2001/12/11 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETINGS MINUTES for: CITY COUNCIL COMMUNITY DEVELOPMENT COMMISSION ROHNERT PARK FINANCING AUTHORITY December 11, 2001 Tuesday The concurrent meetings of the City of Rohnert Park for the City Council, the Community Development Commission, and the Rohnert Park Financing Authority met this date in regular session for a regular meeting to commence at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Mackenzie presiding. CALL TO ORDER: Mayor Mackenzie called the regular session to order at 7:17 p.m. and led the pledge of allegiance. ROLL CALL: Present: (5) Councilmembers Reilly, Spiro, and Vidak- Martinez; Vice Mayor Flores; and Mayor Mackenzie Absent: ( 0 ) None Staff present for all or part of the meeting: City Manager Netter, City Attorney Strauss, Assistant City Manager Donley, Management Analyst Fogle, Recreation Director Barry, and Fire Commander Cassel. MOMENT OF SILENCE: Mayor Mackenzie shared brief comments about Mr. Dick Day, one of the early and valued members of the Rohnert Park community who recently died. A moment of silence was observed in honor of Mr. Day. 1. MAYOR'S REPORT ON CLOSED SESSION: Mayor Mackenzie reported on the closed session which commenced at approximately 6:00 p.m. to discuss matters listed on the agenda attachment, representing an update. Annual Performance Evaluation - City Attorney: Nothing to report. LITIGATION MATTERS: 1. Sonoma County Housing Advocacy Group v. City of Rohnert Park: Nothing to report. 2. Las Casitas et al. v. City of Rohnert Park Mediation: Nothing to report. REAL ESTATE NEGOTIATIONS: 1. Lands Around Stadium: Nothing to report. 7. UNSCHEDULED PUBLIC APPEARANCES: [Out of order.] at the suggestion of Mayor Mackenzie, Council CONCURRED to allow a member of the public to speak at this time since she had a very young child with her. 1. Chip Worthington, 4695 Snyder Lane, and Joanna Sienkiewicz, 8029 Mackey Court, were recognized, and Mr. Worthington indicated that he had encouraged Ms. Sienkiewicz to come speak to the Council about a problem she has been having. Ms. Sienkiewicz outlined her efforts over the last year to get City staff to plant and maintain trees at the tank site on Maple Drive, across the street from her home. She discussed consistent problems with weeds and the insufficient fertilization and irrigation of the existing trees meant to screen the tank site. She REQUESTED that the City respond to her concerns, and she SUBMITTED her business card to City Manager Netter so that he can contact her. City Manager Netter INDICATED that he would contact Ms. Sienkiewicz tomorrow and that staff will respond immediately. *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES December 11, 2001 Page(3 ) 2. APPROVAL OF CONCURRENT MEETING MINUTES FOR: REGULAR CONCURRENT CITY MEETINGS - NOVEMBER 27, 2001 Upon MOTION by Vice Mayor Flores, seconded by Councilmember Vidak- Martinez, the Regular Concurrent City Meetings Minutes of November 27, 2001, were APPROVED 4 -0 -1, with Councilmember Spiro abstaining, AS AMENDED: *Per Councilmember Reilly: Agenda Item 20, page 16, delete the phrase "with DIRECTIONS FOR STAFF to come back with a report from the Department of Public Safety" from the last sentence. 3. COUNCIL COMMUNICATIONS, IF ANY (INFORMATIONAL ONLY): Mayor Mackenzie asked the Councilmembers if there were any informational communications to add to the agenda. * Councilmember Vidak- Martinez INDICATED that she has returned from a week with the National League of Cities, and she shared comments about the discussions regarding homeland security and the costs to local jurisdictions. Furthermore, she DISTRIBUTED a copy of the resolution, passed by the Board of Directors of the National League of Cities, entitled, "A New Partnership for Homeland Security." ANNOUNCEMENT: Mayor Mackenzie announced that AT &T Cable complaint forms, on pink paper, as well as AT &T Cable speaker cards, are available for interested members of the public to address said topic this evening. 4. YOUTH REPRESENTATIVES TO THE CITY COUNCIL FROM HIGH SCHOOL YOUTH LEADERSHIP OF ROHNERT PARK SELECTIONS: 1. Recognizing Youth Representatives: Senior Nicole Medeiros and Junior Laeya Kaufman, of the Community Service Committee - Environmental Prevention Coalition, were recognized. *Youth Report /Comments, if any: Highlights of the Youth Report included the following: *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES December 11, 2001 Page(4 ) (1) Thanks to Mayor Mackenzie and Counciimember Vidak -- Martinez for attending the last Youth Leadership meeting and sharing their comments; (2) Environmental Prevention Coalition's (AOD) first meeting last week included discussion of spreading anti - tobacco messages, arranging for guest speakers, hosting booth at 24 -Hour Relay, tobacco stings; and recruitment committee's presentation at Mountain Shadows Middle School; (3) REQUEST to serve as skate park liaisons to Rancho Cotate High School in order to keep students informed on the skate park matter; (4) Decision not to create a Youth Summit this year; (5) RCHS Football team takes championship; (6) RCHS newspaper, The Catamount, takes ninth place in the nation at the Boston convention; (7) Next Youth Leadership meeting, December 19, 2001, 4:00 -6:00 at The Vision; (8) Next AOD meeting, January 17, 2002, 5:00 -6:30 at The Vision. At the suggestion of Vice Mayor Flores, the youth leaders INDICATED that they would be distributing copies of The Catamount to the Councilmembers at future Council meetings. 