APPROVAL OF SCOPE OF WORK AND FEE ESTIMATE
FOR WINZLER & KELLY TO DEVELOP
CITY STORM WATER MANAGEMENT PROGRAM
WHEREAS, the City is required by the U.S. EPA to meet the National Pollution
Discharge Elimination System (NPDES) Storm Water Phase II Rule and to submit a Storm
Water Management Plan by March 10, 2003; and
WHEREAS, Winzler & Kelly was selected and approved by Council on December 19,
2002 to perform city engineering services for the City.
NOW, THEREFORE, the scope of services and fee estimate provided by Winzler &
Kelly Engineers in a letter proposal dated January 15, 2003, has been reviewed and accepted by
the Public Works Manager. Said proposal is approved by the Council and authorization to
proceed with the work is hereby granted.

Dear Bill:
Winzler & Kelly Consulting Engineers ( Winzler & Kelly) is pleased to present this Proposal to
the City for the preparation of its NPDES Phase II Storm Water Permit Application and the
development of the City's Storm Water Management Program. For purposes of this Proposal, it
is presumed that the City will be obtaining a General Permit for Phase H communities.
Background
According to the Draft General Permit for Storm Water Discharges from Small Municipal
Separate Storm Sewer Systems (1\4S4s) obtained from the Regional Board, the permitting
authority for the Phase II NPDES program, the City is designated as a regulated Small MS4. To
be in compliance with the NPDES Phase H regulations, Small MS4s are required to file a Notice
of Intent (NOI), submittal of the City's Storm Water Management Plan Summary Outline and
payment of permit fees by March 10, 2003.
Project Team
The key team members proposed for this work are shown below. Both team members are
currently preparing storm water programs for four other Small MS4s in Sonoma County.
Toni Bertolero, Project Manager
Toni has over 20 years of experience in municipal civil engineering. She currently holds the title
of City Engineer for the cities of Cotati and Rohnert Park and has held the title with the City of
Benicia. In that regard, Toni understands the needs of small municipalities and is responsive to
those needs. Toni developed the City of Benicia's Storm Water Pollution Prevention Program for
construction activities, the City's Corporation Yard and the Wastewater Treatment Plant. The
City's Program also included various best management practices (BMPs) such as public
education, erosion control measures for grading activities, and storm water monitoring.

Teresa Adams Burke, Environmental Scientist
Teresa has over eight years of experience as an environmental scientist and project manager in
the environmental consulting industry. Her experience includes the preparation of Stormwater
Pollution Prevention Plans and Spill Prevention Countermeasure and Control Plans for various
industrial facilities. She managed a pollution prevention assessment program for the State of
New Mexico, which analyzed the operations of small businesses, developed cost - effective
alternatives to waste - generating practices, and assisted the businesses with implementing BMPs.
Teresa has worked with a wide spectrum of clients, from private individuals to corporations,
financial institutions, attorneys, major oil companies, and numerous municipalities. She has also
worked with many regulatory agencies, including county health departments and the Regional
Water Boards.
Vicki Shidell, Water Quality Specialist
Vicki's role will be to perform quality control/quality assurance for the Storm Water
Management Plan. Vicki has been the water quality specialist for the City of Benicia and has
performed in that role for about 13 years. Vicki is in charge of Benicia's storm water program
and has developed and monitored that program for a number of years. Vicki has worked
alongside with Selina Louie with the SF Bay Regional Water Quality Control Board and
provides good insight as to what the Board staff will want to see in the program.
Scope of Work
Task 1— Review of Documents, City Procedures and Existing Program
This initial task is the gathering of existing data, documents and review of what the City is
already doing in the area of storm water management and pollution control. This task is
necessary to understand what the City is already doing and taking advantage of existing
procedures and practices when developing the Storm Water Management Program. Example
data needs include the City's General Plan, Land Use Map, CEQA checklist, current erosion
control ordinance, grading ordinance and City organization chart.
Task 2 — Develop. Program Purpose and Goals
Winzler & Kelly will assist the City in the development of purpose and goals for the Program.
The requirements of the Phase H Final Rule state that the purpose and goals of any Phase II
storm water program should include the following elements:
The development and implementation of a Storm Water Management Program;
The reduction of the discharge of pollutants to the "maximum extent practicable" (MEP);
Protection of water quality; and
Satisfaction of the appropriate water quality requirements of the Clean Water Act.

