1970/05/18 City Council Resolution (5)WJ1,1 &L: PDA :: .i: JS : p 5/6/70 10c RESOLUTION NO. 70 -69 A RESOLUTION DETERMINING UNPAID ASSESSMENTS AND PROVIDING FOR ISSUANCE OF BONDS AVRAM AVENUE AND SANTA ALICIA DRIVE IMPROVEMENT PROJECT NO. 1969 -3 RESOLVED, by the Council of the City of Rohnert Park, California, that, WHEREAS, this Council did, on October 6, 1969, pass and adopt its Resolution No. 69 -97, a Resolution of Intention to Acquire and Construct Improvements, under and pursuant to the provisions of the Municipal Improvement Act of 1913, and did therein provide that bonds would be issued pursuant to the provisions of the Improvement Act of 1911, reference to said Resolution of Intention and the pro- ceedings had subsequent thereto hereby being expressly made for further particulars; WHEREAS, notice of the recordation of the assessment and of the time within which assessments may be paid has been given in the manner provided by law, and the time so provided for receiving pay- ment of assessments has expired, and the City Clerk has filed with the City Treasurer a, list of all assessments which now remain unpaid; and WHEREAS, this Council has considered said list and has deter- mined that the same is an accurate statement thereof; NOW, THEREFORE, IT IS HEREBY ORDERED, as follows: 1. That the assessments now remaining unpaid, and the aggre- gate thereof, are as shown on said list and on Exhibit "A" hereto attached and by this reference made a part hereof. 2. That for a particular description of the lots or parcels of land bearing the respective assessment numbers set forth in said list, and upon which said assessments remain unpaid, severally and respectively, reference is hereby made to the assessment and to the diagram recorded in the office of the Superintendent of Streets of this City after confirmation by this Council, the several lots or parcels of land represented by said assessment numbers being so numbered and designated upon said diagram and assessment as so confirmed and recorded, severally and respectively. 3. The unpaid list is in the amount of $170,800.00, and bonds shall be issued upon the security of said unpaid assessments in said amount in accordance with the provisions of the Improvement Act of 1911, and under and pursuant to the provisions of said Re- solution of Intention and the proceedings thereunder duly had and taken. Said bonds shall be designated Series 1969 -3; shall be ten (10) in number; shall be dated May 273 1970; shall bear interest from their date at the rate of seven percent (7 %) per annum, repre- sented by coupons payable on January 2 and July 2 in each year, commencing January 2, 1971; shall each be in the amount of the un- paid assessment on the particular lot or parcel of land described therein; and, the principal of each shall mature in even annual amounts, represented by coupons, payable on January 2 in each of the years 1971 to 1985, inclusive. Said bonds shall bear a premium of five percent (5 %) of the unmatured principal thereof on call, and shall be made payable to bearer at the office of the Treasurer of Sonoma.. County, fiscal agent of the City and of its Treasurer. 4. Said bonds shall be signed by the City Treasurer and the coupons a.tta.ched thereto shall bear the Treasurer's engraved, printed or lithographed signature, and such signing shall consti- tute and be a. sufficient and binding execution of each and every one of said bonds and coupons thereof, respectively. Said bonds and coupons shall be substantially in the form provided in said Improvement Act of 1911, except the words "after the acceptance of said work" shall be deleted from the first sentence of the second paragraph of the bond form. The City Treasurer is hereby authorized and directed to sign said bonds and coupons. 5. The City Clerk shall forward certified copies of this re- solution to the City Treasurer and County Treasurer.
