2002/10/22 City Council Resolution (8)RESOLUTION NO. 2002- 949 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING A WASTE EDUCATION BUDGET FOR PRINTING, MATERIALS, ADVERTISING, DESIGN AND COMMUNITY CLEANUP COSTS TO BE ADMINISTERED BY ARCADIA MARKETING SERVICES WHEREAS, the State of California has, through enactment of state law AB 939, directed the responsible State Agency, and all local agencies to promote diversion, to maximize the use of feasible waste reduction, reuse, recycling, and composting options in order to reduce the amount of refuse that must be disposed of in disposal sites, and for the City to achieve diversion of 50% of the waste stream by December 31, 2003 (including the time extension granted to City); and WHEREAS, City of Rohnert Park must increase its rate of refuse diversion from the landfill from its current rate of less than 39% to 50% by the end of 2003 to comply with AB 939; and WHEREAS, City Council budgeted $100,000 for fiscal year 2002 -03 to provide recycling education consultants to help City meet AB 939 mandated diversion rates, City goals and its obligation under the Refuse Franchise Agreement with Rohnert Park Disposal (RPD) to provide ongoing education consultants during the full term of the Refuse Agreement; and WHEREAS, on August 27, 2002, the Rohnert Park City Council approved agreements with Arcadia Marketing Services (Resolution 2002 -209) to provide marketing, graphic design and education coordination services, and with C2 Alternative Services (Resolution 2002 -210) to provide one -on -one multifamily and commercial education in the field; and WHEREAS, City needs to budget additional funds for printing educational materials to disseminate, distributing Utility bill stuffers and advertising for Community Clean Ups, paying for media advertisements, purchasing other recycling education materials, translating materials into Spanish, and designing additional pieces required by the consultants to carry out their education programs during fiscal year 2002/03; and WHEREAS, the estimated costs of education materials and printing, which are $55,000, have been previously collected through rates, and are currently held in the Garbage Utility Fund Diversion/Education Set -Aside Fund, in addition to other solid waste education funds previously budgeted for 2002/03 and 2003/04, and said funds may only be used for solid waste education or diversion purposes; and NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Rohnert Park that $55,000 in funds held in the Garbage Utility Fund Commercial and Diversion/Education Set Aside Fund be approved for expenditure for waste education printing and materials as specified in the budget to be administered by Arcadia Marketing Services as part of their contract. CITY ARK ATTEST: MACKENZIE: AYE THE CITY OF RO � R P Mayor REILLY: ,AYE VACANXi'N/A VIDAK- MARTINEZ: AYE FLORES: AYE AYES: (4) NOES: (0) ABSENT: (0) ABSTAIN: (0) RESOLUTION NO. 2002- 250 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING AND AUTHORIZING CITY MANAGER REVIEW ROHNERT PARK DISPOSAL WITH HILTON FARNKOPF & HOBSON T O EV COMPANY'S APPLICATION FOR YEAR THREE COMPENSATION ADJUSTMENT WHEREAS, at its regular meeting on February 13, 2001, the Rohnert Park City Council selected Rohnert Park Disposal as the City's new refuse service provider, and the Mayor signed- the new Rohnert Park Disposal Refuse Agreement, which became effective on July 1, 2001; and WHEREAS, maximum annual compensation for Rohnert Park Disposal (RPD) is determined per the Refuse Agreement as follows; 1) Years One and Two are paid at a fixed amount of compensation based on the original RPD bid proposal; 2) Years Three, rov din actual require hauler to submit a detailed Application he City to conduct an in depth review of hauler data and projected income and expenses, and fort Y Five, submitted to determine appropriate compensation; and 3) Compensation for Years Four, Seven, Eight and Ten (if Agreement is extended beyond seven years) is calculated based on a formula which includes a portion of the percentage of the cost of living increase for the prior year for costs other than disposal, and actual percentage increase of disposal costs; and WHEREAS, Rohnert Park Disposal must submit a detailed application for a compensation adjustment for Year 3 on December 1, 2002, and the Refuse Agreement provides for an in depth review of their actual first year and projected Years Two and Three income and expenses to determine the amount of compensation due them for Year Three, an WHEREAS, City requires consulting services to review and analyze all the data submitted in Rohnert Park Disposal's Application for Compensation Adjustment, determine the appropriate maximum compensation per Refuse Agreement for Year Three, and review City refuse rates to insure they are adequate to pay hauler the required contract compensation and reimburse City for billing and contract administration costs, franchise fees and education/diversion fees; and WHEREAS, City Council finds that conducting a compensation review in accordance with the Refuse Agreement is in the best interest of the refuse rate payers; and WHEREAS, the Consultant is well qualified and experienced to provide such review services, has extensive knowledge of City of Rohnert Park Refuse Agreement and requirements from conducting City's procurement process and preparing the Agreement, and is experienced in working with North Bay Corporation staff and financial system from conducting similar reviews for other cities. WHEREAS, funds which have been set aside from refuse rates in the Utility Rate Stabilization Fund are available to pay review costs in an amount not to exceed $50,000; and NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Rohnert Park that the Agreement between Hilton Farnkopf & Hobson and the City of Rohnert Park to provide consulting services to review the Rohnert Park Disposal application for compensation and recommend revised refuse rates at a cost not to exceed $50,000.00 is hereby approved; and BE IT FURTHER RESOLVED, by the City Council of the City of Rohnert Park that the Rohnert Park City Manager is hereby authorized to sign the Agreement on behalf of City.
