2003/06/24 City Council Resolution (15)RESOLUTION NO. 2003 - 158 A RESOLUTION OF THE CITY COUNCIL ACCEPTING THE QUITCLAIM DEED EXECUTED BY CROCKER HOMES, INC. AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CERTIFICATE OF ACCEPTANCE ON BEHALF OF THE CITY OF ROHNERT PARK WHEREAS, on April 24, 2003, the Planning Commission adopted Planning Commission Resolution 2003 -24 which made the finding of General Plan Conformity for the sale of the City property located south of Roberts Lake at 5000 Roberts Lake Road to a private developer for the purpose of converting an existing building into a restaurant; and WHEREAS, on May 13, 2003, the City Council adopted Resolution 2003 -110 authorizing Parcel Map No. 173 for the sale of Wine and Visitors Center. Parcel One (2.235 acres) of Parcel Map No. 173 included the Wine and Visitors Center, a portion of the Golf Course, Roberts Lake itself, and the adjacent park. Establishing Parcel One created a separate parcel to execute the sale of the Wine and Visitors Center; and WHEREAS, on May 13, 2003, the City Council adopted Resolution 2003 -111 approving an agreement for the purchase of the Wine and Visitors Center; and WHEREAS, during the course of executing the sale of the Wine and Visitors Center, a title search discovered an obsolete claim by Crocker Homes, Inc.; and WHEREAS, on September 12, 1977, the City Council adopted Resolution 1977 -158 approving a subdivision agreement with Crocker Homes to develop Mountain Shadows Subdivision, Unit No. 1. On September 8, 1980, the City Council adopted Resolution 1980 -155 recognizing the satisfactory completion of public improvements for the Mountain Shadows Subdivision, Unit No. 1. However, this resolution did not rescind Crocker Homes development rights for Subdivision, Unit No. 1. Since the subdivision has been developed, Crocker Homes no longer requires its development rights; and WHEREAS, on June 5, 2003, H. Arthur Nottingham, President of Crocker Homes, executed a Quitclaim Deed releasing his company's development rights to the Mountain Shadows Subdivision, Unit No. 1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it accepts the Quitclaim Deed executed by Crocker Homes and the City Manager is hereby authorized to execute a Certificate of Acceptance on behalf of the City of Rohnert Park.
