A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ROHNERT PARK, CALIFORNIA,
ADOPTING A MITIGATED NEGATIVE DECLARATION
AND A MITIGATION MONITORING PROGRAM
FOR THE SEWER INTERCEPTOR/OUTFALL PROJECT #2003 -11
AND APPROVING THE PROJECT
WHEREAS, in June 24, 2003, the City Council gave direction to investigate the
replacement of the existing Rohnert Park sewer interceptor and outfall to the regional wastewater
treatment plant to increase reliability and capacity of its sewer conveyance system as part of the
2003/04 Capital Improvement Program budget; and
WHEREAS, on July 13, 2004, the City Council gave direction to provide for the design
and construction of the Sewer Interceptor / Outfall Project as part of the 2004/05 Capital
Improvements Program; and
WHEREAS, the existing 24 -inch interceptor was constructed in 1975, is nearing the end
of its reliable service life, has limited capacity to convey peak wet weather flows from the City,
and represents a weak link in the critical sewer conveyance system through the Laguna de Santa
Rosa flood plain; and
WHEREAS, the City Engineer reviewed a Route Study prepared on January 7, 2004,
from the Rohnert Park pump station on Redwood Drive to the outfall at the Subregional Water
Reclamation Facility for this sewer interceptor replacement, which concludes that a route along
Wilfred Avenue will best serve the City's needs; and
WHEREAS, the City Engineer reviewed a Pre - Design Report prepared on August 23,
2004, which describes in detail the project to be built; and
WHEREAS, at the request of the City Engineer, a Draft Initial Study and Proposed
Mitigation Negative Declaration was prepared in conformance with the requirements of the
California Environmental Quality Act; and
WHEREAS, on December 23, 2004, the Draft Initial Study and Proposed Mitigated
Negative Declaration were circulated for a period of no less than 30 days and a Notice of Intent
to Adopt a Mitigated Negative Declaration was published prior to that circulation period in the
Press Democrat and mailed to adjacent property owners within 300 feet of the project alignment;
and
WHEREAS, on February 8, 2005 the City Council held a public hearing at which time
interested persons had an opportunity to testify regarding the Draft Initial Study and Proposed
Mitigated Negative Declaration; and,
WHEREAS, the Draft Initial Study and Response to Comments did not identify any
significant environmental impacts of the project after implementation of mitigation measures,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROHNERT
PARK DOES RESOLVE, MAKE FINDINGS, DETERMINE AND ORDER AS
FOLLOWS:
That the above recitations are true and correct;
That the Council has read, reviewed and considered the information contained in the
Mitigated Negative Declaration, and the Mitigated Negative Declaration reflects the
Council's independent judgment and analysis;
That on the basis of the whole record before the Council, there is no substantial evidence
that the project, as mitigated, will have a significant effect on the environment;
That the record of the proceeding on which this decision is based shall be maintained by
the Planning Director at the City of Rohnert Park Planning Department; and
NOW THEREFORE BE IT RESOLVED, based on the records and the findings made
above, the Council determines that the Sewer Interceptor /Outfall Project will not have a
significant effect on the environment with implementation of the mitigation measures identified
in the Mitigated Negative Declaration; and
BE IT FURTHER RESOLVED, that the City Council adopts the Mitigated Negative
Declaration and Mitigation Monitoring Program for the proposed project and approves the
Rohnert Park Sewer Interceptor /Outfall Project.
DULY AND REGULARLY ADOPTED on this 8th day of February, 2005, by the City
Council of the City of Rohnert Park.
