Adopting the 2004
Department of Public Safety - Fire Services Division Fee Schedule
WHEREAS, the City of Rohnert Park, Department of Public Safety — Fire Services
Division has conducted a review of the current fee schedule, the beneficiaries of those
services, and the revenues produced by those fees and charges, and
WHEREAS, the City of Rohnert Park Department of Public Safety —Fire Services
Division finds that it must charge fees to cover the cost of fire prevention services which
the City must provide. to ensure compliance for which the City has the responsibility to
enforce in accordance with all applicable ordinances codes, regulations and or laws;
and
WHEREAS, the Department of Public Safety — Fire Services Division desires to
establish a policy of recovering the costs reasonably borne for providing fire prevention
services, such that general taxes are not diverted from general services on a broad
scale; and
WHEREAS, the Department of Public Safety — Fire Services Division finds that there
is a reasonable relationship between the amount of the fees charged and the services
performed; and
WHEREAS, all plan reviews, construction inspections and code enforcement
inspections required by the Uniform Fire Code, Rohnert Park City ordinance or the
California office of the State Fire Marshal may be subject to the adopted user fees; and
WHEREAS, no fee on the schedule exceeds the costs reasonably borne by the
Department of Public Safety in providing the service or enforcement of applicable codes
or regulations for which the fee is charged; and
WHEREAS, all requirements of California Government Code Sections 66016, 66017,
66018 and other applicable laws are hereby found to have been complied with; and
WHEREAS, any modification of the existing fee schedule imposed and adopted may
be modified annually by resolution from the City Council.
THEREFORE, THE CITY COUNCIL OF THE CITY OF ROHNERT PARK DOES
RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
The following fee schedule titled, the Rohnert Park Department of Public Safety — Fire
Services Division 2004 Fee Schedule, and any associated charges are hereby directed
to be computed and applied by the Department of Public Safety — Fire Services Division
for the listed fire prevention services when provided by the Department of Public Safety
— Fire Services Division or its designated contractors.

All fees set by this resolution are for each identified service; additional fees shall be
required for each additional service that is required or requested. Should there be a
conflict between two applicable fees to the same service, the lower dollar amount of the
two shall be applied.
If in question, this resolution may be interpreted by the Director of the Department of
Public Safety or a duly authorized representative thereof.
If any portion of the Resolution is held to be invalid or unconstitutional by any court or
competent jurisdiction, such decision shall not affect the validity of the remaining
portions and all other portions shall remain in full force and effect.
The adoption of this Resolution, including the fees and charges provided herein, is
statutorily exempt from the California Environmental Quality Act under Public Recourses
Cost Section 21080(b)(8), as the establishment and modification of charges by a public
agency to meet operating expenses.
BE IT FURTHER RESOLVED that the 2004 fee schedule set forth in this resolution,
shall be effective from and after the adoption of this resolution and all existing Fire
Division fees for the Department of Public Safety, current or past, are hereby rescinded.
DULY AND REGULARLY ADOPTED by the City Council of the City of Rohnert Park

• All hourly rate charges are for a I hour minimum and .5 thereafter,
• The fees listed are for typical plan review and inspection. If additional inspections are necessary due to non - compliance or excessive
problems during the process, additional charges will be assessed at the minimum hourly rate.
Fire Alarm and Fire Sprinkler plans shall be submitted directly to the Department of Public Safety. All plans should be accompanied by a
plan review application. All fees should be submitted with the plans. Reviewed plans will not be returned as approved until all fees are
paid.
(1) The City ofRohnert Park reserves the right to, and may at any time, send plans submitted to this department for review, out to an
independent plan review firm of their choice. The cost of the review will be the responsibility of the individual who has submitted the plans. The
cost of the outside plan review will be subtracted from the balance owed at the time of final billing. Individuals submitting plans for review will
be notified at the time ofsubmittal if an outside f rm will review plans.

• Commercial business inspections are charged at a rate of $40.00 for the first hour and every .5 of an hour
thereafter. This charge includes one re- inspection to verify compliance if items were found to require
correction on the first visit. if items remain outstanding on the re- inspection, a fee of $40.00 per hour will be
charged for follow -up visits until corrections are completed.

gallons they must comply with the requirements of SB2985, enforced by the Sonoma County Department of
Emergency Services. if a business generates any quantity of a material listed as a hazardous waste, they
must comply with the requirements of the waste program enforced by the Sonoma County Department of
Emergency Services.

that the nature of the business includes one or more of the following and has
been determined to constitute a high hazard. - The cost of the permit is in
addition to the annual inspection fee. Currently only businesses having materials

15.28.7804.1.1 Section 7804.1.1 added -- Application for permit.
Section 7804.1.1 is added to the California Fire Code to read as follows:
All applications for permits to sell state - approved fireworks shall be in writing to the Fire
Chief. Applications may be filed beginning the first day of April of each year up to and
through the end of the work day of the last day of May of the same year, at which time the
filing period for that year will be closed. Applications shall set forth the proposed location of
the fireworks stand being applied for, and other information as may be required by the Fire
Chief.
Applications shall be accompanied by an assurance that, if the permit is issued to the
applicant, the applicant shall, at the time of receipt of such a permit, deliver to the Fire
Chief a one hundred thousand /three hundred thousand dollar public liability, fifty thousand
dollar property damage and one million dollar products liability insurance coverage, with
riders attached to the policies designating the City of Rohnert Park, it's officers, agents,
and employees.as an additional insured there under. No policy will be acceptable which
contains a provision allowing a deductible amount.
A copy of the requisite State retail sales permit from the Office of the California State Fire
Marshal must also be attached.
Every application for a permit to sell state - approved fireworks shall state the zoning of the
real property on which the fireworks stand is to be located, which zoning classification shall
be determined by and filled -in by the City Planning Department of the City of Rohnert Park.
Applicants for such permits shall be notified by June 22 of each calendar year by the Fire
Chief of the approval or disapproval of such applications for such permit. All organizations
whose applications have been approved shall receive their permit at the time their
fireworks booth passes a required fire inspection.
Every application for a permit shall be accompanied by a non - refundable application fee
established by resolution of the City Council. This application fee shall be in addition to any
fee or tax imposed by this chapter or by City Council resolution. In addition to all other fees
imposed, the applicants may be required to pay each year, to the City, a portion of costs
incurred for enhanced public education and compliance. Said amount to be determined by
resolution of the City Council.
Every application shall set forth the proposed location of the fireworks stand, the name,
address and telephone number of one or more responsible adults who will be in charge of
and responsible for the fireworks stand during the period state - approved fireworks are
sold, displayed or stored at such location, and written permission from the owner of record
and /or lesser of record of the property (whichever is controlling) upon which said proposed
stand will be located.
Every application shall set forth the proposed location of night storage. The continued
validity of any City of Rohnert Park permit issued pursuant to this chapter shall be subject
to the requirement that at least one or more representatives of each nonprofit organization
shall attend a state - approved fireworks stand operator safety seminar conducted by the
Fire Department and /or the licensed fireworks wholesaler that is supplying the state -
approved fireworks to the non - profit organization. The failure of a non - profit organization to
have a responsible individual(s) attend the safety seminar shall result in the revocation of
its permit to sell state - approved fireworks.
