2003/07/22 City Council Resolution (10)RESOLUTION NO. 2003 -176 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING ALCOHOL PERMIT AND REGISTRATION PROGRAM IN CITY PARKS AND RECREATIONAL FACILITIES WHEREAS, the City Council of the City of Rohnert Park on June 24, 2003 approved Ordinance No. 698, amending section 9.34.020D of the City of Rohnert Park Municipal Code, Alcoholic Beverages; drinking and possession thereof prohibited in certain locations, and WHEREAS, Ordinance No. 698 as amended, prohibits possession or consumption of Alcoholic Beverages on any public park; and WHEREAS, Ordinance No. 698 allows the city manager or his or her designee to approve a permit that allows alcohol to be served in a public park, WHEREAS, the City Council understands that residents and organized groups may wish to partake in the responsible consumption of alcoholic beverages in city parks and recreational facilities and, BE IT RESOLVED by the City Council of the City of Rohnert Park as follows: SECTION ONE. The City Manager or his designee is hereby authorized to establish a permit approval program and to issue permits in accordance with the following standards: 1. The applicant for the permit is over the age of 21 and is applying for the permit on behalf of a group of people the majority of whom are over 21. 2. All information on the application is truthful. 3. The activity for which the permit is applied will not substantially disrupt the use of the park at a time when it is subject to traffic congestion, or potentially interferes with the operation of emergency vehicles in the proposed permit area. 4. The permit will be issued for a specific permit area. 5. Permits will not be granted for sporting events or activities primarily involving persons under the age of 21. 6. A permit shall not be issued if the proposed activity violates federal, state or local laws including licensing requirements. 7. A permit shall not be issued when the activity, when combined with the consumption of alcoholic beverages, poses a potential threat to health, safety and welfare of the park users. If any person is aggrieved by the denial of a permit pursuant to Rohnert Park Municipal Code 9.34.020D and this resolution, s /he shall have the right to appeal the determination of the official denying the permit to the City Manager.
