1969/02/03 City Council Resolution (2)RESOLUTION NO. A RESOLUTION AMENDING RESOLUTION NO. 68 -45, A RESOLUTION OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVEMENTS CODDINGLAND UNIT 1 ASSESSMENT DISTRICT 1968 -1 RESOLVED, by the City Council of the City of Rohnert Park, California, that WHEREAS, the City Council of the City of Rohnert Park, Cali- fornia, did, on the 6th day of May, 1968, adopts its Resolution No. 68 -45, A Resolution of Intention to Acquire and Construct Improvements, which said resolution described the acquisitions and improvements to be made in said proceedings therein provided for; WHEREAS, subsequent thereto it has been determined that said acquisitions and improvements shall be made and done in several units; and WHEREAS, the description of the acquisitions and improvements in said Resolution of Intention must be modified to describe the acquisitions and improvements to be made in the first unit thereof; NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED and. ORDERED, as follows: 1. Section 4 of said. Resolution of Intention be amended. to read a.s follows: "4. The acquisitions and improvements are described as follows: (a) The acquisition of property necessary for for the opening of the southerly extension of Frontage Road from a point 3500 feet, more or less, southerly of Wilfred Avenue running thence southwesterly, southerly and southeasterly to a point on Frontage Road 3500 feet, more or less, northerly of Helman Avenue crossing Hime- baugh Creek at a point 900 feet, more or less, westerly of U.S. Highway 101 and the improvement thereof by clearing, grubbing, grading, removal of existing trees, shrubs, and structures and the construction therein of base, pavement, curbs, gutters, berms, tree planting, monuments, traffic striping, drainage ditches, culverts and surface and. subsurface storm drainage facilities where required and the construction of a vehicular bridge at Himebaugh Creek. (b) The construction of a sanitary sewer trunk, main manholes with manhole frames and covers, together with all appurtenances thereto, in an easement to be acquired from the existing City of Rohnert Park Sewer Plant generally located 3100 feet, more or less, sourtherly of Wilfred Avenue and 750 feet, more or less, westerly of U. S. Highway 101, running thence 4200 feet, more or less, southerly and generally parallel to said U. S. Highway 101 to a point approximately 300 feet northerly of the southerly boundary of Rohnert Park Annexation No.. 4, 740 feet, more or less, westerly of U. S. High- way 101. (c) The construction of a water supply and pump station, including pumps, pump house, pressure tank and all appurtenances thereto on property to be acquired and generally located 1000 feet, more or less, westerly of U. S. Highway 101 and adjacent to the southerly line Of Himebaugh Creek. (d) The acquisition of capacity rights and a right of service and use in sewage treatment and disposal facilities of the City of Rohnert Park on behalf of properties within the proposed assessment district, including the right to discharge sewage from said -2- district into and through main trunk interceptor and outfall sewers and. appurtenances of said City, and the right to have said sewage discharged from the area of the assessment district treated and disposed of in and through the disposal plant of said City and the acqui- sition of disposal capacity rights in said sewerage facilities and plant, together with the acquisition of capacity rights and a right of service and use in water supply, treatment and storage facilities of the City of Rohnert Park on behalf of properties within the proposed assessment district. (e) The acquisition of all lands and easements and the performing of all work auxiliary to any of the above necessary to complete the same." 2. Section 11 of said Resolution of Intention be amended to read as follows: "11. Said contemplated acquisitions and improvements, in the opinion of said Council, are of more than local or ordinary public benefit, and the costs and expenses thereof are made chargeable upon an assessment district, the exterior boundaries of which district are the com- posite and consolidated area as more particularly shown on a map thereof entitled, 'Proposed. Boundaries,, Cod. - dingland Unit 1 Assessment District 1968 -1, City of Rohnert Park, Sonoma County, State of California; on file in the office of the City Clerk to which reference is hereby made for further particulars. Said map in- dicates by a boundary line the extent of the territory included in the proposed. district and shall govern for all details as to the extent of the assessment district." -3- 3. Section 13 of said Resolution of Intention be amended to read, as follows: 9113. Notice is hereby given that serial bonds to re- present unpaid assessments, and bear interest at the rate of not to exceed seven percent (7 %) per annum, will be issued. hereunder in the manner provided by Division 7 of the Streets and. Highways Code, the Improvement Act of 1911, and. the last installment of such bonds shall mature not to exceed fourteen (14) years from the second day of January next succeeding the next September lst following their date. Said bonds shall be made payable to bearer and provide a premium of 5% of the unmatured principal thereof on call. The Council hereby elects that the first 1% penalty on said bonds shall be retained by the Treasurer and shall be charged as a cost of servicing the delinquency.1P 4. Section 19 is hereby added to said Resolution of Intention to read as follows: "19. The estimated cost of said. project is $465,140.94, of which the Sonoma. County Flood Control and Conservation District will contribute the estimated amount of $35,722.90 and the City of Rohnert Park will contribute the estimated amount of $15,186.97, leaving a balance to assessment of $414,231.07.99 -4- T hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the City Council of the City of Rohnert Park, Sonoma County, California, at a meeting thereof held on theme ay of ,196 -, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen:; DOES, Councilmen: c�' ABSENT, Councilmen: 6�� City Clerk Mayor
