(09- too A RESOLUTION DETERMINING UNPAID ASSESSMENTS AND PROVIDING FOR ISSUANCE OF BONDS CODDINGLAND UNIT 1 ASSESSMENT DISTRICT 1968-1 RESOLVED, by the City Council of the City of Rohnert Park, County of Sonoma, California, that WHEREAS, this Council did, on May 6, 1968, pass and adopt its Resolution No. 68-45, a Resolution of Intention to acquire and construct improvements in said City under and pursuant to the pro- visions of the Municipal Improvement Act of 1913, and did therein provide that bonds would be issued pursuant to the provisions of the Improvement Act of 1911, reference to said Resolution of Intention hereby being expressly made for further particulars; WHEREAS, notice of the recordation of the assessment and of the time within which assessments may be paid in cash has been given in the manner provided by law, and the time so provided for receiving payment of assessments in cash has expired, and the City Clerk has filed in the office of the City Treasurer a list of all assessments which now remain unpaid; and WHEREAS, this Council has considered said list and has deter- mined that the same is an accurate statement thereof, NOW, THEREFORE, IT IS HEREBY ORDERED, as follows-. 1. That the assessments on said list, now remaining unpaid, and the aggregate thereof, are as shown on Exhibit "A" hereto attached and by reference made a part hereof. 20 That for a particular description of the lots or parcels of land bearing the respective assessment numbers set forth in said unpaid list, and upon which said assessments remain unpaid, sever- ally and respectively, reference is hereby made to the assessment and to the diagram recorded in the office of the Superintendent of Streets of the City after confirmation 'by this Council, the several lots or parcels of land represented by said assessment numbers being so numbered and designated upon said diagram and assessment as so confirmed and recorded, severally and respectively. 3. The unpaid list is in the amount of $223,141.61, and bonds shall be issued upon the security of said unpaid assessments in said amount in accordance with the provisions of the Improvement Act of 1911, and under and pursuant to the provisions of said Resolution of Intention and the proceedings thereunder duly had and taken. Said bonds shall be designated Series 1968-1; shall be five (5) in number; shall 'be dated June 16, 1969; shall bear interest from their date at the rate of seven percent (7%) per annum, represented by coupons payable on January 2 and July 2 in each year, commencing January 2, 1970; shall each be in the amount of the unpaid assess- ment on the particular lot or parcel of land described therein; and, each shall mature in fifteen (15) equal amounts, represented by coupons payable annually on January 2. 1970 to January 2, 1984, inclusive. Said bonds shall bear a premium of five percent (5%) of the unmatured principal thereof on call, and shall be made pay- able to bearer at the office of the County Treasurer, fiscal agent of the City and of its Treasurer. 4. Said bonds shall be signed by the City Treasurer and the coupons affixed thereto shall bear his engraved, printed or litho- graphed signature, and such signing of said bonds and coupons shall constitute and be a sufficient and binding execution of each and every one of said bonds and coupons thereof, respectively. Said bonds and coupons shall be substantially in the form provided in said Improvement Act of 1911, except the words "after the accept- ance of said work" shall be deleted from the first sentence of the second paragraph of the bond form, The City Treasurer is hereby authorized and directed to sign said bonds and coupons. 2 5.
