2002/04/26 City Council MinutesCITY OF ROHNERT PARK SPECIAL MEETING MINUTES for: CITY COUNCIL COMMUNITY DEVELOPMENT COMMISSION ROHNERT PARK FINANCING AUTHORITY ROHNERT PARK DISTRICT SPECIAL MEETING MINUTES for COUNCIL VACANCY APPOINTMENT PRESENTATIONS /INTERVIEWS April 26, 2002 Friday The City Council of the City of Rohnert Park met this date for a Special Meeting open to the public to discuss Council Vacancy Appointments. The Special Meeting commenced at approximately 6:00 p.m. in the Council Chamber, 6750 Commerce Boulevard, Rohnert Park, with Mayor Flores presiding. CALL TO ORDER: Mayor Flores called the Special Meeting to order at 6:00 p.m. and led the pledge of allegiance. ROLL CALL: Present: (4) Councilmembers Mackenzie and Vidak- Martinez; Vice Mayor Reilly; and Mayor Flores. Absent: ( 0 ) None. Staff present for all or part of the meeting: City Manager Netter and Assistant City Manager Donley. ACKNOWLEDGING THE CITY MANAGER /CLERK'S REPORT ON THE POSTING OF THE MEETING'S AGENDA: The Council acknowledged the City Manager /Clerk's report on the posting of the meeting's agenda. City of Rohnert Park *SPECIAL MEETING MINUTES April 26, 2002 Page(2 ) UNSCHEDULED PUBLIC APPEARANCES: In compliance with State law, the Brown Act, Mayor Flores invited members of the public wishing to make a comment to do so at this time, limited to 3 -5 minutes per appearance with a 30- minute limit. No members of the public responded. ITEMS FOR DISCUSSION AND /OR ACTION: 1. REVIEW OF CITY ATTORNEY MEMORANDUM REGARDING COUNCIL ALTERNATIVES IN MAKING AN APPOINTMENT TO THE VACANT COUNCIL SEAT CREATED BY THE RESIGNATION OF FORMER COUNCILMEMBER /VICE MAYOR LINDA SPIRO: City Attorney Strauss' memorandum of February 14, 2002, was provided to Council in the Special Meeting packets. 20 PRESENTATIONS /INTERVIEWS OF APPLICANTS FOR APPOINTMENT TO FILL THE CURRENT VACANT SEAT ON THE CITY COUNCIL TO SERVE UNTIL THE NOVEMBER, 2002, GENERAL MUNICIPAL ELECTION: Each applicant made a brief presentation followed by an interview and a question -and- answer period by the Councilmembers. Applicant presentations were done in the following order: Len Carlson 349 Circulo San Blas Michael L. Harrow 131 Southwest Boulevard, G -3 Dan Hubley 135 Alma Avenue Shawn Kilat 1374 Rebecca Way Ron Militello 4304 Heritage Lane (City Manager Netter read Mr. Militello's letter regretting his absence this evening, as well as his better of interest in *h° ^a-Y'^".) 1..111.. V aVUllliY Greg Nordin 4590 Fairway Drive At this time, Mr. Greg_ Nordin ANNOUNCED his intention to run in the General Municipal election this November, 20020 Loy C. Rayos 4759 Fairway Drive (City Manager Netter read Mr. Rayos' letter regretting his absence this evening, as well as his letter of interest in the vacancy.) PUBLIC COMMENTS: 1. Bob Fleak Rancho Grande, was recognized and indicated that he was impressed with the candidates. He expressed his support for Mr. Len Carlson as an individual with honesty and integrity, as well as solid ideas and a good approach, particularly to the mobile home park issues. 2. Roster Martin 20 Circulo Lulo, was recognized and congratulated the fine group of candidates. In terms of filling the vacancy, he indicated that the Council must have the ability to make a decision; that 50 -50 has never worked; and that problems can arise anytime, so the Council needs the ability to break a tie. Furthermore, he noted that the City cannot afford to stagnate and that the citizens have a right to know that the Council can move forward on all of the issues that come before it. 3. Letter of Gail Forni 419 Bruce Avenue, in support of Greg Nordin, read by City Manager Netter in the absence of Ms. Forni. RECESS: Mayor Flores declared a recess at approximately 7:55 p.m. RECONVENE: Mayor Flores reconvened the Council at approximately 8:05 p.m. with all of the Councilmembers present. 4. SELECTION /APPOINTMENT PROCESS TO FILL THE CURRENT VACANT SEAT ON THE CITY COUNCIL TO SERVE UNTIL THE NOVEMBER, 2002, GENERAL MUNICIPAL ELECTION: Council Discussion /Action: Councilmembers shared their perspectives about the applicants' presentations and interviews. Following Council comments, Council action proceeded as follows: *City Council /Community Development Commission/ Rohnert Park Financing Authority / Rohnert Park District City of Rohnert Park *SPECIAL MEETING MINUTES April 26, 2002 Page(4 ) Councilmember Mackenzie recommended the nomination of Shawn Kilat to fill the current vacant seat on the City Council to serve until the November 2002 General Municipal Election. Mayor Flores conducted a roll call vote, and said nomination FAILED 1 -3 with Councilmember Vidak - Martinez, Vice Mayor Reilly, and Mayor Flores dissenting. Councilmember Vidak- Martinez recommended the nomination of Greg Nordin to fill the current vacant seat on the City Council to serve until the November 2002 General Municipal Election. Mayor Flores conducted a roll call vote, and said nomination FAILED 2 -2 with Councilmember Mackenzie and Vice Mayor Reilly dissenting. Mayor Flores conducted a roll call vote, and said nomination FAILED 2 -2 with Councilmember Mackenzie and Vice Mayor Reilly dissenting. Mayor Flores recommended the nomination of Ron Militello to fill the current vacant seat on the City Council to serve until the November 2002 General Municipal Election. Mayor Flores conducted a roll call vote, and said nomination FAILED 2 -2 with Councilmerriber Mackenzie and Vice Mayor Reilly dissenting. Vice Mayor Reilly STATED that until a procedure is defined for filling vacancies on the City Council, he will continue to vote down any nomination to fill the current City Council vacancy. Councilmember Mackenzie STATED (1) that he continues to support adoption of a procedure for now and the future that would fill City Council vacancies with the first runner -up in the last General Municipal Election; and (2) that he will be pressing for City Council consideration of a campaign financing reporting ordinance proposal. *City Council /Community Development Commission/ Rohnert Park Financing Authority / Rohnert Park District City of Rohnert Park *SPECIAL MEETING PMINUTES ) April 26, 2002 Upon MOTION by Vice Mayor Reilly, seconded by Councilmember Mackenzie, a motion was made to adopt the procedure of granting a City Council vacancy to the first runner -up in the last General Municipal Election. Said motion FAILED 2 -2 with.Councilmember Vidak- Martinez and Mayor Flores dissenting. *Upon MOTION by Vice Mayor Reilly, seconded by Councilmember Mackenzie, a motion was made to fill the City Council vacancy with the first runner-up in the last General Municipal Election. ADMINISTRATION OF OATH OF OFFICE TO NEWLY APPOINTED COUNCILMEMBER: As noted above, Council was unable to select an applicant to fill the vacancy. At this time, Mr. Len Carlson ANNOUNCED his intention to run in the General Municipal election this November, 2002.
