A RESOLUTION APPOINTING ENGINEER AND ATTORNEYS
PROJECT 1968 -1
RESOLVED, by the City Council of the City of Rohnert Park,
California, that
WHEREAS, this Council has determined to undertake proceed-
ings pursuant to appropriate assessment and assessment bond acts
for the acquisition and construction of public improvements in
said City;
WHEREAS, the public interest and general welfare will be
served by appointing and employing engineers and attorneys for
the preparation and conduct of said proceedings and work in
connection with said improvements;
NOW, THEREFORE; IT IS ORDERED, as follows:
1. That Milton Hudis, Santa Rosa, California, be, and he
is hereby, appointed as Engineer of Work and employed to do and
perform all engineering work necessary in and for said proceedings,
including all preliminary surveying, preparation of report, plans,
profiles, specifications, estimate of costs, diagram, assessment,
setting grade stakes and supervision of work; that his compensation
bo, and it is hereby, fixed at a reasonable engineering fee for
all of said engineering, said fee to be approved by the City
'ouncil of said City, and to be assessed as an incidental expense
of said proceedings.
2. That the law firm of Wilson, Jones, Morton �, Lynch,
San Mateo, California, be, and they are hereby, appointed and
employed to do and perform all legal services required in the
conduct of said proceedings, including the preparation of all
papers not required to be prepared by the Engineer, examining and
approving the engineering documents and advising the Engineer in
the preparation of his work, advising all City officials on all
(a.) The acquisition of property necessary for the opening of the
Dutherly extension of Frontage Road from a point 3500 feet, more or less,
Dutherly of Wilfred Avenue, running thence southwesterly, southerly and
outheasterly to a point on Frontage Road 3500 feet, more or less, north-
rly of Helman Lane and for the opening of the westerly extension of
ohnert Park Expressway from a point on said Frontage Road, to be opened
erein, 5800 feet, more or less, southerly, southwesterly and southerly
f Wilfred Avenue at its intersection with the northwesterly prolongation
f Rohnert Park Expressway, running thence northwesterly, westerly and
orthwesterly 8200 feet, more or less, crossing Himebaugh Creek at a
oint 900 feet,, more or less, northeasterly of Laguna De Santa Rosa
hannel and. the Belleview-Wilfred Ditch at a point 1100 feet, more or
ess, northerly of Laguna De Santa Rosa Channel to Stony Point Road at point 3000 feet, more or less, southerly of Wilfred Avenue an d the
mprovement thereof by clearing, grubbing, grading, removal of existing
rees, shrubs and structures and the construction therein of base, pave-
Lent, curbs., gutters, berms, tree planting, monuments, traffic striping,,
:nderground serviced street lighting facilities, the lowering of existing
utilities where required to meet the new grade, drainage ditches, culverts
tnd surface and subsurface storm drainage facilities, where required, 'and
ahe construction of vehicular bridges, where required.
(b) The construction of a sanitary sewer trunk main, manholes with
ianhole frames and covers together with all appurtenances thereto in an
Basement to be acquired from the existing Rohnert Park Sewer Plant
,renerally located 3100 feet, more or less, southerly of Wilfred Avenue
ind 750 feet, more or less, westerly of U. S. Highway 101 running
-hence 4200 feet,, more or less, southerly and generally parallel to said.
J. S. Highway 101 to a point on the southerly 'boundary of Rohnert Park
annexation No. 4, 750 feet, more or less, westerly of U. S. Highway 101.
(c) The construction of streamline electrical facilities, under-
.7round. telephone facilities and. natural gas facilities necessary to serve
the properties of Santa Rosa Enterprises.
(d.) The construction of a water supply and pump station,, including
pumps, pump house, pressure tank and all appurtenances thereto on prop-
erty to 'be acquired and generally located 3000 feet, more or less, west-
erly of U. S. Highway 101 and 800 feet, more or less, northerly of the
southerly 'boundary of Rohnert Park Annexation No. 4, and the construction
of water mains, valves and hydrants, together with all appurtenances
thereto in an easement to be acquired from said water supply and pump
station site, running thence easterly 2700 feet, more or less, to Front-
age Road, to 'be opened herein, at a point 6600 feet, more or less,
southerly of Wilfred. Avenue.
(e) The acquisition of capacity rights and a right of service and use
in sewage treatment and disposal facilities of the City of Rohnert Park
on 'behalf of properties within the proposed assessment district, includ-
ing the right to discharge sewage from said district into and through
main trunk interceptor and. outfall sewers and appurtenances of said City,
and the right to have said sewage discharged from the area of the assess-
ment district treated, and. disposed of in and through the disposal plant
of said City and the acquisition of disposal capacity rights in said
sewerage facilities and plant, together with the acquisition of capacity
rights and a right of service and use in water supply, treatment and
storage facilities of the City of Rohnert Park on behalf of properties
within the proposed assessment district.
(f) The acquisition of all lands and easements and the performing
of all work auxiliary to any of the above nece-ssary to complete the same.

NOW, THEREFORE, IT IS HEREBY FOUND; DETERMINED and ORDERED
that all of the owners of more than 60% in area of the property
subject to assessment for said proposed acquisitions and improve-
ments have filed with the City Clerk of this City a written peti-
tion for the construction of improvements pursuant to appropriate
special assessment and assessment bond acts, without further
compliance with the provisions of Division 4 of the Streets and
Highways Code.
IT IS FURTHER FOUND, DETERMINED and ORDERED that said pro-
ceedings for the construction of said improvements shall be had
pursuant to the Municipal Improvement Act of 1913 and the bonds
upon the unpaid assessments thereof shall be issued pursuant to
the Improvement Act of 1911.
IT IS FURTHER FOUND; DETERMINED and ORDERED that the pro-
visions of Division 4 of the Streets and Highways Code be, and
they are hereby, dispensed with.

matters relating thereto when called upon, and furnishing their
legal opinion on the validity of said proceedings and bonds, and
that their compensation be, and it is hereby, fixed at 2% of the
acquisition and construction cost, exclusive of incidentals, or
$750, whichever is greater, together with reasonable fees for
services in acquiring easements or in eminent domain or other
suits, to be assessed as an incidental expense of said proceedings.
3. That the fees provided to be paid herein be paid from
said assessments to be levied and bonds to be issued, and not
otherwise.
