
1. Al Barr, 5746 Dexter Circle, was recognized and
discussed the contents of a packet DISTRIBUTED to
Council and containing the following items: (1)
Examples of variances granted to various companies
by the Cal O.S.H.A. Standards Board; (2) Application
form to get the variance; (3) address of Mr. Mike
Mason, Chief Counsel for Cal O.S.H.A.; and (4) a
copy of Mr. Barr's version to the proposed noise
ordinance given to the Council several weeks ago.
Mr. Barr asked that his proposed ordinance be sent in
its entirety to Cal O.S.H.A., and he also requested
copies of any written communications between City staff
and Cal O.S.H.A. City Attorney Strauss indicated that
she will call Mr. Mason and report back to the Council.

2. Bryan Duncan, 26 Ryan Lane, was recognized and noted
that, as the Vice President of Sigma Alpha Epsilon, he
was present to follow -up on that group's efforts to put
on a haunted house to raise funds for the local Boys
and Girls' Club. He reminded Council of the group's
request for Council consideration of the $500 fee to
use The Vision Teen Center as well as the need for
portable toilets at the event.
17. CITY MANAGER'S REPORT: [Out of Order.]
1. Non - Profit Use of Vision Teen Center: At this time,
City Manager Netter moved this agenda item forward
and shared his recommendation that any contribution to
the event come from Community Promotions. Recreation
Director Barry shared the contents of his staff report.
Council CONCURRED to DIRECT STAFF on several matters:
(1) To work out the issue of use of Community Promotion
funds for this event; (2) To work out the amount of time,
ranging from one week to two weeks, for the set -up of the
haunted house; and (3) to address the issue of the
necessity of portable toilets on the premises.
3. Lynne Conde 5732 Dexter Circle, was recognized and
thanked the City for having the Founders' Day Parade
despite the national events. She noted the large
crowds in attendance, and she discussed the growing
enthusiasm for the new library. She SUGGESTED that
a website be set up outlining the progress of the
new library, and she indicated that the Library
Foundation is moving ahead.
Vice Mayor Flores gave a brief update on the progress of
construction of the new library, and he noted that it is
still ahead of schedule despite a delay in getting the
structural steel. Council CONCURRED to DIRECT STAFF to
set up a section of the City website, www.rpcity.org, to
show digital pictures and updates for the new library and
other civic projects.
Regarding the Founders' Day Parade, Councilmember Reilly
REQUESTED that the City Manager convey the gracious
outpouring of support, which Councilmember Reilly
personally noted, for the firefighters and what they
and other public safety personnel represent.

Mayor Mackenzie asked if there were any questions about
the matters on the Consent Calendar, which were explained
in the City Manager's Council Meeting Memo. The Mayor
signified removal of one Consent Calendar item for further
discussion as follows: Resolution No. 2001 -216 per
Councilmember Vidak ®Martinez' recommendation.

2001 -216 AUTHORIZING A SALARY RANGE ADJUSTMENT FOR THE
POSITION OF FIRE INSPECTOR
Councilmember Vidak- Martinez *expressed her concerns about
fire inspection services and the City's ability to
adequately staff that position. She noted her preference
that the position be classified as "Safety," specifically
class 85X, which is that of Building Inspector in Rohnert
Park.

9. MOUNTAIN SHADOWS GOLF COURSE RENOVATIONS UPDATE -
PRESENTATION BY COURSECO:
Recreation Director Barry introduced the CourseCo
representatives, who shared a slide presentation on
the progress of the work being done on the Mountain
Shadows Golf Course. Highlights included comments
about the seeding, drainage and irrigation systems,
reshaping of the lake, renovation of the cart path,
and creative mounding around the clubhouse.
Furthermore, CourseCo thanked the golf course neighbors
for their support during the construction process, and
they responded to Council questions.
Mayor Mackenzie REQUESTED continued updates on the
golf course renovations.
10. BICYCLE ADVISORY COMMITTEE APPOINTMENT RESIGNATION:
*Accepting Resignation from Christopher Costello -
two -year term to expire December 31, 2002:
At the suggestion of Councilmember Reilly, Council
DIRECTED STAFF (1) to send a letter to Mr. Costello,
expressing regrets and thanking him for his service on
the commission, and (2) to post a public notice of the
vacancy.
11. PLANNING AND ZONING MATTERS:
1. File No. 2001- 048RZ /SR: Consideration of John and Lea
Marchisiello application for site plan and
architectural review to convert an existing office
complex into 20 townhouse units on an approximately
1.27 acre property located at 6920 Commerce Boulevard,
Rohnert Park, CA (APN 143 - 380 -020). Also requested is
a rezoning from a Professional, Administrative Office
District (R- M:1500) designation. The adequacy of a
Negative Declaration for the project will be
considered.
a. Staff Report: Associate Planner Bendorff shared the
the contents of the staff report provided to Council
in the agenda packets, and he responded to Council
inquiries.
b. Public Hearing:

recognized and noted that the project is moving in a
positive direction for the property, the community,
and the owner.
Mayor Mackenzie CLOSED the Public Hearing at 9:28 p.m.