2. Other Youth Comments, if any: None. 5. SONOMA STATE UNIVERSITY ASSOCIATED STUDENTS, INC., REPRESENTATIVE: 1. Recognizing SSU ASI Representative Travis Tabares: ASI Representative Tabares was recognized. 2. SSU ASI Report /Comments, if any: ASI Representative Tabares reported on several events /issues, with highlights including the following: (1) Finals time at SSU; (2) Transitional housing programs for students to remain open between semesters; (3) Extensive report for JUMP, community service club, at next meeting; (4) Acquisition of new volleyball players for next year's team. *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES December 11, 2001 Page (5 ) 3. SSU Student Housing Issues - City Staff Report by Assistant City Manager Steve Donley: Assistant City Manager Donley shared the contents of the staff report provided to the Council in the agenda packets. 6. SCHEDULED APPEARANCES /PRESENTATIONS: 1. Resolution for presentation expressing appreciation to John Hartnett Recreation Services Manager, for successful efforts for Veterans' Day Event held at the Community Center: Mayor Mackenzie called forward Recreation Services Manager Hartnett, read the resolution, and commended him for his outstanding efforts. 2. Certificates of Excellence for presentation as follows: *Rancho Cotate High School Football Team and Coach Ed Conroy *Rancho Cotate High School Year 2001 "A Grand Year;" Mark Alton, Athletic Director At this time, the varsity championship RCHS Football Team came forward, as well as Coach Conroy and Athletic Director Alton. Mayor Mackenzie read the certificate of excellence, and Council commended the team for its accomplishments. Player Maurice White, Coach Conroy, and Athletic Director Alton shared brief comments. 3. Recipients of the Mayor's Secular Eternal Gratitude Awards came forward to be commended, and some shared brief comments. Councilmember Reilly SUGGESTED making a copy of the Youth of the Year Gratitude Award for each person who has served as a youth representative and mailing it to them, and Vice Mayor Flores SUGGESTED framing the Gratitude Award to be hung in The Vision. 4. Gary Jelinek, President, Rebuilding Together Rohnert Park *Presenting Certificates of Appreciation to City Council members *Providing update report on Rebuilding Together Rohnert Park Mr. Jelinek PRESENTED Certificates of Appreciation to the Councilmembers for their support of the Rebuilding Together program, formerly called Christmas in April, and he GAVE picture boards of last year's program to the three Councilmembers who participated in it last April. Furthermore, he gave a brief update on the status of this year's program, and he INDICATED that a seven - minute informational video about Rebuilding Together is available for interested members of the public by calling City staff at 588 -2233. 7. UNSCHEDULED PUBLIC APPEARANCES: Mayor Mackenzie stated that in compliance with State law, The Brown Act, members of the public wishing to make a comment may do so at this time, limited to 3 -5 minutes per appearance, with a 30- minute limit. 1. Daniel Navarrette, 150 Raley's Town Center, was recognized and noted that he is the Postmaster here in Rohnert Park and has been for the. last. 15 years. He thanked the Department of Public Safety for their support and cooperation, particularly in dealing with the anthrax scare after the events of September 11, and he indicated that the United States' postal employees are dedicated to doing their jobs. *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES December 11, 2001 Page(7 ) 2. Al Barr, 5746 Dexter Circle, was recognized and REQUESTED a verbal response from City Attorney Strauss with regard to any contact she has made with Cal- OSHA's Chief Counsel, Mr. Mason, regarding the legality of Mr. Barr's proposed alarm ordinance in light of State law. City Attorney Strauss indicated that she has no information to report on that matter at this time, and that she will REPORT BACK at the first Council meeting in January, 2002. 