A RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK
SETTING SOLID WASTE DISPOSAL OR REFUSE COLLECTION RATES
WHEREAS, A public hearing was held on July 23, 2002 to consider these rate
changes, and a notice (attached to this resolution) was sent to all refuse collection customers
and to all owners of property; and
WHEREAS, No written or oral protests to the proposed rate changes were received
by the City Council; and
WHEREAS, The City's Agreement with Rohnert Park Disposal, which was first
approved by Resolution 2001 -32, adopted on February 13, 2001, requires that the City
establish rates at an amount reasonably estimated to produce revenues sufficient to provide
payment to Rohnert Park Disposal in accordance with the annual amounts due Contract Agent
per their Agreement; and
WHEREAS, Waste Consultants Hilton Farnkopf & Hobson conducted a Residential
and Commercial Refuse Rate Review, and determined that certain residential and commercial
rates could be reduced due to the lesser cost of the new Rohnert Park Disposal Agreement;
and that other commercial rates should be increased to make rates more progressive and fair
among various rate payers, and to provide financial incentives for customers to recycle and
reduce waste disposal; and
WHEREAS, members of city staff have carefully reviewed the refuse rates proposed
by Hilton Farnkopf & Hobson and have determined that the proposed rates are sufficient to
make payment to Contract Agent in accordance with Contract Agent Agreement, and said
rates promote the waste diversion goals of the City, and as City Council Members thoroughly
reviewed the proposed refuse rates with -City staff and Consultant in a Refuse Rate Study
Session on May 28, 2002; and
WHEREAS, that last adjustment of rates charged to city customers for this service
occurred on either March 1, 2000 or February 1, 2000 depending upon the type of user; and
NOW THEREFORE, BE IT HEREBY RESOLVED by the Rohnert Park City
Council as follows:
Any persons from whom solid waste, rubbish, refuse, yard waste and /or recycling
materials is collected under the provisions of this article shall pay to the City the following
fees for such services:
A. Single Family Residences — Cart Service - Households may select a 20, 32, 68, or 95
gallon automated refuse container service. At no additional cost (included in refuse
rates and required by State to achieve 50% waste diversion) households are
automatically provided a 95 gallon green yard waste cart for collection of
uncontaminated green waste, grass, leaves and wood, and a 95 gallon blue recycling
cart for collection of uncontaminated recyclables such as cans, bottles, plastics, paper,
and cardboard. Rates include weekly collection of refuse, yard waste and recyclables
placed at the curb for pick up.
(1) For the 20 gallon container service, the monthly charge shall be $4.50 that
shall include all solid waste, rubbish, and refuse which has been placed within
the 20 gallon receptacle with the receptacle placed at the curb for pick up.
(2) For the 32 gallon container service, the monthly charge shall be $8.25 that
shall include all solid waste, rubbish, and refuse which has been placed within
the 32 gallon receptacle with the receptacle placed at the curb for pick up.
(3) For the 68 gallon container service, the monthly charge shall be $11.95 that
shall include all solid waste, rubbish, and refuse which has been placed within
the 68 gallon receptacle with the receptacle placed at the curb for pick up.
(4) For the 95 gallon container service the monthly charge shall be $18.68 that
shall include all solid waste, rubbish and refuse which has been placed within
the receptacles with the receptacles placed at the curb for pick up.
(5) There shall be a charge of $5.00 for each additional bag of refuse placed
outside the container.
(6) There shall be a charge of $15.00 per container for contaminated yard waste or
recycling materials.
(7) Customer may change container size one time per year at no cost. There shall
be a $5.00 charge for each additional change of container size per year.
B. Commercial and Multi - Family Complexes — Cart Service. The City may require, at its
sole discretion, the use of bins furnished by the Contract Agent for refuse and
recycling collection at any commercial establishment or multi - family complex. For
multi - family complexes, rates are based on total number of apartments, complex units
(duplex, triplex), condominiums or mobile homes, whether occupied or vacant, subject
to the following provisions:
(1) For those households or businesses that City determines may best be collected
by residential cart service, customers may select a 20, 32, 68, or 95 gallon
automated refuse container service. At no additional cost (included in refuse
rates and required by State to achieve 50% waste diversion) households are
automatically provided a green yard waste cart for collection of
uncontaminated green waste, grass, leaves and wood, and a blue recycling cart
for collection of uncontaminated recyclables such as cans, bottles, plastics,
paper, and cardboard. Rates include weekly collection of refuse, yard waste
and recyclables placed at the curb for pick up.
(2) For the 20 gallon container service, the monthly charge shall be $4.50- that

