2004/05/25 City Council Resolution (5)RESOLUTION NO. 2004 -124 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING AND APPROVING A VACANT LAND PURCHASE AGREEMENT FOR AN 18 -ACRE PARCEL LOCATED IMMEDIATELY NORTH OF THE CITY LIMITS, ASSESSOR'S PARCEL NO. 045-041-018 WHEREAS, an opportunity exists to purchase Assessor's Parcel No. 045- 041 -018, an 18 -acre parcel located outside the City's Urban Growth Boundary immediately north of the City Limits and in a community separator; and WHEREAS, the purpose of purchasing this parcel would be to preserve open space and to create a wetland mitigation bank; and WHEREAS, the City obtained an appraisal from Anthony Mills which verified that the proposed $475,000 purchase price is a fair market value for this property; and WHEREAS, the Interim City Attorney has reviewed the Purchase Agreement and found that there were no legal issues identified with the standard form agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve a Purchase Agreement for vacant land of that certain rural 18.21 acre parcel located immediately north of the City Limits and known as Assessor's Parcel No. 045- 041 -018, subject to negotiation of final terms by the City Manager for an amount not to exceed $475,000 using funds from the General Fund Endowment Reserve for the purchase of this parcel. BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to sign the Purchase Agreement and to execute any and all other relative documents necessary to complete the purchase of the property.
