2004/04/27 City Council Resolution (13)RESOLUTION NO. 2004-97 A RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATES' STATEMENTS WHEREAS, the governing body of any local agency is required to adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs of the candidate's statement. WHEREAS, the City has received petitions for the recall of two Council Members; and WHEREAS, the City Council has scheduled a special election to be conducted on August 24, 2004; and WHEREAS, Elections Code Section 11327 provides that an officer whose recall is being sought may file a statement with the elections official and candidates may submit statements as well; and WHEREAS, Elections Code Section 13307 requires that the candidate statement shall be filed in the office of the elections official no later than the 88`'' day before the election, if it is for an election for which nomination papers are not required to be filed; and WHEREAS, the City of Rohnert Park will also conduct a general municipal election on November 2, 2004; and WHEREAS, the candidates in the November 2, 2004, election will also have the ability to submit candidates' statements; NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Rohnert Park does hereby resolve, declare, determine and order as follows: 1. Each candidate for elective office may prepare a candidate's statement on an appropriate form provided by the City Clerk. 2. The officer to be recalled shall file the candidate's statement no later than 5:00 p.m. on May 28, 2004 which is the 88t" day prior to the special recall election. The candidate to succeed the term of an officer shall file the candidate's statement at the time of filing nomination papers according to nomination process calendar provided upon issuance of nomination papers. 4. The candidate's statement may include the name, age (optional), and occupation of the candidate and a brief description of no more than 200 words describing the candidate's education and qualifications, expressed by the candidate himself or herself. 5. The statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. 4. The candidate shall not be required to pay for the cost of printing the candidate's statement in English. 5. The candidate shall be required to pay for the cost of printing the candidate's statement into any foreign language, as specified pursuant to State and/or Federal law, and shall pay for this in advance at the time of the filing of nomination papers. Reso. No. 2004 -97 (Page 2 of 2) b. The City Clerk shall provide each candidate a copy of this Resolution at the time nomination petitions are issued. 7. This Resolution shall apply at the special election to be held within the City of Rohnert Park on Tuesday, August 24, 2004, and the general municipal election to be held within the City of Rohnert Park on Tuesday, November 2, 2004.
