1969/07/07 City Council Resolution (4)RESOLUTION NO. 69- 64 A RESOLUTION OF THE CITY OF ROHNERT PARK PROTESTING THE EXECUTION OF A CONTRACT BETWEEN THE COUNTY OF SONOMA AND DONALD DUNCAN FOR THE PURPOSE OF INCLUDING LAND WITHIN AN AGRICULTURAL PRESERVE (California Land Conservation Act of 1965) WHEREAS, the Clerk of the Board of Supervisors of the County of Sonoma has given written notice to the City of Rohnert Park of the intention of the County of Sonoma to consider a contract which includes land within one (1) mile of the exterior boundaries of the City; and WHEREAS, the proposed contract is between the County of Sonoma and Donald Duncan; and WHEREAS, pursuant to Government Code Section 51243 and 51243.5, the City of Rohnert Park elects to protest the execu- tion of the contract: NOW, THEREFORE, BE IT HEREBY RESOLVED, that the City of Rohnert Park hereby protests the execution of the contract pro- posed between the County of Sonoma and Donald Duncan for the purpose of including certain land within an Agricultural Preserve as provided in the California Land Conservation Act of 1965, (Government Code Section 51200 through 51295, inclusive). WHEREAS, the costs and expenses of said contemplated acqui- al''k-.iors and improvements are to be chargeable upon an assessment diz,trldilct, the exterior boundaries of which are the coterminous ex- terior bc-ondaries of the composite and consolidated area shown on the map thereof on file in the office of the City Clerk, to which reference is hereby made for further particulars; WHEREAS, the public interest and convenience will be served by the taking of said proceedings; NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED that all of the owners of more than 60% in area of the property subject to assessment for said proposed acquisitions and improve- menta have filed with the City Clerk of this City a written petition to_r the acquisition and construction of improvements pursuant to a-DroDriate special assessment and assessment bond acts, without furt-ner compliance with the provisions of Division 4, of the Streets, and Highways Code. IT IS FURTHER FOUND, DETERMINED and ORDERED that said pro- ceedings for the acquisition and construction of said improvements be had pursuant to the Municipal Improvement Act of 1.91,-3 and the bonds upon the unpaid assessments thereof shall be issued pur- s',.)ant to,.,the Improvement Act of 1911.
