2005/09/27 City Council Resolution (6)RESOLUTION NO. 2005-296 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING AN AMENDMENT OF THE GENERAL PLAN LAND USE MAP FOR A 5.61 ACRE SITE LOCATED ON THE SOUTHWEST CORNER OF REDWOOD DRIVE AND MARTIN AVENUE MORE PRECISELY KNOWN AS ASSESSOR'S PARCEL NUMBERS 143 - 040 -094, AND -108 (Ashley Furniture /David Jarvie) WHEREAS, the applicant, Ashley Furniture /David Jarvie, has submitted an application for a General Plan Amendment for the property located on the southwest corner of Martin Avenue and Redwood Drive (APN 143 - 040 -94 and -108; and WHEREAS, the Planning Commission reviewed the Initial Study prepared for the project; determined the project would not have a significant effect on the environment; accordingly directed staff to prepare a Negative Declaration; and has otherwise carried out all requirements of the California Environmental Quality Act; and WHEREAS, pursuant to California State Law, public hearing notices were transmitted to all property owners within a 300 foot radius of the subject property, a public hearing notice sign was posted on the property, and a public hearing was published for a minimum of 10 days prior to the public hearing in the Press Democrat; and WHEREAS, on September 8, 2005, the Planning Commission held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and, WHEREAS, on September 27, 2005, the City Council held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and, WHEREAS, the City Council of the City of Rohnert Park has adopted the Negative Declaration for the proposal; and WHEREAS, the Planning Commission and the City Council of the City of Rohnert Park have reviewed and considered the information contained in the General Plan Amendment application for the proposal; and WHEREAS, the City Council of the City of Rohnert Park makes the following findings: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Findings. The City Council, in approving Planning Application PL2005- 037GP (General Plan Amendment) makes the following findings; to wit: General Plan Amendment PL2005 -037GP 1. That the proposed site is appropriate for development under the General Plan Land Use Designation of Regional Commercial. The property is adjacent to properties designated Regional Commercial to the north and south and by properties currently being considered for potential regional commercial development. Development of this property as a retail site would reinforce positive attributes of the City's urban structure by emphasizing the regional retail amenities along the Highway 101 corridor. The maximum Floor Area Ratio established under the General Plan is 0.4 for commercial uses. The proposed project would have an FAR of 0.30, which is under this maximum allowed for the proposed land use. Furthermore, the proposed FAR is well under the 0.5 FAR allowed for Industrial land uses, so the proposed development would not conflict with the development intensity standards identified for commercial development in the General Plan. Based on the aforementioned, the proposed land use amendment from Industrial to Regional Commercial would be appropriate. 2. That the proposed General Plan Amendment would be consistent with specific policies in the Land Use Element of the General Plan relative to commercial development. The property is adjacent to properties designated Regional Commercial to the north and south and by properties currently being considered for potential regional commercial development. Promoting development of this site as a regional commercial site emphasizes the current trend along Redwood Drive for this area to become a Regional Commercial corridor, thus the proposed redesignation of this site to Regional Commercial would be consistent with policies of the General Plan. 3. That a duly noticed public hearing has been held to receive and consider public testimony regarding the proposed amendment to the General Plan Land Use Map. A duly noticed public hearing on the proposed General Plan Amendment was held on September 9. 2005. NOW THEREFORE BE IT RESOLVED, that the City Council does hereby approve Application No. PL2005- 037GP: General Plan Amendment for a 5.61 -acre site located on the southwest corner of Redwood Drive and Martin Avenue (APN 143 - 040 -094 and -108) from Industrial to Regional Commercial, as depicted on the map attached hereto as (Exhibit "A ") and by reference thereto incorporated herein. DULY AND REGULARLY ADOPTED on this 27th day of September, 2005, by the City of Rohnert Park City Council.