16. CAMPAIGN FINANCE REFORM - CONSIDERATION OF PROPOSED ORDINANCE ESTABLISHING DISCLOSURE REQUIREMENTS FOR POLITICAL CONTRIBUTIONS: Council Discussion /Direction: Mayor Mackenzie and City Attorney Strauss shared brief comments on the draft ordinance provided to the Council in the agenda packets. The City Attorney responded to Council inquiries, and Councilmembers shared their perspectives on the matter. Upon MOTION by Mayor Mackenzie, seconded by Councilmember Reilly, a motion was made to direct the City Attorney to review the ordinance and present it for Council action at the first Council meeting in January, 2002. A FRIENDLY AMENDMENT was made by Councilmember Reilly, and accepted by the maker of the motion, to place a two -year sunset clause in the ordinance. Said motion FAILED 2 -3 with Vice Mayor Flores and Councilmembers Vidak- Martinez and Spiro dissenting. 10. City Attorney Strauss and Management Analyst Fogle responded to Council questions, and Councilmembers expressed their concerns with the AT &T Cable TV matter. 2. PUBLIC HEARING: Mayor Mackenzie OPENED the Public Hearing at 9:16 p.m. 1. Peter A.Tscherneff, Rohnert Park resident, was called forward by Mayor Mackenzie. No one responded. 2. Dave Buchholz, 903 Hudis Street, was recognized and noted that he had filled out a complaint form. He gave a detailed account of his efforts to get a simple channel block fixed and receive a credit for it. In his efforts to contact local customer service, he noted how, over the course of a week, he spent a great deal of time on hold or speaking to various customer agents in Arizona, Washington, and Idaho. He expressed his frustration that a communications company had made the task of setting up a brief repair appointment so difficult, and he noted that he had been informed that in order to get the above - mentioned credit, he would have to initiate the process all over again. 3. Malina and Eddie Saiz 7186 Gravenstein Highway, were recognized and noted that they are from The Satellite Guy, a business in Cotati. They explained the benefits of satellite t.v. as a viable option to cable t.v., including a variety of ways to purchase a satellite set -up, the availability of local channels, Internet access, and 30 premium channels. Furthermore, they discussed the benefits of smaller local satellite shops which use local installers and are more readily available to serve their customers. 4. Vicki Vidak- Martinez, Rohnert Park City Councilmember, was recognized and shared two stories involving AT &T. She indicated that it took her daughter over two months to switch cable from one residence to another residence in a different neighborhood. She also explained her personal difficulties in getting cable for a homebound elderly lady. *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES December 11, 2001 Page(11) S. Leslie Ann Fong, Director of Local Government Affairs & Franchising for AT &T for the North Bay, and Deb Padia, Customer Care Specialist for the North Bay, were recognized and indicated that AT &T has tried to be responsive to the concerns of the City by meeting with City staff and Councilmembers and providing updates on the progress of system upgrades for the City as well as improved customer service. They noted that it has been a challenging year for AT &T and that the company will continue to help the customer as quickly as possible. Furthermore, they apologized for the inconvenience that Mr. Buchholz had endured in trying to get his problem resolved with AT &T. At this time, Ms. Fong and Ms. Padia responded to Council inquiries about the poor quality of customer service, the lack of options for AT &T subscribers, the failure of AT &T staff to adequately listen and respond to the City's mounting concerns, the lack of a local presence for AT &T in Sonoma County, and the failure of corporate officers of AT &T to come before the Council to address the matter with the City. Ms. Fong indicated that an influx of capital funding next year may be used to upgrade the City's system; that steps have been taken to improve customer service; and that AT &T's web site has been improved to provide market - specific information. Mayor Mackenzie CLOSED the Public Hearing at 9:51 p.m. 3. Council Discussion /Direction: Mayor Mackenzie REQUESTED that Ms. Fong provide the names of senior corporate managers at AT &T for more direct and effective communication between the City and AT &T regarding the various issues, particularly the possibility of approving a system upgrade for Rohnert Park in AT &T's next budget cycle. City Attorney Strauss noted that the legal issues will be discussed in closed session. Ms. Fong agreed to bring the highest level of representation from AT &T, specifically the Vice President of Finance, to the meeting with the Subcommittee and staff in January, 2002. GENERAL PLAN IMPLEMENTATION PROGRAM - MATTERS RELATED TO THE GENERAL PLAN PROCESS: 1. General Plan Committee - Information on meeting of December 10, 2001: Councilmember Vidak- Martinez and Mayor Mackenzie summarized the contents of the staff report and solicited Council input on various matters per the