2005/11/08 City Council Resolution (9)RESOLUTION NO. 2005 -333 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING AMENDMENT NO.2 TO COLLECTION SERVICES AGREEMENT BETWEEN THE CITY OF ROHNERT PARK AND ROHNERT PARK DISPOSAL WHEREAS, the stadium site is being demolished and no longer available for Fall and Spring Clean -ups; and WHEREAS, there is no other alternate site for the clean -ups; and WHEREAS, the existing agreement between the City and Rohnert Park Disposal, the contractor, includes community clean -up services; and WHEREAS, the City has asked the contractor to develop a curbside clean -up program to replace the community clean -up. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve the amendment to the Collection Services Agreement regarding community clean -up services. BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to execute documents pertaining same for and on behalf of the City of Rohnert Park, DULY AND REGULARLY ADOPTED this date of 8th day of November, 2005. Now, THEREFORE, the City and RP Disposal agree as follows: Section 5 Article 5.2.2 is hereby deleted and replaced by the following Article. 5.2.2 Community Clean -up Services Contractor shall conduct two (2) one week curbside cleanup events each year, one during the spring, and one in the fail. The dates for the cleanups shall be proposed by the Contractor and approved by the City Manager. Contractor shall pick up authorized cleanup items from all single -family customers at the curbside and properly dispose of such waste. The Sonoma County Waste Management Agency provides ten (10) free disposal days per year to the City so there will be no additional cost to customers. Single- family living units may place two (2) cubic yards (14 bags, boxes or regular trash cans) at the curb per event, or one Bulky Item or Appliance (e,g. water heater or couch) plus seven (7) bags, boxes or cans, or two Bulky Items or appliances. Waste will be collected on customer's regular trash collection day. As appropriate, items are to be bagged in thirty -five (35) gallon size trash bags, boxed or placed in 32 -gallon trash cans provided by the customer. Items set at the curb for these cleanups must weight less than 50 pounds (except for Bulky items), be less than 5 feet long and be capable of being easily loaded into standard garbage packer trucks. Cleanup material shall not include dirt, rock, concrete, tires or stumps. No hazardous waste will be collected curbside. Loose material will not be collected. During cleanup events, customers may make an appointment with Contractor for the collection of used appliances (e.g. washers, dryers, stoves, refrigerators, freezers, etc.) and bulky items (couches, mattresses, etc). In the case of pick up of appliances containing Freon, mercury switches, compressor oil, capacitors or other controlled hazardous waste, the City will be responsible for the costs associated with removal of Freon or other hazardous waste. The Contractor will coordinate with a licensed entity for the removal of the hazardous waste and bill the City for costs.
