2005/05/24 City Council Resolution (16)RESOLUTION NO. 2005- 157 RESOLUTION OF THE CITY OF ROHNERT PARK ESTABLISHING SOLID WASTE DISPOSAL AND RUBBISH OR REFUSE COLLECTION RATES WHEREAS, The City Council of the City of Rohnert Park did, in 1962 adopt Ordinance No. 9 establishing Section 8.12 of the Municipal Code regarding Refuse Disposal; and, WHEREAS, section 8.12.260 of said Municipal Code does provide that the City Council shall set rates for city refuse collection from time to time by resolution; and, WHEREAS, the City Council has previously adopted Resolution 2002 -169 on July 23, 2002 establishing solid waste disposal and rubbish or refuse collection rates; and, WHEREAS, the cost to dump the City's solid waste at the Sonoma County Landfill and other facilities has increased since those rates were established; and, WHEREAS, The City's agreement with Rohnert Park Disposal requires that the City establish rates at an amount estimated to produce revenues sufficient to provide payment to Rohnert Park Disposal in accordance with the annual amounts due under their contract agreement; and, WHEREAS, the garbage rate model has been updated with actual budget figures and requires a 20% increase in rates to meet the revenue requirements under the contract agreement, and WHEREAS the 20% increase will not exceed the costs of providing solid waste disposal services, and WHEREAS, the City Council held a duly noticed public hearing on May 24, 2005, concerning the proposed increase in refuse disposal rates and has taken into consideration the comments received. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Rohnert Park does hereby rescind Resolution 2002 -169 effective June 1, 2005 and subsequent amendments thereto and does hereby adopt the following: Any persons from whom solid waste, rubbish, refuse, yard waste and/or recyclable materials is collected under the provisions of this article shall pay the City the following fees for such service: A. Single Family Residences — Cart Service — Households may select a 20, 32, 68, or 95 gallon automated refuse container service. At no additional cost (included in refuse rates and required by the State to achieve 50% waste diversion) households are automatically provided a 95 gallon green yard waste cart for collection of uncontaminated green waste, grass, leaves and wood, and a 95 gallon blue recycling cart for collection of uncontaminated recyclables such as cans, bottles, plastics, paper and cardboard. Rates include weekly collection of refuse, yard waste and recyclables placed at the curb for pick up. All fees shall include all solid waste, rubbish, and refuse which has been placed within the container with the container placed at the curb no later than 6:00 am for pick up. 1. 20 gallon container $ 5.40 per month 2. 32 gallon container $ 9.90 per month 3. 68 gallon container $14.35 per month 4. 95 gallon container $22.40 per month 5. extra bags placed outside container $ 5.00 per bag 6. contaminated yard waste or recycling container $20.00 per incident 7. special trip charges $ 5.00 per trip 8. second and subsequent can size changes per year $ 5.00 per change Special trip charges shall apply if the container is not placed at the curb by 6:00 am and the driver has to come back to the residence to pick up the container. B. Commercial Businesses and Multi- Family Complexes — Cart Service — The City may require, at its sole discretion, the use of bins furnished by the Contract Agent for refuse and recycling collection at any commercial establishment or multi - family complex. For multi - family complexes, rates are based on the total number of apartments,. complex units (duplex, triplex), condominiums or mobile homes, whether occupied or vacant. For households or commercial businesses that the City determines may best be collected by cart service, customers may select a 20, 32, 68, or 95 gallon automated refuse container service. At no additional cost (included in refuse rates and required by the State to achieve 50% waste diversion) commercial businesses and households are automatically provided a 95 gallon green yard waste cart for collection of uncontaminated green waste, grass, leaves and wood, and a 95 gallon blue recycling cart for collection of uncontaminated recyclables such as cans, bottles, plastics, paper and cardboard. Rates include weekly collection of refuse, yard waste and recyclables placed at the curb for pick up. Yard waste containers are available free upon request. Rates include weekly collection of refuse, recyclables, and yard waste placed in the bins for pick up. All fees shall include all solid waste, rubbish, and refuse which has been placed within the container with the container placed at the curb no later than 6:00 am for multi- family complexes and mobile homes and no later that 5:00 am for commercial businesses for pick up. 1. Special Collections - For a special collection of rubbish or refuse, there shall be a charge of $45.80 per cubic yard or fraction thereof. A special collection of rubbish shall consist of any collections not included within the established monthly rate and shall include any bulky items which cannot be placed within the regularly used collection receptacle. E. Commercial Compactor - Compacted solid waste collected from commercial compactors operated by large industrial or commercial businesses shall be charged for refuse collection for each pull or collection of refuse plus the disposal fee charged by the central landfill for the load (Tons multiplied by Current compactor rate per ton as set by the County of Sonoma) as shown below. The County of Sonoma revises disposal rates annually effective January 1st. The County Compactor Disposal Rate for calendar year 2005 is $70.00 per ton. Commercial Permanent Debris Boxes — Compacted solid waste collected from permanent commercial debris boxes operated by large industrial or commercial businesses shall be charged for refuse collection for each pull or collection of refuse plus the disposal fee charged by the central landfill for the load (Tons multiplied by Current compactor rate per ton as set by the County of Sonoma) as shown below. The county of Sonoma revises disposal rates annually effective January 1St. The County Compactor Disposal Rate for calendar year 2005 is $71.00 per ton for refuse. Free Services to the City — The Contract Agent shall provide free service to all City owned facilities and bus stops. H. Repeal of Conflicting Resolutions - All previous City Council actions and all other Resolutions inconsistent with the terms of this Resolution are herewith repealed. I. Effective Dates — The rates outlined in this resolution shall become effective for all refuse disposal customers on June 1, 2005. DULY AND REGULARLY ADOPTED this 24th day of May 2005.
