2003/04/22 City Council Resolution (2)RESOLU'T'ION NO. 2003-78 A RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING AND APPROVING IMPLEMENTATION OF A RETIREMENT SERVICE CREDIT PROGRAM WHEREAS, the City Council of the City of Rohnert Park approved Resolution 92 -74 which approved an amendment to its contract with the Public Employees' Retirement System to add two -year additional service credit for local miscellaneous members and local safety members; and WHEREAS, the City Council of the City of Rohnert Park did, with timely public notice, considered the Service Credit Program on its regular agenda on April 8, 2003 at which time additional employer contributions and the funding therefore were disclosed and members of the public had an opportunity to be heard; and WHEREAS, the City "met and conferred" jointly with representatives of each employee unit on April 14, 2003 pursuant to the Meyers Milias Brown Act and no alternatives to the proposed Service Credit Program were presented. BE IT RESOLVED by the City Council of the City of Rohnert Park that because of an impending curtailment of, or change in the manner of performing service, the best interests of the City of Rohnert Park would be served by granting two years of additional service credit to certain employees, regardless of credited service; and BE IT FURTHER RESOLVED by the City Council of the City of Rohnert Park that it elects to become subject to the provisions of Government Code Section 20903 because of impending mandatory transfers, demotions, and layoffs that would affect at least one percent of the employees in certain designated job classifications resulting from the curtailment of, or change in the manner of performing, its services; and BE IT FURTHER RESOLVED by the City Council of the City of Rohnert Park that it is its intention at the time Section 20903 becomes operative that any vacancies created by retirements under this Section will remain permanently unfilled thereby resulting in an overall reduction in the work force of the City; and BE IT FURTHER RESOLVED by the City Council of the City of Rohnert Park that employees, eligible for retirement according to the provisions of their respective Memorandum of Agreement or Outline, and in the following positions are eligible for the service credit: All classes of City positions except Public Safety Lt., Public Safety Sergeant, and Public Safety Officer because it is necessary to maintain these positions to assure adequate police and fire services and protect life and property. BE IT FURTHER RESOLVED by the City Council of the City of Rohnert Park that the service credit shall be offered only to employees who select to retire during the 92 -day period commencing on May 1, 2003 and concluding on July 31, 2003; Resolution No. 2003 -78 (Page 2 of 2) BE IT FURTHER RESOLVED by the City Council of the City of Rohnert Park that the Finance Director shall transmit to the retirement fund an amount that is equal to the actuarial equivalent of the difference between the allowance the member receives after the receipt of the service credit and the amount he or she would have received without that service credit and any administrative costs; BE IT FURTHER RESOLVED by the City Council of the City of Rohnert Park that it elects to make payment with respect to all eligible employees who retire during the specified period in full within 30 -days of the invoice from the California Public Employees Retirement System; BE IT FURTHER RESOLVED by the City Council of the City of Rohnert Park that it certifies that sufficient positions have been deleted whose total cost equals or exceeds the lump - sum actuarial costs of the additional service credits granted; and BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to execute same for and on behalf of the City of Rohnert Park.