(5) For the 95 gallon container service the monthly charge shall be $18.68 that
shall include all solid waste, rubbish and refuse which has been placed within
the receptacles with the receptacles placed at the curb for pick up.
(6) There shall be a charge of $5.00 for each additional bag of refuse placed
outside the container.
(7) There shall be a charge of $15.00 per container for contaminated yard waste or
recycling materials.
(8) Customer may change container size one time per year at no cost. There shall
be a $5.00 charge for each additional change of container size per year.
(9) If the entire premises (all units) is unoccupied, no charge is made.
(C) Commercial Businesses and Multi-Family Complexes — Bin Service. The City may
require, at its sole discretion, the use of bins, furnished by the Contract Agent, for any
commercial establishment or multi - family complexes. For Multi - Family complexes,
rates are based on total number of apartments, complex units (duplex, triplex, etc.),
condominiums or mobile homes, whether occupied or vacant. At no additional cost
(included in refuse rates and required by State to achieve 50% waste diversion)
businesses and multi - family complexes are provided blue recycling bins for
aodection
of uncontaminated recyclables such as cans, bottles, plastics, paper,
-,yard waste - -containers are avai=lable free upon request: -Rates include-'Weekly collection
of refuse, yard waste and recyclables placed in bins. When bins are used to provide
Commercial and Multi- Family refuse services, the following rates shall be charged:

(5) Where a complete bin is not regularly utilized, the rate may be adjusted with the
consent of the City or costs divided for shared use. Where a type of bin service is
_._,
- provided `for -which no rate rs provided by this Resolution; a comparable rate (based
upon a cost of $38.15 per cubic yard) may be established by the City.
(6) All businesses conducted in a residence must pay the commercial refuse rate for all
solid waste, rubbish and refuse collected.
(7) The City shall have the right to require that multi - family complexes, condominiums,
planned developments and other multi - family residential units utilize bins for the
collection of solid waste, rubbish and refuse.
(D) Mobile Home Parks. The owners of all mobile home parks shall pay charges of $6.40
per unit. At no additional cost (included in refuse rates and required by State to
achieve 50% waste diversion) households are automatically provided green yard waste
cart for collection of uncontaminated green waste, grass, leaves and wood, and a blue
recycling can /cart for collection of uncontaminated recyclables such as cans, bottles,
plastics, paper, and cardboard. Rates include weekly collection of refuse, yard waste
and recyclables placed at the curb for pick up.
(E) Special Collections. For a special collection of rubbish or refuse, there shall be a
charge of $38.15 for each cubic yard or fraction thereof. A special collection of
rubbish shall consist of any collection not included within the established monthly rate
and shall include any bulky items which cannot be placed within the regularly used
collection receptacle.
(F) Commercial Compactor. Compacted solid waste collected from commercial
compactors operated by large industrial or commercial enterprises shall be charged for
refuse collection for each pull or collection of refuse plus the disposal fee charged by
central landfill for the load (Tons X Current Compactor Rate Per Ton As Set by
County of Sonoma) as shown below. County of Sonoma revises disposal rates
annually effective January Is'. County Compactor Disposal Rate for calendar year
2002 is $46.75 per ton.

(G) Commercial Permanent Debris Boxes. Compacted solid waste collected from
permanent commercial debris boxes operated by large industrial or commercial
enterprises shall be charged for refuse collection for each pull or collection of refuse
plus the disposal fee charged by central landfill for the load (tons x current disposal
rate per ton as set by County of Sonoma) as shown below. County of Sonoma revises
disposal rates annually effective January 1st. County Debris Box Disposal Rates for
calendar year 2002 are $48.00 /ton for refuse, $ 12.00 /ton for wood waste, and
$28.00 /ton for sawdust.

(H) Free Services to the City. The Contract Agent shall provide free service to all City
owned facilities and bus stops.
(I) Effective Dates. The rates outlined in above Section A for Single Family residences
shall become effective September 1, 2002. The rates outlines in above sections B, C,
D, E, F, and G for multi - family residences and commercial businesses shall become
effective October 1, 2002.
DULY AND REGULARLY ADOPTED by the Rohnert Park City Council this