meeting as follows: (1) Discussion of a process for considering projects that significantly vary from current programs: Councilmembers discussed the possibility of incorporating two options as outlined in the staff report and giving the applicant the option to have a General Plan Subcommittee provide feedback for their proposal prior to processing the project proposal through the Planning Commission and City Council as required. Vice Mayor Flores CONCURRED with Council's DIRECTION TO AGENDIZE the matter of a General Plan Subcommittee for the first Council meeting in January, 2002. (2)Discussion of the Growth Management Ordinance and Housing Unit Allocations: Councilmember Vidak- Martinez summarized the matter and noted that the sewer trunk line is a major issue on the eastern side of town. (3)Discussion of the Spanos proposal for multi- family residential west of the freeway: Councilmembers expressed concerns regarding the challenge of retaining business on the west side of town, the affordable housing and zoning issues related to the proposal, and the lack of public services on the west side. Mayor Mackenzie indicated that said concerns will be conveyed to the applicant in future meetings. (4)Discussion of the Southeast Specific Plan: Council discussed their concerns regarding the size of a mixed use development, the viability and location of a park, and the disposition of the industrial portion of the plan. Response letter from California Department of Housing and Community Development (HCD) on City's Housing Element - Approval with conditions: City Attorney Strauss gave a brief overview of the staff report provided to Council in the agenda packets, and she outlined the staff recommendations. Mayor Mackenzie commended staff for their efforts in acquiring the H.C.D. certification of the City's Housing Element. 15. HOUSING LEGISLATION /WIGGINS - ASSOCIATION OF BAY AREA GOVERNMENT (ABAG) NUMBERS: *City Attorney Report: City Attorney Strauss referred Councilmembers to her report provided in the agenda packets. No questions were raised at this time. 17. COMMISSION /COMMITTEE /BOARD APPOINTMENTS: *Council review of terms to expire December 31, 2001: Mayor Mackenzie referred Councilmembers to the staff report provided in the agenda packets. Council CONCURRED to DIRECT STAFF to inform the commissioners, committee, and board members that the expiration of their terms will extend from December 31, 2001, to the first Council meeting in January. 18. COUNCIL COMMITTEE AND /OR OTHER REPORTS, IF ANY: 1. Economic Development Subcommittee: Councilmember Spiro reported that due to the address by Joe Nation followed by the Airport presentation, the Subcommittee will reschedule a meeting with local major employers in the near future. Mayor Mackenzie thanked Councilmembers Spiro and Vidak- Martinez for working with Assistant City Manager Donley on the Economic Development Subcommittee. 19. TRANSPORTATION MATTERS: 1. Train Station location recommendation and consideration of formal notification to SMART: Mayor Mackenzie noted that he will be at the Sonoma County Transportation Authority (SCTA) meeting tomorrow, at which time governance issues relating to the Sonoma -Marin Area Rail Transit (SMART) will be discussed. *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES December 11, 2001 Page(16) A. Staff Report: City Manager Netter shared the contents of the staff report. B. Council Discussion /Action: Councilmember Reilly SUGGESTED that a rail station be considered at some future time as an option at the proposed site. Upon MOTION by Councilmember Vidak- Martinez, seconded by Mayor Mackenzie, a motion to approve the train station location as recommended by staff and to formally notify SMART was UNANIMOUSLY APPROVED. 2. Other, if any: None. 20. COMMUNICATIONS: Communications per the attached outline were brought to the attention of the Councilmembers. No communications were discussed at this time. 21. MATTERS FROM /FOR COUNCIL: 1. 2001 Annual League of California Cities Conference Sacramento Convention Center December 18 -20, 2001: City Attorney Strauss indicated that she will be attending the conference, which had originally been scheduled for September 12, 2001. 2. Concurrence to cancel December 25th City Council meeting due to holiday: Council CONCURRED to cancel the City Council meeting on December 25, 2001, due to the holiday. 3. Other informational items, if any: A. Ticket refund: Councilmember Spiro indicated that she was unable to attend a recent conference in Atlanta and that she has refunded the City the cost of her ticket and expense money. B. Sonoma County Workforce Housing Study Administrative Draft: City Manager Netter briefly summarized the staff report, and he noted that the draft will be brought back to the full Mayors' and Councilmembers' Association at the January 10, 2002, meeting here in Rohnert Park at the Doubletree Hotel. 4.