This task will necessitate the involvement of City staff from multiple departments in several
meetings with Winzler & Kelly staff. The development of goals will be based on identified
issues and problems (such as storm water quality and pollutant discharges), which should be
discovered through discussions and interviews with City employees and even local citizens, as
appropriate.
Task 3 — Identify BMPs to Address Each Minimum Control Measure
Once the goals of the program are developed and the RWQCB's priorities are identified, Winzler
& Kelly will assist the City in identifying and determining BMPs for selection within each of the
minimum control measures to address the goals identified in Task 1. The minimum control
measures developed under this task are shown below:

Public Involvement and Participation
Illicit Connection Detection and Elimination
Construction Site Storm Water Runoff Control
Post- Construction Storm Water Management in Development
Pollution Prevention/Good Housekeeping of Municipal Operations
Following the development of a select list of BMPs from these six categories, Winzler & Kelly,
will help the City prioritize the list to those BMPs that address local storm water issues in the
most cost - effective and feasible manner. Once the list has been narrowed down, Winzler & Kelly
will develop costs and resource needs for each of the BMPs, as well as estimates of pollution
reduction.
Task 4 — Identify and Establish Roles and Responsibilities for BMP Implementation
Winzler & Kelly will work with the City to identify the appropriate personnel resources for the
team. If desired, Winzler & Kelly will assist in identifying other MS4s who may want to team
with the City to pool efforts in implementation of specific BMPs. Teaming with other MS4s for
this purpose is an approach that can be used to reduce costs and maximize the use of available
resources.
Task 5 - Develop Schedule for Implementation
Winzler & Kelly will work with the City to develop a schedule of implementation for the BMPs.
The schedule(s) developed with the City will consider the scope of the project or program within
which the BMP or BMPs are being implemented, as well as the financial and personnel resources
of the City.

Task 6 — Permitting
Winzler & Kelly will meet with City staff and the Regional Board to identify the minimum
requirements the Regional Board will impart on the City in the preparation of their Phase II
Permit Application. This step will, with the purpose and goals, help to identify the priorities of
the storm water management program. This task includes completing the NOI for City's
approval and preparation of the Storm Water Management Plan. The City will submit the
completed NOI, the Storm Water Management Plan and pay applicable permit fees. The Storm
Water Management Plan will be in the format developed by Selina Louie of the Regional Board
entitled Phase II Guidelines.
Task 7 — Project Management /Coordination/Meetings
This task includes one kickoff meeting with the City and Winzler & Kelly, monthly progress
reports and meetings with City staff. This task also includes the preparation of the Project Work
Plan. The Work Plan will include a list of the deliverables and a schedule of the work. This task
includes up to two (2) public meetings to develop goals and to identify and select BMPs. City
will provide all noticing requirements for the public meetings.
Estimated Fees
The estimated fee for the scope of work described above is $25,000. A copy of the detailed
spreadsheet is attached to this proposal.
Schedule of Work
The NOI and the Storm Water Management Plan is due to the RWQCB on March 10, 2003. The
scope of work, as identified above, will be completed by late June, 2003. This schedule is fairly
aggressive and presumes that meeting(s) with the Regional Board staff, City staff, and the public
can be scheduled in a timely manner; documents requested are provided in a reasonable period of
time; and City reviews are performed judiciously.

Permit Application and the development of a storm water management program that will allow
the City to meet the requirements of the Phase II NPDES regulations.

Miscellaneous In-House S .rvices
The cost of using equipment and specialized supplies is billed on the basis of employee hours
dedicated to projects. This method is less costly, but less precise, than billing on the basis of "units of
service." We strive to maintain fair and competitive rates, designed to recover our investment in these
items which bring increased efficiency to employee labor. Instead of billing one rate with no regard to
the types of projects, we have opted to apply four separate rates, such that only those projects utilizing
certain types of equipment are charged. Our rates are:

Winzler & Kelly is pleased to submit this letter proposal to provide the City with city
engineering services on an as- needed basis.
Currently both the City and Winzler & Kelly are working towards a formal agreement including
a scope and estimate of costs for services, which include capital improvement engineering,
development review, and general city engineering services. Until that agreement is finalized, the
City desires a temporary arrangement to ensure that the role of City Engineer is provided without
delay and that there is coverage for ongoing projects that require the immediate review and
oversight of the City Engineer.
Toni Bertolero will be assigned as the Interim City Engineer and will report to Bill Stephens, the
City's Public Works Manager. We acknowledge that the City wishes to. maximize the use of the
City's Engineering and Public Works staff and Toni will do so. At times, she may need to use
Winzler & Kelly technical staff for support services not available to her in the Engineering and
Public Works departments, and as approved by the Public Works Manager. It is estimated that
Toni will spend approximately one to two mornings (or afternoons) per week at the Rohnert Park
City Hall office and will be available to answer calls from the City at our Santa Rosa office. The
specific times will be coordinated with the Public Works Manager, .depending on the workload
and staff needs.
Winzler & Kelly is ready to commence with this arrangement, effective immediately, and upon
your approval. Attached is a copy of Winzler & Kelly's standard labor charges. Toni's standard
hourly rate is $125 per hour, however, for the City engineering services, her hourly rate will be
$95 per hour. We acknowledge that this hourly rate is open to negotiation of the engineering
services agreement that is ongoing.
