2004/10/12 City Council ResolutionRESOLUTION NO. 2004 -260 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING A POLICY REGARDING THE EXTENSION OF CITY SERVICES TO PROPERTIES LOCATED OUTSIDE THE ROHNERT PARK CITY LIMITS WHEREAS, the City occasionally receives requests from the owners of properties located outside of the City Limits of Rohnert Park to connect to City utility services; WHEREAS, there is currently no formal policy regarding such extension requests and Staff has recommended that one be established to help evaluate similar requests in the future; WHEREAS, Staff has prepared a draft policy that reflects the requirements of the Local Agency Formation Commission (LAFCO) regarding the extension of services to areas outside a City's current service area, WHEREAS, Pursuant to Public Resources Code 21065 and CEQA Guidelines Section 15061, the proposed policy regarding the extension of City Services to properties located outside the Rohnert Park City Limits is not a project subject to the California Environmental Quality Act, as it would result in no increase in the use of a given property and thereby have no foreseeable direct impact upon the enviromnent; WHEREAS, on October 12, 2004, the City Council of the City of Rohnert Park reviewed and considered the information contained in the Staff Report and all relevant materials regarding the proposed policy regarding the extension of City Services to properties located outside the Rohnert Park City Limits. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park - that the following policy be used to assess requests for the extension of City Services to properties located outside the Rohnert Park City Limits: "The City of Rohnert Park may extend City services to properties outside of the City Limits and the City's Service Area, provided the following conditions exist: a. there is an existing or impending threat to the public health and safety; b. the area to be served is contiguous to the City Limits and is within the City's Sphere of Influence; c. the service systein capacity is adequate to allow the extension; d. the service extension would be consistent with the Sonoma County General Plan; and e. the service extension would be limited to a size that would meet the area's existing need for that service and would not result in any growth- inducing impacts."
