1970/03/16 City Council Resolution (5)JEL:vb 12002 RESOLUTION NO. 70- 41 A RESOLUTION DETERMINING THAT AND NECESSITY REQUIRE THE ACQ' LAND AND DIRECTING THE FILING PROCEEDINGS AVRAM AVENUE AND SANTA IMPROVEMENT PROJECT THE PUBLIC INTEREST JISITION OF CERTAIN OF EMINENT DOMAIN ALICIA DRIVE NO. 1969 -3 RESOLVED, by the City Council of the City of Rohnert Park, California, that, WHEREAS, it is the intention of this City Council to con- struct and maintain public streets and public utilities and work auxiliary thereto in and on the land hereinafter described, NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED as follows: 1. That the public interest and necessity require the acquisi- tion, construction and completion of public streets and public untilities and work auxiliary thereto, in, over, across and upon the parcels of land more particularly described in Exhibit "A ", attached hereto and by this reference made a part hereof, within said City of Rohnert Park, and the taking of the fee simple title for public street and public utility purposes in and to said parcels is necessary for said improvements. 2. That said proposed acquisitions and improvements are planned and located in the manner which will be most compatible with the greatest public good and the least private injury, and all of said acquisitions are situate within the City of Rohnert Park, County of Sonoma, State of California. 3. That Richard B. Maxwell, City Attorney of said City, and the law firm of Wilson, Jones, Morton & Lynch, attorneys for said city, be and they are hereby directed to institute and conduct to conclusion an action in eminent domain for the acquisition of the estates and interests aforesaid and to take such action as is necessary therein, and said law firm of Wilson, Jones, Morton & Lynch 1. shall be paid a reasonable fee therefor. 4. That an Order for Immediate Possession and Use be obtained in said action, and that a warrant be issued to the County Clerk, Sonoma County, California, in the amount determined by the Court to be so deposited, as a condition to the right of immediate possession. I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the City Council of the City of Rohnert Park, Sonoma County, California, at a meeting thereof held on the 16th day of March, 19 70, by the follow- ing vote of the members thereof: AYES, and in favor thereof, Councilmen: (4) Buchanan, Hopkins, Roberts, and Smith NOES, Councilmen: (0) None ABSENT, Councilmen: (1) Rogers Deputy City Jerk, r 2.