Bendorff responded to Council questions *which
included confirming that this parcel previously had
some unapproved construction and the corrective
action required and recommended by City staff at
this time would bring it into compliance.

2. Smart Growth Strategy Rectional Livability Footprint
Project Workshop: Mayor Mackenzie referenced Planning
and Community Development Director Kaufman's staff
report, and he DIRECTED STAFF to notify Council of
the Spring 2002 Smart Growth Workshop, at which time
various options for growth in Sonoma County will be
discussed.

3. Garage Conversions - Discussion for future agenda:
Council CONCURRED with City Manager Netter's direction
from Planning Director Kaufman to bring this matter
of garage conversions forward at the time of the
Zoning Ordinance update.
RECESS: Mayor Mackenzie declared a recess at
approximately 9:34 p.m.
RECONVENE: Mayor Mackenzie reconvened the Council at
approximately 9:39 p.m. with all of the
Councilmembers present.
12. GENERAL PLAN IMPLEMENTATION PROGRAM - MATTERS RELATED
TO THE GENERAL PLAN PROCESS, IF ANY:
1. Communication from property owners behind G Section on
open space mitigation:
*Council Discussion /Direction: City Manager Netter
noted that he will be meeting either this week or next
week with Mr. John Scharer, representative of the
property owners, to discuss relative matters.
2. Submission of letter request to Local Agency Formation
Commission (LAFCO) on sphere of influence: Mayor
Mackenzie referenced the letter from Planning Director
Kaufman, and he DIRECTED STAFF to inform Council of the
LAFCO meeting, possibly in December, when this LAFCO
application will be considered.
3. Other informational items, if any: None.
13. COUNCIL COMMITTEE AND /OR OTHER REPORTS:
1. Sonoma County Tourism Council Investors' Committee,
September 19, 2001, meeting: Councilmember
Vidak- Martinez stated that she was unable to attend
the meeting due to illness, and that she will report
back on the meeting.
2. Canon Manor Ad IIoc Committee, _S_eptember 26, 2001,
meeting: Mayor Mackenzie reported that City Attorney
Strauss continues to work with County Counsel on the
matter, and he noted that the Canon Manor issue is on
track to come in front of the Council. City Manager
Netter shared brief comments on ongoing discussions
regarding the property taxes change.

Vice Mayor Flores reconfirmed the date of Thursday,
December 13, 2001, for the Changing -of- the - Officers
Celebration, and he DIRECTED the Councilmembers to
submit their invitation lists to staff by the first
week in November.

14. TRANSPORTATION MATTERS:
1. Sonoma County Transportation Authority (SCTA),
October 8 2001, meeting: Mayor Mackenzie reported
on the progress of the Novato Narrows /Petaluma project.
Furthermore, he DISTRIBUTED and REVIEWED a map
outlining the SCTA's Highway 101 Widening Project. He
also reported on a delay in the EIR preparation on
the Wilfred Avenue overpass.

15. COMMUNICATIONS:
Communications per the attached outline were brought to
the attention of the Councilmembers.
* Councilmember Reilly referenced his letter regarding
"Public Safety Future Needs," and he REQUESTED TO
AGENDIZE for discussion the rules of Closed Session.
Council CONCURRED TO AGENDIZE the matter of Closed
Session rules for a full Council discussion, and to
DIRECT STAFF to report back on said issue.
16. MATTERS FROM /FOR COUNCIL:
1. Utility Bill Inserts: Councilmember Vidak- Martinez
expressed concern over a City policy that states that
only City - related functions could be included in
utility bill inserts. She cited the Gong Show, a
fundraiser for the school district, and she suggested
a review of the definition of City- sponsored and
whether that should include any function that will
benefit the community and which is sponsored by a
government agency. Council CONCURRED TO AGENDIZE
the policy on City- sponsored functions and to DIRECT
STAFF to report back on the issue.

*Vice Mayor Flores noted that he and Councilmember
Reilly, the Council Subcommittee on Public Safety
Future Needs, will have their public report ready for
the City Council agenda for October 23, 2001.
Council briefly discussed the items which should be
brought forward in the public report from the Ad Hoc
Subcommittee. Council CONCURRED that the report should
cover the general reactions from all levels of the
Department of Public Safety personnel regarding programs,
staffing, and resources.
17. CITY MANAGER'S REPORT:
1. Non - Profit Use of Vision Teen Center: [Out of order.]
Discussed during the "Unscheduled Public Appearances"
portion of this evening's City Council meeting.
